Forty-three-year-old Gregory Augustine has been found guilty of indecent assault on a 15-year-old girl.
A jury of seven women and two men found Augustine guilty of indecent assault, but determined that he was not guilty of a second charge of unlawful sexual connection.
Judge Birnie Brooks handed down a three and a half year sentence; however Augustine will spend only six months in jail. The remaining sentence will be suspended.
Five hundred hours of the sentence will be spent doing community service, and if Augustine gets into trouble with the law within two years of being released from prison, he will serve the remainder of the sentence.
The complainant told the court that Augustine led her to a dark area at a friend’s home during a party for his five year-old daughter.
The incident occurred on March 21, 2009 at about 10:15 p.m. The party was held upstairs while the incident occurred downstairs.
According to witnesses who testified on behalf of the prosecution, the complainant reported that the incident occurred when she went to bring a container of food down to her aunt’s car. On her way back upstairs, the accused man led her to a dark area under the house and put his hand in her pants and his finger into her vagina.
Before handing down her sentence the judge said, “I have noted your previous clean character in that there is no previous antecedents. You have a family…I have also noted what your lawyer has said in mitigation the nature of the offence was not in excessive force… However, it would be remiss of me to say that even though your offense was not excessive in force it was a breach of trust. [Complainant’s name] trusted you…looked up to you…”
“I wanted to believe that it was an error of judgment… [Complainant’s name] may not have suffered any physical damage, but I would not know what mental damage…She may have been scared…this could affect her,” the judge added.
She also told the convicted man that his actions have not only affected the complainant but the relationship between two families who had been very close.
“Your lapse in good judgment affected not only Gregory Augustine but all these people. It’s a domino effect,” the judge said.
Defense lawyer David Bruney said in mitigation that his client was gainfully employed as the proprietor of a heavy equipment business, earning a healthy salary. He is also an ex-pilot who flew aircrafts for Cardinal Airlines up to 1998.
He has a son aged 16 and a daughter aged five. Bruney asked the judge to take into consideration that his client has a family when handing down her sentence.
The judge complimented the complainant’s family for what she said appeared to be a “strong family network”, and said that such a network should aid in the victim’s recovery.
The investigating officer, WPC P. Dupigny, stated yesterday under cross examination by defense lawyer David Bruney that the scene of the alleged incident had been tampered with.
She made the statement on Monday during a court visit to the alleged crime scene. She noted that during investigations, the complainant had pointed to a door which she had found hidden behind a lattice attached to a column when she visited the house.
Yesterday, in a visit to the scene of the crime, Woman Police Constable P. Dupigny testified that a column, a lattice and door which the complainant had pointed to during her previous investigations at the scene of the crime had been tampered with.
Dupigny said that the column was now narrower and the lattice and the door had been removed. The lattice was found resting against a table on the floor.
Under cross examination, State Lawyer Wayne Norde asked the accused man whether he had paid for the “fresh” cement work where the alleged door was replaced at the scene of the crime. The accused said no.
“You know about that fresh construction job at [owner of the house’s name] house? Did you pay for it? You know where the door is now?”
The accused answered no to all questions.
Norde also had the opportunity to ask the owner of the building who insisted that the cement work was done last June.
According to the judge, the maximum penalty for an indecent assault of this nature is seven years.
You have just served part of your time for the crime you committed. Nevertheless, it is hoped that you have reflected upon your much regretted actions. PRAY each day so you won’t fall prey to those types of indecent activities. Ask for forgiveness.

It’s my opinion that the judge should not have taken Gregory”s family into consideration when handing down the verdict, since he obviously didn’t take his own family into consideration when he committed the crime. Yes people it was a crime against a minor. I have known Gregory for years and I never imagined that he was capable of such. But how well do we know the people we interact with? The people we allow our children to interact with? Parents take heed!!! How many of our young girls and boys out there have been molested by someone they know and are were too scared to come forward? Are still too scared to come forward? Parents talk to your kids. Let them know to come to you if ever something like this would happen to them. It is about time we learn to open up to our kids about life and teach to open up to us in return.

