UPDATE: Partner files criminal complaints against Attorney Stephen Isidore

A business partner of Attorney Stephen Isidore has filed criminal complaints against him.

Included in those complaints are 42 charges relating to alleged theft, false accounting, obtaining property by false deception, false statements, among others.

The complaints filed relate to the partnership in the law firm Emanuel, Isidore & Associates.

The complaints were filed by Glenworth O. N Emanuel of (now) Emanuel and Associates against Isidore of (now) Isidore and Associates in the Magistrate’s Court on November 19, 2010.

Isidore faces five charges of false accounting, one charge of false statement by a firm’s partner and one count of theft. He will also answer to 35 counts of obtaining property by deception.

The theft charge involves $6,975,070.88 which was allegedly stolen by Isidore from the partnership between 2006 and 2010.

The news was revealed on Lennox Linton’s Between You and Me show on Q95 on Saturday and a portion of which was repeated by Mat in the Morning on the said station this morning.

According to court documents read by Linton, Isidore is expected to answer the criminal charges in Magistrate’s Court on Dec. 6.

Last week, the court agreed to freeze Isidore’s assets in a move to prevent their dissipation, which could affect the judgment process.

Law enforcement authorities have refused to get involved in the matter, Linton said.

In September 2007 Isidore claimed to have made a $51,000  error regarding a transfer tax calculation on a 2.989 parcel of land purchased by Prime Minister Roosevelt SKerrit at Wall House. This was subsequent to pressure from the public on a land transfer tax evasion.

The amount was later refunded to the Treasury.

this case brings so many things out that it should be studied by the concerned citizens. Hopefully we can get someone unbiased, preferrably with a legal background to give us a running commentary. It seems already that there is a good bit of information already not available to the public.
What was the whole fraca yesterday with ssu in army uniforms at all entrances of the court? I thought it was a coup attempt or something:-)
Seven million dollars is a whole lot of money to move around without being traced. It would appear that some of Mr. Isidore’s moving around money to make clandestine or untraceable payments were amateurish and could easily be traced by sharp investigative journalists like LL. Case in point is the bobol bin refund.
It will be interesting to figure out where the monies came from and who they went to. The problem that i see is that the pace of these transactions is far too large to escape observation.
So my question to Mr. Isidore is the lawyers that he has retained may have more allegiance with someone else and when he becomes too hot a potato to hold in the hand whether he will be dropped in order to save someone else.
In my studies of finance the rate of return on any investment is proportional to the risk. This applies to this case. It is quite evident that there has been lots of dollars moving through the young lawyers hands. The new business selling grocery items, delivery trucks/buses and the massive structure trying to be completed in St. Joe. Any way you look at it that is at least a 2 mill investment. So where did the $ come from. And I am not saying he is not a competent lawyer.
On the other hand if he was that competent he would not have made some of the “errors” that he admitted in making.
So how much do these guys really expect to get away with.

Mr Clean, how could he be the best PM and his name is in so much curruption? No doubt this man has done a lot of damage to the office of the Pm and the country on a whole. Now Mr clean, If you had a business and you have a manager that is stealing your money, would you not clean up the office py firing him? Stop being an advocate of wrong doing and stand for uprightness, truth and justice. If this PM is to be questioned by any honest and independent firm and if people like Bubbles would fear God first and speak the truth, you would see what would become of this so called “Best PM.”

If a complaint was made to the police and they did not investigate which left Mano to consider civil proceedings then this is shameful on the police. This simply means that “someone” directed the police not to get involved in the matter even if it appears like crimes were committed. Mr. Emmanuel may be angry but he is a legal scholar and would by no means embarass himself by filing these charges if there was no merit to it. Shame on the police for not investigating the matter.

While “someone” in government may have been successful in blocking the police investigation (criminal investigation) I am very happy that Mr. Emmanuel proceeded with his civil matter. Matter of fact, this case will be much easier to prove because guilt beyond reasonable doubt is not needed but rather preponderance of the evidence. I hope the police chief is summoned to appear and explain why and who gave the orders not to investigate. At the end of the day, Isidore is smart enough to settle this matter rather than destroy his name and career. Very unlikely this will make it to the CCJ or Privvy Council before a settlement is reached. Time will tell!!!! Hail Mary Full Of Grace…………..

