Four months in jail for a lighter

Kerwin Prosper of Virgin Lane will spend the next four months in jail after pleading guilty to wounding Matthew Nicholas in the ear with a stone during an altercation on February 11, 2011.

Prosper appeared before Magistrate Candia George today.

According to the facts, which were presented by the police prosecutor, on Friday, February 11 at about 10:40, the complainant and his girlfriend were walking on Fields Lane where he met the defendant. The complainant asked him for a lighter that he (the complainant) had lent him a month ago.

Prosper did not answer and the complainant then asked him if he wanted him to get into trouble for his own lighter. The complainant threatened to chop the defendant.

Nicholas then left but the defendant followed and confronted the complainant several times, once with a bottle in hand and then with a stone.

While arguing, the defendant threw a stone which struck Nicholas on his ear.

Nicholas had to be treated at the Princess Margaret Hospital.

When confronted by police the defendant said that he had no problems with Nicholas and that they went to school together. He also said he would have no problem with an out-of-court settlement.

“I doesn’t look nobody trouble,” he said in mitigation today. “I sorry… he that come threatening me, telling me he will chap me. I am very sorry to see he and I raise up together.”

The complainant, who appeared at court, said he had experienced pain in his ear and was on medication for the injury. He also had visible stitches and swelling on and behind the ear.

After receiving his sentence Prosper apologized and added that his grandmother had just died, that he was working and could pay a fine for the offence.

“Fines are for first-time offenders,” the magistrate told him. “If you keep coming here it means that the fines are not working.”

The magistrate then mentioned that Prosper was very well known to the court, both for impending matters and past convictions.

    for a lighter. man just go in the shop and buy box of matches or a lighter.that was not necessary at all.

    what about a larg plot of land out of town, well secured and managed, to put guys that keep finding themselves in front the court for rediculous things, make them do some organise labour to benefit the state and themselves, a form of city clensing to help develope the town and troubled villages.

    Yall complaining about the fact that these men can’t speak or write properly!!! Its the dam system! Universal education my a*&!! Its ruining the STRIVE for excellence because everyone knows that they will move on to the next form. Whether or not they can articulate is not the point, we have to hear them out, see what they are trying to get at!!!
    A LOT of our youth are frustrated and nobody is listening.
    Why should they try to better themselves when there is no PUSH, no ENCOURAGEMENT, No JOBS??? WHat are they articulating about?? Allu kno what d man had to do to get his lighter?? Im not saying its right to act out in violence, but if u read properly he asked for it first before he acted!!! They are more than just violence!! We just need to listen.

    At first glance, I would have said that 4 months was very harsh, but this individual is a repeat offender, so like the judge noted, fines are not working, a custodial sentence was the only option.

    How much is a lighter, and if they grew up together surely the history they share is worth much more than a lighter.

    The previous comment touched on their lack of ability to form a coherent sentence, I’m not convinced that even if they were educated that they would be less confrontational. What some the these young men are lacking is not so much as education, but respect for others, and even more important, respect for themselves.

    Are we educating these men? How many times am I going to read quotes of these people who are unable to form a coherent sentence? No wonder, they are always in trouble – they are incapable of articulating so the first option is violence.
