Dr. Benjamin files defense in unlawful detention matter

Head of the Acute Psychiatric Unit (APU) at the Princess Margaret Hospital (PMH), Dr. Griffin Benjamin, has filed his defense in a lawsuit brought against him by school teacher Ruth Ann Cyrille-Prince, who alleges she was unlawfully admitted to the unit by him.

In the lawsuit, DOM382 of 2013, between Cyrille-Prince, Dr. Benjamin and the attorney general, redress is being sought for hurt and embarassment.

In May 2013, the school teacher said she was detained for seven days in the psychiatric unit for reasons unknown to her.

A letter written in May 2013 to Dr. Benjamin by attorney at law, Heather F. Felix-Evans, claimed Cyrille-Prince was admitted to the psychiatric unit in “total violation of the Mental Health Act Chap 40:62 of the 1990 Revised Laws of Dominica.”

However, in his defense filed late last year, Dr. Benjamin said that he acted within the confines of the law and “in accordance with the provisions of the Mental Health Act lawfully detained” her at the APU on 24, May 2013.

In an amended response Cyrille-Prince, through Felix-Evans, denied that claim. “When the Claimant (Cyrille-Prince) visited the APU on 24, May 2013 it was for a specific purpose of speaking with the psychologist,” the reponse stated. “However, the 1st Defendant (Dr. Benjamin) who was present at the APU at the time again requested to see her and it was on that occasion that he treated her unlawfully.”

According to Dr. Benjamin, at the time of the claimant’s admission on the ward at the APU, she was assessed by him and a medical doctor to have been suffering from bipolar disorder and was a threat to her children.

“She was admitted for the protection of her children and in order to allow her to received treatment so that she would regain control of her moods and behaviour,” he said. “She was monitored and treated while on the ward and she benefited as far as her mental health is concerned from the said treatment. The Claimant was lawfully admitted under Section 8 of the Mental Health Act Chap 40:62 and is not entitled to any damages for assault, battery and or false imprisonment.”

But Felix-Evans labeled the assessment as “baseless and a rush to judgement.”

She said that Dr. Benjamin admitted and /or detained Cyrille-Prince at the APU when he knew, or ought to have known, that the statutory requirement of the Mental Health Act, including Section 8 had not been satisfied or not caring whether or not the statutory requirements of the Act were satisfied.

“The Claimant (Cyrille-Prince) says that the Defendants’ (Dr. Benjamin) defense should be struck out as disclosing no reasonable ground for defending the claim and judgment should be entered for her with damages to be assessed and costs,” the lawyer stated.

The matter is now before a mediation court.

Cyrille-Prince alleges that on May 24, 2013 she was detained by Dr. Benjamin when she went to the APU to see a pscychologist.

She stated she was told by Dr. Benjamin that she was crazy and had mental issues.

She noted that she left but was eventually arrested by the Police Task Force and dragged to the APU. She further stated that Dr. Benjamin threatened to drug her if she did not obey orders.

On May 30, she simply walked out the APU.

    Mental illness is real and it doesn’t discriminate you could have it together today but tomorrow something could push you over the edge….I witness my friend becoming mentally ill in just days I was shoke and it had a told on me to because it was very hard to accept an educated friend with such potential being so sick. We have to stop the stigma towards the mentally ill she was locked in to because she didn’t want to go to the hospital, now she is home and doing better all ready to go back to work thank God. This lady should thank her blessings that she is doing much better now because Dr. Benjamin just did his job as a doctor he thought she was at risk of hurting herself and others definitely lock her in. If Dr. sent her home and a crime was committed the shoe would be on the other foot with her family they would be suing him.

    I think we all need to familiarize ourselves with the Mental Health Act to formulate an opinion as to what is really happening here, and who might, quite frankly, be lying.
    It is available at the Documentation Centre on Kennedy Avenue for a few cents.
    It is probably even online.

    I do hope Dr. Benjamin will be exonerated. He was operating in the best interest of the woman. Does he really deserve this accusation? I wonder, probably not.