      December 1, 2010

Karkabeff. A little bit of information for you which might help. In law, the Theft Act is what we call a “common informer” piece of legislation. That means that any busy body who can show “cause” can bring a private prosecution under the act. The informant has to prove in the magistrates court that there is a “Prima Facie” case to answer. That is sufficient for the magistrate to then commit the case to the high court for trial.
This is not a civil law suit. It is a private criminal prosecution attempt.
Once the magistarte decides that there is a case to answer, and commits the case to the highre court, then Mr Isidore will be arrested on the spot and charged.
The case at the moment is on a summons. If committed, then it will be read as an indictment.
The magistarte will not hear all the evidence, just the preliminary enquiry to decide if there is a case to commit.
You guys are jumping to all kinds of conclusions without checking first.
      This is a criminal proceeding!!!

It was because of Last Born personal connections that a lot of business came to the firm. The young man was a business loan officer at a Canadian Bank in Dominica and has been loved by many throughout the length and breadth of Dominica.

Ask any court/registry employee and they will tell you that this young man’s signature is affixed to many bills of sale documents, many company registration documents, many caveats on Certificates of Titles and this man has the energy of ten men in the courts defending clients. In short d man is a starring!!!

So I want to know something: When this young man was getting a lot of government business and money was flowing in the firm and that young man was working all on a Saturday night when his fellow colleagues were having fun , drinking and having a good time there was no problem! Before that there was no person from foreign that wanted to come and work in that firm!

When d bom sewo stared to run over foreign start to play d two man dem and start a campaign to oust d young man. But foreign thought Stephen would ah fall flat on his face.

News flash!!! Stephen may be imitated but can never be duplicated!!! And so Clients start to follow Stephen wherever he may go and set up office and that is d reason why d old man vex up to now.

You see throwing Stephen out was not good enough. He has to try and crush him and try to make a journalist appear to be speaking the truth! Where in any business agreement it is ever written that if you fallout with an associate the first thing you do is to call a journalist. You are a lawyer but you sideline the courts of the Country and go to the Court of Public Opinion instead!! And then make a show and dance about you going to court and feeding that journalist with all your court filings. But all secretes will come out and those that working without renewed work permits must leave d Country immediately.
It have a news site called Wikileaks.org and it have 55 documents that d Americans have about Dominica but we will be seeing our own wikileaks in Dominica very soon and plenty people including journalist going and start pretend they is farmer and start buying G-zone and cyanide pills. Mark my word.
It is a known business practice that Law Firms always have meetings with partners mostly at night and on weekends to get an update on the financial health of d firm. All Accounts must always be reconciled monthly – operating and clients accounts. Clients Accounts are scrutinized down to the last cent. Every time a client comes to a law firm one sees the sign that says how much is charged for a consultation and such fees are to be paid before seeing that lawyer or it accrues in that Client’s name or deducted from the retainer that the client has prepaid. That is simple accounts. Law Firm time is precious. They are in business selling their expertise in periods of time – lots of 30 minutes. Thus in a typical working day a Law firm expects to bill a minimum of 16 times in a working day.
Additional sources of revenue comes in for specific services such as preparation of a will, a warning letter which is a very common service to clients who want to show off on their neighbor, collection of rents, registration of a company, Notice to pay, registration of land, selling of land, land transfers, bills of sale, preparation of contracts, registration of copyrights, patents, and intellectual property rights. Some Law Firms do economic citizenship applications or what is commonly called sale of passports, some others do general insurance, offshore bank s, trust companies, IBCs, debt collections, research , opinions expressed , and quite a lot more!
Funds in the Clients Accounts do not belong to the owners in a Law Firm. When services are rendered, then the Law Firm transfers funds to the operating account that takes care of the expenses of the firm including the payments of salaries and utilities and professional licenses and VAT.
It is the norm that most lawyers will help a friend – they are human. Lawyers in Dominica cannot advertise in the media but will use the media to voice their concerns on issues that affect society and indirectly benefit from their publicity generated!!
It is the duty of every member of a law firm to have a through appreciation of the finances of the firm and see which area that gets in the most revenue. Anything else is unacceptable. A senior partner must demand a monthly or quarterly report on the activities of junior partners! Anything less is grossly unacceptable. There should also be an annual report – a review of the performance of the Law Firm – where was justice achieved, where was justice delayed, why were there so many days of vacation , how many times partners were called to practice out of the Country and the successes and cost benefit analysis revelations!!!
The above cannot be sidelined and think running to a journalist will take care of one’s mismanagement, tardiness, and laziness!!! If you are old and way past 74 years, you should do the honorable thing and retire!!! If a lawyer has lost vigor that lawyer should proceed to either mentor younger lawyers with the clear indication that he/she intends to pass on the firm to them within a stipulated time period, or close down your practice all together and write to your clients that you recommend that they seek the services of another lawyer.
But lawyers in Dominica must wake up and understand that CSME will affect them right here in Dominica where lawyers from another country will take an established Law Firm from a retired Dominican lawyer. It may not be fair but the law it is!!!!!

