FULL STORY: Stephen Isidore’s case at a standstill after high court order

A highly controversial case involving attorney Stephen Isidore and his former partner-in-law Glenworth O. N. Emanuel has been halted by the high court and may only resume upon an order from that court.

Isidore, who is facing charges of  theft relating to the partnership which had gone sour with his former business associate, did not appear at the magistrate’s court initially when his case was called earlier this morning.

One of Isidore’s lawyers, Heather Felix-Evans, appeared shortly after and explained that her client was attending to a matter in the high court. She asked the magistrate that the matter be stood down.

Subsequently, Isidore appeared with his other lawyers – Lennox Lawrence and Julien Prevost – and eventually submitted an order from the high court to Chief Magistrate Evelina Baptiste.

This order, according to Baptiste, ruled that the matter be stayed or not to be continued. There was no definite date as to when it will return to court.

Charges had not yet been read to the defendant.

Lawyer for Emanuel, Geoffery Letang, told reporters after the hearing that Baptiste had been served an order of the court in respect of judicial review matters. He considers this move as surprising and called it a “trial by ambush”.

“Well this is very new to me, I’ve never seen that in… our court. Here it is an aggrieved party has lodged complaints in the court [and] expect that the matter to be heard or the charges be read to the defendant. What we have noticed is like a trial by ambush that the defendant and his council has sought judicial review of the magistrate decision in relation to the warrant in the first instance – to arrest the defendant. As a consequence the magistrate power is stayed, cannot even have the charges being read to the defendant,” the lawyer said.

“We had no idea or knowledge about this  but it’s very, very surprising that here it is an aggrieved party, my client has filed complaint charges…expecting that the charges being  read to the defendant, not withstanding that, the magistrate has issued a warrant of arrest of the defendant, the defendant was not present when his name was called, and we got information that he was upstairs. And at this very short moment that here it is the magistrate has been served an order of the court in respect of judicial review matters,” Letang told reporters after the hearing.

He assured that his team will take the necessary steps and guaranteed that his client has a strong case.

“We are going to do the necessaries and the appropriate and you will be informed. Not totally surprised. I’m not disappointed; I’m not disappointed at all because I believe that my client has a very good case…,” Letang said.

When asked what was the next move Letang replied, “You’ll get to know. We’re going to do the necessaries. We have to respond to the active order etc and do the necessaries.”

During his arguments in court, Letang said that the Director of Public Prosecutions had no jurisdiction in the case as it is a private criminal matter,  therefore he asked that the charge be read to the defendant. He also cited that it was an indictable matter.

Lawrence countered however, and called for the court to take the high court order into account before proceeding further with the case. He pointed out that that the magistrate’s court is subject to the jurisdiction of the high court.

“If the court allows the prosecution to proceed any further in respect to this matter, then the court will be in violation of the high court order,” Lawrence defended.

This was done and the case stayed indefinitely.

The defence promised to make a copy of the order available to Letang.

Criminal complaints were filed against Isidore in the magistrate’s court on Nov. 19, 2010 by his former business partner of law firm, Emanuel, Isidore & Associates.

The complaints, which include theft, false accounting, obtaining property by false deception, false statements, was filed by Glenworth O. N Emanuel of (now) Emanuel and Associates against Isidore of (now) Isidore and Associates.

Emanuel is represented by Letang, and two foreign attorneys.

Isidore faces 35 counts of obtaining property by deception, five charges of false accounting, one charge of false statement by a firm’s partner and one count of theft.

The theft charge involves $6,975,070.88 which was allegedly stolen by Isidore from the partnership between 2006 and 2010.

The court had agreed to freeze Isidore’s assets in a move to prevent their dissipation, which could affect the judgment process.

In September 2007 Isidore claimed to have made a $51,000  error regarding a transfer tax calculation on a 2.989 parcel of land purchased by Prime Minister Roosevelt SKerrit at Wall House.This was subsequent to pressure from the public on a land transfer tax evasion.

The amount was later refunded to the Treasury.

    we were once the most peacefull and honest people of the caribbean but now we have
    all become endulged in crimes and ungodly activities. wouldnt it be nice to know the truth
    about what is happening .