    Doctors must find out what caused the person to develop a mental disorder. Dominica is a small place, a tropical one. People should be happy no matter what their status. One would think there would not be at least people with mental disorders.
    Some people in Dominica with mental disorders may never have been employed. Granted, problems at home could also cause this. Boredom could be another cause. Therefore, doctors must get to the root of their problem.
    I do believe that when people do not recognize God, do not worship him, do not attend church and do not pray, some of them will eventually develop some sort of ailment and/or mental disorder.
    There are those who practice the faith but their faith is weak; it is only on the surface. As it is said (US Catholic Radio) when they experience problems this is when their faith is tested and the type of faith they will project. Some of us are fully aware of that.
    They need God in their lives and to be strong of faith.
    They need to cultivate their faith and become strong in faith. This is the solution to their problem and a mental one.

    It is time we treat mental issues differently in Dominica. Mental health does not look kindly upon class, race, social standing, jobs etc in any society. Lets not start throwing stones for not everyone who visits a psychologists is doomed as being “crazy” or suffering from being “BIPOLAR”. Sometimes one may feel low, or even depressed or maybe need to vent ad let out some air, need a bit of counselling but it does not make them “CRAZY, BIPOLAR OR OTHERWISE” So we have to becareful in reaching diagnosis.

    Warrington all psychiatrist, be it in Dominica, the United States, and Canada, and Europe: A psychiatrist is a physician (a medical doctor) who specializes in psychiatry. Psychiatry is a branch of health science that deals with the study, treatment, prevention of mental disorders.Be reminded that Dr. Griffin Benjamin practiced general medicine prior to becoming a specialist in the field of psychiatry, and psychiatric treatment.

    A qualify psychologists must at least earn a PhD, in psychology; and let it be know abnormal psychology in order to perform the duties of a psychologist: that is why they are referred to as doctor. Even after a person is diagnosed as having a mental disorder, the actual doctor will recommend that the patient go through psychological therapy with the psychologists, as part of their treatment.

    That is when, one goes into group therapy, or on one therapy with the psychologist, where people sits and discuss their mental problems with other patients in a group. Sometimes the patients discovers the reasons for their problem; the patient may discover that the reason for their mental issues or depression is due to life atrocities, and are able to overcome the problem, by finding a resolve, such patient may be on medication, or not, and do walk away from their problems.

    Now when dealing with someone who has a chemical imbalance in the brain, that is more complicated issue to deal with, such requires medication which will help to control the illness, the doctor need to constantly monitor the patient at least once per month if the person is an out patient, since the dosage of the medication may have to be tweaked (adjusted) occasionally; depending on the progress the patient has made.

    Mind you a mentally ill person more than ninety percent of the time acts and appear normal, if the person can read, write, teach school, drive a car, and communicate normally and fluently they will continue to do that until one day during an acute episode, they will kill themselves, or someone of their loved ones, or a whole family believing they are doing the right thing.

    I knew a psychiatrists who operated in a high rise building in Century City, while he was helping patients, the doctor had an acute episode which caused him to fly through a window, and killed himself.

    Mental illness is nothing someone should be ashamed of, we should not use it to stigmatize others, because we are all vulnerable to mental illness, sometimes I too believe I am darn crazy.

    It does not take much to flip okay. She may believe that nothing was wrong with her, on the day she visited the hospital; however; if Griffin did not hospitalized her for observation, and she went home and killed herself, or one of her children, her family or here same lawyer would be doing exactly what she is doing right now, and that is suing Griffin for malpractice.

        Here is a challenge for you since you know so much; I challenge you to describe to me the relation of “neuroses” and DSM-III-R in all categories!

      I would fear those who are mental; bad enough someone who has a bad temper. These people are too unpredictable. Did you say, you, too believe you are darn crazy? I hope it is not merely a bad temper. :lol:
      Some people with a bad temper could act as if they are crazy/mad.
      Incidentally, for women, it is “crazy” – feminine gender. For men, it is “mad” – “masculine” gender. I learned this since elementary school.

        Baby, I am cool; perfectly sane, I mean I get angry like any other person, however, I detest it when I am speaking the truth, and someone such as that person comes along and try to make appear as if I do not know what am talking about.

        The only way to deal with situations like that is to ask these know it all a question which directly relates to the matter, and se what answer they give, the question I ask the person is a very simple and easy one, if he/she answers the question half way correct, I’ll know they are either trained in the science, or at least know they have some knowledge about what the conversation is all about.