Hey Mr Isidore .. One on your side. I know you from school days. Put your trust in Jah. From what I know is Mr Emanuel who took you to court after your broke up and he put you out even without any of your clients file. The staff came over to meet you. This is trial from the world. Just put your trust in Jah. I know that I will recieve a lot of crtiticsm from all of those who are too polical and everything is politics for them.. The clients had to go to the office of Mano to quarrel for their files. We some of the clients were there because of you not because of Mano. You worked at the Bank and you did a splendid job. They seem to forget that.

They are all judging but the same stick that is used to whip you will whip some of them in the future.

Please get your facts people before putting comments. Today is Mr Isidore’s day. Tommorow may be yours . Be encouraged and put your trust in Jah. We your clients who came to Isidore and Emanuel because of you will stand with you and we will come to you chambers since we were always your clients and not Emanuel’s. We will get back our file. Mr Emanuel take note.nnYour clients are those who came to your to represent them. Mr Isidore’s clients are those who contacted him. So give the people dem their file when they come for it.

i’m not the smartest one but the article says that he is expected to face the court at a certain date to answere to the charges. what does this mean. i think it means that he was charged after the complaints were filed against him

A criminal charge is a formal accusation made by a governmental authority asserting that somebody has committed a crime….then again the article read tht law enforcement have refused to get involved in the matter……………..maybe they later did….how the hell does he have a court date then

A matter was filed against friend recently and no criminal charge were laid he later received a court date he went to court as requested and the matter was thrown out.I am by no means a legal mind but i tried to correct what was posted earlier in the day by DNO which had a different headline from what is on now. From what do know any one who is convinced that wrong was done to them by another can
file a matter in court and you will be given a date to prove you claim, but to say that the guy was charged was wrong and it gave the impression that he was subjected to some kind of investigation and wrong doing was found.NOW “WELL” WHAT IS SO DIFFICULT ABOUT THAT TO COMPREHEND.

Why is it that revalations must come out on that particular radio station. It is strange though. They must investigate the reporters at that radio station. Lets not rejoice about people. We do know what is in store for us reports, announcers, politicians etc.

What happen Sandra are you in denial. Are you saying that because the news came from Q95 the news should not be trusted . When you DLP supporters have no way out you come up with all sort of STUPID excuses. It was the same Q95 that made us aware of the Garbage bin fiasco- not DBS nor KIARI; the same Q95 that inform us about the inconsistencies in the ownership of the Villas; The same Q95 made us aware of the $5000 salary Million dollar properties-a case that was put in lock box for one reason or another. By the way Q95 also reported the same when it was Earl Williams

Sandra democracy is not for sale – Those of us who would like to hear the truth and get at least a glimpse of this crooked government dealings we are happy to have Q95. Until otherwise disputed all Dominicans and the rest of the world know that one of Dominica’s PM foot soldier and cover up artist is in a lot of trouble. Instead of coming here and criticize Q95 you should be questioning our PM’s association with this lawyer. You should be wondering whether or not this lawyer really made a genuine mistake when he forgot to pay the taxes on the land deal. These are the questions that honest, sincere and true Dominicans should be asking.

Sandra don’t take yourself down be more intelligent.

    @Patat:

U hit the nail on the head!! That’s the issue at play there and nothing political like some comments I’ve read.

