Argument over ‘affair with wife’ leads to fight

A Wotten Waven man will have to pay the court $650 for besieging the home of Hilson St Jean whom he accuses of sleeping with his wife.

Julien George appeared before Magistrate Ossie Lewis Friday afternoon at the Roseau Magistrate Court where he was found guilty of malicious damage, battery, throwing of missiles and threats.

“It seems bad blood have existed between you two for a long time,” Magistrate Lewis told the defendant and the complainant, who are both from the same community and used to be friends in past.

According to the facts of the case, on April 2, 2007, St Jean along with his pastor was walking on the Wotten Woven public road when they met the defendant.

“Pastor don’t worry with that man. He used to [have an affair] with my woman,” George reportedly said.

Stemming from that statement a quarrel and fight ensued in which the defendant was beaten and his daughter, Nakita George who came to his assistance, also sustained an injury. The complainant ran away after the defendant picked up a stone to throw at him.
George allegedly went to St Jean’s home on the night following the road episode.

“I come to kill all of all you in the house. Even a fly will die,” George is alleged of shouting by the complainant who took the stand during the preliminary.

“My sons held me and tell me not to go outside. I heard cutlass lashings on my doors and windows and the pelting of stones on the roof,” St Jean continued.

“The next morning I saw my bathroom flat on the ground and my pig was let to run around loose,” he added.

The complainant’s wife was considered by Magistrate Lewis as a “critical witness.”  Juliet St Jean told the court that she was returning home from service about 9:30 on the evening of the incident when she heard noises in her yard. She indicated to the court that she met the defendant along with his daughter and nephew, Dylan George, in the yard.

She added that the defendant verbally insulted her and repeated threats of killing her family.

Police brought no charges against neither Nakita nor Dylan George. The defendant, while admitting to the earlier road scuffle, continually denied the claims against him.

However, the report and observations of police from investigations and an admission from Nakita George during her statement that she was on St Jean’s property with a cutlass, helped the court to believe the claims against the defendant and arrive at a guilty verdict.

In handing down the sentence, Magistrate Lewis made a re-evaluation of the charges. On the charge of threats Lewis said, “Taking everything into consideration, I believe it was a loss of control, people say things and do things at the spur of the moment. A lot of time has elapsed since 2007 and the defendant has not repeated those threats.”

He indicated that on the charge of threat the defendant was being sentenced to pay the court $200 by August 31 or spend one month in prison.

For the throwing of missiles the defendant was charged $150 to be paid by September 30 or one month behind bars. George will also pay $290 in compensation on the charge of malicious damage to St Jean’s bathroom.

    I had to read the date of the altercation twice. I could not believe that it took 4 years to bring this case to Court and to mete out judgment and a fine. This took very long.
    Pertaining to threatening lives, this is a serious matter. He should be imprisoned since the altercation or thereafter. The charge is too low for the damage he did.
    This man is an extremely jealous man and has a terrible temper. It may be too that he is suspicious of his wife’s friendship with his friend. This gives him no reason to threaten to kill them, trespass on the man’s property and damage it. These are serious crimes which are punishable by imprisonment for a number of years.
    Was he given probation and also a restraining order never to trespass the man’s property and to threaten him again?
    The Court should request that he take an Anger Management Course but then again Dominica probably does not have such a Course.
    The other alternative is that he should take his religion seriously, practice the faith and pray to God to grant him the grace to curb his anger. He may flair up again and worst than previously.
    A saying: Anger is such a good thing that we should not lose it.
    Another saying: Be Happy! For every minute you are angry you lose 60 seconds of happiness!
    I suppose that he made up with his wife.

    Government not paying the Magistrate enough money. There is an acute shortage of Magistrates in Dominica. You mean you didn’t know that?

      Anonymous, I’ve heard that too but surely you must be mistaken as at the same time I hear of a magistrate looking for employment!

      What I don’t undersand how the guy is only charged $290 for malicious damage when the complainant’s bathroom was “flat on the ground”. Who paying the man for his bathroom?!

    Are we seriously saying that a case like this takes four years to be presented in court? Are we that far behind with processing cases? Are our judiciary slow? This is unacceptable.

      You are stretching this. Most cases I read about here are dispatched within days of the incident. In fact, I wonder if there is even sufficient time for a proper investigation given the speed with which cases are dealt with at the magistrate’s courts in Dominica.

        Cases you hear about which are dispatch within days are arrests matters. The are only dispatched soo quickly because the defendant would have pleaded guilty, the facts would be read and sentence given right then and there. Many matters do take that long to be dealt with. Sounds ridiculous but it is a reality.
