Capital punishment a topic of discussion – Skerrit (poll added)

Frederick Newton is the only person to have been executed by Dominica as an independent state. He was hanged in Roseau in 1986.

Prime Minister Roosevelt Skerrit has said before moving to implement capital punishment one has to obtain sufficient feedback from the public and examine international human rights.

“When I called for it as prime minister some time ago I was heavily criticized by the same public who is now calling for it,” Skerrit said, adding that capital punishment is a hot debate – one which will continue.

Speaking on yesterday’s DBS radio programme, Talking Point, with two other guests, the prime minister said government will also be examining state agencies and the standing regime of legislation and decide which ones need to be further defined and what new legislation needs to come into play.

National Security Minister Charles Savarin and Acting Police Commissioner Cyril Carrette were the other guests on the programme, which was used to address the recent upsurge in the murder rate, in which six people were killed in two weeks. Savarin later that day released an official statement addressing crime in Dominica.

“The persons who commit the crime must be held responsible and if we give people the impression that the police or someone else should be then we have to be very careful,” the prime minister said.

Capital punishment, the death penalty, or execution is the killing of a person by judicial process as a punishment for an offense. Crimes that can result in a death penalty are known as capital crimes or capital offences.

Frederick Newton, the head of the Dominica Defence Force (DDF), is the only person to have been executed by Dominica as an independent state. He was executed in 1986 for organising an attempted coup d’état in 1981 that resulted in the death of a police officer.

He was hanged in Roseau.

    Don’t hang them. Build a jail in the countryside and make those murderers work until they die. Let them make blocks,banisters ect. Let them work for the Gov’t to make money.

    This Priminister is so naively out of touch…Its about time he comes out of this virtual world unwhittingly confusing fact with fiction.” Bringing in the death penalty wont do anything to stem the upsurge in crime on the island”. Criminals will only become more creative in their criminal behavior than become more responsible civil citizens…If this priminister is genuingly concern about the crime situation on the island he to first of all address the spiralling and cronic lack of jobs in the country. ” As we are well aware lack of jobs poverty and squalor brings with it undoughtably high incident of persons falling on the wrong side of the law” period! Hanging wont solve a thing! And he needs to lead by example and demonstrate humblenest and humility. How in the world are our young men and women are supposed to respond when thier own priminister and his other government coffers lavishly parade in expensive suv’s brandishing and promoting material gain most appallingly while the poor country continues to suffer and is becoming increasingly overrunned by haitian and chinesse nationals . So of course these young men will do anything do aquire material gain by any means neccessary for after all our own government is setting the stage so our young people regects the idea of conduct discpline and industry and believes that just like their representative that with a little bit of luck and carefull juggling they to can make it out. Sadly in the meantime the country dies and we restore back to more years of meaningless relavance as our leaders lacks the moral conviction to make the tough choices that will ultimately leave the country a better place for our children to inherit. The death penalty is a completely ridiculous and unreasonably proposition and it is no more than just political demagoguery to appeal to the public desires and prejudices rather than using reasoned and practical steps to tackle the problem. This leader is no more than a “circus clown” and sadly the slob like degenerate public are so dumb they dont even realize how much of a nuisance their priminister really is…..

    this situation is very hard 2 decide but we are living in a time where no one care about any-thing they just believe that they have right 2 kill how they want and there family still encouraging them. what did the french lady they killed in bense did 2 those that kill. The 2 innocent children there mother killed and so many other’s that died innocently ,so many abortion ,killing is like a game in our country .Our country is getting worst than many crime countries.So all those negatif thinking people stop speaking none sense about people following the pm minister my cross is 4 the most high i don’t vote. What if it was an accident of self defence , does your family deserve to die for protecting their lives . Let’s not think inside the box only , but also outside of it . The government is funded for jailing criminals , so dont say It’s your money , cause It’s not . If it was so , everyone would have Big house nice car business booming etc….     I am against Captital Punishment. I do not even believe that serial murders should be executed. Every individual should get a chance at reformation. If it is medically proven (which it won’t be) that said person cannot be changed, then life in prison is always the next best thing.

