Gavin George gets 14 years for murder

Twenty-two-year old Garvin George of Calibishie has been sentenced to 14 years for the murder of Julien Junior Joseph of Vielle Case.

The incident occurred on the February 5, 2010 carnival weekend in Calibishie.

George appeared for sentencing before Justice Birnie Stephenson-Brooks on Monday morning.

The court heard earlier that he had inflicted seven stab wounds to Joseph’s body, with the fatal one to his chest during an altercation.

George was convicted on November 23, 2011.

In an unsworn statement at his trial, which was heard before a three-man and six-woman jury, George not only declined to admit to the Carnival weekend murder but told the court that he was unconscious while the stabbing occurred.

Two years will be deducted from his sentence to reflect the two years he has already spent on remand at the state’s prison.

The Director of Public Prosecutions, Gene Pestaina , Clement Joseph and Arthlyn Nesty represented the prosecution while attorney Wayne Norde represented the accused.

The third poster “Anonymous”…how dare u call someone who is clearly grieving “simple minded” for speaking what she feels at a time when she is feeling victimized a second time. You are the simple minded one. Why are Dominicans always bringing God into their ignorant conversations…you tell her judge not yet you judge….Disgusted

shallow minded Dominicans. He who have no sin cast the first stone. By the time he is in there you too will not know what will happen to you. Try to think of the fun times you had os him instead of trying to to cause more harm which in turn will be on yours shoulders.

you what amazing me in Da? we are all professionals in every sector. we are all prime ministers, we are all engineers, we are all attorneys. etc etc.. if we are such skilled people, why on earth we lack leaders? why we out source the kills needed in the country?

we need to let the professionals do their jobs. yes you have an opinion, but alas… “empty barrels make the most noise” typical dominicans. empty brains, making a whole set of noise.

though this is a difficult situation on both side, two families are at loss. We Dominican people like to sit and complain about sentencing laws and guidlines, why dont you use you voice and complain and force them to ammend the laws, everyone is suffering, its a public outcry, but unless you go to the government and fight for these laws to change then nothing will happen, they dont just change laws, its a process and the public has to use their vocie.

I can’t believe what I am reading! 14 years – you must be joking! And we all ask why crime in Dominica is on a steep up. Well, we have one answer now.

    February 28, 2012

14 years? What! A bicycle he steal man? We need to amend our laws in Dominica. That’s a slap on the wrist punishment for one of the worst crimes that can ever be committed on earth. it’s even worst when you take into account how 14 years is not really 14 years in Dominica. I believe in love for all but i also believe that he who do the crime should do the time and the punishment must fit the crime! Someone need to check on the judges and lawyers of this land.

The joke is Day is 1 and night is 1
so 24 hours is 2 days

So the actual time he has to serve is 7 years
if he behaves (which they always say they do)
He’ll get a year to 2 years knocked off
He’ll be out in the next 5 -6 years at least

the time that these criminals get is so unfair, at 36 he will be out maybe even sooner released on good behavior, start over. the justice system is only saying to the public you can kill and be out Before you hi 40. if i rob or do drugs i get more, so i might as well kill a man. PLEASE give the man life or bring back hanging…………. :(

14 years ….A strong message needs to these criminals. He murdered someone and he gets 14 years….We will lose tourism if violent crime continues to escalate. These fools need to be locked up for life or sentence to death.

14 years for killing my cousin,my own flesh and blood. God be with all of you people for giving criminals such little time of imprisonment. They deserve lifetime jail. People like them should not be roaming the streets, just as they killed my cousin who cannot come back to his family just so this guy should rot in jail cell.As I said God be with you all.

I always thought that the saying was ‘talk is cheap’, but the justice system in Dominica has rewritten that saying to ‘life is cheap’

I doubt he’ll serve the full 12 years. They will release him on good behaviour, forgetting the bad behaviour that sent him to prison.

My sympathy goes out to Mr Joseph’s family who have waited 2 years for justice and instead got a slap in the face.

    February 27, 2012

    well,
it is sure sad to hear the small numbers of years one gets for taking the life of another. so unfair. so many offences in need of stiff penalty are let down. right now u almost get more jail time for theft than for a murder.
Nevertheless, birds of a feather flock together. u leave by the sword, u die by the sword.

A person’s life is worth much more than the 14 years he will spend in prison. Time spent in prison could never be sufficient for taking a life. He still has not admitted that he committed the murder. This is cause to keep in prison longer than 14 years.
He may be released earlier for good conduct. Does the DA government have “a Panel” who will question him towards the end of his sentence, to determine if he is fit to be released from prison? If not, one should be established for all prisoners who commit murders and other atrocious crimes who will be slated for release.
Government and Police authorities please take note!

  19. February 27, 2012

14 years for taking another persons life this is a joke, where is justice for the victim and his families, what i was expecting is life without seeing day light any more, only in Dominica what a slap in the face, they need top make examples of these low life criminals

Is this a damn joke ? Are the judge and jurors serious to have only given twelve years to this murderer for taking another young mans life ? My stomach just turned
on hearing such ridiculous verdict…Is that the message Dominicas judicial system is
sending to criminals that they can kill and get away with it ? Well maybe the citizens need to take matters into their own hands and rid the nation of these criminals..justice would better be served since the judge and jurors are incapable of doing their duties.. this is really a sick joke of the judicial system…people have been given longer sentences for much lesser offences..if ever there was a need for a demonstration it would be ..now

sending to criminals, that they can kill and get away with it
judicial system is sending to criminals, that they can kill and get away with it ?..What the hell is becoming of dominica? is it now a lawless nation ? well maybe the citizens of dominica need to take matters into

Jurors have no authority over what the judge sentences. All they say is if they find the man guilty or not. I sat on Jury once for a rape case; found the man guilty of raping a young child..only to find out he had another case he had admitted to for and even younger child. And you know what he got two years…and recently..I saw that man on the road. Out in less than a year for raping two children….JUSTICE.. eh they say… JUSTICE my big toe. I was so sickened. Couldn’t believe the nonsense the judge was saying. I lost all respect for the courts then.

Esau Hector was given 17 years for Manslaughter by the same Judge AFTER HE PLEADED GUILTY (reduced to 14 years by the Court of Appeal) and now she gives Garvin George 14 years for Murder when he refused to plead guilty to the same crime? Although we have to respect the decisions of the Court, this is an imbalanced decision. I wonder what Kenrick Tyson will get? 10 years? Allah Akbal! God is Great!
