A high Court in Dominica has awarded damages in the sum of EC$45,000 to former Prime Minister, Edison James against Claudius ‘Kon Kom’ Letang of Pichelin.
Letang was also ordered to pay cost of more than EC$4,000.
Court Master, Cheryll Mathurin, handed down the decision this morning, December 15, 2011, at the High Court in Roseau.
Earlier this year, Judges of the Eastern Caribbean Supreme Court (ECSC) had dismissed an appeal by Letang against the High Court’s original decision.
James sued Letang for libel after he alleged that Letang on a show then hosted by Leonard “Pappy” Baptiste on Kairi FM on July 22, 2008, made statements which were defamatory to him and which were motivated by “malice” after Letang is alleged to have accused James of building a $4-million hotel in Barbados and went on to inquire as to where James had gotten the money.
Letang denied having spoken or published the words which James accused him of uttering or that the words bore any defamatory meaning and asked the Appeals Court to dismiss the application with cost to him.
However, in handing down her judgement, Court Master Pearlette E. Lanns, while striking out a few of the claims, upheld that there was case for Letang to answer.
“Applying those principles to the present case, I have analyzed the words, and I have concluded that, prima facie, the words complained of, in their ordinary and natural meaning are capable of bearing the meaning ascribed to them,” Master Lanns said.
She explained further, that the fact that a judge or a Master has the power to strike does not mean that the initial approach will be to strike out the statement of case. “In many cases, there will be alternatives which enable the court to deal with cases justly without taking the draconian step of striking the case out,” she remarked.
The Eastern Caribbean Supreme Court then threw out Letang’s appeal and remitted the matter to the High Court for hearing. The ECSC also ordered Letang to pay cost of EC$2,000 to Edison James.
At the subsequent High Court hearing, Master Cheryll Maturin ruled in favour of the former Prime Minister awarding damages of EC$45,000 to James who told Dominica News Online that he was delighted with the decision.
Next week, James will square up in court with Legal Affairs Minister, Ian Douglas whom he also sued for libel.

I trust that such a judgment and others to follow will deter many callers and hosts on TALK SHOW AND MEDIA PRACTITIONERS. owners and mangers of media houses etc and Politicalites from involving themselves in acts of defamation.
I do believe that too often many POLITICIANS are being subjected to forms of ridicule and their reputations are being tarnished. In light of such I am very happy of the courts’ ruling.
We as citixens have to be quite careful about the statements which we make and are published or are allowed to be published in the oral and visual and print media. Good! It had to reach the Eastern Caribbean Supreme Court because we have NO justice in Dominica anymore. But thank God not all the legal system is blinded by that red veil of filth.

How much Cucumber Korkom have to sell to pay that money. Korkom you need to have evidence in your hand – for example emails (lol), receipts of garbage bin transactions, diplomatic Passport numbers and transactions; receipts of money trail; Denny Shillingford confession; inconsistent stories and explanations; evidence of multiple ownership of company and properties; evidence that the fake owner was broke and owing people but was able to build multimillion dollar property; police refusal to read charges to an alleged crooked lawyer; plane loads of illegal voters with VIP treatment; Peter Wickam confession; Duty free infinity; clear and deliberate Tax evasion by the lawyer for the PM. The list goes on Mr Cucumber.
Couple of observations. Good to know that people are being held up for their unfounded and malicious statements. Like Kon Kom I too have bore the pain of having to hand out money on a libel matter – paying for our mouth, but not as much as my friend. Let us all learn. I think I have learned my lesson.
It is also interesting that the system of the East Caribbean Supreme Court is working for the UWP – at least for Eddy James. Only this week, the UWP’s electronic mouth pieces are on record tearing the High Court into shreds. It is the same High Court, the same civil court rules of procedure which existed and awarded Kieron Pinard Byrne $50,000.00. On that occasion the UWP told the world that they did not expect justice as the court was controlled by Skerrit. I wonder who is controling the same court now.Should we say that the judge (master) is a UWP sympathizer? I do not think so.
But then Tony Astaphans has gone on public record literally tearing away at the reputation of the Mr. James particularly during the tiem when he served as Prime Minister. Aftyer more than a decade of such malignment there has bben no law suite from Edison James against Tony. Perhaps it is the way Tony says what he says. Sorry Kon Kom, like me, we are the small sprats attempting to swim among the giants of sharks.
But the truth is we must beholden to our public statements whether it is for or against Skerrit, Edison James, Matt Peltire or Lennox Linton for that matter. Good lesson for all of us. Kon Kom I commisurate with you

You morons don’t know how to separate issues of party politics from private and personal issues? Cucum made an allegation against one Eddison James and not the UWP and Mr. James as is his right to do sought redress in the court and he winning the case doesn’t by any stretch of the imagination suggest that the UWP is getting justice from the courts. These are two separate and distinct issues.

I am not fond of our politicians in Dominica but I must note that it is intriguing that Edison James and the UWP were accused of so much corruption , even from men like Tony Astaphan yet Tony and others are yet to bring the evidence to support those claims – Note I am not saying that UWP was not a corrupt regime because we know for sure that Passports were on sale in unscrupulous ways during the UWP reign. I am just baffled by the fact that Tony and DLP supporters are now asking for evidence.
Well I applaud Mr James for going to court – I do hope that the present PM can REALLY go to court over all the allegations. We see that interestingly THE GOVERNMENT of Dominica is suing Fontaine. Note neither Skerrit or Tony is suing Weekly Blitz. My other question is why is Tony and Skerrit not suing Weekly Blitz. It seem to me that Weekly Blitz would bring much more money than Fontaine’s $250 K. Weekly Blitz is big money media business and is likely to bring much more money because Weekly Blitz has done greater damage because of their world wide viewership whereas Thompson’s site only have a a few Dominicans. Can we reall y compare Thompsons damage to Weekly Blitz’s damages . Some things just don’t make sense.
some things just don’t make sense – I agree with that. But do you know the legal process and what it entails…it’s much easier for them to sue Fontaine maybe because of jurisdiction issues, cost etc…they know who Fontaine is … as opposed to the name and face behind weekly blitz.
I am under the impression that weekly Blitz is a middle eastern entity – who wants to go through all that troubel of doing the research behind who to sue, where we can sue and the legal system over there.
On the other hand – Fontaine is accessible, it could be a cost issue – can afford to sue him as opposed to the entity…