Before Isidore folks was hardly visiting Follow office. Here comes new lawyer and mind you a nobody hailing from the Village of Sen Joe up and coming …new face, new clients, new BUSINESS into the firm with a buisnessman suaviness = more cases + prestige + more MONEY!!
Sure recipe for discontentment among partners when the MONEYMAKER in the firm was ISIDORE!

Exit Mr. Isidore = lil cases (won) + lil Money.

What better way to settle this matter by filing probably some false, some true charges against the breadwinner? afterall they were partners before..so someone has to have some dirt on the other!!

This should be a Prime example for young lawyers trying to make a name for themselves in those Old Goats offices in Roseau.

Anonymous I don’t get your point. You seem to be bashing the complainant based on your perception that the law firm is obsolete or would have been without Isisdore. That is very presumptuous .In fact one would be more inclined to believe you follow the younger lawyer needed the older partner to start off. Why jump on a dead horse knowing that you cannot make any strides.
I believe that it is perfectly legitimate to align this issue with the political climate in Dominica. How can we not immediately question the famous mistake made in the land transaction of the PM. How can we respond in fear that this lawyer is a close confidant of the PM and is involved in Public entities and matters related to Tax Paying Dominicans.
Anonymous the logical reaction is to question this man’s integrity and by doing so you will have not choice but to ask yourself the pertinent questions – the pertinent questions my friend will inevitably lead you to where every independent mind will.
I was a by stander during a political discussion. At the end of the conversation I ask my self the obvious question. Are we the god fearing people of Dominica really permissive of the get rich at any cost type behavior or is it that we love our politicians soo much that we are prepared to sideline our religious convictions and the love of god all for the glory of a political party. ( I feel like I am filling in for the pastors and priest who remain mute on these issues)
During this conversation or discussion I couldn’t help notice a couple of intelligent men arguing that it is OK for politicians to use their office for their personal gain however . Silent shhhhhhhhhhh think logically. Tell that to your kids.

Some Law Firms do economic citizenship applications or what is commonly called sale of passports, some others do general insurance, offshore banks, trust companies, IBCs, debt collections, research , opinions expressed , and quite a lot more!

Our people just looking to crush and trample on their own brothers. No love only hatred. Only gossip no good report spreading only negative vibes going around and quick to spread without checking the validity of the statements.

I speak from experience of this young lawyer who is my solicitor. See my other comments.

This shouldn’t surprise anyone – until such time when Dominicans begin electing people into public office who understand that public service means service to the people of Dominica, not self-service, then this will continue to go on. Far too often we elect people who, upon walking through the doors at government headquarters, trade “public” for “self”, and proceed to rape the citizens of Dominica. And that applies to all the parties as they exist now.

Unfortunately, our political mindset is so parochial that we either cannot see it, or choose not to. Far to many of our citizenry are “POTO” this party or that party. I have adopted an independent position. This allows me to analyze a candidate based on merits and my confidence that they will fulfill their task as a PUBLIC servant. Some say that my independent stance only indicates that I am unable to commit to something, but I totally disagree. I refuse be a member of and to commit to any political organization. Far too often they nominate people of minimal technical skill and instead choose people who toe the line. If I am a member of a political party and I know, or if “our” candidate has a history, factual or circumstantial, that indicates that he/she is a sakway voleh, there is no way in this world I voting for that person. If I do that, and that person proceeds to perform in a fashion that somehow mirror’s his/her reputation, say for fraud, then I would not only have to share the blame, but I would have allowed that individual to steal from ME. Now, why would I want that – I hate thieves as it is.

The “poto” mentality that is so endemic in our society needs to change in order for these things to go away. Unfortunately, our young people seem afflicted by it as well, and that is where our only hope rests, since the older generation is probably not going to.

Our society also seems afflicted with the “I want it now” mentality; working hard to achieve one’s goals over a period of time seems to be on the way out – everybody want what they want now, and if they have to rob another to get it, they will. Alleged theft of $6 million is serious in a country as small as Dominica. I also have questions about the other attorney – how do you know about this theft? Were you a participant once upon a time and now that you and Isidore have fallen out, is this retribution? Stuff like that…..there’s more to come – stay tuned.

Was Isidore Skerritt’s lawyer on the Trafalgar LAND DEAL? Did that same Isidore deliberately make a mistake trying to defraud the Treasury of thousands of dollars In that deal? Didn’t they run and pay the money owed back to the TREASURY? Any SMALL MAN would be brought to court and fined or jailed.