Currently, Dominica exists at the very lowest level of civilization, to wit; that anyone would defend the behavior of Gregory; and anyone would fail to appreciate that a potential rape was averted by the 15 year old that could have disastrous consequences for both parties concerned.

Yes it was time for Gregory to be put to rest from his acts. Well deserved!!!. His time in jail is short but he will learn a lesson. For those supporting his actions, if i know him well he is feeling something in Storky and that should make him reflect. i can finally say that although that this is not enough jail time for this crime,the law in D A is taking a step forward.i believe although he will be out in a few months,people know who he is and his role in society,he will definitly be ashamed and humiliated to be in public so soon.when i got raped 24 years ago and i went to the police myself to report the crime,the police made me feel like it was my fault,that i went looking for it.i am still today nursing my wounds.so now i am happy to see that once the child is underage …i have prayed so hard for this day.i did not get justice but i am glad someone else did.

He will be out of prison in three months according to the prison system in D.ca like you said. That little sentence he get not enough but the desperate prisoners up there will deal with him doe worry for his 3 months. When he comes back out to his normal life in May 2010 it will not be the same.

I agree with Karkabeff, we need to create legislation that will protect the welfare of our children. A sex offender registry should also be created to track the whereabouts of these offenders.
I can’t believe that adults are actually blaming this young woman for what has happened. It is so easy to blame the victim.
I guess many of us have forgotten what is was like to be young. Whether we like it or not, to preserve the future, and ensure that kids grow up umblemished, is part of our responsibility to protect the welfare of our children – even if they are not our family members. As adults, we have the experience and judgement to prevent such vile actions.
I commend the girl for her courage. These types of crimes have been happening in Dominica for years; but were kept in the shadows, because of fear, family name, and political influence or prominent family affiliation. The thing is, the world is changing, and kids have more access to the media and internet – where they are seeing that they can be empowered to take action.

That is something I just cannot understand. While no crime is justifiable, a person who commits a white collar crime seems to get a much harsher punishment than a man who sexually assults a young child. I have been just outraged by this. He should have been give the full sentence.

I applaud the young girl’s family for sticking it out in spite of the the social and emotional impact this is going to have on the young lady. In our Dominican society she is most likely never going to be given a chance to forget this by folks pointing fingers and identifying her as the one Gregory went to jail for.
His wife and kids are also going to face a lot of humiliation and emotional shame from his actions. I will pray for them that God will intervene in this very very sad situation. Is this justice? A crime with a maximum sentence of 7 years, he got 3.5 years and ONLY SERVING 6 MONTHS BEHIND BARS?????? Seems to me that because he belong to a good family network, makes a healthy salary etc exempts him from a fair judgement. What about the victim? A 15 year old female who may be damaged for the rest of her life, her pain and suffering and that of the family. This man will only be spending six months in jail…The judge thinks that this may have been a lapse in judgement. What!!!!!!!!! This was not a lapse in judgement. It was premeditated. I also cannot believe he was not found guilty of unlawful sexual connection. How did the court interprete unlawful sexual connection?
We are talking about evidence tampering (who else would have the motive to alter the scence of the crime). It was a open and fresh case…everyone knows that you cannot alter and tamper with evidence.

This man has just permanently altered this little girl’s life. No amount of therapy will ever heal the deep wounds that he has inflicted on her and her future generation. Such a light sentence is a travesty and mockery of our justice system. This man will be out in a couple of years, and will resume his sadistic and vile behavior. Don’t despair. My wife had similar circumstances and trust me it took her 5yrs into our relationship to tell me but I had already figured it out within 1yr. She never told anyone but affected her…so many years after. This incident will never leave this child. Such a shame for a man to do such a thing. Thank God is not my child because it would be my trial and jail sentence you would be reading about now.