    Maybe the Caribbean should have 1 major prison for all sentenced to life in prison – let them rot in a jail cell instead.

    I fully support the death penalty.

    For all those complaing that an innocent person might go to jail, PLEASE, what u think? A quarter of a million people that in Dominica? When someone commits a crime, majority of the time before police hold the person, everyone already know who they are.

    I cannot imagine someone murdering a family memeber of mine, and before five years past I seeing the person roaming the island laughing, enjoying them selves having a dandy time and my people in a grave rottening. NEVER!! Those murders think is a joke because as far as they concern people don’t stay long in prison.

    I think prison is too much like a retreat, it’s like they go up there to relax, they don’t have to worry where their next meal going to come from, they have no bills to be bothered with. I think they should have some serious punishmnet for non-murder crimes, ex: go and weed at one 1:00pm and make sure is a hot day not shirt, somebody building a house , hey free labor. You are a theif , give u a big sign and put you infront of the place you stole, give you a job to wash down infront of the business every morning. Those people should be miserable, they should regrette.

    the government of dominica is always one step ahead of where they should be…they want to build an international airport but dont have roads to take people to and from there…..they build a stadium with no parking facilities…..before even thinking of capital punishment you first have to invest in the proper resources to aprehend the law breakers….too many unsolved crimes….and wrongful convictions…..measure twice cut once…..

    Believe me Dominica is a small community and everybody always knows who did it. Based on Dominica’s population how many innocent people do you think will go to the gallows? How many innocent people do you think are sitting in Dominica’s jail right now? It’s hard to get away with murder in Dominica; our population is two small for that. If he did it, he did it.

    Further, muder is murder. I do not care what method or means was employed to commit the fatal act. People do go on crime sprees, one murderer inspires another. He got away with it, well so can I, they reason. Dominica needs to demonstrate that they cannot get away with it.

    Capital punishment is supposed to deter these people. When they remember that there is a noose awaiting those who carelessly take the life of someone else, they will think twice. I remember some years ago in one of these Asian countries, an American young man was accused of defacing public property with graffiti. He was to be beaten with a cat-o-nine. Oh, there was public outcry and public rage, but that sovereign country did not back down. Dominica must do what is best for Dominica.

    Well if man decide to arbitiarilly take another man’s life, why society shouldn’t take his life back nah?

    People are talking education and all that, this is good, but how much education going to deter man from making the easy money on the street? The only way we make money on the streets is by totally disregarding the lives of our customers and competitors you know. We do whatever it takes to keep the benjamins flowing, and then we doh wanna face the consequences?

    It is a culture thing that needs to be broken and that is what needs the attention. Dominican youths it seems has lost the fear of punishment and is so inclined to chook, cut, shoot, and stab first and think or ask questions later. Some might say it is a television thing, while I don’t disagree, but Dominica is a small place. All man raise together and know each other and I don’t see how television influence could make me go and snuff out the life of my bredren. For what? Because I want the reputation as a bad man?

    Some talk about the way people are raised in their home, but maybe with the threat of capital punishment looming, parents might start to keep their children closer to their bossoms fearing that they may be raising their children for the gallows. The threat of capital punishment makes a man think twice. No man wants to go out that way.

    Now that capital punishment start being talked about, people start coming with human rights. Where are the human rights activists when you see the victim’s families bawling and moaning at the grave sight when they are burying their love ones? Or do you see them in the troubled areas after dark standing between the bad men and their gun shots? No, they only come after when is punisment time.

    Ah Dominicans it seems all you want omlete but doh wanna break eggs….

    It doesn’t matter what life throws at you, all man is responsible for his own self, and there comes a time when you have to ask yourself, ‘are you part of the solution or part of the problem?

    Sorry if I come across as cold, but I am deeply troubled by the way that the country is turning out when it comes to crime.

