Charges of murder and conspiracy to commit murder have been withdrawn against Curtis “Shakes” Richards of Newtown and Andy Prosper of Morne Prosper.
The charges were in relation to the deaths of Allan Bardouille of Newtown, Mannison Thomas of Fond St. Jean and Kenneth Birmingham of Kingshill whose bodies were found riddled with bullets in a boat 26 miles off the coast of Salisbury in October last year.
This morning, the prosecution told Magistrate Candia George that it was no longer willing to give evidence against the two men on the matter.
Magistrate George therefore withdrew the charges upon their request. The prosecution gave no reason for their decision.
Richards and Prosper had been bailed two days before Christmas last year with sureties for $500,000 each at the High Court.
This morning, their lawyer Zena Dyer requested that the defendants travel documents and other exhibits and documents be returned.
Magistrate George, though stating that nothing had been presented to the court, said that it was left to the police to return what was taken from the ex-defendants. She however ruled that the items be restored to the men.
Richards and Prosper had been remanded for a few weeks last year before they were bailed.

It is time for a cultural revolution. Dominica needs Islam. We believe in the same creator who sent prophets such as Moses, David, the Messiah etc. We believe that the creator is one without any one sharing in his dominion. Only an Islamic system of government will provide a conduscive society for all to worship God and live their lives. We all want to get closer to God, thus tough laws from Allah must be implemented in order to curb these criminal behaviour.

If you really want these things, it is time for islam. I must say that I am surprised that anyone could even get bail relating to a murder charge.
It has happened here before.
The accused men have had the charges dropped and infact have not actually been found
innocent (as there was no trial. Well not a court trial). The charges were dropped as there was
a lack of evidence. The police cannot make the facts public knowledge, just incase they
have other suspects and it is not a threat to national safety.
As for the police being sued for wrongful arrest, that would be in very poor taste.
Yes I agree there doesn’t appear to be much law and order in Dominica, and it does seems
that the rules are changed according to who you are or who you know.
We should also remember the old adage ‘innocent until proven guilty’.

People have come out on 2 sides here, those who believe the accused are innocent and those
who believe that they are not. None of us can actually be sure of what happened on that fateful

Number one the police never had a case against the two men.. ..everyone knew they were not the killers. forensics seemed to have confirmed that the bullets can be traced back to a particular country. so i hear it so i selling it but it makes perfect sense because a reason was not given. boats from that same country have been seized with drugs and nothing done. shame on the choices that are made as a representation of the people and the country. Every decision

When there was a matter of interpretation of some gun law, he was quick to discredit AC Carrette on the radio and was quick to prosecute a businessman confronting people who were trespassin in his property, but now he can’t give an explaination as to why the charges are being dropped against these guys.

About two weeks ago, one guy was denied bail for possession of less than one pound of cannabis, if I recall correctly. He was also represented by Mrs. Dyer. Now I am reading that two suspects of a tripple murder case were out on bail. If the case lacks evidence, they should not have been arrested, in the first place. Once they were arrested, presuming that the case had evidence, then they should not have been on bail. not for a tripple murder case!!! The use of firearm alone should warrant indefinite detention until the case was adjudicated

our police and prosecutors need to be better trained in investigative techniques and the details of the law….for a murder charge to hold weight in court “intent” must be clearly proven, so is it a wonder that those criminals walk away scot free??? The charges are not relvant!

I went to two of their cases! And everytime they had to postpone case cause the police didn’t have evidence! Police always and does never have enough! That’s why they always have to dismiss a case or drop charges! I think we need better police investigators to. Is not always money talks and bullshit walks! I knew these charges would of been dropped, they just didn’t have enough to prove it. Next time really dig in
Why am i not surprised, when they were released on bail i know that would be hte out come. I know Andy and shakes very well Andy as a co-worker and very close friend but by no means should they be out. That is so unfair but this one I will have to say to the both of them do not forget what happened to Mwanga Freeman u get away one way somebody will get you in another way.

What has become of our justice system? Three men (though not innocent beings) lost their lives and the perpetrator (s) are out there somewhere laughing at the law. I wonder if the police followed every lead. There was so much talk on the ground about who did what, who went to rescue who, who was under boat, who served as interpreter, who recieved the first telephone call etc etc. Everybody seem to know everything.They said it pointed to the interpreter and boat owner,. The boat owner was not there,but he knew about the plot – all kinds of information. the fellas dfied on shore and the boat was towed out and allowed to drift. Who was hiding under the bed on a side streeet when the police came. All kinds of information was flying around. To this day certain people have been despised.
Alas! the hallowed walls of the courts are unlike a talkshow where any piece or string of emails is rationalized, torn apart, scrutinized and reduced to laymans parlance as irrefutable, credible evidence of corruption. In this mater the custodians of the law once they have analyzed what has been presented saw that the “EVIDENCE” cannot substantiate the charge. The “Victoria Street” talk cannot stand in court. So I suppose the rational evidence that is presented on radio as materials for guilt wil also be tested.
I wonder if the “blue mealy bugs” will find interest in this outcome. It should bring them some joy. After all the “blue mealy bugs” are known to fight each other in public. They will tear down others but are adept in hiding theirs and supporters mischief.
