Auditor of company registered in Dominica pleads guilty to massive fraud charges in US

The auditor of a company, which the United States Department of Justice said was registered in Dominica, has pleaded guilty to a $670-million fraud scheme in the US.

In a press release yesterday the Department of Justice said Jorge Luis Castillo, 56, a resident of New Jersey and a citizen of Costa Rica was an outside auditor for Provident Capital Indemnity Ltd. (PCI). He pleaded guilty on Monday for his role in the scheme involving victims throughout the United States and abroad.

The release stated, “PCI was an insurance and reinsurance company registered in the Commonwealth of Dominica and doing business in Costa Rica. PCI sold financial guarantee bonds to companies selling life settlements, or securities backed by life settlements, to investors. These bonds were marketed to PCI’s clients as a way to alleviate the risk of insured beneficiaries living beyond their life expectancy. The clients, in turn, typically explained to their investors that the financial guarantee bonds ensured that the investors would receive their expected return on investment irrespective of whether the insured on the underlying life settlement lived beyond his or her life expectancy.”

The release stated that the guilty plea was announced today by U.S. Attorney for the Eastern District of Virginia Neil H. MacBride and Assistant Attorney General Lanny A. Breuer of the Justice Department’s Criminal Division.

According to the release McBride said, “Mr. Castillo used his position as a CPA to give PCI an air of legitimacy that provided their clients the peace of mind to invest millions. Auditors stand as a gatekeeper to fraud, and we are aggressively pursuing those who abuse their position to facilitate the fraud rather than take steps to put a stop to it. I want to commend the outstanding work of the Virginia Securities and Financial Fraud Task Force for detecting and disrupting this massive, ongoing international fraud before the scheme victimized even more investors.”

The release stated, “From 2004 through 2010, PCI sold approximately $670 million of bonds to life settlement investment companies located in various countries, including the United States, the Netherlands, Germany and Canada. PCI’s clients, in turn, sold investment offerings backed by PCI’s bonds to thousands of investors around the world. Purchasers of PCI’s bonds were allegedly required to make up-front payments of six to 11 percent of the underlying settlement as “premium” payments to PCI before the company would issue the bonds.”

    This is not the first time and may not be the last. Those as this man who plan to open a business in Dominica or any West Indian island for that matter should be properly investigated prior to allowing them in the country. They should first have to apply from outside the country to the government of the island and only after investigation if accepted should they be allowed entry and to open a business.
    Too many use the islands, the vulnerability of the government and nationals as their scapegoat to perform illegal business. They think that they will never be caught. Consider Sandford.
    Frankly I do not trust some of those people. There is a lot of fraud in the world and some of them will go elsewhere and open a business only to continue their fraudulent practices unsuspectingly. This one did not get away from the U.S. government.
    Even though they invest in Dominica, why are they given a DA passport and immediately at that. There should be a grace period as 5 years also for them and proof of credibility prior to being a DA passport. The passports should not be sold or given away to them. Those islands welcome investments for economic and employment reasons.
    The government of those islands as DA must wake up and question whether those prospective business owners are credible and that their businesses are legitimate ones. Diligent research work would help. As the saying, “Take time to do good” which will benefit the country.
    The government should be careful not to allow Dominica to get a bad reputation which in the long run will ruin it and also the reputation of any government present or future. Should this occur, Dominica and nationals may suffer permanently.

    Dominica and Dominicans should not be surprised by all these revelations!!!

    The seeds were planted even before 1995. It started under the Freedom Party government with the Economic Citizenship programme.

    The natural progression was for the offshore industry to have followed. Our financial wizard under UWP introduced the offshore legislation. This was the response to the USA challenge to our bananas some years earlier and thing look very promising where jobs were concerned.

    With these two activities – sale of passports and offshore activities Dominica was hoping to be like Antigua!!!

    But we were always saying that Antigua government under the birds were operating differently from us and we even had prominent Dominicans that were very close to the birds – one when he came back to Dominica under UWP went to jail within 6 years after coming back to Dominica. He was already under surveillance by the US in Antigua. A minister delivered him unknowingly. Dominica’s reputation took a serious stain and was blacklisted.

    Why?

    The combination of economic citizenship and offshore activities is really designed to help individuals and companies to evade the payment of legitimate taxes in the countries that they operate.

    Thus US companies can continue to operate in the US and serve US citizens but can register their headquarters in an offshore jurisdiction like Dominica and even have their own offshore bank, offshore insurance, offshore trust, and other offshore activities and pay no tax to the US treasury!!!

    But the US and Europe has the handle holding when it comes to banking in the world and that is where they have held us by the balls.

    All banks in Dominica and the Caribbean are nothing without a bank holding their foreign currency in the USA or any other Big country in the world and the USA and Europe will not allow any of the local banks have a branch of their banks in the USA or Europe.

    And that is where you and me have to now declare any funds above 10,000.00 dollars. You must fill out forms and give details of your source.

    People let us think and make the conclusions to these questions.

    All computer, banking and telephone traffic from Dominica and the Caribbean is routed to the USA and Europe and they see and hear all of our activities.

    This is a game we cannot win

    Financial product companies can be registered anywhere in the world.

    This was a reinsurance company. Why didn’t Dominica know? Common, Dominica does not have the resources to determine these. How long did it take the US to find out?
    Stop acting like these things dont happen all over the world.