    It is a very simple math: you don’t wanna get executed, don’t kill your bredren, period!!!

    Capital punishment does not deter crime. Before screaming for the prime minister to implement capital punishment I suggest looking at the few countries that still allow it and look at their rates of crime. Most of the world especially places with lower crime rates realize that capital punishment is barbaric and serves no purpose.

    I firmly believe in capital punishment because it is a definite deterrent of crime. An eye for an eye comes from the bible. As long as criminals know that they will live to commit crimes again, we will have more than our share of crimes. I am sure that if capital punishment is resumed, it will definitely straighten many murderers. They will think twice before they act.

    The fact that our young people regard dangerous weapons as part of the dress code is sick. Most young men get dressed; underwear, shirt, pants, shoes, knife, gun, cutlass, hat and shades. What is wrong with this picture? Not one of these murders occur when someone just picked up a weapon which was close at hand. All of these murderers were armed when they left their homes.

    I say hang one, the rest will get the message. Victims and victim’s families need closure. They need a voice. Do you know how hard it is to see your son or daughter’s killer walking the streets? Think about that people. It is hard.

    For years I have been asking the Government of Dominica to amend the Constittution. The death Penalty is one thing, however, if you do not have the right judicial system it becomes of know effect. What I mean by that. (1) you must have pepole with common sense of the law, they must have a clear understanting of evidence collection and, the protection of evidence, (2) clear understanding of interpretation of evidence, and a strong knowledge of how to present the evidence to the jury. (3) the recreation of a crime sense is the most powerful visual evidence a jury like to see in a court room, unfortunately the persecution need lots of help to represent the Government in a court case. I remember in 2005 after my son get killed in Dominica I went to the police station in Grrand-bay to investigate the chain of events the led to my son death, to my supprised the police took out the weapon that was used with his naked hand from his desk draw and showed me. I knew from that very moment that this case was lost. I went home and explained to my family what I experience with this case, and I asseured them that the individual will get away. they all thoughts that I did not love my son, most of them turn away from me. However, about two months later the case was dismissed. Death penalty case must be proven without a reasonal doubt that the person that is charge committed the crime, but I am afraid Dominica do not have such person to try death penalty cases. More training is need on the collection of evidence and protection of such evidence, also reporting writing is the key issue of the police department. And the most dangerous thing of the judicial system in Dominica is the dependent on one man to decide whether a case goes to trial or not. I think this is a very bad principle where law is concern. I in 2005 I had the opportunity to discuss that matter with the Primminster to chang that British Lawwe are not under the British. We are an Idependent Nation, so we can established uor own rules and law. We as a Nation should not have one man to make decisions wether a case should go to trail, or not this is right and need to take a very close look at. The Government of Dominica have the all the right to protect the Citizens of Dominica with all what it takes. There should not be a vote to evaluate whether or not Dominican need the death penalty, or not. Once the Government noice that killings are increasing they have to implement laws to safegard it Citizesn. I am hoping that we all can help bring back Dominica what it was 30-years ago.     I have lost a family member to this heinous crime. But do i want the perps to die? No. However i do want them punished. what does that mean. It means that the police have to do a better job at investigating and finding evidence so that the case are all sorts of proof. It means that once found guilty whoever that person is will serve some serious time. One doesn’t get sent to prison for life and comes out 10 years after. That’s not life. If you go in when you’re 30 lets say for arguement sakes , you come out when you ready to go under. Period.
    I think that the guilt of having killed someone is the worse form of punishment there is. No one not even one who is paid to kill legally or not can withhold that can of torment.

    this is just a big joke. i would think that the main purpose of capital punishment would be to discourage others. tell me how effective is it in reducing crime.in my opinion life in prisonis worst than capital punishment.

    stop playing with the uneducated minds mr pm. you can’t teach an old dog new tricks or may i say you can but it’s very difficult to do so. you majored in phycology in college. a child personality is well formed by the age of 7. you can look at a child’s behaivour and make a very good guess on what they are going to be like as adults. while crime is inevitable because we are living in a fallen world,our leaders can certainly try to reduce it. capital punishment is not one of those ways to reduce it. it has never worked in the past and it’s not ging to start working now.

    oh and another thing, sometimes soemone is to be blamed. if a child is raised with no discipline by thier parents, wont the paents be blamed if this child turns out to be a deliuquent?