        Because regardless of where they get their medical training in psychology, that must be part of the teaching, and everything I said is taught in Abnormal Psychology, and to get close to becoming a psychologist, by way of earning a PhD. you must know that.

        That the fact that person is talking about masters degree in clinical psychology, is capable of treating patients who has mental issue is an indication that person knows nothing. Because you see while a psychologist can conduct evaluations, and therapy, they cannot proscribe medication, the doctor is the doctor, the psychiatrists; he/she is the one who has the knowledge, the power, and authority to prescribe medication.

        But then again with all things equal, in Dominica, one never knows!

        Well, you know in our country things usually works the opposite, if they had a psychologist in charge of the unit, I also wonder why; since the job of the psychologists are supposed to be as I stated earlier.

        Since they usually counsel people, in group therapy, as well as in one on therapy, maybe that person was in the unit that day talking to the patients. So, could it be that when the lady in question went to speak to the psychologist; the psychologists discovered an emergency which warrants the attention of Dr. Benjamin, hence, she/he referred her to him.

        It could be as simple as that, and if so, I believe the medical protocol was followed!

        And by the way, I never thought for a moment that you had any mental issues, and even if you ever suffer any form of mental disorder, it not anything to be ashamed about. I mean there are different levels of mental illness, one can be psychologically depressed, and not actually mentally ill.

        If I had the time I could go into it in depth, nonetheless, I will say this: people who are actually termed crazy, which is not a very kind term to use, are people who are born with chemical imbalances, normally such patients will suffer their first episode of the illness prior to their eighteenth (18) birth day, such patients need to be on some form of medication to help control and regulate the chemical imbalances within their brain.

        People with mental illness can live actual normal: A relative of mine worked all of his life, he taught classes at DGS, and I believe in Mahaut, he later became a Methodist minister, worked in the Cayman, islands and in England I believe, he had recently earned a PhD, he returned to Dominica as Superintendent of the Methodist Church in Dominica, As far as I know he had some mental issue all of his life, we grew up together until I was fourteen years old, my cousin functioned normally until about three years ago, the man simply got up one day, and drank some pesticide right there in Wesley, he is a few years solder than I am, he might be about seventy-one, or so when he died.

        People who are psychologically depressed may not even require any medication, however, counseling therapy may be needed. Sometimes when people without a chemical imbalance indulges in psychiatric medication, it can actually make them crazy.

        That is something commonly found in the prison population in the United States, some prisoners in order to prevent certain things which occur in the population, they go to the prison hospital, and claimed to be crazy, so when they take the medications proscribe to them; in the interim they, finds out they have developed some sort of mental illness.

    My question here is simply this; why would someone go to a psychiatric hospital to visit with a psychologist, if they does not have a mental, nor psychiatric issues. One of the main responsibility of an psychologist, is to perform psychoanalysis; which is an insight-oriented type of psychotherapy. The goal here is to uncover unconscious psychologic patterns, and enable the patient to discover the influence of these patterns in daily life.

    Someone who is bipolar, may believe that at the time of the visit to they were perfectly normal, however, left alone for a minute that perfect looking person could harm themselves, and others too. The great majority of depressions: 80 to 95 percent of depressions are unipolar, and occur without mania. This levels between 5 and 20 percent of depressions that occur as part of manic-depression; which are called bipolar depression.

    Bipolar depressions are classified in the following way: Given the presence of manic symptoms, an individual is judged to be manic-depressive if he/she has had one or more depressive episode in the past, do we know how many episode this lady may have had in the past, I am sure the hospital must have her records. On the other hand if he/she is diagnosed as having experienced only a manic episode if he/she has never had an depressive episode.

    Mania itself can occur without depression, although this is very rare; usually, a depressive episode will occur eventually, once a manic episode has happened. A chronic form of mania is called chronic hypomanic disorder, or hypomanic personality. This diagnosis is made when an individual has experienced an unbroken two year long manic state. Finally, wen depression is regularly set off by the approach of some season such as summer, winter or fall, it is characterized as seasonal affective disorder (SAD).

    am sure Dr, Benjamin saw some symptom id acute, or severe depression which caused him to hospitalize this lady, which he was obligated legally do.

    Note: one can be 5150, and not know it, however, a doctor will recognize such condition as soon as the patient commence speaking.