Was Isidore the Lawyer with the GEOTHERMAL PROJECT? All you Dominicans hearing anything about that important project? Wasn’t the Chairman of West Indies Power Co. removed as Manager of our NBD recently, but he is in charge of our GEOTHERMAL RESOURCES to EXPLORE? Expect plenty more news on that former manager and the Geothermal Project.

Has Isidore made any other deliberate mistakes and calculations? Well Mano could not take again. It is said 99 times for the thief, but only one time for the police. Aren’t you all seeing and hearing the kind of people, lawyers, political advisers, doctors, ‘professionals,’ the former ambassador at large in jail in the US, and many others of Skerritt’s ‘HIGH REPUTE FRIENDS’ that have been involved in questionable activities? That is the man Dominicans want as PM of Dominica? Is not one or two or three or four TWAKA PM Skerritt has been involved in, NUH? In fact, there are TOO MANY to mention.

Remember fellow Dominicans, DUAL CITIZENSHIP, VILLAS, RUBBISH and FERTILIZER BOBOLS, SECRET LAND DEALS, Susan Olde and US$400,000.00 matter JUST NAME THEM. But those are what we hearing about? What about those we do not know about yet? Isidore, is your turn now to FACE CHARGES LIKE PEAS. PM Skerritt and his unscrupulous friends will be next. MARK MY WORDS.

PM Skerritt EVADING SUMMON? He FRAID court like DEVIL FRAID GLO BENNI. The case with Matt, he could not allow that case to take its natural course in the courts. MEDIATION was the outcome. He FRAID. He cannot sue Lennox regarding the ownership of VILLAS. He FRAID COURT. BUT he getting INVOLVE IN ALL KINDS of CONTROVERSIAL ACTS. RUN Skerro Run, BUT you all cannot HIDE.

Isidore thought he could disrespect the laws, do all kinds of KOKOMAKAK and LAVI DO. WELL Isidore you miscalculated with another Lawyer older and wiser than you. All you will DAYBAT in COURT. All eyes watching closely the integrity of our JUDICIAL SYSTEM. RUN BUT ALL YOU CANNOT HIDE. LET JUSTICE BE DONE. Those in HIGH PLACES also commit CRIMINAL ACTS and MUST be brought before the COURTS. It is up to the COURTS now to PUNISH THEM, once they do WRONG and act illegally. TOO much NONSENSE happening in Dominica.

Isn’t that the same Dude that conveniently forgot to pay the taxes on the land deals. Like the old people say – a lie is like a boomerang it goes around comes around. Power and corruption turns into obsession. As the lawyer of Dominica’s almighty the man feels that he is untouchable – just like the almighty himself.
My mum use to say to me “ show me your friend and I’ll tell you who you are” – alleged theft, false accounting, obtaining property by false deception, false statement, among others. Dominicans how long are we going to seat back and defend these characters. The next crook that need to be investigated is the Penguin- that compulsive Liar spin doctor and the other lawyers in charge of selling our passports – the one that think that his name starts with the LAW and is working behind the scene. D N O I did not call names OK.
Let us not be fooled If you are looking for a good lawyer just wait till August Monday – Beach Day I bet you will find them swimming in a cesspool. Some might just be wearing scuba diving suits so that the sh*******t won’t stick. Some of them take a fresh water bath but they still stink; some of them you can see the crap over their shirt belt and suspenders. It is such a pity that our corrupt system and government is crippled and cannot investigate and prosecute so many of these wicked men and women.
ONE OF THESE DAYS BABYLON MUST FALL.- PUT THAT IN YOUR PIPE AND SMOKE IT. We can defend these politicians as much as we like but we are beginning to see is return of the monster. The lies and deception ; unlawful gain ; more lies to cover up property acquisition; more lies in the declaration of assets. This Cesspool swimmer is looking 42 counts but for DOMINICA ALMIGHTY be prepared to use a multiplication factor of 4 because every misconduct had been backed up by at least 3 lies . In fact lies are actually colliding with lies.

