Fifteen years each – these are the sentences High Court Judge Brian Cottle on Friday imposed on convicted murderers Herbert and Lauretta Xavier and Manuela Williams.
The brother and two sisters were earlier this month found guilty of murdering their brother Harrison Williams 17 months ago.
The sentences were delivered after lawyers for the three, Dawn Yearwood-Stewart, Wayne Norde and Ronald Charles mitigated on their behalf.
Yearwood-Stewart told the court that in the face of the guilty plea by the jury on 43 year old Manuela Williams she maintains her innocence, with similar sentiments expressed by attorney Ronald Charles who also represented the mother of five.
“She has suffered openly and continues to suffer the loss of her favorite brother,” the court was told.
Yearwood-Steward also made a case for leniency on behalf of Lauretta Xavier and asked the court to “look at the circumstances surrounding the death of the deceased (Harrison Williams) and look at the character of the convicted persons who have no previous convictions”.
“The murder does not fall into the worst type of murder…..it is difficult for me to stand here and say she is remorseful for what happened the night since she maintains that despite the verdict of the jury she is innocent,” Yearwood-stewart stated.
Her colleague Charles asked to court to “temper justice with mercy” and not to impose “a lengthy jail sentence on Williams.”
Wayne Norde mitigating on behalf of Herbert Xavier said the convict was remorseful and is willing to take part in rehabilitation while incarcerated.
He asked the judge not to impose a lengthy jail sentence, adding that the deceased was the “aggressor” on the night of the incident.
“There are no winners in this matter, he is young (32 years) with two young kids, the incident was unplanned and unfortunate and we are begging the court for mercy,” Norde pleaded.
Before passing sentence on the individuals the Judge said that the jury had rejected the stories of all three individuals and “found that they were not telling the truth and I am not surprised at the verdict.”
He frowned on them for refusing to be remorseful and accepting the verdict of the jury which he says was very correct.
“To refuse to accept the verdict of the jury even at this late stage show no expressions of remorse not a faint of that. All three are jointly responsible for the death of the deceased. He was lying in the drain injured and helpless and blows were inflicted on him, the force used caused the wood to break what they did was beyond what was required,” Justice Cottle stated.
The judge indicated that he took account of the social inquiry report, also the fact that the deceased had entered the yard armed with a piece of stick.
However he said that pathologist’s report was “damning” on the three.
He then pronounced sentenced on all three – 15 years each, starting from the day they were arrested.
If I recall reading, the brother was driving and minding his business. A drum was placed in his path to prevent him from driving. This led to a confrontation. They were the perpetrators which led to his death, depriving him of his God-given life. The accomplices also contributed to his death. If the sister loved him so much she should have called the Police and during this time she should have asked them to cease their attack on him. She is very well guilty of murder. So much for her love of him.
God is not blind, deaf or sleeping. His blood has been crying to Heaven for vengeance. They deserve 15 years. Consider that 15 earthly years is a long time and consider their age. I do hope that they can be rehabilitated.
They must turn to God and ask Him forgiveness, make penance, sacrifice and restitution so that God will forgive them otherwise they will face a worst fate, eternal damnation for Thou shalt not kill! This is the Commandment of God. No one will be excused or exonerated from it.
Its a very sad ending for both family,but if you get to know the deceased wife she is such a trouble maker,always beleives in obea etc,her husband maybe would still be alive,and would be getting on with her brother and sisters.
15 years jail adds up to minus remission which is 1/3 so thats down to 10 years and then minus time served.So its about 8 years jail time…A Life is not worth must at all these days..OMG

Everyone has something to say,everyone wants to be judge.The bible tells us the wages of sin (any sin) is death when its unconfessed, yet it goes on to say if we confess our sin he (God) is faithful and just to forgive us of our sins and cleanse us from all unrightousness. Prisoners in Dominica serve 2/3 of time sentenced. 15 years x 2/3 = 10 years.
10 years less 17 months (time already served); The sibblings should be out by end of 2020.

