Neil Hamlet and Richardson Alexander both of Marigot, and Laudrick Bruno of Woodfordhill have been charged with conspiring to commit robbery and robbery of the National Development Foundation of Dominica (NDFD).
According to the charges, the men allegedly robbed the establishment of EC$3771.30 at gun point on Wednesday August 11, 2010.
The defendants were not required to plead since the offense is indictable.
Dominica News Online was informed that Hamlet was an intern assigned to the NDFD from the Youth Skills Department at the time of the incident.
Bail was denied for three men when they appeared before Magistrate Candia George earlier today.
Police Prosecutor Levi Maximea had argued that bail should be denied on the grounds that the alleged offense was a serious one in which police were still attempting to retrieve the said firearm and exhibits used in the robbery.
Maximea also based his application on the premise that the defendants were interfering with witnesses involved in the case, adding that one witness was already being threatened by the defendants.
Investigating officer Corporal Vernon Pacquette, told the court under oath that out of the nine men who had been held for questioning on the matter, only the three were charged. Pacquette confirmed that one the men who were released was the one threatened in his presence.
According to reports, that individual has turned state’s witness.
“The three men (the defendants) who were in the cells yesterday at the police headquarters…were all making threats…saying what they will do to a certain witness when they get out of here [because is he that have them in that].” Pacquette told the court.
“…Richardson was brought upstairs. We had to keep him away because of his behaviour towards a witness…” Pacquette noted.
Lawyer for Hamlet, Gildon Richards, argued that his client was only attached to the incident based on his association as an employee of the firm. He labelled the prosecution’s grounds in its request to have bail denied as matters of “hearsay, general allegations and not evidence.”
“What he told you is not a fact…It’s an assumption,” Richards said to the magistrate.
“My client is not accused of using any firearm…” he said.
When Richards requested that the name of the threatened witness be mentioned in the court, the prosecution objected stating that this would put the witness in harm’s way.
The magistrate ruled that the names of witnesses who were not charged need not be mentioned to the public.
“I am not going to open bail at this time…Especially bearing in mind that the police gave evidence of threats…” Magistrate George stated.
“Bail is denied for the moment…I am not going to specify the time…” she ordered.
The preliminary inquiry into the matter is set for November 15, 2010.

Neil Hamlet was raised to fear God, is from a well respected family in the community of Marigot. What is ALLEGED that he has done has broken the hearts of many who knows him and where he came from and how he was raised. All parents knows that you make children and do not make their minds, so they choose their own paths.

As Dominicans we ALWAYS seem to enjoy the hurt and pain of others, this is the reason why so many things are happening to our people, young as well as old. They were not given bail because the THREATENED to take a persons life. if I am not mistaken that is probable cause! and if you are going to kill someone you should not be given bail! duh! if they gave a suspected murderer bail it means that 1 the murder has already occurred therefore it cannot be prevented and a person is presumed innocent until proven guilty. Learn the law people. They r not being denied bail because of the alleged robbery they are being denied bail because they stated their intent to harm someone. If they don’t skip bail the money will be given back to whomsoever posted bail anyway.

The Law and the Government should transfer young fellons like that to Millitary training camps in Venezuela to do hard labour and learn a dicipline to serve Dominica. Great police work, but it is ashamed that they took pictures of these guys in their street clothes, why wern’t those jailed morge shot clothes used? Were they sitll in the washing machine? Aren’t they alleged to be criminals? Why weren’t they chained in their feet as well, these guys looked like they could start running, that would have showed the effective use of resources. The crime of a youth or Juvenile and the crime of an adult must be judged differently. The Law does not allow for the names or pictures of those under aged–under 18 years old I believe–who commit a crime to be made public. The same goes for the terms of granting bail.
Young people are killing each other and committing other crimes all the time in Toronto. But as long as those people are under the age of 18, names and photographs are withheld from the public. The crime case of a youth is not even conducted in an adult court. Those cases are brought before the Judge of a Juvenile Court. People on DNO, really need to be better informed, if they intend to write comments.

I agree with Tyani Behanzin when he says there should be a bail act. Earlier in the year same the same Bruno guy was in that robbery at a store in town he got bail . Now he is at the next level robbery at gun point. When criminals get bail and they get in trouble with the law again while on bail it should be denied and the fines are too small.
