Defense takes witness stand in dual citizenship case

The respondents in the election petition matter involving Prime Minister Roosevelt Skeritt and Education Minister Petter St. Jean continued to give evidence in court this afternoon.

Four witnesses took to the stand in the matter concerning St Jean, including Jenner Guiste and two took the stand in the matter concerning Skerritt, with another two expected to give testimony tomorrow.

St. Jean Matter

Taking the stand after Guiste was Chairperson of the Delices Village Council and a DLP supporter by her own admission, Joan Hilaire-Guiste. She stated that she had attended a number of DLP meetings and spoken on the platform at times but couldn’t recall how many times she had done so.

When asked by Douglas Mendes, the petitioners’ attorney, how she knew that St Jean was born in Dominica, she replied “I don’t know,” which contradicted what she had given on the subject in her witness statement. She stated that she had met Ron Green only once during the election campaign and that she first heard of the accusation against St. Jean’s French citizenship after elections and on the streets. She could not recall who had said it, when exactly it was said and where it was said.

Hilaire-Guiste affirmed that such allegations were not being made in Delices and despite Mendes’ suggestion to the contrary, stuck to the belief.

Pentecostal preacher Lawrence DeGallerie also took the stand in defense of St Jean, claiming to have known him for approximately 20 years and that the two were friends. He could not recall anyone making an issue of Green’s US citizenship and he knew that St. Jean was French because of his mother’s French Citizenship.

He said that he was not aware that St Jean had made an application for renunciation of his French citizenship before nomination day, while Mendes suggests that he was not being truthful when he says so, seeing as the two are such close friends.

Davis Thomas was the last witness called in this matter affirmed that he and Green met during the campaign and each time they would exchange greetings, but they had never conversed. In his witness statement, he had said that he and Green never had any conversation about allegations related to St. Jean’s citizenship. Mendes probed into why he had made specific mention of that fact and not just made a general statement instead.

Thomas also contradicted the earlier testimony of Jenner Guiste in testifying that the DLP motorcade had left the bus stop in Laplaine at about 7:30PM on 17 December 2009, returning at around 9PM. Guiste had testified that the motorcade left the same location on the same date at around 5:30PM returning at around 7:30 PM.

Thomas disagreed with Mendes’ suggestion that the UWP had a meeting at the same bus stop on the same date beginning at around 5PM.

Skerrit Matter

First to the witness stand in the matter concerning Skerritt was Theodore Remy who said that he had not made much of talks concerning Skerritt’s French citizenship because he has known Skerritt for much of his life. He said that in reference to the Veille Case constituency, there had been no talk of Skerritt’s French citizenship and alleged passport after an intervention by the PM on a radio show. He said that he did not know that Skerritt was French or that he had written to the embassy for renunciation and that he thought that Edison James’ statements at the time were foolishness.

He claimed to have only heard about the alleged passport in Skerritt’s letter to the electorate dated 17 December, 2009 and that he had heard that press release from the Electoral Commission on the morning of the same date via the radio. He insisted, in spite of Mendes’ suggestions, that he was telling the truth in saying that no copies of the Notice of Disqualification were distributed in the Veille Case Constituency.

Chris Walter also testified in the matter, insisting that the Prime Minister was born in Dominica because he had known him his whole life. Walter was Skerritt’s campaign manager during the 2009 General Elections and said that they had had discussions on various issues but had held no conversation about dual citizenship before election.

He also said that Skerritt was not present at any of the meetings in the Veille Case constituency but that he kept the minutes of the meetings as campaign manager. In his witness statement, he said that he does not believe that there were any UWP meetings in the constituency during election. One of the petitioners Maynard Joseph had already given testimony that he was launched at a meeting in Veille Case.

He also said that he had never met Joseph during the campaign despite the fact that Joseph was his neighbor.  His witness statement said that he and Joseph had never had any conversation about Skerritt’s dual citizenship and Mendes probed and prodded as to why he had made specific mention of that issue and not any other, in the statement.

He further claimed that the issue of Skerritt’s French citizenship never arose after 2 December, 2009 and that he had heard no talk on the matter. He had only spoken to Skerritt about the fact that persons were coming to Veille Case to block his nomination.

Walters admitted that he had also heard the Election Commission press release, but had not spoken to anyone about it, because the issues raised had never been of any concern to him.

Adjournment

The court has adjourned its sitting until 9:30AM tomorrow morning, when two more witnesses are expected to give testimony for the respondents.

One of the petitioners’ witnesses, Felix Prosper, is yet to give testimony. Prosper is employed abroad and is set to be back in Dominica to do so by Friday at the earliest.

    Y can’t the courts request from the French government the documents proving that these men of dishonor are indeed French citizens? wouldn’t that be the fastest and simplest way to end this mess?
    If neither are holders of French passports, then why were letters sent to French renouncing their citizenships?

        Well just like you I am a born and bred Dominican. My navel string is buried under a tree in Plasiance Laplaine… I will always be Dominican by birth. NO one can take this away from me. No one!! When I was taking the oath to become an American citizen I felt that I was betraying my country, that feeling stayed with me for a while, but after really taking in the mentality of Dominicans, I thought I did the right thing.
        The first seven years of my stay in American I wrote love letters to my country, you can see some of the on the Dominican, I stayed away from Dominican politics for that long even if I was active in Dominica politics before I left, but when I saw where my country was going, I had to raise my voice for my country, I knew it was my duty to do so.. Dominicans have ravaged and savaged me for doing so because they do not like what I have to say… If by now they don’t understand that they cannot and will not shut me up, they are very hard headed people. First of all there is nothing else that they can come up with about me that they have not come up with. I am immune to their denigration, libel, slander and all, I just let it ride and dump it in the garbage where t belongs…
        You asked me if I am a proud Dominica, my answer to that is unequivocally NO!! not at this time, I am not a proud Dominican, I cannot be proud of Dominica in its present state as much as I love, this would not be doing her good. I want her cleaned and sanitized. Then I will be proud of her again, and that is BECAUSE I LOVE HER!!! You got it???