Whilst tiyani was a great magistrate, he would not be able to do anything much with that case. The reason being that magistrates sit in the low courts, and that particular trial and sentencing is being handled by the high court.
If they are allowed to serve their full time in Jail……The 15 years is okay. There is no punishment that we can give them that will bring back their brother.
My only hope is that they do not let them back on the streets before 10 years.

Am I reading well. The trio have been sentenced. Yes this was a hurtful thing to happen. Now all of you acting worse off then them now. You want to judge them further and is as though some of you hate so much that you have all even removed God from the equation. Do you all know that hatred is also murder. To hate those person with such emotions, you are all actually committing murder. They were found guilty. They have been sentenced. You do not know the condition of their heart with the Creator. They may have repented like the thief on the side of Jesus. They have had to live with this for the past 2 years when this happenned. This is a sad thing for a family to go thru. They have children also the deceased man has children. The deceased man was their brother. They are the Aunts and Uncle of the deceased man child.

Fifteen years for murder? Oh my God! Now if the sentence is to run concurrently, it will mean that they will actually be required to serve 7.5 yrs…right? So technically speaking by 2019/2020 they are expected to be out.

How can it run concurrently if there is only one sentence?… Concurrent is when you have two or more sentences that run at the same time, they can be give time for good behavior, the judge already granted them time served, so thats 15 years minus 17 months so actually 13 years and 7 months is what they are expected to do unless they are given time out for good behavior or just released because of over crowding.
Harrison should come at them every night with the same piece of stick they bit him with and they will see how sweet it is, they are alreading looking like hunted people. now the wife should go to guada a let them see harrison coming after them. (lol)

Actually, 15 ‘prison’ years amounts to 10 calendar years, since 8 calender months is equal to one year in prison. Given that they have already served about two years, they are expected to serve an additional 8 and should be out in 2020.
Have any of you who are making these negative commments gone to the law books to see how many years the judge could sentence the people to? have you all thought about what the judge took into consideration? Do not compare others to the woman and others who murdered him. While they are in prison they will regret it and will have a lifetime of regret.
You state they did more serious crime, judging others. What is worst than murder; family members standing by, be it a wife or friend, observing a family member being beaten to death and doing nothing about it?. They wanted him to die. This was their intention.
She gave away his belongings because she fears if they remain in the home, she will be haunted by it. His spirit will haunt her. Ever gave this a thought?

I had a family member who died under normal circumstances of illness. A few months after she died I dreamt of her. She was in a biege or off-white long gown with no shoes. She placed her head on my shoulders and sat on my lap. I felt nothing; not even a feather weight which has no weight at all; I was not scared. When I awoke, I just reflected on the dream. I concluded that she came to tell me that she is OK in Heaven and thank you.
I prayed a lot for her while she was sick and gave her much consolation. Many times I cried knowing that her end will be near. The night she was passing on I stayed up all night and prayed for her. This dream continues to be vivid in my mind.
The best thing we can do for people when they are alive and sick, is to be kind to them. We must never harm them and do not be deceitful and pretend to love them. God knows our heart. God rewards the good and punishes the wicked.
What they did to their relative was extremely bad. How the Most Sacred Heart of Jesus hurts when people are not kind to others and commit crimes and murder athem. They will not escape God’s fair and just wrath.

I understand what you trying to say, but just because someone else allegedly committed a crime without conviction, it does not mean that another criminal should not get the sentence deserved. They are guilty and respionsible for putting their own children in this predicament, not the public or the judge. It are they, who are the cause of their childrens’ suffering and they should have thought of them before robbing their brother of his life!

when i saw that headline i gasped.. and thought well 15 years is ‘good enough’… knowing d.a i was expecting to see a 5 years etc… but coming to read the comments i’m taken aback… one day equals two days in d.a… so 15 yrs equals 7.5 real years minus time served which is almost 2 years and ‘good conduct’… all in all 3.5 years maybe could be trimmed off…. so in reality they might only serve just 4 years in prison…