      Do you think we are all fools in Dominica? You are trying to say that a tangible property registration is different from registering a Financial product and I agree with you. However, when registering a car in Dominica, you must bring proof of purchase before they register it for you. Also, to register a piece of property you must take it to a lawyer who will take time to ensure that all is legally well before they submit an application to the registry. When that is done the registry will delay it further just to ensure that what they are registering is not stolen. We go through this hassle as Dominicans living in Dominica. How then could a person who is not a Dominican, and does not reside in Dominica just come to register a Financial product in Dominica, especially when that business is opperating in a foreign land?

      What is even more alarming is when I see you all are still trying to defend that nonesense. Shame, shame, shame on you all!

No wonder when I’m in the USA or somewhere and people ask me where I’m from, I say Dominica. The next words from their mouth is “oh, you speak spanish”?     Even the USDoJ (US Dept. of Justice) doesn’t seem to know the difference.

    Because it’s on the internet doesn’t mean it’s true.

    This has been an extensive investigation to the point of finding one person guilty in committing mail and wire fraud. The person convicted made particular mention of those he conspired with to make his scheme possible. While there is mention that the company was registered in the Commonwealth of Dominica no one from Dominica has been implicated or has been considered to be persons of interest for their involved in this fraudulent scheme. However typical Dominicans are already making unsubstantiated claims about the government involvement in this fraudulent scheme. This is precisely why Skerrit has taken the stance of suing the people responsible for making false claims about him and the government, it’s like ‘monkey see monkey do”. Time to put monkey at ease!

    Why are some automatically linking the PM to this? Where does it mention him.

    I’ve Googled the company and the only registered address I found was in the heart of the financial hub in London, England. Is there more than one Provident Capital Indemnity Ltd. The only link to Dominica was a c/o address in Virgin Lane,Roseau (yes a gentlemans name was mentioned, but look it up just like I did).

    Yes there has been so many scandals, but lets be rational here, is the PM linked to all of them. Some might say ‘yes’, but people be honest, can/should the man know every move/phone call all Civil Servants make.

    There are issues we should get answers to from the PM. Yes he should have an enquiry to find out why Dominica is linked with PCI.

        Claudius Anthony, registering a ship in another country is quite different from registering a financial scam simply because the purpose for which a ship is used is different from a scam.

        Also, I try to tarnish the name of my beloved country? My name does not appear on the list of passport sale which will eventually prevent us from getting a visa to visit the USA, Canada, Europe, and other countries of the world. I never sold our passports, I did not sell the Bird Island, my name was not called with Gadafi and I do not have a Diplomatic passport. I am simply trying to restore our lost image as Dominicans but day by day with people like you being so blind, I realize we will be lost for good.

    How do we benift from all this registered companies . Is it that only those lawyers cronies that profit from these cladistine companies. Does the financial report include revenues from this companies. All these things begs for responsible citizens to start questioning government irrespective of party affiliations. It is time to ask the elected officials to put the cards All the cards on the table. We want an audit of passport transactions – All Passports not some passports. Instead of asking for evidence why not ask the government to give an account of our royalties – not Skerro, Eddison , Tony, Alick or Judith’s but Dominica’s property.

    Dominica is the Vegas of the Eastern Caribbean- any thing goes. Are we surprised when we witness Blaire court change hands from one owner to another. The second owner have no idea when and under what conditions he acquired the company. When all these corrupt practices had been flagged we called the messengers all kinds of names now the time of reckoning is at hand note that the old messenger is npot the one making the revelations. Truth will rise at all times even when scum seem to be floating.
    There is a treasure trove of scandal coming down the pipe line my people of Dominica. Just stay on the beat- there will come a time when they can no longer lie and cover up the corruption. I hope the people in the cabinet with any bit conscience left take the six O’clock train out of town.
    This registered company – We would like to know about it; the revenue it generated, who signed the company and who is or was the representative? I hope those DLP idiots wont ask for evidence.

    Admin: they are still trying to clarify whether it’s the Commonwealth of Dominica or Dominican Republic. If you google, you will notice that it said CAstillo was born in Dominica…. that’s where the disparity seems to be.

    I am not a labor supporter. I have seen a number of things done by this present administration that I just cannot support. But criticizing Skeritt must be seen to be valid and unbiased. With the passport issue there is some credence to the blame levied at the PM but I don’t see how he could be blamed for this particular issue. Criminals setup fraudulent companies all over the world, especially right here in the US and places like London. Should we also tie these criminals to the leaders of these countries? It’s with this; I urge Dominicans to be smart and be constructive and sensible in criticizing the PM and not be carried away with everything that pops up. All that does is to delegitimize the valid critic of the PM…

    This is not anything new. There are hundreds of fraudulent companies & universities registered in Dominica. All you have to do is a google search of “8 Copt Hall Dominica”. You will get pages and pages of companies registered in Dominica. Most of them are Scams, some are involved in online pornography. Something just does not seem right to me. I would like to know if this was the intention of our Government and who is responsible for monitoring these activities.

      What did Dr. Fontaine say when he was offered the job of Financial Secretary? Do I understand that he said that the salary for the position is simply not attractive and is really an affront to his qualifiactions and experience? Is It true?

      So the position of Financial Controller does not have enough money, although it pays better than the salary of the Prime Mimister. Now you asking him to come and take a smaller salry.

      Thos pyramid schemes exist everywhere. I lost money in a pyramid scheme when UWP was in government here. Remember the man who established an office here hired a number of sales agent? Some of the agents operated ot of the building which now houses DHL (Let it be clear. Whitchurch had nothing to do with that).