    Dear Dr. Liverpool (Mr. President)

    As the keeper of our democracy can you please request an explanation from the Chief and Deputy Chief of Police on the matter of using our armed forces at taxpayers expense to protect “accused” criminals? The politicization of our police force has gone too far and its now time to stop this type of moral decay. The police should NEVER be used as security guards to those who yield influence with government officials. It is bad enough that the police is being used in such a despicable manner but it hurts even more when we see member of our Special Services Unit (SSU) who are know in the region as the best of the best being used as lap-dogs in this case.

    Our democracy is already at stake and using these officers in such a manner puts an additional nail in the coffin of a dying democratic society. Hail Mary Full Of Grace………..

    Did you all really follow Peter Karam’s logic? He is basically saying that if one partner brings in more money into the business then that partner has a right to steal it away. Let’s put it on the next level now. Skerrit bringing in a lot of money to Dominica so he can take some right Peter. Maybe you still hearing them stones boy. Now what that burning me is nobody doesnt even collect those fellas money in their business far less to steal it, yet they condoning other people theivery. Alas Peter.

    Judging from some of these responses here, some of you will not get to cross Roseau River muchless work at any company worth it’s salt, local, regional, international. Some of you are thieves and would do a lot worst than this man. This is an outrage that people can feel if the allegations stand as they were that this is ok and even try to bring in a political defense.

    It is said that ” tief never like to see tief with long bag”.. but alas my people on here different they don’t mind soutiweying, because they just waiting in the slips and hoping they get a chance to rob de same tief. :twisted:

    ..and…, when last you allowed any of your employees to use your company letter head, tax number, bank account etc to order a use car and sell?     I am very disappointed to see the direction my country is taking. A lawyer, who took an oath to uphold the law, has chosen to dishonour that oath. When charges are being brought against him, he and his lawyers have chosen to abuse the judicial system, by running ahead to the high court to stop a proceeding in the magistrate’s court. He blatantly disregarded the fact that he had to appear in the magistrates court. He sent his one of his lawyers to delay the proceedings while they are upstairs railroading a judge to stop the magistrate. Who is that judge? Why would you side an accused criminal against an officer of the court and perveyor of the law? How cna you allow an accused criminal to convince you to prevent him from being prosecuted? They then proceed to threaten the magistrate that she cannot disobey the high court ruling. They just disobeyed the court order to be in the magistrate court!!

    Well I now understand the presence of the SSU. The precedence we are seeing now is that once you have the proper connections in Dominica, you can be a brazen criminal and you will get protected. What more do you people need. What more!!!

      I totally agree with you. the precedent set in this matter is a cause for concern. our criminal will now think that yes they are wrong but they will take it to the High Court for decisions to over turn the decision of the lower court. will they get a response? thats another question but this situation just shows us that all we need in this country to get away with things is a GODFATHER.

    Ok, I understand the argument from both sides here. Mano is an old vinidictive guy vs. the young lawyer is industrious and took all the clients – Mano is envious vs. the young lawyer is a thief.

    But seeing there is no known death threats, and no celebrities involved, and this is a court dispute between two private business men, then what is the reason for the police and the guns?

    True, you never see smoke without fire. I smell a HUUUGE rat!!! I going to sit down and see how this one plays out… This will be a huge test for the judicial system of Dominica.

    If so , bring forth the evidence of the Partnership Agreement!!!!

    If there was no intention to create a partnership , is Table A a reliable document to depend on here ?

    Was there any intention to create a legal relationship when they worked together?

    Was there a contract of employment ?

    Was there any contract at all?

    Was there an offer? Was it written or was it oral?

    What was the consideration? How were profits ,if realised, shared among themselves?

    Who was responsible for salaries? Who set the salary figures and who brought in the secretaries?

    Can you truly say there was a breach? What type of breach? Was there an agreement signed indicating the remedies that would be saught? Is it damages or a specific performance?

    There are many other questions to be asked including obvious bank accounts and outstanding obligations to banks.

