Behanzin speaks, contemplates legal action

Behanzin

Magistrate Tiyani Behanzin has said that he may be forced to take legal action against the government for promises it made to him that have not been fulfilled. These promises, according to him, relate to him being called to the Bar.

Behanzin was appointed magistrate by the Judicial and Legal Services Commission (JLSC) based in St. Lucia and was granted a two-year contract by the Dominica Government.

Being called to the Bar

Behanzin explained that he had served as a magistrate for several months before actually signing his contract, and only did so when the previous attorney general promised that he would be called to the bar soon after he signed.

“I have legitimate expectations for being called to the bar and you can see that through the various communications. I only signed a contract after a promise was made by the then attorney general. She gave me her word that I would be called. On that basis, that is when I actually signed,” he said.

He continued, “That is a legitimate legal obligation that the Government of Dominica has and if they do not wish to come clean with those promises that they made then I will have no other choice but to take the matter to court.”

Contract renewal

The magistrate’s contract comes to an end this month-end and a decision has not been made as to its renewal.  Minister for Tourism and Legal Affairs Ian Douglas recently stated that the matter is to go before cabinet.

“Treat Behanzin the way you treat anybody else. I’m not asking you for special favors. It has to be just, it has to be fair,” Behanzin stated, noting that two of his colleagues’ contracts were recently renewed.  Douglas had said that there are processes involved in renewing a magistrate’s contract which have to be followed.

“What I think is wrong is whatever rapid policies or actions they took to appoint the other two whose contracts had expired, one in the end of December and the other one just a few days ago, I cannot see why this Behanzin issue is such a major hurdle for everyone,” he stressed.

The exclusion of certain individuals from the process

Behanzin is asking that a few officials who have had “previous engagements” with him be excused from the contract review process. He fears that these individuals could make submissions that could pollute the course of action.

“Three individuals, who perhaps because of their previous engagements with myself, should not form any part of this process of review and I’m assuming that they could make submissions, as they probably are doing at the moment, but I think it’s unfair to have anybody who have already had some engagement with me, to be able to interfere or pollute the process,” he stated.

He mentioned one of his colleagues as one of those individuals.

“The first of those would be my colleague who has attacked me in the press in a very unprofessional and crass manner to which no sanction, I believe, were duly applied to her from the Public Services Commission,” he said.

He mentioned the current Attorney General, Peter Levi, as another individual he would like removed from interfering in the contract review process.

“The current attorney general had complained against me in a series of letters. While president of the bar, there was an email that was circulated on the eve of the enquiry, encouraging people, those who hadn’t complained yet, to send a complaint to the president. He also have target my decisions and appealed against a number of my decisions,” he noted.

Behanzin also made a specific call for the Minister of National Security Charles Savarin not to be involved in the process due to what he said was Savarin’s “attacks” on him on a radio program some time ago.

“Thirdly, I believe the minister of national security who appeared on a radio program, as I was told, attacking me during the sitting of a matter before the Portsmouth Magistrate’s court. The program, I understand, was attended by the head of Government Information  Services, the minister himself, and a government-paid lawyer who himself attacked me. I think those three individuals, in the interest of fairness, in the interest of natural justice should not form any part of any reviewing process,” he stated.

Contracts by governing political regimes

The magistrate questioned whether in a constitutional democracy anyone should be subject to a contract by any governing political regime in the judiciary. He said that he has been under serious political pressure due to his involvement in certain magisterial cases which came to him by accident.

“I sit in District G and I deal with all matters –juvenile matters, civil matters, criminal matters – and therefore it seems to me that the constitution would need to protect somebody in my position. I have come under tremendous political pressure because of the types of matters that have fallen in my court purely by accident, purely perhaps because of geography, where these incidents may have taken place,” he pointed out.

He added, “If a magistrate subjected to political anointment or approval, then doesn’t that affect the magistrate’s ability to be truly independent ? And if that’s the case what measures would you put in place to protect the magistrate.”

He said that in spite of all this, in the event that the government does not renew his contract, he will basically have to agree with its decision, simply stating, “I’m not gonna fight to serve.”

He called on those in authority to be open about their decisions.