  41. Looking in from the outside
    November 29, 2010

I tried getting some clarification from DNO on this matter but I got none, hence I will have to add my ten cents piece to this affair.
I am amazed at the level of irresponsible journalism which exist in Dominica,I am reading this “”news item” and the comments that are been made and i am wondering what is going on here. For i am getting the impression that mr Isidore was charged by the police for wrong doing,as if this matter was subjected to an investigation and the investigation revealed some amount of truth so he was charged.
This my brothers and sister is further from the truth the man was not charged for anything. It is a simple matter of a partner or a citizen who has gone ahead and filed a private matter against mr Isidore so it is up to that individual to prove to the court that the allegation that he is putting forward has some merit. It is not a matter where the police was called in and they found certain evidence so the man was charged.ANY CITIZEN CAN FILE A PRIVATE MATTER IN COURT AGAINST ANOTHER,the important thing is ,you have to prove your case before the magistrate. This not a police case.
So for DNO to take this matter from some political hit men posing as journalist and print as it was said, on programmes designed to achieve one goal only,is an act of irresponsibility. To headline this thing to say that the man was CHARGED is wrong, and to allow these types of comments to be printed is also irresponsible.
I am quite aware of circumstances surrounding this matter. This latest episode is one of bitter grape and trying to play on the public mind by someone who cannot accept his loss and is out for revenge, his sole motive being to destroy a young man who has shown that he can rise from adversity and make it on his own.
We as a people must stop this practice of trying to destroy young progressive talent for the sake of politics.
Mr Isidore was been used as a CASH COW by his partner ,a partner who we all know had lost the trust of Dominicans because of the time he spent on the bench as a magistrate and what he did to Dominicans which forced Sir Brian at the time as AG to remove him.It was Isidore who brought new life to the law firm after returning from Trinidad on studies where he worked with the very reputable and sought law firm of Reginald Armour in Port of Spain. His return to Dominica is another story which i am certain will be revealed in court during the episode as will, the facts of who else was being paid large salaries from the law firm for doing nothing, and how much money going to one household from the firm’s coffers, all this at the expense of Mr Isidore’s hard work.
So Dominican please do not jump to judge the young man because Lennox and Matt have given it their spin for obvious political reasons and getting at anyone is associated with one Skerrit.

Yes Isidore was the young lawyer there with all the clients. I am speaking from facts. I am one of his clients and I have brought quite a few persons when they ask me for a good lawyer. I know this young man from school days so he is like a personal friend. I don’t know if you remember him at the Bank? he worked there diligently before going to study law.

When a partner asking you when you come for your file if you had paid Mr Isidore and how much. What is this about? When one pays receipts are given. One does not pay Mr Isidore himself. The staff – Clerks are the one who writes the receipts. And if is Isidore is your lawyer then it is Isidore. point blank. So why Mr Emanuel holds back all the Isidore clients file and just telling clients bad things about Isidore. This is not right and he has sued Mr Isidore. Then so be it and people stop making comments without facts. If the Clients wants to stay with Mr Emanuel then they will but i fthey request their file then give it to them and stop turnign and twisting them around. Mr I sidores Clients are his own.

Let the court do their work at the appropriate time and if Isidore is guilty then the court will decide so. Enougth of your negative comments and not one of you know what tomorrow may bring. You don;’t even know the facts but only just repeating what someone else tells you or what you hear on the bye ways and high ways.

      People take note.

Third Side – Madam or Sir

No one asked me to get my file. I went for them myself as an independent individual since I realised that my file was not at my Lawyer (Isidores’ office). I personally went to get my file since whenever I went to that office, it was my Lawyer – Isidor that I asked for and not eh other Gentleman.
I am a very independent individual and I do not indulge in gossip so neither one nor the other would entertain me to talk about the other. I was not invited to the wedding although as I have said before I know Mr Isidore from way back school days and I will stand next to him since I am the one who retained him as my Solicitor.

Roro if I have to take him to lunch I will and i f you want to join you can. Mr Isidore is my friend (from School days) and I will stand with him. For your information, I have not discussed the whole issue with my friend – Mr Isidore. I am a working individual and he has his business and court matters to see about. We papa met, another lawyer-liar again, they have not learnt from the Earl Williams saga, when will they learn. Greed man greed. I can live comfortable with my $1800.00 salary, why cant they live with their more than $5000.00 salary.
