PROSECUTION NOT PLEASED… Gage, Webster, Davis granted bail (PHOTOS ADDED)

Three persons – Mitchel Larry Webster, Jowani Gage and his mother Arah Davis – appeared in Magistrates Court yesterday on possession of unlicensed ammunition charges and were each granted $12,000 bail – a move which did not sit well with the prosecutor who argued in court that the defendants breached several conditions of their previous bail.

According to the charge, four rounds of 12-gauge shotgun ammunition were allegedly found at Gage’s home in Shawford on Sept. 29.

The trio pleaded not guilty.

In early July, Gage, Davis and another man were arrested and charged for money laundering after an investigation by the Financial Intelligence Unit (FIU) Act.

At yesterday’s hearing, applications from defence lawyers Xena Dyer, Gina Dyer-Munro and Kondwani Williams won the favour of the court amidst insistent pleas from the prosecution for the defendants not to be bailed.

The prosecution had argued that the accused persons had breached several conditions of their previous bail, highlighting that they all had matters pending before the courts – two of whom had similar offenses.

According to the prosecution, one of the conditions under their bail was that they not commit any offense while on bail.

The state drew close attention to Gage and Webster’s June 26, 2010 charges of possession of unlicensed ammunition and firearm where they had both been granted bail in the sum of $10,000.

“Within three to four months of having being granted bail… they’re here for the same offense , this time they graduated from a 9 mm to a 12-guage which is the most powerful,” the prosecutor said.

The prosecution also contended that the defendants had not informed police of a change of address.

“That condition has also been breached,” the prosecution said.

The police claimed that after several attempts Gage could not be reached at his residence in Shawford. “Day after day, we could not find him there,” the prosecutor said.

“The defendants must understand that when granted bail and conditions are imposed he must adhere,” the prosecutor stated.

However, Defence lawyer Dyer-Munro argued that according to the law, the main purpose of bail is to secure one’s attendance in court. She contended that there was no point raised by the prosecution indicating that her clients would abscond or not attend trial.
Citing the absence of a bail act to govern the procedures of bail, Dyer-Munro presented supporting provisions used in law which stated that the main principles for withholding bail.

According to her these are: failure to appear at court and interfering with witnesses and otherwise obstruct the course of justice. She noted that bail, according to these provisions, should not be used as a punishment.

“The court is duty bound to admit the defendants bail… as there are no allegations that they will not appear,” Dyer-Munro said.
“Bail is being asked to be withheld so as to punish the defendants for one reason or another,” Dyer told the court. “We cannot seek to punish him until he is proven guilty.”

Dyer-Munro also raised concern over what she said was the “suspicious” discovery of ammunition in the defendant’s premises – a home which she claimed was seized by police.

She disputed that her clients had no access to the building at the time of the alleged offense. She claimed police had searched the home before the day in question on previous occasions, in absence of her clients, and nothing had been found.

“The police made numerous operations on the premises,” she stated. “Police can come as they please.”

Meanwhile, the prosecution came in defence of this accusation stating that the house was not in the care and custody of the police. The prosecutor told the court that Gage had access to the home.

“The police had to wait for the defendant to open the door for them to go in. It is not fair to say police had access. He had to be called by his mother to get the keys… It is not correct to say we have full access to the house,” the prosecutor stated.

The prosecution informed the court that police had not seized the home but only ordered that none of its contents be disposed.

In continuing her arguments, Munro-Dyer asked the court to consider that Davis has a medical condition which will only worsen if she is incarcerated.

Williams, who also spoke on behalf of the defendants, raised issue with what he said is the re-arresting of defendants right after they are bailed.

Before granting bail, Chief Magistrate Evelina Baptiste stated: “All this depends on what the law says. The order set by the court must be in keeping with what the law says and without a bail act then there’s no choice.”

When asked if there are any conditions that the prosecutions wished to attached to the bail of the defendants the prosecutor said, “If we cannot enforce it what’s the point?”

The defendants are to report to the Roseau Police Station on Tuesdays and Thursdays and are to inform the police of any change of their address. All three of the defendants were said to be living in Bath Estate.

They will reappear in court in February 25, 2011 for trial.

    So three poor malaway accused of “kidnapping” from Stocky get no bail, but big shot drug dealer spreading money around get no bail by the same magistrate because the magistrate say there is no Bail Act.