        Telemaque, it could be DNO’s server. I have noticed there are times I type a word correctly and then it changes on me.
        I noted tonight when I typed the name and email address there was an error. I am a perfectionist and ever so careful when I type. I look at what I type rather than the keyboard. Such is my proficiency in typing. :lol:
        I always find this strange that words will change on me. It makes me suspicious of who it could be.
        I am reiterating that I have stated this on DNO more than once.

    I once thought I was going mad! I was at the “casualty dept” almost every night. Doctors told me that I was stressed but I didn’t believe them because I felt that I was dying. To me, being stressed should not feel that way! I took ECGs after ECGs, both at the PMH and at Dr Grell’s clinic. I thought I was dying and the Doctors didn’t want to speak the truth to me. I did all types of blood tests. I saw an ad about calcium and magnesium deficiency on tv and off I was to La Falaise. It can back normal. Whenever I was rushed to the ER, my blood sugar, blood pressure and cholesterol were elevated. With nowhere else to turn, a colleague suggested I visit Dr Benjamin. Dr Benjamin? The doctor dealing with mad people! Awah! Not me! But my pain grew worse. I just could not fall asleep. Finally, I picked up the phone and called him. After a couple visits, he made an initial diagnosis that I was suffering from general anxiety disorder. I disagreed and suggested I have a CAT scan done. He advised against it, but I still proceeded. I didnt trust the PMH scan, so I went to T&T. The CAT scan read normal! Following a few more visits, Benjamin confirmed his initial diagnosis. General anxiety disorder with the whole baggage (OCD, panic attacks, muscle contraction, adrenalin flows, cortisol flows, bowel movements, hot flushes, cold flushes, cold sweat, anal pain, etc., etc..). That was 14 years ago. I am alive today, and still medicated but I have not visited him for many years now because he assisted me in developing the coping mechanisms to deal with anxiety disorders. Now, I even assist my friends who experience some of the symptoms I used to have. My point? I was very sick but kept denying it! Thanks, doc!

      You could be an excellent character witness for Dr. Benjamin. Since you have had some experience with the disorder, you will understand this brief: Fear And Anxiety. There are four disorders in which fear, and anxiety are actually felt by the individual, and these divided into two classes: the fear disorders, and the anxiety disorders. Fear is distinguished from anxiety by the presence of a specific, dangerous object.

      Phobias, and post-traumatic stress disorders constitute the fear disorders; in these disorders, a specific object causes the anxiety; in phobic disorders, the individual shows fear of an object such as a chicken, or small cat which is out of all proportion to the reality of the danger that object presents. In post-traumatic stress disorders, the individual experiences anxiety, depression, numbing, and constant reliving of the trauma after experiencing some catastrophe beyond the normal range of human suffering: i.e., a college undergraduate who was raped in her dormitory may subsequently relive the trauma repeatedly in memory, and in her dreams, becoming numb to the world around her, and experiencing intense anxiety whenever she is alone with a man.

      Panic disorders, and generalized anxiety disorder are the anxiety disorders. In these two disorders, no specific danger, or object threatens the individual, yet he or she still feels very anxious; this might be the disorder you experienced, when I was going through my divorce, I suffered this type of anxiety, one morning I was driving down the road, I could swear, I saw a lamp pole falling on my car.

      In panic disorder, an individual is suddenly overwhelmed with brief attacks of anxiety, apprehension, and then terror. Generalized anxiety disorder, on the other hand, consists of chronic anxiety that can be more or less continually present for months on end. All four of these disorders share in common an exaggerated version of the normal, and adaptive fear that each of us has felt on many occasions.

      if you were not diagnosed hyperglycemic “diabetic” prior to the bouts with anxiety, the anxiety may have been the cause of your elevated glucose, and your other chemical elevation. Every human have experienced fear at some point and time. The of danger we encounter has to do in large with our job, where we live, our finances, ect, ect,ect.

      I would like to touch on fear, and the elements of fear, and the cognitive elements, and somatic, but that would be to extensive. In any event Griffin knows his profession very well, the only two Cuban trained doctors I would risk my life with, are Griffin, and Jonathan Provost. One time I spent more than forty ($40,000.00) thousand dollars here visiting one doctor, who gave me the impression I may not be able to walk; after talking to Jonathan on the phone, he suggest I came to Dominica to visit him, since my visit with Jonathan, I doh no where the medical problem I paid more than forty thousand dollars to treat went.

