Calibishie man convicted for murder; said he was defending himself

Twenty-two-year old Garvin George of Calibishie has been convicted for the murder of Julien Junior Joseph of Vielle Case.

The incident occurred on February 5, 2010, Carnival weekend in Calibishie.   He will be sentenced on December 5, 2011.

George had inflicted seven stab wounds to the deceased body, with the fatal one to his chest during an altercation.

In an unsworn statement before a three-man and six-woman jury on Tuesday, George not only declined to admit to the Carnival weekend murder but told the court that he was unconscious while the stabbing occurred.

In his statement on Tuesday, George said that he had defended himself against an attack by the deceased after he confronted him with a question about a young girl.

“While confronting him, he jacked me. I jacked him back. Soon we started fighting. While we were fighting…he had a scissors. He make some wild blow after me. While fighting, the scissors fell. I was afraid, I took the scissors and I use it to defend myself,” he told the court.

“In defending myself he gave me a blow to my head which I was unconscious for a while. Soon after my cousin and Yolanda Carbon came and shared us. After they did so, the guy left and they go. Soon after some guy come saying that the guy had died. I felt a way. I didn’t have any intention to causing harm to this young man. I was only defending myself that day. That’s all I have to say,” he stated.

Initially, when George was confronted at about the pair of scissors he told police that he knew nothing about it.

The prosecution’s case was based on the notion that during the said altercation, George had stabbed and killed Joseph with the said pair of scissors.

The testimony of Investigating Officer Sergeant Linton Mills on Tuesday revealed that Joseph was stabbed once in the center of the chest, twice on the left hand, once at the back of the left knee and three times on the side of his body.

The investigating officer said that  measurements taken during a visit to the crime scene on the day of the incident also revealed that the incident occurred about 30 feet from the Calibishie Main Road in a yard separated by a galvanize fence. On that fence, Mills said, he noticed what appeared to be blood stains.

The following day, Mills revisited the scene along with police photographer Sergeant Theophile. While there Mills said he noticed a silver pair of scissors about five to six inches 73 feet away from the bloodstains on the galvanize.

According to further measurement taken, the distance from the scissors to the road was 7 feet 4 inches while the distance from the scissors to where the deceased fell was 510 feet.

When he later confronted at the Marigot Police station George, in a statement, gave an almost identical story as the unsworn statement presented in court in Tuesday.

He told police that when he revivd from unconsciousness he saw the deceased walking away and that someone later told him that Joseph had gone to the hospital and died. “I heard he had get couple ‘chooks,” George said.

Under cross examination from defense counsel Wayne Norde, Mills revealed that he did not go to the crime scene as soon as he heard the report but had sent a police Constable Andrew there. He later went after he had found out that Joseph had died.

He admitted that he never took the accused back to the scene of the crime during his investigations and agreed that it would have been important to take the accused back to the scene.

Mills said that he was acquainted with the deceased and described him as a “troublesome” individual who was always getting into confrontations with others.

Mills told the court that there had been at least 30 people in the area of the indecent around the time it happened.

The jury had initially decided on an 8-1 guilty verdict but was instructed by Justice Birnie Stephenson-Brooks to deliberate a second time in order to present a unanimous decision, as required for every murder case by law.

The state presented a total of 10 witnesses while Joseph had none. The trial began on Monday. Bernadette Lambert also represented the defense.

    They should send this brute to Prison and throw away the keys. He was not defending himself at all, and yes I believe that someone in calibishie helped him by holding the deceased in place to receive the stabs. I’ve spent time in that village and that’s how those animals there operate. Apart from that all they can do is worship a stupid fool drug dealer who can’t even read and write, with locks on his head and a mouth like a dover-man dog, who thinks that everyone is afraid of his retarded self. Send that fella to Prison because he wasn’t defending himself at all. He was trying to gain ranks among those degenerates in that village to boast and say that he kill. MURDERER, send him up to Prison so that they can deal with his back-side hole, and open it up for him if is people he wants. Well he should be accustomed because calibishie is full of rapist and borgaras!

    Come on now guys. How would you all feel if one is coming at you with a pair of scissors? Lets put ourselves in his place for a while. I think he got scared and get hold of that scissors and use it to defend himself.I would vote for aquittal, I think he spoke the truth we must always think before we judge one because it can happen to the best of us.My heart bleed for both the victim and the defendant.

    i already say is only when a judge, lawyer, police and so on, lose their loved one by being murdered/or raped, then and only then they will straighten the law against those murderers or rapists.     A friend turned enemy and murdered his friend. What type of friend is that?
    He is only making excuses to get acquitted. I hope this does not happen.
    Whether the victim attacked him, this gave him no reason to stab him and so many times which caused his death. Some people love to retaliate which could lead to a fatality. One has to have a heart of stone/rock to murder someone even though the person attacked him and he is angry. He could have walked away and filed a complaint at the Police Station. There is a Court which could have handled this situation. Now, he is deemed a murderer and may spend some years or the rest of his life in prison. If after spending time in prison and he is released he may not be a better person.
    The message and lesson are, think twice before you act and curb your temper.

    We must be careful of wat we wish upon others, no one knows whether he did it out of self defence or not but the father above. It does remain dat whether one is a ‘trouble maker’ gives one a reason to murder dat person, yet still did it ever cross da investigators minds to do a proper check on d background of the deceased? There cud be leading information dere to determine da defender’s life, let’s not be bias about this people let’s really sit down and think about this cuz our young generation are just going down the drain and we do nothing about it but point fingers at them! My dear awaiting trial, I say to u God be with u whether u are guilty or not cuz either way u need him in ur life as a person. Whatever ur sentence will be, stay safe and bless and to the 8 to 1 jury verdicts I say to u dere was no need to da 1 who thought to himself or herself that he is not guilty to change ur mind.     should prison always be the answer?we al have brothers and sisters so should we wish bad on others,,,he defended himself….do u know what its like to get in a heated argument and a fight breaks out,,u think but u do more defending as this is one of our natural instincts,,,,,,to defend oneself when in danger,,,,,,seven stabwounds r all the signs if show hard the young man had to fight to stay alive……why wasnt he taken to the crime scene when arested? these police men need to watch csi miami on how to solve crimes,,,i bet positive rastaman,,elder from the villages where old mama and papa rules still exist could solve a case rather than those rum heads we call police,,,,,30 witnesses so why didnt he have one witness,,,so the moral is stay away from trouble and trust no one,,,,,i wish u a fair trial young man

    Regardless of any conflict one may have, resolution can always be met…. It’s become habitual to defend ourselves so quickly because nowadays threats have become the norm “I will kill you”!!!!
    But I extend sympathy to the family of the deceased: no one has the right to take the life of another.
    Shamelessly, regardless of the verdict people in similar situations will not see this as an opportunity to change the way they deal with conflict.
