Charles Francois begs for jail time

A Giraudel man begged a magistrate for jail time on Monday on the premise that he would be killed if he was not sent to the slammer.

“I have beef with people out there … it’s better if you send me to jail for 3 to 4 years. Some people will kill me if you let me go,” Charles Francois told the court.

Francois is facing some serious charges including the burglary of the homes of attorney Wayne Norde and Peter Lavinier. He is also accused of vagrancy and giving  false name and address to the police.

Court documents indicate that he stole items worth $49,000 from the home of Norde and $6,000 from the home of Lavinier.

Francois was found by police on the steps of Issa Trading early one morning recently and when asked for his name and address said his name was “Charles Benjamin of Paix Bouche.”

He told police that he had not been able to get a bus home but on investigations, the police were able to discover his proper name and address.

When he appeared in court on Monday Francois said, “I am sorry for giving you false name.”

He also begged for 3 to 4 years in jail.

Francois got part of his wish when he was sentenced to six months in jail after he pleaded guilty to vagrancy and giving false name and address to the police.

On the burglary charge, Magistrate Evalina Baptiste said a Prelimenary Inquiry (PI) must be conducted into the matter and she cannot do otherwise. “That is another X against PI … a man wants to plead guilty and because of the laws regarding PI we can’t do otherwise,” she said.

She expressed disgust and frustration at the process and said she hopes it is remedied very soon.

She also told Francois that “according to the statues he is branded rouge and a vagabond” and also set December 10, 2012 as “reporting day” to revisit the matter.

The PI in the matter is set for June 24, 2013.

    Thia article missed the main point! I am a Police Officer sitting in the Court. I was in the Court when Attorney Behanzin rose to his feet to assist the Court when Chief Magistrate said that the matter had to go to a full Priliminary Inquiry. Behanzin said that there was a speedied process in Sec 12 of the Criminal Reform that allowed an accused to allow a speedy process, if the Magistrate reads to the Acciused a specific wording that speaks to the accused stating to the Court that they do not wish to have the complainant and/ or witnesses to appear and give evidence against them, this intern, Behanzin explained amounts to a guilty pleas because the Accused cannot then change his mind. Behanzin also talked about the difficulties that the Prosecution will have giving that there is no proof of the real value of the gold and jewellery that was stolen, and if any theft of that magnitude actually took place. The Prosecution will have to determine whether the theft was actually a theft and whether it can be sustained within the appropriate charge. If the Accused is indicating that he may plead guilty, then the suggestion was that the Prosecution should consider changing their strategy and perhaps select a portion of the stolen goods that amounts to less than 10,000, the threshold for the Magistrates’ Court, and present a Summary matter. The Offence of theft at Summary carries a 7 years sentence, so Behanzin explained that there was certainly scope for the Prosecution. I see him rise to his feet and corrects the Court all the time, including all of the Magistrates, each time the sitting Magistrate checks the law books, Behanzin is right down to the side of the page where the citation is found and the correct interpretation. We all learn when he is on his feet!!, this man should have been left on the side of the Court, he exposes everything!!!!!

    This man is a big-time thief. He says he has a beef with people. I would think it is the other way around, ‘they have a beef with him.’
    These days Dominican thieves do not go for small bucks and items but for big and expensive ones.
    What exactly did he steal? Money? $49,000 could be items as a computer, T.V. stereo, blackberry, IPad, microwave, etc.
    If he stole that amount of items from both homes he would need a vehicle to transport them. If he stole money, only a knapsack or bag would be required. Which is it? I thought that they were items but money also falls under the category of items.
    This is the era we reside in. It is a technological age and what with all sorts of them which is why those criminals have become big-time thieves. They are greedy, wanting what they do not work for and refusing to work for.
    Man, do something beneficial with your life and time. Why do you not look for a legal-paying job, whatever you are qualified to do? You will be happier and peaceful for it. While you are at it and searching for a job, look to Our Lord Jesus Christ, who could heal you of your thievery tendencies.
    So he wants jailtime? I would give him no less than 10 years for the cost of the items that he stole and especially if this is not his first infraction.

    Stealing is a grievous sin/crime. He is not even apologizing for taking the people’s property. He does not appear to be sincerely remorseful. He is beyond rehabilitation.

    This man may have gotten int the situation that he’s in due to the decisions that he made in life. There is a saying,”you can’t make wrong decisions and get good results. I also believe in the old adage, “if you don’t listen, you will feel.” However, what I don’t understand is why is part of his six month’s sentence due to vagrancy? If someone doesn’t have a place to stay what should they do? I’d like to know whether he had a choice of living in a home or the streets.

      Now that I have some information from a few people who know about Giraudel, I believe that this man is someone whom I knew from since he was a boy. It would be true that he was living in Gummier, but still for all Gummier is not Giraudel, just Egliston is not Giraudel.

      The people of those three communities do interact, Giraudel being like the mother village—when I was living there. But those communities have boundaries to separate the land from each other.

      Today it seem to me that many people from the areas nearby—from the south side of Newtown– may have moved to Gummier, where they build their houses—Gummier was not so developed when I was living in Dominica.

