Feud leads to stabbing of man; attacker convicted

A four man, nine woman jury yesterday found Eustace Letham guilty of the grievous bodily harm of Allan Lockhart.

The both men, 41, are from Grand Bay and have reportedly been in a feud for several years now.

The proceeding of the trial happened over the course of this week and last before High Court Judge Justice Bernie Stephenson at the Roseau High Court.

Leatham’s sentencing was differed to early June as Justice Brooks await a Pre-Sentencing Social Report from the Social welfare Department.

According to the fact of the case from the state prosecution on Carnival Monday 2008, the defendant approached Lockhart in a carnival band in La Lay and stabbed him in the abdomen, chest and at the opening of his nostril.

The stab to his abdomen resulted in his intestine protruding which Lockhard held in his hands while being assisted to the Princess Margaret Hospital where he was operated on.

Police also indicated that whilst Letham was awaiting trial for this present crime, police arrested him in a carnival band earlier this year dressed in mask and sensay clothing armed with a fish gun with intent on doing harm to the accused.  Letham has since been convicted on those charges.

Lawyers representing the state, including the Director of Public Prosecution Jene Pestaina, Clement Joseph and Kimala Alfred used the help of an eye witness and the doctors report to secure the conviction of the accused.

Peter Alleyne represented the accused in court. Alleyne told the court that the defendant was attacked by Lockhart and an accomplice who stole his bag which contained drinks.  He added, the defendant was beaten and was only acting in self defense.

DNO will follow the sentencing of Leatham next month.

These court reporters are so inept!

I advise y’all to digest this with a pound of salt.

What should be reported on here is the judge’s chiding of the prosecution!
    Justice delayed is justice denied.

It is amazing the morass that the legal system in Dominica is wallowing in !

My humble opinion is that there should be a more severe form of punishment for anyone who commits a crime during carnival. These crimes are premeditated and deliberate. If he was so innocent as his lawyer argues, why didn’t he go to the police and report his bag stolen? No!! He chose to take the law into his hands and like a coward he ambushed the man in a carnival band. Shame!! And to add insult to injury, he was out and about intent on another attack with a fish gun in another carnival band!! My God!!
