DEVELOPING STORY: 25 government officials, parliamentarians facing legal action

Several politicians on the Opposition and ruling party and official heads of Government departments are among those summoned to appear in court in November for breaching a law under the Integrity in Public Office (IPO) Act 2003 as they failed to declare their assets within a required time.

When contacted by Dominica News Online (DNO) Director of Public Prosecutions (DPP) Gene Pestaina refrained from giving details on the matter, and only responded by saying “Persons by law who were supposed to declare their assets to the IPO Commission were charged for not declaring their assets”.

A source close to the situation who chose to remain anonymous informed that 44 names were published in the official gazette on June 2010 stating the requirements of their declarations.

Managers of statutory corporations, boards and commissions are also part of that list.

Speaker of the House of  Assembly Alix Boyd Knights, Chief Cultural Officer Raymond Lawrence, Chief Fisheries Officer Andrew Magloire, Chairman of DBS Radio Board Aurelius Jolly, former Opposition Leader Earl Williams, Deputy Speaker of the House Ronald Toulon,  United Workers Party (UWP) political leader Ronald Green and its deputy leader Claudius Sanford, Eleanor Lambert,  Director of ChildFund Caribbean Francis Joseph, Dr. Gerald Grell, Chairperson Planning and Development Division Juliette Shillingford-Tonge,  Dr. Dorian Shillingford,  Senior Physical Planner Kelvin Rolle, Brian Vernon Bynoe, Acting Chief Medical Officer Dr. Griffin Benjamin, Antoine Defoe,  Chairman of the Independent Regulatory Commission Carl Duncan, Director of Telecoms Sylvester Cadette,  former UWP Senators Marcel Nicholas and Nicholls Esprit, Anthony Leblanc, former Government Parliamentarian Urban Baron, Executive Director of National Telecommunication Regulatory Commission Sylvester Vital are accused of not filing their declarations by March 30, 2010.

New Government Senators Tammy Jean-Jacques and Bentley Royer are also charged for not filing their declarations by May 31.

Up to Wednesday afternoon, summons were being distributed to these public officials.

Others were excused since they filed their declarations although it was late.

According to the source, the prime minister was not one of those charged.

In a telephone interview with DNO, Ron Green claimed the first day he visited the office there was closed.

“It was four o’clock that day. I went there at four o’clock and they were already closed. So I went next morning eight o’clock and I filed. That’s what they charging me…. Late filing. Simple, simple reason. It’s a simple thing… and I’m suppose to go to answer that in court I suppose. These are the facts,” Green stated.

An hour after being served today, Green said he was unaware that any other members of his party were charged.

“It’s important that whatever institutions we have are institutions that take action that are able to deliver, so to the extent that this is a beginning of a delivery I am very happy for that. There are concerns that have been expressed with lack of delivery so if this is the beginning of delivery then praises to them,” he stated.

Claudius Sanford’s reaction upon receiving the summons was shock, according to him.

“I’m totally surprised that I was served that,” he stated.

He claimed that he filed his declaration when the legislation was enacted and passed in 2003, adding “I did declare; I have receipts.”

It is also surprising to him that the summons read that the legislation was passed in 2005.

“I am further surprised [because] I am not a public officer. As of the pronouncement of elections in November 2009 my post as a senator was terminated, so I didn’t see why I had to oblige to their request [to declare my assets],” he explained.

He further clarified that because he was not elected or nominated as a senator he did not see it “fit” to be referred to as a public officer.

Sanford said earlier today that he already held discussions with his lawyer about the matter. Consequently, he will know what needs to be done.

Alix Boyd Knights also claimed that she had filed her declaration.

In his address at the swearing-in of members of the Integrity Commission during a ceremony at the State House on September 2, 2008, Chairman Julian Johnson said the Parliament enacted the IPO Act 2003, which “deemed it necessary to subject a class of persons (all state functionaries) to a special regime of disclosure of their financial affairs and to a detailed Code of Conduct. This was done for the express purpose of establishing probity, integrity and accountability in public life in the Commonwealth of Dominica.”