    People, I was listening to Matt in the Morning today, and I heard him talking about Dominica’s health report.There is some astounding inrformation in his report. While you guys are here, accussing everyone who speaks some sense which is not flattering to Skerrit and his regime of being mad or crazy, the report states the 65% of Dominicans are at risk for mental problems, let me repeat that 65%, don’t you think you guys should be asking yourselves why is that? The prcentage of Dominicans on drugs and alchohol is another matter of grave concern; don’t you people realze what is happening to you? When will you snap out it and get realwith your condition in Dominica? When? Do some backyard cleaning nuh man!!!Take some time to think about that. For heavens sake remember the children? What is in store for them? Come on people THINK!!! Go look for the report and study it well. The show that is going on in th courts currently is just a distraction from the real serious issues facing Dominica. It is already decided, even before it began. The constitution will lose!

    The issue of dual citizenship was never an issue in the past so I don’t see the big deal right now; however I think it’s time that the PM and St. Jean show their passports so that the country can get back to more pressing issues at hand righ now. Too much time has been wasted on this nonsense just as President Obama did just show them so that we all can move on.

    I’m not too impressed by Mendes’ line of questioning though…at least those quoted by DNO. I mean the issue at hand is dual citizenship/passport..so what else does he expect the witneses to refer to in their statements except the matter before the court? Should they have mentioned specifically about ‘the world economic crisis’ or the building revolution..the ‘yes we care’ programe…the hurricane season? You know I think Eddo has done enough damage to Dominica since he left the banana industry…its time he follows his leader Earl and fly into exile.

    DNO, I am happy that you identified Lawrence DeGallerie as “Pentecostal preacher.” What a shame! What business does a pentecostal preacher have at the court trying to defend? This discribes the condition of the church in Dominica today especially that of the Pentecostal Church of which I was once part of until I saw how unfaithful the leaders are. Surely, if they were after The father’s business, people like Rev. Bill Daniel would have deciplined preacher DeGallerie but they have all together drunken from the same cup of lies and greed and hence, the Pentecostal church especially is in such a mess as the leaders have all become materialistic and politicians and therefore they don’t care about the testimony of Christ. How could a preacher who preaches the Bible use that same bible to vow to speak the truth when he well knows that he is going to lie?

    Listen folks, the preacher says he has known St. Jean for approximately 20 years and they are friends. This preacher is in his 60’s and you mean to say he has only known St. Jean for about 20 years? Lie that! Thou shall not Lie preacher. Furthermore, he knows the man is French due to his mother being French? Again Lie that and, Thou Shall Not Lie Preacher!
    No one is automatically french because their parents are french preacher. Yes, you do have the previllege of being frnch IF you choose. For example, My dad was a Dominican and became french before I was born. My mom on the other hand was a Dominican who became a US citizen when I was two years. My mom and dad have been married for 35 years and both leave in the US. By virtue of my dad’s french citizenship I could choose to become french without a problem or become a US Citizen because of my mom. It’s my decision and my choice to become a citizen of either US or french. I have not decided on any. So to hear the precher say that St Jean is french because of his mother being French is a BIG LIE. It’s a choice and St Jean chose French instead of Dominican.

If he receives $100 for Dominica he will put 60 in dominica and the rest will go into his pocket. but when uwp received the same amount they put 90 in their pocket and only gave dominica 10.       I respect the court as the final arbiter in its final ruling whether I like it or not. I talked with Mr. Green early this morning before he left La Plaine for town and wished him well and offered my unequivocal moral support. Regardless of how the final chapter in this case is written, one thing is for sure, Ron is handling himself like a gentleman and a scholar in the face of adversity. That’s the mark of a real man and that’s why I am proud to be his friend and confidant.

      It’s difficult to find a sitting government guilty- one has to have 200% proof- that’s the real world, especially in our region and developing countries where there are cozy alliances and partnerships.

      Whichever way this goes, I guess the history books will sort it out long after Skerrit, Te Brotha St. Jean, Ron and the others have moved on. Hope DA is still standing as we know it. This is not a time to rejoice, jeer and laugh my friend; our small island home is in crisis. Who ever wins, in final analysis, Dominica looses. I hope you can appreciate that point of view, then again, maybe not.

        Mr. Finn, while for now I will choose to remain unnamed, you need (and Dominicans by and large) to stop being so bombastic and hyperbolic in our utterances.

        You assert the Mr. Green is facing “adversity.” Why, because of his role in this case? One in which he is a main petitioner and principle witness, therefore setting himself up as the pivot upon which the case rises or falls? Can’t quite see the persecution there.

        Secondly, your assertion that it is “difficult to find a sitting government guilty” is an attempt to skew the facts, and is false.

        This is not a criminal case and thus no finding of guilt or innocense may apply. You of all people should know that. At least we expect you to.

        Finally, words have meaning, Mr. Finn, or that which gave us the power of speech communication would have known better not to.

        And exactly how and what does Dominica loose when the dust settles on that case, no one has ever made clear. You’re a science major Mr. Finn.

        Come with the facts, please.