“Whatever you do, do it in the public, don’t hide behind your offices and your walls and your ministries to do whatever you have to do. I serve in the public, I have been vilified in the public, I have been humiliated in the public. Well bring your so-called investigations of Behanzin to the public; let everyone see what you’re doing to me,” he said.

    Let us be honest ….facts are stubborn things and all lawyers in Dominica cannot be wrong !!!!!!!!!!!!!!
    Dont allow our emotions cloud our vision…this is not a political issue. Never in the history of the Dominica/OECS COURTS that so many of the judgment of one magistrate had been successfully appealed at the court of appeal. It is our very lawyers who are paid to represent the very interests of their clients who upon recognition of assumed injustice at the magistrate courts occasioned by a clear lack of understanding, knowledge and application of the law. 60 million french men cannot be wrong—the court of appeal continues to set aside that SAVAN MAGISTRATE rulings and litigants whether they are guilty or innocent continue to walk out of the courts!!!!! The Da judiciary has become the laughing stock of the caribbean and YOU KNOW WHO is yet to make an appearance at the court of appeal in defence of judgments made on the bence which had been appealed…ha ha ha every year doctor excuses—-all big mouthers must prove their salt and come before the court of appeal when requested to do so to prove their salt……its so funny that media addicts are afraid to face the oecs court of appeal…..well unfortunately the said court had nothing good to say about the SAVAN MAGISTRATE ! OH yes the family has attempted to try to temper an approach but arrogance continues…..as a northerner am really embarassed by arrogance runs in some members of some family . best you join the new party they forming…..i wander if you can run in st jo or possie bondieu dual citizenship issues may well mean that the canadian passport/british passport will have to be surrendered ( ha ha ha ) oh i want a LAGON MEETING !

    I have been out of D/ca for the past eight years. Before leaving D/ca, I worked in law enforcement for thirteen years. I am very familiar how the system works in D/ca. From the various articles I have seen about this Magistrate, I am not surprised that he is experiencing major problems in his contract renewal. It makes no difference who he is or what he stands for; he must understand that his job is a political one and he must keep his personal feeling to himself regardless, his intentions. He must understand that he is a magistrate and not a politician. Personally, I think some of the public comments he made in his capacity as a magistrate were unbecoming. I guess.. this will be a wake up call to him. May be he will make a more meaningful to Dominica as a politician.

    Too much politics, dividing the people, that’s how the gov’t need us, yes divided. A united people is a dangerous one. Lets unit in moving forward. We Need Progress, We Need Fairness, We Need Jobs for our people, and more Tyianni to make that happen. It scares me when I see a good man being treated this way. You too should be scared, because it could happen to you or family. So let’s show support to mr. Behanzin and ensure he receives fairness that he deserves.
    Mr.b personally I can’t decide wether I like you or not, but you seem to care for this country. You have lived aboard as myself and we know that this country ain’t right. There are some many areas that need an overhaul. The people don’t know any better and they may not recognize our vision. But I will appreciate you, even if i don’t know whether I like you.

    Behanzin come Dominica playing starring and hoping to catch a ride on the fame and name of his good father well is there he was wrong. the magistrate bit off way more than he could chew and got involved in all politics before he concentrated on the job to which he was appointed.

    i for one have problems with the crime rate in dominica and was never one against the harsh sentences the he handed out. as a magistrate he has my support but behanzin must step down from his political high horse come down to the ground walk among the ppl and earn his name and reputation through honest toil like his father and uncle did and like every other good douglas did. dominica not hollywood and and being the son of a douglas does not make u a superstar (go ask your cousin hahaha).

    dominica just not big enough to hold Behanzin ego.

    Mister been in too much hot water and conflict with too many people. How could he have been in problems with all these people 5 or more i cant keep count. He had too many of his sentences thrown out by appeals court. @ 365 rivers Dominica has no royalty so there needs to be no reserved Douglas seat anywhere.     Mr Behanzin should just forget about these guys and use what looks like a set back and turn it around as a set up. Dominica is in a serious political decline with the likes of DLP, UWP and DFP. All three parties have led us for a number of years, except the UWP whose term was shortened because of their own foolishness. They have all failed us and needless to say that this Skerrit administration is the worse of all. All my hope for a better Dominica was all but gone but in recent days listening to young people like Mr. Behanzin, Ashton Riviere, Dr. Fountain, just to name a few have really inspired me. I would advise these young people to get together ASAP and form a party to lead this country. Dominican’s have lost faith in Skerrit (and really those who still have a little faith in this young man should quickly give up because he is just getting worse) and the DLP, they have lost faith in the UWP and also, the DFP. So this is your opportunity Mr. Behanzin to step up. Your wise judgements over the years have inspired us and we need you to lead us instead of begging these greedy men to renew your contract.