The offense carries a maximum penalty of $ 20,000 or jail term of two years.

The names that are on the list were not chosen arbitrarily as you would like to think. Why don’t you find out what Is the IPO commission, and how it functions. and stop thinking fairy tales.

    As to your reference to corrupt Politicians” does that not include members of the UWP to, they are politician also. Why is it you want to use the word “politicians” and not include UWP members, is it because of your convenience as to who you want to be classified as corrupt.

    I now hold in my possession a copy of d official gazette dd June 2010. DNO you either have not mentioned all d names listed on d official gazette or i want to know if the ppl u have mentioned were d only ones action was taken against. Please DNO tell d ppl the truth. 44 names were listed plus two senators. I didn’t c d name of Alvin Bernard, Abraham Browne, Gerald Burton, Kelver Darroux, Eisenhower Douglas, Mandra Fagan, Vince Henderson, Loreen Bannis-Roberts, Hector John, Sam Martin etc. just to name a few. What is really going on? Were these ppl served with notices?

We ask for IPO as it was in the 2003 law and now we are surprised that the IPO Act is looking for us even when we are not in Public Office. can you imagine that an aspiring Prime Minister does not know that the IPO ACT can reach him long after he leaves the Public Life. Doesn’t he know such a simple fact. after all he was one of those who was lobbying for the Act. Coemon Sandford. If you lawyer cannot advise you that the IPO Act still has implications for you long after you leave Public (and in this specific case rejected) life then he should not be paid…

    it is a shame, to all these official, how on earth, can you be trusted to work for the people, when you do not adhere by the laws of parliament?.. I think declaration of assets should be done before nomination day, so if you failed to desclosed your assets, then you are not qualified to run for political office. Its time to clean house.

    So Claudius, if you were given a specific date in December, why wait until the election results to file?

    The point is and has been, you were running for public office, which means that if you had won your seat or your party had won the elections, you would have became a Minister of Government, and possibly Deputy Prime Minister of Dominica.

    Isn’t this sufficient reason to declare your assets?

    The integrity issue is a simple one you know… it doesn’t get anymore compicated than this.

    Why are we rushing to judgment and pointing fingers when we do not have the facts as to why some people failed to comply by filing the proper documents to the commission before the deadline date, Let us also remember, by not filing before the deadline does not in any way makes someone guilty of a crime ,illegal activity or corruption . So please let us wait and see what the facts are before pointing fingers and going on a witch hunt. The IPO is not a Court to determining peoples innocence or guilt and should not made to believe so, and it should not be quick to pass judgment without hearing evidence.

    I’m not against having a body like the IPO, sure, it serves a very credible function just as what it implies and what it is supposed to achieve. The people who are chosen to administer it, they to should have some integrity and perform their duty in a nonpartisan manner. One of the things that bothers me, is the amount of information one needs to provide to the commission under the act. What are the safe guards put into place to protect such sensitive and personal information? Who has access and privy to such information? The IPO Commission should not be looked at as a “gestapo” body of people looking to harass Public officials and intimidate them as some people would like to think, there are Laws and procedures as to how such body should operate legally, that is why there are courts and a justice system.

    Public Office??? So if I am public officer in the public service, I have to declare my asset to the state…Is this some sort of communist operation. So as a private person in public life I might not be able to invest hereby creating economic growth in a stagnant economy.

    Is this what lennox, matt and the uwp wanted?

    Your savings and checking account is monitored by the Financial Services Unit and you must file your taxes every year….so why this other organization monitoring me?

    This is slavery and economic imprisonment and the government should ban this IPO nonsense.