      Incidentally Prevost and Benjamin studied at the same medical school, they shared the same dome, and just turn out to be my relatives.

    Well If Dr. Benjamin did say those things to his patient that’s terrible. this is a situation that needs very careful scrutiny and mediation. In order to protect both Doctor and Patient. If The patient was on certain kinds of medications the could have caused her to hear voices telling her the things the claimed the Doctor said. I hope that is the case. People on a whole after the recover from an episode of illness dealing with
    Mental Health issues may have a transferee of negative feelings; embarrassment and shame especially in a community where everyone knows them. I can imagine as a school teacher this may be very embarrassing especially because of the traditional stigma the mental Health still carries in Dominica. I hope and pray that this matter gets resolved in a positive way. I hope also that the police department have trained officers assisting all our citizens regardless of how severe there condition is especially people dealing with mental Health issues. Most of the time trying to restrain someone who is in the process of causing harm to themselves and others may get really physical and seem like the person being restrained I treated badly. This is something that has to be done in a carefully planed and executed way to protect both the person (patient) being restrained and the people (Mental Health Workers and Law enforcement personal) We need Education in Mental health In Dominica on an on going basis. Thank you

    I don’t know how comes the doctor always saying that people are crazy.. Everyone who walks into that APU comes back crazier than b4..

    I believe they should seriously check this out. Someone goes to him for basic counseling and he pins a certain mental disorder to that person and medicates them for something they do not have at all.

    We need more psychologist in d/ca.

    Remember hearing this woman on the radio speaking about this.

        I tend to think so too. It is as if this person knows everyone who goes to the doctor. Well, if they do not have a mental problem why do they go to him? He did not send for them. If I have a headache, I would not go to a dentist. I would go to a medical doctor.

        To those who have a memory, recall when he saw Lynne Augustine who murdered her two children and assessed her, he said she was fit for trial. This meant she was not mentally ill. He was not listened to. Dr. Benjamin was not pleased. No doubt he felt disappointed.

        The former DPP arranged for her to return to Toronto/Ontario, saying that D/ca does not have the facility to treat her and/or for her to be admitted there. He took it upon himself to let her leave the country without standing trial. He did not deceive all of us.

        Having stated that, this woman has yet to pay for the murders of her two children. I would like to see her brought to justice. As far as I know one of her children, the older one, is Canadian-born.

        One day justice will be meted out. God is not blind, deaf nor sleeping.

      thats a lie! I know of persons who got admitted to APU once and never returned, because they are currently on medication and live very NORMAL LIVES

      I would not accuse Dr. Benjamin of wrong doing because I do not know the full story and whether the woman is telling the truth. If she has a mental problem I would not trust her words.

      Psychiatrists and psychologists serve a good purpose.
      There is a psychologist who has a weekly program 6 times a week on the U.S. Catholic Radio. He provides advice to mostly parents on disciplining their stubborn and wayward children. He is called Doctor. He is an excellent doctor and he could be funny too. He calls himself jokingly, “a shrink.”

      My Psychiatrist and psychologist is Our Lord Jesus Christ:

      What a Friend we have in Jesus.
      Take it to the Lord in prayer.

      I read, “What hurts Our Lord most is because we do not trust him.”

      This is true. For specifically we believers and Christians, the first person we should go to is Our Lord in prayer. We have recourse to him but we do not utilize this God-given golden opportunity.
      No one is immune from problems. It is also said, when we consistently think solely of ourselves this is when we have additional problems. We lay our problems too heavily on our heads and on our minds. This leads to anxiety, stress and a mental disorder.

    If she had gone home now and stab her children to death..then now scans would be singing a different story…i work with mentally ill patients and as long as the psychiatrist and clinical SW believes the client is a danger to self or others they are admitted…..a lot of work is needed in DCA in educating people about mental illness….there is no diagnosis called crazy…mental illness is not only Yellows walking down the street naked..

    The stigma of mental illness still apparent in DCA. I work with mentally ill people in a community setting and have had EMS take clients to the ER if I think they are a risk to themselves or others. Once we get to psychiatrist to agree the client is admitted, even against thete will…Sometimes it may be a one time breakdown the person is experiencing