    The commandments are the guideline to life , the man made laws overide most of them anyways. To abuse any substance is wrong but each substance on the earth has its good. Where does the term blood money comes from its not a term that even make sense you sell your rum everyday its killing people but its ok because the law allows it. Make sugar becomes illigal , its a need and necessity for some of us will the money from sugar be blood money?     Sensationalism, a lack of understanding of the most basic commonsensical principles. Most of their opinions are based on emotion and have no logical sequence to them.

    I must say as a Dominican living out of Dominica, i am so ashamed the Minister of Security must take more drastic measures to see that Dominica is a place i would love to come back bring back hanging and they will stop. Right now i am so pissed when friends meet me and the first thing out of their mouth is do you know in your country had 6 murders in a weekened? Dominica is right up there with Antigua, Jamacia and do not tell me is because of change that is bull, Sir you have to cut the head of the snake in order to get to the tail, unless your a gaining something from what is happenig in our country prayers can’t do nothing for us

    i still wonder why this guy was the target.. so many rental companies and construction companies and security companies and restaurants and wholesale departments and building supplies companies and stores are being used as fronts for the drug trade.. why is that young man they target first. and they so damn … they did not charge everyone because they turned state witness, they know that this case is not going anywhere so they have to try their best to make him pay to get locked up.

    The real story is that this guy is a threat to the competitors and if he is out of business the others will thrive…

    Please do not blame the lawyers for defending clients based on what is written in law. The problem is with the legal system. Our laws need to be reviewed and necessary adjustments are to be made to punish fairly those who commit crimes. From reading the quotes from both prosecution and defendants it is obvious that they are working within the limits of the law. And yes the Dyers are talented lawyers and based on their reputation, it is no wonder why so many utilize their services. At the end of the day, a lawyer must follow the law of the country by which they are bound.

    As a former law officer i respect all lawyers and the rule of law i also respect people`s right to be defended and understand that regardless the lawyers job is to fight and by any means necessary to win their case for their accused. But i resent the fact that in miss Dayer`s case as she usually does and get away with it most of the time for her to insinuate that the police had access and serched the premises in the absense of the accused and that was proven not the case by the court, is stooping very low on her part to just about built her case at a bail hearing that the police may have planted the ammunition or other items found during the search for the magistrate who have to follow and apply the law regarding bail and the operations of the court and in some cases have to use their decreation on mattersbefore them in this case the magistrate drop the ball and cave in to the untruth submission by miss Dyer nothing frustrates the police department more to undergo such blatant disrespect comining from the bench some times who feels it knows it” when our police officers find themselves on the wrong side of the law there`s much ranting taking place and its warranted “I must add” But lets be fair these are some of the things that sends the wrong signals to the criminals and hense they have no respect for law and other much less the police officers. We have to look at all the components and fix them and not to operate in a mumbo jumbo manner and expect change. OH! man how things have changed in such a short time. Thats why we cannot recruit suitable persons in the police force few of them come on board with one thing in mind as a passage to move on to other venture. And finally let me remind those persons who are calling for according to them “EDUCATED people to be recruited in the police force i am not saying we have to elevate and fall in line in todays world but to think “EDUCATED” persons automatically becomes good police officers is a gross misconception on some people`s part> I worked along side a former collegue who came to the police force having attained 12 in those days G.C.E subjects and sadly that person could not even write a proper statement much less to investigate a simple Larceny case needless to say that individual was very frustrated so people it can work both ways hope you all get the message too much to continue writing. One day some one will lecture us further on what it takes to be a good police i am sure he or she will not say itsby having a MASTERS DEGREE. it helps i already said that for those who will come at me and i always welcome that from any one.