    The mechanics of peter’s shop should use the garage’s tools and equipment to do side jobs and leave him out of the loop because he figures that will be ok. What a businessman! On another note, whom was the police outside the court protecting with those riffles. I know some charges were leveled at Isidore but none were for any violent crimes so why the guns. Were these policemen from the same police force that could not effect a court ordered arrest about 76 hours before, of the same man that they were now protecting? what a laugh. Did you observe who were the lawyers for Mr. Isidore? People read between the lines, connect the dots. I will implore of you again to descend from your party political perches and get on the ground to learn whats going on in Dominica so that when time tells the truth you wont have to bury your heads up or down wherever in utter disgust and shame saying “I am so disappointed, I did not expect that nah boy”. Lets hope that that is all you would do and say and not anything worse than that. If you dont trust what the speakers of truth say then you need to do some serious pray and reflection and ask our god to remove your blindfolds

    . that’s exactly what i mean. the karam guy made a comment syaing that all of isadore assets should not have been frozen. when in fact it should even it it means selling his kids computer,or any other valuable item that he poseses. one could be made to do this so in a patnership in anything goes wrong.

    DNO it is amazing to read the comments of your readers. Isidore is guilty as charged. There is no need for a trial.

    It is clear to me that Isidore did all the Donkey work for the clients which he himself brought. He billed them and received his money from his clients. He paid all the staff, he paid the rent, purchased all the computers etc.

    Isidore was the one working GON EMMANNUEl was doing no work. Wh said that ISIDORE was GON EMMANUEL”S slave.

    The man work hard for his money now he has to face trial? Shame on Letang. Jealousy and Envy.

      Attorney, it seems you studied law at tony astaphan’s law school. To you and the rest of the foolish contributors, I’ll try to explain this in my lay man’s terms. (I am not a lawyer) . “ a person is guilty of theft if he DISHONESTLY, appropriates property belonging to another, with the intent of PERMANENTLY DEPRIVING that person of it”
      Isidore as a member of the firm did work for people, and he did so as a member of the firm. That fact is attested to by the issue of invoices in the name of the company and on the company’s letterhead. Therefore, any monies received, belong to the company and “must” be deposited in the company’s accounts.
      He dishonestly appropriated the monies by secretly depositing them into an account which does not belong to the company and of which the senior partner has no knowledge.
      The intent of such action was to “dishonestly” deprive the company of those monies.
      All the elements of the charge have been made out therefore he is guilty. The fact that he may have brought clients to the firm is immaterial.
      He is further guilty of false accounting in as much as VAT on those amounts, although charged on the company’s IRD number, were not accounted for in the company’s accounts.
      What are you people teaching the young people of this country? I do hope that there are still parents left in Dominica who teach their children right from wrong and that the youth will adhere to the teachings of those parents, otherwise this country of ours is doomed. Not by anything which Lennox Linton discloses to the public or any letters written by Jerry Brisbane but by the action and opinions of person like yourselves and those preachers who turn a blind eye to corruption and iniquity in the society.

      It is indeed not surprising that the matter was “stayed”; Dominicans, wake up, maybe we have underestimated the reaches of these wolves. He got someone to “scratch his back”, “friends in high places” (CERTAINLY NOT HEAVENLY). We have not seen the last of these alleged criminal in high places getting away with their white collar crimes. Wait and see!!!Me gonna keep looking and listening.

    Latang you are so so laughable. So you determined that isidore should be arrested and whether or not its an indictable matter? I don’t know where you studied your law, but you should wheel and come again. Letang should be greatly embarrassed. This man is after PM Skerrit in many ways, but letang who Jah bless no man curse.     When Eddo was and continue to be harassd for corruption during his time on stage, and even though I do not support him and his party, I still believe he is innocent until he has been proven, guilty, not by “compere lapenm” and “compere tigre”. He cannot be guilty because some labourite say so. His guilt has to be proven in a duly established court of law in this jurisdiction – not on the radio or television or around the court house. That is the system we have all come to know and which we all have benefitted from. We all have had good days and bad days- good experiences and bad experiences with the same judicial system. Ak Lennox. But the system is the same.

    My question remains. What is the difference here between the current matter and any other situation where someone is charged, allegedly of committing a criminal wrong doing? Who is to determine Mr. Isidore’s guilt? Is it a duly established court system or “foow”. is it f what Mr. “All Perfect, No Skeleton, Never wronged” says on his Saturday program or what Matt says or what Brian says about the “prime Minster’s lawyer is in court and the police is trying to frustrate justice”. Brian more than anybody else knows that the large majority of officers throughout the rank and file do not support Mr. Skerrit, much more to do his bidding in in an illegal acticvity. It his his party that the officers openly support without fear. remeber “Fear No More?

