The High Court in Dominica has rescheduled sentencing of three defendants – Andy Alexander Cassell, Ronald Lestrade and Clement Labassiere, to March 22, 2013.
The three were to have been sentenced on Friday March 8, 2013.
Labassierre was found guilty of manslaughter after the charge against him of murdering his grand uncle, Ambrose Leblanc, had to be reduced because of an 8-1 split decision by the jury.
His lawyer, Darius Jones, asked the court for more time to refine certain points of his submission. Jones made the same request on behalf of Ronald Lestrade whom he also represents and who had pleaded guilty to attempted rape and burglary.
Cassell was convicted of stabbing Joveen “Pete” Williams of Princess Lane Goodwill on July 23, 2008 on Old Street in Roseau. His attorney, David Bruney, was given until March 18, to file written submissions to the court.
Justice Bernie Stephenson, in granting the adjournment, remarked, “In law we don’t pull things from the hat…law comes from text books and precedence. That’s the process.”

How can you find someone in a criminal case guilty of manslaughter with a 8-1 split verdict. To get a guilty verdict in a criminal case, the full jury have to find the defendant guilty. This should be a miss trial and case should be reschedule. Only in Dominica.