      If this man is the boy I used to know, it is possible that he is a homeless man today—perhaps not by choice, but because of his state of mind; for he was already out of place, in attitude and conducts, when I knew him as a boy—we even used to view his mentality as one with a bad shape of mind. No wonder he is asking the court to incarcerate him for 3 to 4 years; he wants good food to eat and a bed to sleep in—which is much better than a cold night outside.

      However I will still say that he is not from directly from Giraudel—if he is the man in my mind, his parents were neither from Giraudel nor Gummier; they moved there from Guadeloupe—whether or not they were Dominicans before that.

      Who in their right mind would want to be sent to prison? He has already acknowledged his guilt. Note that criminals will say “not guilty” to try to avoid prison.
      When I was a student, I recall overhearing a woman who lived in upper King George V Street, a walkway inside where there were many small houses said in patois, “If she was in prison she would have had breakfast already.” She was near the Police Station when she said that. :lol: I suppose that she wanted the police to hear her.
      She may have been in prison for petty thefts or probably for a disturbance. She had a young daughter who was always with her – the poor child – today a grown woman if she is alive. Their hair was hardly ever combed. They were unkempt. She was a real pauper. I wonder if that woman is still alive; probably not.
      To a certain extent they are correct. They will receive three meals in prison and on time. Nevertheless, prison is not a place sane and law-abiding people would want to go to. Something has to be wrong with their brains that they want to be sent to prison. This man knows too well that he may be protected while in prison. He should be examined by a psychiatrist.

    Well he being branded rouge and a vagabond, that part is true for sure, according to the news details, but the part about him being from Giraudel–that part is a bit too hard for me to swallow, you see!

    That man might have set foot in Giraudel to hide from the police. We have always accepted people into our village, and to live with them, until they make our village their home. I am sure it is like that everywhere in Dominica.

    I met a man in Barbados, when I was travelling to Dominica; he was travelling to Dominica as well, even headed to Giraudel on the bus that picked me up at the airport. But when I got to Giraudel, I found out that he was from Haiti. So that is how far they can come to our peaceful people and our village.

    For that reason, based on this man’s reputation, it is much easier for me to accept that he is from Paix Bouche, but no matter where he come from in Dominica, or from wherever, he is not a Giraudelite at all, nah!

    My people from Giraudel are too much of a God fearing people to do the things this man has been doing–stealing $49,000.00! Say what! A man from Giraudel! No way!

    And who, in Giraudel, he think would stoop so low to commit murder on him? As if he has not spoiled our name enough, he is doing more than that by his hypocritucal plead to the court. Well that is all it is okay! Pure hypocrisy! For that man is no more than a lazy bumb who would like to go to prison, where he will be served on a silver platter–who is ashamed of such service.

    And may I remind this François –what’s his last name—“that the wages of sin is death”, one way or the other.

    Please, Please, my people of Giraudel, if you are reading this, stay on the alert–tell those kinds of people that they are not welcome in our village, if they are going to leave us with such bad reputation.

    We do not need this among the glorious peace, which our God has blessed us with, because of our reverend fear towards Him. Really and truly; has the whole world gone mad?

      The police should look at his birth certificate to begin with. Dominica should have a registry of every national and where they reside. Is a census not conducted? If this were so it would be simple to find out where he is from and where he resided at that time.

        To the four of you individuals above, I have copied and paste your comments, so that you will see exactly what your wrote to me.

        If you all had any reading comprehension, you would have noticed that I did not deny this man lived in Giraudel, but he is not a product of our people there–that is what I am saying.

        I know many people who live in Giraudel up to today, who come from other parts of Dominica. They are even from other places–like the man whom I met in Barbados heading to Giraudel, in Dominica, but he is a man from Haiti.

        What kind of person is that man? We do not know; but he could bring his wife/girlfriend, or even marry someone in Giraudel, and raise a family there; however, their attitude and conducts would not come from our true people of Giraudel.

        We are a very small community, related to one another–it is very easy to identify us. We do not have Francois people who are directly from Giraudel.

        My Father’s family is the only Xavier people in Giraudel, even if other Xaviers may have evolved in Giraudel I would know that they are not Giraudelites–because, between my two brothers, there is only one child–who is a girl.

        According to you “Thank you” and thank you for you humble response. That man is an example of what I am saying–since you mentioned Gummier. I am sure that I know this man’s father–perhaps he is not even alive, at this time.

        What I know about that man’s father–if that is him–it is that he was from Guadeloupe. Yes he and his wife raised a family in Gummier–I can even say that I have an idea who this man “Francois” is, by the name “Possie or Persey” The point is they are not of the seeds of Giraudel–I am looking at the attitude and conducts of the man.

        For those you, who are so quick to evaluate my credibility in that negative sense, I would suggest that you read what I write, that you might learn something from me.