    Here is a matter involving two learned attorneys. One ( the senior) is acusing the other (junior) of a highly unethical, immoral and criminal behaviour. Certain information and evidence has come to the fore. By what ways and means few people seem to know. However, there is a buzz suggesting that Dominica’s “Mr. All Perfect, No Skeleton, Never Wronged” has been holed up for weeks now with his computer guru digging deep into a computer left behind by the junior attorney when he departed his former partnership.

    Practicing attorneys, particularly those involved in criminal matters ought to know the law and are free to use whatever aspect of the law to their advantage. Whether working for a client or in their own self interest. The law is the law. Where they find themselves on the receiving end of criminal charges, they are expected to use the same law to their advantage. Who wont? Is it that what our people have difficulty with? Is that what our peopel have relied on to once again let Skerrit have it? Mr. Isidore would be living in a fool’s paradise not to use the law to his advantage.

    When a complaint was made against a certain politcian attorney, didn’t he use the law by physically removing himself form this jurisdiction when only a complaint was made against him. Didn’t he use the law to his great advantage? He ran away and will remain away for atleast seven years, pased the statutory limitations. That is the law – our law. If we have problem with the law then let us call for a revision of the law to provide for anybody with a miniscule information to strip the other of their character or the slightest hint of impropriety. Let us go for that.

    My people, Dominicans, we are Dominicans first and foremost, before any party.let us not surrender our intelligence to always and forever tote the colour line. It has not assisted with our efforts and it will never. We can rise to the occasion. Mr. Lennox Linton for example is innocent of “Bubbles” charges untill “Bubbles” can prove his case. Of course Lennox will have the opprtunity to tell his story and defend himself as he sees fit. Why should it be different for Isidore or anybody for that matter?

    The law is a dynamic creature of statutes and interpretation. There was a time when a police officer could confront someone for using indecent language in a public place, arrest that person and press crimninal charges against that person. These days are now long gone. Many years ago, during mamo’s time on stage, the practical application of that particular law was interpreted otherwise. The police must first find somebody who was offended by the use of the indecent language before he can press charges. He cannot press charges because he personally felt emabrassed. In another instant, the police accepted practice of arresting someone on suspicion of having committed a crime without an arrest warrant was thrown out as illegal – thanks to “instru”, an attorney. A police now has to get a warrant before somebody can be arrested on suspicion of a crime if the police was not a witness to the commission of the crime at the very moment it was taking place.

    If we have difficulty with the law, then by all means, let us agitate for a review. Let us not bring it down to Skerrit informing the police to stop the case. We can do better Dominicans. Party come and party go. Personalities in our lives, personal or national come and go. But our “Dominicaness” must remain forevere

    So what I would like to know, is Dominica becoming a Police State, protecting criminals, thieves and robbers in ‘high places’? Because, this is what I am witnessing in this particular case. Never have I, as a Dominican seen this in my life history.
    See the expression of Isidore’s face in the photo? It is one of smugness because he knows that he was protected by people in high places. It is a kick to all of Dominicans on how this case will progress, because as we all know, he will not answer any of these criminal charges, there will just be a settlement out of court. It’s inevitable.
    Are we, as Dominicans here and abroad really that blind that we can’t even see what is happening to our beloved Dominica, right in our faces? How many more injustices will have to happen before the truth will one day prevail?

    @’The Third Side” I’m not a lawer but an officer of the court. What Letang is saying the matter is brought before the court not by the police but privately , therefore the DPP has no Jurisdiction-but he the Defendent can be arrested by the police if there is a court oder for such. Also the matter is indictable because of the amount involved which is beyond the jurisdiction of the Magistrates court. The Magistrates Court can only do the PI and with sufficient evidence, send to the High Court.

    IS this Letang guy a lawyer? Here is what he said from the DNO news

    “During his arguments in court, Letang said that the Director of Public Prosecutions had no jurisdiction in the case as it is a private criminal matter, therefore he asked that the charge be read to the defendant. He also cited that it was an indictable matter.”

    So if the DPP has no jurisdiction in this case, how can you ask the Police to arrest Isidore? Also if the DPP has no jurisdiction, how does this case become indictable?