    In the public service an appraisal must be done before the renewal of contract. Who is going to do that appraisal when he has dismissed the Chief Magistrate, the Attorney General and the Minister of National Security?

      I am a Journalist, I found out that there was no appraisal done before Mr Lewis was reappointed. There was also none done on Baptiste when she was reappointed. Baptiste was never sanctioned for her savage attacks on Behanzin. The Ministry is refusing to five true information about why they others took so little time and they were not appraised, when we call.

      The Court of Appeal critised Lewis and Baptiste more, for deliberately frustrating people from Appeal. During the last Appeal Mr Christopher’s client’s appeal documents was never signed by Baptiste. The Court of Appeal consisted of judges, one Ola Mae Edwards, a personal friend of Davidson Baptiste, Chief Magistrates’ Brother, Ola mae Edwards attacked Behanzin on a matter that Baptiste, who first handled the matter in 2008. Behanzin came on the Bench in 2009, why did Ola Mae Edwards attacked Behanzin for sentencing a Def who was declared not fit, when she knew that the second assessment,(all done in 2008 when Behanzin was not even there) said that the def was in fact fit. If the true story is told, Behanzin will bring great embarrassment to not only Dominica but the Eastern Caribbean appeals system. He must be a true patriarch that is why he has not yet exposed them- he flat out refused to give an interview, instead sent me to the people concerned. I believe he will break his silence on the Appeals, just as he broke his silence and the public is stunned!

      I have seen the the notes from the Chief magistrates’ desk, the email from the bar association when Mr Peter was President, and recent emails from him attempting to encourage a lawyer to complain about Behanzin, but the ministry is shielding them! I have seen the letters from the JLSc sent secretly to peters etc. you have no idea what you are saying!

      The National Security Minister, did go on Radio, Kari Fm and attacked the magistrate during the Bubbles trial!!! They attacked him for more than a week, non stop!!!!

      Behanzin should open his mouth and release the rest of the information- what they are doing the man is clear victimization.

      We in the Media have been asking the AG whether he has ever encouraged anyone, including lawyers of others to complain against Mr Behanzin – the Ministry remains silent!!!

        But off course they will remain silent. This country is obviously in chaos. Why would the government play politics with a straight up magistrate. Let us assume that Tiyani may have been over the top in some of his decisions but then is that an adequate reason to let him go. Let us be honest the work of Tiyani has instilled more fear in the criminals and thugs than the work of the police department. As to why people like Levi and Benjamin would lauch a parade against tiyani is beyond me. If we are criticizing Tiyani for what they refer to as misguided sentences to offenders then what about the faux pas of the other magistrates , the present AG etc. In fact we have seen more misconduct and unprofessionalism from those who are seeking to victimize Tiyani. Maybe these self serving paraders should do the honorable thing and resign immediately.

        I am trying to understand the difficulty this magistrate is experiencing to do his legitimate duty to end all type of criminality in Dominica. His previous method of sentencing may seem divorced to the accepted procedures, but we have to admit it has brought results in the fact that those who commit a crime are worried to be brought to this magistrate for a hearing. It is true some of the cases brought before him and his sentencing maybe the reason for his present predicament, this sentencing in itself directly, may have reduced crime in the Country.