I thought, “He got what he deserved.” :lol: What goes around comes around. He really did not read the article properly. He must have been dreaming. :lol:
        Surely a lawyer could not possibly have had that amount of money in his home unless it was in a locked safe and also he was hiding it from the government so as not to pay income tax on it and also bank interest. I do not think that he would so unwise to do something like that, hide so much money in his home.
        He is a man of status who makes a good income from his profession. Obviously, he would furnish his home adequately with all what he feels necessary to make his life a comfortable one and for his enjoyment. But that amount of money? Although I do not know and cannot confirm it, I doubt he would ever consider keeping so much in his home. It was stated that they were ‘items – goods’. Therefore the majority of us assumed that they are household effects – not money, although Francois could have stolen some money but not that amount as a few assumed.

    OK Mr. Attorney, you have just begun to feel the might of the criminals you help set free. Not that Mr. Francois or anybody else is right to buglarize anybody’e property. But the young and upstart lawyer has chosen to reprenet the hardened criminals among us and look for technicalities in the law to set them free or prevent them from facing justice at all cost.     Please don’t resist arrest even if you know you are within your rights. They may use force and claim that you resisted arrest and impeded them from doing their job. If you can, have someone record the act. They may ask you to turn it off. Don’t!!You have every right to record.

    The police does not have the right to take away your video camera/phone for recording a public servant in public. If they grab your phone just keep reminding them that you do not consent to them taking your phone. There is no law that states you cannot record a public servant in public.

    Always remember that the police are trained to lie to you to get you to do or say what they want.

    A police officer CANNOT FORCE YOU TO ANSWER ANY QUESTION. Don’t forget they need your permission to talk to you. Do not Consent!!!

    They will use scare tactics/intimidation to get you to do things. They will sometimes even misquote the laws. Always stand your ground..Well if you choose to talk to them or go with them you are giving them consent then it’s all up to you.

    When a police officer comes to search you or your home he is not looking to make friends. He is looking for something on you so that you can be arrested.

    A police officer may question you with regard to your whereabouts…YOU DO NOT HAVE TO RESPOND IF YOU DONT WANT TO. Of course sometimes police officers get mad when you know your rights, they may threaten to arrest you if you don’t respond. This would be false arrest as not responding to an officers questions doesn’t constitute arrests.

    If a police officer comes on your property asking you questions ask them to see a warrant if they don’t ask them to leave as they also need your permission to come on your property unless they have a warrant or probably cause. You can tell them to leave cause they are trespassing and not answer any of their questions.

    The police may approach you to question you and you may be on the phone. They may tell you to turn it off you are disrespecting them. You do not have to and they are NOT withing their powers to have you turn off your phone. Just remember to tell them that you DO NOT HAVE THE TIME TO TALK TO THEM OR YOU CHOOSE TO REMAIN SILENT.

      Well after writing all of this, you should read the news article and to discover that the man, in question, does not need any of your information–he simply wanted to spend 4 years in prison, where he thinks he would live longer, than if he was set free.

      Remain silent you say! Don’t you hear him begging the Judge to find him guilty and to send him to his home at a jailhouse? He was certainly voicing out that people would kll him if he was set free–I don’t hear anything silent in that plead to the Judge,nah. So much for all of that writing!

        A police officer may stop frisk n search based on REASONABLE SUSPICION.

        AN OFFICER MAY NOT ARREST someone based on reasonable suspicion but based on PROBABLE CAUSE.

        Know your rights honey AND PLEASE read and understand as it seems that you have very little comprehension skills.

        REASONABLE GROUNDS does not PROVIDE GROUNDS FOR ARREST.

        Reasonable suspicion to stop Probable Cause to ARREST. Please do some research sweety you have the terms mixed up.

        A police officer may stop frisk n search based on REASONABLE SUSPICION.

        AN OFFICER MAY NOT ARREST someone based on reasonable suspicion but based on PROBABLE CAUSE.

        Know your rights honey AND PLEASE read and understand as it seems that you have very little comprehension skills.

        REASONABLE SUSPICION does not PROVIDE GROUNDS FOR ARREST.

        Reasonable suspicion to stop Probable Cause to ARREST. Please do some research sweety you have the terms mixed up.

      Did you not read that he asked for 3 to 4 years. If this man thought that he was goind to be disciplined, the way discipline ought to be at a jail house, he would not even ask for four days, so much more for 4 years.

      But not only that, he sees being in prison as a security for his life–instead of being set free. He don so much wrong to people, he claim that they will kill him.

      When we have people asking for jail term in the place of freedom–we must know that this world is really a wicked and evil place to live–O dear God!

        Perhaps DNO is being more careful pertaining to the qualifications of those who would give thumbs up and thumbs down. Perhaps they are more interested in the quality of people’s comments, and would rather not allow thumbs up and down–just for the fun of it, with people like you.

        Personally, I have a facebook friend from African who searches DNO to read my comments. It would be extremely humiliating for me, if I knew that you, and others like you, were rating my comments with a thumbs down.

      I know wayne norde pretty well. he knew the path that he was taking a few years ago when we spoke in my office under unfortunate circumstances. He knew if he had continued he woould have needed a defense lawyer himself. Happy you took my advice. Hope its not a cover though. The Dog is watching.