    So I guess based on the way things go in the courts even to this day: just based on a bunch of circumstancial evidence, hearsay; subjectivity by a “jury of your peers” and a few smart-assed attorneys we will just impose capital punishment.
    Well Skerro many men the world over, on deat row, have and continue to be set free after being wrongly/falsely convicted.
    The Moral of the story? Modern Forensic science Roosevelt!!!!!!!! Boy, train and equip the police; as Chairman of CARICOM time and again boy push for changes in the laws boy. We know about CCJ and all and it will be better to address such at that level. We cannot expect to hang people using these same old laws eh. Remember court of appeal freed “Monga” and them: what if they were executed before to that?

    @Deoborah & jemmal: Capital punishment isn’t the best thing. Killing someone isn’t the best thing either. when someone is being killed, i guess it would be a traumatic experience too. Especially for the victim family&witness. Capital punishment wont stop murder or capital offenses. However, it should be an indicator to criminals and the lawless that there’s a stiff penalty for such offenses.

    I support the capital punishment. now in the year 2010 and beyond.

    I have some experience relating to the carrying out of the execution of the death penalty. It is a very traumatic experience for everyone involved, the court personnel, the executioner and the prisioners on the compound where the prisoner is being executed. That is why executions take a very long time in Dominica, causing the death penalty to be reduced in many cases to imprisonment for life. All of the blood that would be shed in Dominica if were to execute all the recent murderers awaiting trial in addition to those already on death row would be too much blood shed for a small country like Dominica, where every one is inter-connected. When the murders are fresh in our mind we all want necks to hang, but later on when we have cooled down it is difficult to imagine killing someone in such an inhumane manner. There is no conclusive evidendence that death by hanging prevents persons from committing murder or any other crime punishable by capital punishment.

    I am happy that this is coming to light now. It is true that he organized the coup but they did not hang Patrick John. They wanted to make and example and they used the poor man to do so.

    Why does Skerrit need a vote?! We are never asked to vote on anything else so why now, and why capital punishment? I voted for the administration but that does not mean that I have to stomach the crap that you did out at times Mr. Skerrit.

    Capital punishment is necessary! When an man takes the life of another brutally and with malice he should be hung! If the three killed their brother they all should face the rope!

    i am all for the death punishment of persons who commit murder and i urge the people of dominica to agree as well

    there is too many murders in dominica and not harsher punishement for the murderers

    we use to criticise the caribs and refer to them as savages

    so far i have not heard of any murders in the carib reserve amongts the caribs

    keep this as a lesson

    does any one here understand the term capital punishment and capital offences… i think that we dominicans should know better. capital punishment wont change the situation in dominica. i think that we need judicial reform rather. as we all know the situationis not with the people as we have all our murder cases walking right out.. these are people that have been caught,,,, with evidence and all kind of witnesses, at the end those ppl walk because the procecution cannot deliver their cases.. and the defense lawyers doe mining them big checks i think that is where they should start there money laundering investigation and their tax evasion,,,

    i suspect that dno that have to put them on the spot..

    I am against capital punishment. i believe that every one has a right to life,human life is so valuable that even the worst murderers should not be deprived of the value of their lives even those who commit murder; sentencing a person to death and executing them violates that right.innocent people will get killed, because of mistakes Witnesses, prosecutors and jurors can all make mistakes. human life is so valuable that even the worst murderers should not be deprived of the value of their lives.