        I hope this is not a situation when overseas Dominicans leave comfortable and secure employment and dedicated themselves to do their service for the Country. We talk, discuss and when we do according to procedure, there is a stumbling block. This man has to be given the full support from his legal fraternity to be given the full status to practice within the Dominican Judiciary without any delay

    As Toro Toro says Ian got a good heart and that is so true. It is sad that Ian is placed in this uncomfortable position of having to spite his family to please his cabinet colleagues , the very same people who berates him and show him little respect. It is quite obvious that Ian is not respected within the ranks of the DLP. Ian knows that, Ian’s family know that and Ian friends know that too. Because of the history of Portsmouth and the DLP Ian could have been one of the most influential member of this cabinet but Ian does not have the personality to ruffle feathers and sometimes step on toes.. Ian has a Teddy Bear personality. Ian does not have leadership qualities – I have always seen Ian as a follower, someone who could eloquently contribute to verbal discussion and planning but does not have it in him to go out and execute plans. Ian is not the boots on the ground type person. To be blunt – talk no action type person. But then again this is typical of the Douglasses

    One other factor that comes into play is the uncertainty in the allegiance of the Portsmouth voters- Do Portsmouth people vote for Labor because the candidate is a Douglas or do they vote for the Douglas because the Douglas is a Labor. This quagmire is yet to be tested. If I recall PJ fired Mike Douglas because Mike Douglas was no Stuffed Bear – Mike would step on toes and hit in the back in order to get his way – Mike Liked Mike. Maybe it is time for Ian to step up his game not only in his responsibilities to the constituency but he must play the game like the man holding the best cards – no need to bluff Ian you have the best hand. I’m saying that Ian should step up to the plate and go bat not only for his cousin Tiyani but for Law and order.

    I am sure that there are members of cabinet who are willing to see Tiyani continue the good work. You can take that to the bank. Tiyani’s situation is only because of a few self serving individuals or a small gang who happen to have all the PM’s dirty laundry information and as a result have a choke hold on the cabinet. There are cabinet members who are just as disgusted by Tony Astaphan as most Dominicans are and due to personal interest these members are not willing to dissent.

    Ian must assess the following; Is Portsmouth willing to stand behind him if he changes his game plan and become more aggressive, assertive and decisive. Will Ian gain some accolades if he stand up to leeches like Skerrit and Tony Astaphan. Ian must also remember that he failed his cousin Sean and is he willing to betray another first cousin just to please people who are stabbing him in the back. I am 100% sure that Ian will have the support of some members in cabinets if and only if he ups his game. It would be more than reasonable to assume that Portsmouth is 50% Labor and 50% Douglas.

    The opportunity is there for Ian to make history and change the face of politics in Dominica. In order to change the people’s perception of him Ian will have to make some bold moves in cabinet and publically. To begin Ian must come out publically and praise the good work of his cousin Tiyani thereby making Tony , Skerrit and the cabinet uncomfortable.

    What Rubbish!

    legitimate expecation to be called to the bar? Nonesense! To get called to the bar, one simply needs to fulfill the legal (requirements/statutory) requirements – full stop end of story! The same is true for any professional body…Once the requirements are met, there is absolutely nothing anyone in government can do to prevent you from being called to the bar…

    The AG has no authority to promise to call someone to the bar who has failed to fulfill such requirements any more than the Minister of Health has no right to decalre someone a doctor until they have fulfilled those (statutory) requirements for becoming a doctor…

    So somebody please tell me how on earth can a guy who not only has not fulfilled those requirements but has been convicted (In England) for pretending that he has can now turn around and say he had a “legitimate expectation” that he would be called to the bar….?

    If you know you have not filfilled the requirements your legitimate expectations must be that you would not be called to the bar until you have…

    The guy has never praticed law before in any jusrisdiction, comes to Dominica riding his fathers coattails and get appointed magistrate by his cousin, and 2 years later he is planning to sue the government for not calling him to the bar….?

    This Behanzin guy need serious help!!!!!

      Law and Order you’re so right. This guy utterances are bordering on arrogance and one is left to wonder who died and made him king, that he now makes demands as to who should be removed from appraising his performance over the past two years. Should the Ministry of Legal Affairs and the Judicial and Legal Services Commission (JLSC) ask Lennox, Angelo, Matt and Jerry to appraise his performance?

      This is utter nonsense by Mr. Behanzin, how on earth he feels he must be called to the Bar and not go through the established process. What amazes me is that people with no knowledge of what obtains to be called to the Bar are the ones shouting the loudest.