    We are so eager to celebrate the misfortunes of others that we no longer care to understand the matter. It clearly is indicated that those individuals were summoned for failure to declare assets and income before a set deadline; this is no different from failing to file tax returns on time. There is no indication of intent to deceive or withhold in the published statement, so for some of the sadists, it’s too early to rejoice.

    We need an ammendment to the Dominican constitution that will allow the voters to vote for the AG. Then, the island will be on its way to real democracy. No independent minded AG, no democracy. That is the implied intent of the corrupt leaders.

I’m sure similar investigations into the the UWP during their reign would prove otherwise, both for party members and supporters. Just look at what the last leader did. He was sent away so everything is forgotten, the garbage was swept underneath the mat; or so it appears. Result: the UWP has never had corruption, and will never be corrupt, having been cleaned off ALL its corruption, that never existed in the first place. Sounds kinda contradictory doesn’t it. Hahahahaha.

    Keep on fooling yourselves and basking in your hypocrisy and amnesia of convenience.

    With all the ranting and raving about lack of democracy, hear it is that all these events are taking place, and you fools are so blinded by your personal political affiliations that you are unable to see them for what they are truly worth.

To the police, there are those with villas,those with 10 0r 15 vehicles,mansions,those who are sponsoring everything in their communities..Dominica is small,we know them..Even school children are mentioning their names..I see this as a dangerous thing,since they could become the role models of these school children.These lazy set of people employed to guard the country against such ills (including the IPO) do nothing…

    The IPO is working for us so why did we not know about this. Let the public know what you doing. It appears that the IPO is conspiring with the officials or even making compromises with the politicians. This is anoying . The very same people that is suppose to be guarding the crooks are secretely talking to the crooks. Why are we hearing this unofficialy.How can we trust the results. This is just a vicious cycle of corruption.

    If the IPO had Balls they would have told us so in March. I am assuming that those in opposition were also ask to declare their assets and if so why did Eddie and others not come out and say something. D/cans open your eyes and get real with those crooked politicians

    This is why you don’t favor working for government???????? Hello if you drink coffee how can you not like the aroma. You play the game leave by the rules.
    Bias if you believe that your public officials are true, sincere and honest there is nothing wrong with we the tax payers and voters requesting a transparent system Whether you are Labor or UWP Or Freedom supporter why not demand honesty. In fact we should not want our next general election campaign to be about unfounded accusations – Right Bias. Here is the opportunity to prove that our government officials are clean. The same goes for the opposition members and those in high government position.

    How can D/cans particularly Laborites oppose this move. After all we deny the accusations about the present administration, we ask for the proof. Then now is the time to get Lenox and others to shut up. Like Goose and gander said – the process must be done correctly and with fairness. It means that the public officials including those who feel they above the law must truly declare their bank account and to include the money in the mattresses and crab holes.

    Like MIGHTY SPIDER say “ Whenever they do wrong I will put them in song” You en greater with your power you en mightier than the Dyno Dyno Dynoooooo ( make that IPO IPO IPOoooooo). To those who remember that calypso- spider was truly a master . wasn’t he .Back to the issue – If we want the next election to be about the growth and development of our nation and not about accusation of corruption then let us all DLP, UWP and DFP supporters agree to have a real transparent system of government. IN ORDER TO GAIN SOME NOTORIETY THE IPO SHALL PROOVE TO US THAT WHATEVER ASSETS DECLARED IF EVER ,BY THE PUBLIC OFFICIALS ARE ACCURATE. WITH ALL THE LIES AND DENIAL BY THOSE DIRTY POLITICIANS HOW CAN WE BE ASSURED THAT THE POLITICIANS WILL DECLARE THE TRUE VALUE OF THEIR ASSETS. AFTER ALL A LAWYER FORGOT TO PAY TAXES ON A PIECE OF LAND BOUGHT BY A MINISTER – PROPERTY OWNERSHIP (PICARD & VILLAS) SHIFTED IN A JIFFY – NOTHING ELSE WILL SURPRISE ME.