    We really need to think about it. And right now more than ever before we need capital punishment to decrease the high rise in crime and violence in our society.
    If this was implemented before just maybe the death rate would not be as high as it is today. People would think of the punishment. Jail is not a punishment but a place we can sit and dine

    Personally I am and would be very careful here because one can go to the gallows and they are innoncent. Then many, many years after this act is carried out they would found out that the person is innocent.

    I know we are all calling for the capital punishmnet , but please we have to think carefully and really ascertain (JUdges or Magistrates) as to whether that peson or persons is really guilty or innoncent before sending them to the gallows.

    I am totally for the death penalty and voted yes, Mr. Prime Minister. If we don’t use it, then it gives the thugs and hoodlums free rein to gallavant about the place killing people for no reason. The death penalty is a deterrent, only if we use it. If we don’t use it, then it does not become a deterrent. We talk of the human rights of thugs and hoodlums; what about the human rights of the persons whom they killed. An eye for an eye, a tooth for a tooth, Mr. Prime Minister. That’s why murders are rampant in St Lucia and Antigua and St. Kitts today. Why? The death penalty is not being applied, that’s why. Too many senseless murders in the region, the judges announce the death penalty in court, the governments rescind the death penalty at the table – this is nonsense, Mr PM. Time to act. We need a peaceful region. Let’s get rid of the thugs and hoodlums once and for all. I bet you the day they gonna be hanged, they will be all crying and begging for mercy. Hang them all, Mr PM.

    Its sad that it must come to this, but i’m for it. Its depressing to see my country come to this. Our youth running all over the place committing crimes, not to mention wickedness in high places(the upper class). Parents and family members, care for each other. The death penalty will not resolve the issues taking place at homes that cause some of these things to happen. A nations problems involving its people always starts at home. We have way too many dead beat dads (and moms) here. Stop leaving your kids to be raised by the television or by their friends. I see too many parents out there trying to be their children’s “friends” INSTEAD OF BEING THEIR PARENTS. And please don’t blame the government, a government is nothing without the strength of its people, WE ARE RESPONSIBLE.

    As much as I would love to say Yes I cannot in good conscience
    A life is something precious and sometimes persons are falsely accused and regardless of how obvious something may seem people can quite possibly be framed

    You can make up for imprisoning someone for a number of years but you can never make amends for taking a life. I feel if we had a crime lab or a much more intricate and error proof way of convicting criminals but our society is based upon innocent until proven guilty and not vice versa

    I believe that the minimum sentence should be changed for crimes and a daily public flogging should be included though I do believe that there are crimes worthy of capital punishment I don’t believe that decision should be placed in the hands of a solitary judge and jury

    We are talking all of this in a time when it is getting hot on the island with regard to crime. We have forgotten that we have laws on the island with consequences. We need to work on the sentencing that is happening in Dominica. We have a lot of sentences that are not being fully used. If we do or allow the people responsible to do there jobs we can curb this crime surge.
    In the past we have set a bad example with regard to sentencing in Dominica. No one takes things seriously in DA anymore.

    Wow, this is something to be seriously considered and well written as a bill n implemented as legislation if it is to be done. We could implement capital punishment, however some people may kill in self defence n could end up on death row. That’s the risk of that kind of punishment. If it is to be passed as legislation then we need to ensure that only the worse crimes are punishable by death n that judges should be given freedom of judgement on this rather than straight legislation n case law. We cannot have people being executed as a regular thing

    I support capital punishment 100% you live by the sword you die by it…. There is too much killings and sensless crimes happening in my beautiful Dominica. Lets show these young people that we intend to keep Dominica the safe country that we grew in.

    While i support the death penalty, it’s most definitely not the solution. I simply believe there are truly vicious crimes for which the ultimate price (your own life) must be paid. It won’t solve the problem of crimes though, especially when those who commit the crimes are willing to throw away their lives.

    I believe we should stop looking at the murders as a whole, as if they were all similar cases (each one was quite different) and look at the underlining cause of those murders. More attention should be focus on attention on how to solve those issues. Prevention is better than cure afterall.