      Mr. Behanzin cannot be called to the Bar by going through the back door as it were, he must be counted as one who has met all the requirements. Some people claim that he is the best, most brilliant, most educated, most honest, most hard working magistrate, yet, he refuses to convince those persons he has what it takes to be called to the Bar and won’t attempted to obtain it by going through the “Back Door” as it were.

      That kind of behaviour is not what is expected from a genuine legal practioner, this is the chanting of a sick person hoping to ride to the Bar through and onthe coat tail of his deceased father.

      How sad Mr. Behanzin. Is that the legacy you wish to establish for yourself?

    This sought of reminds me of ‘you follow’. i was a youngster back then, but I do recall that crime was on the down low as no one wanted to face ‘follow’ in court. Lawyers complained, people complained and that was the end of him… What happened next? People were saying that ‘if follow was there … ‘ and ‘when follow was there ..’. History may just repeat itself. With crime at an all time high wouldn’t we be saying ok give those drug users, murderers etc a break by getting rid of Behanzin because he really coming down to hard on them?

The more crook and dumb you are is the more they want you, because you serve their purposes fine!     It’s clear that Dominicans have fallen in love with Behanzin. I was also one of his biggest fans because I like the idea of a magistrate who sentences firmly as a deterrent to peeps who feel they can commit crimes and get away with a slap on the wrist.

    HOWEVER, after so many of his convictions were overturned on appeal, I do have some doubts about him. It’s OK to sentence firmly within the guidelines, but to ignore the guidelines and just give arbitrary sentences which are then overturned, I really don’t know how is it so many people overlook this. It’s either he isn’t a competent magistrate and doesn’t know the law, or he ignored the law!

    Also, I hope he gets a fair evaluation, and I hope his contract is renewed and that he starts giving convictions which aren’t overturned on appeal.

    HOWEVER, what’s this about he doesn’t want all of these people to have a say in his evaluation? That’s like u’re a teacher and when it’s end of yr evaluation time, you say I don’t want my Head of Department, the school principal, or the Minister of Education to have a say in whether my contract is renewed, because I have clashed with them in the past.

    Since when do things work that way?

      Poor Behanzin

      He can’t be a magistrate if his contract is not renewed, he can’t practice law inEngalnd because of his conviction, and he can’t practice law in DA because he has not been called to the bar….this story keep getting more and more pathetic…maybe he should start planting bananas

      Anti-hate, How would you like to be evaluated or judged by people who have publicly demonstrated their dislike for you? If you applied for a position and on the day of your interview you realize you are going to be interviewed by those who hate you, would you feel comfortable? Stop being naive man! I am awaing the one of Bubbles because with the political trend that is now existing in Dominica and the friendship of those in the region, overturning a conviction is a very small matter. That’s another reason why Dominica is so behind; we have no sense of conviction; we call good bad and bad good. God help us!

    One does not need to be called to the Bar to serve as a Magistrate. If his immediate supervisor the Chief Magistrate, the Attorney General and the Minister in charge of Security have no confidence in him, how does he expect to serve as a Magistrate in the State of Dominica.

    Two concerns are apparent with Mr. Behanzin’s story. First, he should have known better than signing on the dotted line with a mere promise from the AG. While oral agreements of the kind that Mr.Behanzin speaks to have been adjudicated in court and ruled in favor of the petitioner, they are often harder to prove.

    Mr. Behanzin’s case would have benefited greatly if he had a piece of paper documenting the AG’s promise to him as he asserts in this release.

    Secondly, this is another example of how this government continues to put the cart before the horse in matters of state – yet another example of a government adrift, inconsistent and probably beginning to implode under weight of increased scrutiny of its behavior in office to date.

        That quote to me, says alot about the man’s state of mind and how he came to sign his contract with government. He emphasize that it was on the basis of a promise, the word of the then AG, that went ahead and signed a contract.

        I think this line of reasoning is shed a lot of light on the situation and potential outcome.

They get heady, and excited about the job,and rush headlong with really no documents and tapes to support a firing, or job complaint later. This gentleman if not reinstated will be Dominica’s lost and another country gain. The funny irony of the matter is that when Dominica will be in chaos Tiyani service will be sorely missed because as the saying goes, “YOU NEVER MISS THE WATER UNTIL THE WELL RUNS DRY” and he will be missed, but pride filled people would have taken over our country.