    The day will come when a family member(brother, sister, mother, father etc) of those high flying lawyers will experience death, rape, wounding, burglary etc at the hand s of the perpetrators of violent crime. The drug papas have laid waste to the youth of our society by their lifestyle and activities – drug smuggling/running, human traficking etc. Yet still at every turn, these lawyers have simply taken advantage of the weaknesses in the law and have been able to get freedom for those who are involved in violent crime. It not becuse they love the individuals or that they care too hot about them. All they see is how much of the blood stained, filthy lucre they can accrue to themselves under the guise of practising law. And the Chief Magistrate must ask herself the question. What is my role in bringing justice to those/society who have been wronged by the criminal? Shouldn’t I be involved in enforcing the law? I agree with the police. Why set conditions for bail, and when those self same conditions are violated then there are no sanctions?. Is that what we have come to?. So those who killed three on the seas a year ago, can they now break the curfew on the grounds that the lawyers advanced? No more time to tell. We are beginning to reap the fruits of liberalizing freedom, the fruits of astute lawyers, the fruits of a weakened judiciary, the fruits of remaing withthe Privy Council. We are now kiling at will, directly and indirectly. Those lawyers must now take note of what is happening around them. It cannot bwe that evwery murder brings them joy because of the money that is to be made. Can they sleeping well at nights?

    This is in indeed an unfortunate story but should serve as a lesson to parents out there. If your child is bringing you money and lavish gifts knowing that this child does not have a job, you should not accept it. Simple as that. Now look at the embarrassment for this mother who would probably lived her life well to end up in such disrepute. You can love your children but you do not have to condone the things they do, if you spare the rod and discipline the child will be spoiled and you the parent will pay for it.

    So my urge to all parents is love your children but don’t love them so much that you cannot see the wrong they do.

    Persons are accused of committing murder and before a coroner’s inquest is conducted and within 48 hours the charge is reduced to manslaughter and bail is granted. What on earth is wrong to grant bail to an elderly woman who is clearly harassed at every opportunity? What is wrong with granting bail to the 2 other accused of possession of ammunition?

    Instead of wasting time fighting in the court over bail which a constitutional right, the prosecution must enhance their investigative skills in proving all the senseless murders taking place in this land. We need justice for all the blood being spilled before we are turned into a Israel Vs. Palestine state.

But guess what… some of us probably need to turn down certain jobs because of our moral principles and inner desire for justice and the fulfillment of God’s commands, not solely the fulfillment of winning the case, getting the 100 grand check, then sit in church on Sunday and say we are God fearing.

    And we wonder why Dominica is going down the drain…. the absence of a bail act to govern the procedures of bail… does not deter the courts from restricting bail. Remember the commonlaw….

    The absense of a bail act only highlights the need for one. The judges have the right to use their discretion and can choose to grant or deny bail.

    I believe that the evidence of prior convictions for the same offence does not automatically guarantee that one will be denied bail. I am sure that the courts took into consideration the people in question’s past dealings with the courts.

    I do believe though that in these circumstances.. they should be held… they have shown that they do have no respect for the laws, their bail conditiions and the courts. To be charged with the same offense within a couple months proves that, and as such, the courts should not wait until a more serious crime is committed to teach these persons a lesson.

    Guns don’t kill people, people kill people. And it’s persons who normally show disrespect for the laws who have the audacity to commit crimes.

    Rights can be guaranteed only to reasonable limits…..

    Attorney Gina Dyer-Munro raised a critical point in her argument and that is the absence of a bail act on the law books of Dominica to govern the procedures of bail. With the current crime wave sweeping the nation the authorities should move quickly and establish such an act so that prosecutors would have more teeth when arguing that bail should be denied to an alleged criminal. What is on the books right now concerning whether bail should be denied or not (to secure one’s attendance in court) is to lenient and arbitrary.

    Now if the guys in the UWP were smart they would take advantage of the crime wave sweeping the country and argue for the establishment of a Bail Act (which I think is critical right now). If they are ignored by the government they could say the government is not serious on crime. With everyone concerned about crime right now the UWP will certainly gain support among the masses and will slowly begin to undermine the administration. I believe such a strategy would be more effective than walking out of parliament.

    It is with no doubt that every criminal deserves what he or she deserves, destroying the stability of someone’s else future to finance ur own well being in no way right.. crime in no way is right. some of us dominicans tend to cover crime with the idea of poverty or lack of jobs but in no way is that correct. most of the men and women who associate themselves with these sort of things are very well educated and could invest their talents elsewhere. whilst this is true the law enforcement should not only look at one set cause these young men are not the only criminals. right in the mix of the police force are corrupted men and women who deserve to be exposed. they tend to brush off whats right under their noses and try to puncture wounds that they have already created. but in no way should we tolerate the concept of crime to foster a better life. this is wrong in every aspect.