    I need an avocar(a lawyer) to explain this to me please

      To me personally this is a case that has some jealousy attached to it. The Emanuel dude is older and most likely has more experience being a lawyer than the Isidore dude. When Isidore decided to go out on his own more than likely he took the clients with him, his clients and maybe some of Emanuel’s so emanuel’s revenue has droped and therefore after 4 long years he has decided to get even, it sounds almost like a woman scorned.

      the police can arrest if its an order from the court. so DPP is not responsible for the court the court is an independent body, so yes the magistrate can give an order to arrest ur arse even if is a civil matter over which the DPP has no jurisdiction.

    Dominicans must remember, not too long ago, that the same Ag. Police Chief, Carrette, boldly and publicly told Dominicans and the whole world, at a Press Conference, that the police would not be investigating the RUBBISH BIN BOBOL anytime SOON. That was his response to a question put to him by a journalist about that matter. We should never forget that the DPP submitted all the DOCUMENTS relating to the RUBBISH BIN SAGA for investigation by the POLICE DEPT. There are IRREFUTABLE EVIDENCE and FACTS that our TREASURY was defrauded of thousands of dollars in that controversial purchase of BINS. The Ministry of Finance was implicated in that CORRUPT deal.

    It is said that ALL MEN ARE CREATED EQUAL and should be treated EQUALLY before the LAW. Well, why the ordinary citizen is quickly arrested for doing wrong, but Isidore will not be touched for also doing wrong? It should be noted that Isidore’s alleged wrongs are thousands of times bigger than what others are arrested for. Dominicans, such actions by our authorities are recipes for CHAOS and ANARCHY. IS Dominica a LAWLESS STATE? Who now is going to protect Dominica from that LAWLESSNESS? Is DICTATORSHIP embedding itself in our beautiful land?

    See what is happening in Mexico and other countries. Crimes and violence are RAMPANT. Criminals on the rampage. High Ranking police and politicians are part and parcel of those corrupt practices. Some of you Dominicans refuse to learn from those lessons of ‘HIGH REPUTE’ corruption and their effects on Society?

    Forewarned is to be Forearmed. Let’s BET you all will REGRET supporting those CRIMINAL acts and making EXCUSES for people in ‘HIGH PLACES who commit crimes and are protected by the SYSTEM? Never in the history of Dominica has there been so much criminal activities, especially in ‘HIGH PLACES, ‘ controversial deals, blatant corruption of all sorts, Lies and a downright disrespect for the law.     Another case that will vanish through the crevices of a corrupt legal system. People are hyped up about this case because the accused lawyer is a foot soldier of King. Just like I predicted the outcome of the Matt and Skerrit case I will also predict that a settlement will be reached and all the public will be speared the embarrassing details. I have every reason to believe that a settlement will help protect the already damaged image of the PM and other government officials and to include a few other lawyers.

    As indicated it is not just the PM’s tainted character at stake . The people of Dominica will again get shafted by a justice system that seem to work in one way. The PM’s declaration that he is above the law was not just words but a blunt reality. I can’t help but to whisper the song by Jeff Joseph- “ When I say yes and You say know”. Dominicans , we have no clouting power. Right now we are at the mercy of a gang of mafias the likes of lawyers and politicians.

    It is obvious therefore that Earl had to run away because he just did not have the support of those who could manipulate the system to allow him to walk around wrong and strong. As for Mr Isidore he will live …and most importantly to continue the protection and cover up duties for the beloved and corrupt image of the PM of Dominica.

    The wheels of “Dominican” Justice might just show its true head in this matter against the Supremo’s lawyer (or former lawyer?). We might just hear that through some technicality or other concoction, he may get away unscathed. Someone higher up might just “scratch this alleged thief’s back”. As we say, leh we wait an see.

    The amount was later refunded to the treasury……….because it was them…..but now is a different pot of soup …..you Follow.; just before print I hear they call his name by court and he was’nthere,although a warrant was signed on Nov.30th. 4 his arrest;All these are the beginning of sorrows but the end is not yet.

    the ssu should not be standing infront of court wityh guns they should be hunting him down on island and stationed infront of the majour ports incase he tries to flee the island. i dont know what is happening in dominica today with the people.
    it seems like we all are brainwashed supporters and oposers of the primeminister, because every one sitting waiting for another to make a move against the wrong that is happening with the high ranking officials our tax money pay to represent us. instead they involve them self in all sorts of curruption at the expense of struggeling people, ignorance causes supporters to make all kinds of excuse for their actions but those supporters just making excuses for ministers to comit more acts of curruption and sink the public futher in a whole of poverty, debt and misery.
