Alleyne disappointed in Alcapone’s sentence

Defense lawyer in the Edward “Alcapone” Green murder case, Peter Alleyne, has expressed “disappointment” at the sentence handed to his client by the High Court.

Green was jailed for 25 years on Friday to take effect from 2008, the year he was taken in custody for the murder of Damian Dorival.

He was found guilty of the crime almost two months ago.

“I am disappointed, I find it’s a lot it’s more than I expected taking into account his age.” Alleyne said. “But when you take into account one third off for good behavior and the five years that he has spent on remand, it appears he will be serving a 12 year sentence and should be coming out as an elderly man.”

He described the case as ‘difficult’ given the fact that Green’s two sons had to testify against him and said an appeal is expected.

Alleyne along with Darius Jones and Vincia Auguiste represented Green.

The state’s case was led by Trinidadian, Keith Scotland, along with Sherma Dyrample and Artlyn Nesty from the office of the DPP.

Scotland said he was satisfied with the sentence despite the fact that they had requested a “life sentence.”

“The rule of law was obeyed and so we are indeed grateful,” he said. “We made a submission for life, the court did not agree, we are satisfied with the decision.”

He stated that the case “had its challenges and we dealt with them as they came.”

“But we are concerned as it relates to the way the scientific evidence was handled and I think that time has come for Dominica to consider putting in place it’s own forensic scientific center as a commonwealth country,” Scotland said.

    that is so true alcapone have a lot of property that the children could distribute if I was in his position I would make alleyne make my will and put a clause that these sons who testified should never see a dime of my wealth. Waste of sons should have let their mothers abort these no good sons

    Alleyne thank your lucky stars. I would have given him life. Whatever remains of his. That was a wicked, cold, brutal act that he is guilty of. He should never see the light of day again. What happen murder is a joke man?

    Here in Dominica, has no law.

    While it is stressful not getting rent from tenants, this crime was heinous and perhaps the death penalty should have sent a clearer message. You can’t kill a man for ‘not paying rent and disrespecting you’… well, unless he was provoking you..beyond reason and that could be proved. That’s against the law. That was not Capone’s defense. There are other legal ways to deal with those issues.

      I think the whole of dominica knows by now, that Mr Alleyne does most of his work without getting paid. The Creator placed him there to help poor people who have no money but still need a lawyer to advise them of the rights and educate them about the justice system, not to make money!

    How can you be disappointed? This was such a horrible crime. I Think he should never be let out just as Damien will never be back. Alcapone was heading in this direction for a very long time. As a society we should never condone these acts. Let him rot in jail.

    People should pay there rent, he was renting his house to the victim, and the victim use to fail to pay his rent , and still dis respect the man , what he did was wrong but a message to all, pay your rent on time, they come to you inocently and asked you to rent to them , and after a few months they fail to pay there rent , and thats what pissed him of.that story has never been told.

      They ignored it. As he was incarcerated for 5 years prior to the case being called, they still have not even, really proved that he committed the crime. His sons testified against him which made it look like he committed the crime. What if they told a lie in order that he will be convicted?
      Some people do know that they had an axe to grind against their father. This was their opportunity to have him incarcerated for life. None of you know the truth.
      You know that God knows the truth more than those who stood in judgment over him, convicted him and sentenced him.
      “If his sons told a lie” and caused this to happen to him, woe to them for all eternity, in Satan’s cauldron of everlasting fire.
      In fact, during their life they will experience their evil works and words. They will never be happy and peaceful. Just hope that they told the truth and they were not concocted lies.
