Man files criminal general election complaint

A citizen of Dominica, Mervin Jno Baptiste of 12 Great Marlborough street Roseau, has filed a Criminal Complaint against the 15 Dominica Labour Party (DLP) candidates who were successful in the December 2014 general election.

In the complaint Jno Baptiste is alleging that members of the DLP “worked together to corruptly, directly and/or indirectly influence the results” of the poll.

He pointed to two free concerts, one featuring three-time Grammy Award winner and international gospel star, Donny McClurkin, and the other by Jamaican Reggae star, Morgan Heritage, as ways used to “corruptly influence” the outcome of the general election.

Jno Baptiste is alleging these were done contrary to Section 56. a of the House of Assembly Elections Act:

“The following persons shall be deemed guilty of treating within the meaning of this Act:

a) every person who corruptly, by himself or by any other person, either before, during, or after an election, directly or indirectly, gives, or provides or pays wholly or in part the expenses of giving or providing any food, drink, entertainment or provision to or for any person for the purpose of corruptly influencing that person, or any other person, to vote or to restrain from voting at the election, or on account of that person or any other person having voted or refrained from voting at the election.”

The complaint was filed on May 28, 2015 and will be heard on August 31, 2015.

    The real intent of Mr. Jno Baptsite, I suspect, is to test the meaning and effectiveness of the law. That law, as it is currently drafted, has no teeth. It is simply toothless. We need an updated law with real meaning and teeth.

    Clearly, our judiciary think there is a case to answer. If not, they would not have entertained it but thrown it out as frivolous. It does not matter what the road-side lawyers, myself included, think or what they think should , or should not be. It matters not to the court whether or not somebody else may have committed the same offence and unless there is a precedent they will have to establish a new ruling, according to the law and the law only. I certainly can see this going to high court and beyond.

    Is he complaining about disproportionate resources at the disposal of DLP compare to UWP? Why would entertainment provided by DLP be viewed in a sinister manner and that provided by UWP as legitimate…. Why the concerts did not have similar effects in Roseau compared to the other constituencies? Remember the concerts were staged in Roseau….What would the complainant like us to conclude following reported citing of he and other UWP operatives handing out money and other “things” on street corners in close proximity to polling stations around Roseau?

    This is part of the dominican culture for many many years….i do not know for other villages in dominica,but this was happening in soufriere when the man who was a representative for the longest time in history was alive and the same thing was happening in grandbay ,,galvanize sheets,cement,money,plywood,money and vain promises are giving to the public in order to vote..i have always believed that politics should be taught to the public because people in dominica vote for their cousin,best friend,parents friend,father-in-law,my teacher etc…the real objective for voting for someone is not known by the majority of the public,the real plan for the future and the well being of every one …it is time for this to stop,dominicans educate yourselves,stop voting for materials ,use your head,ask questions,what about the promises that were given to you?were they fulfilled?you are getting poorer every day ,our politicians are dirty in dominica,it is time to put them out of power..

    If the above is correct, there is definitely a very good case; the picture above where we see all the patrons are dressed in red confirms that these people indeed were bribe to influence their votes.

    Besides there must be people all over the country who are in a position to testify to the fact they were given food, money, raw building materials, and house as a bribe for their votes. The trouble is in Dominica where the entire population seems to be corrupt, I doubt they want to see the end of this corruption!

    In any event we see solid circumstantial, and reasonable evidence to get a guilty verdict, convicting all the accuse: the danger here is the pendulum in Dominica always swings away from the side of justice, in our country, some judge is going to ensure, that case becomes dormant or he/she will clear the bunch of no wrong doing!

    I must ask…are you all so ignorant to not recognize the importance of citizens challenging constitutional laws?? Why do you think these laws exist? If no one enforces or hold others to them, then they are pointless!

    How do you think schools became integrated in the US? Can you imagine people saying “oh don’t waste your time and money?”

    How do you think women got the right to vote? Or funds allocated to have children with special needs educated in schools?

    Its so easy to sit back and just say “fool” “waste of time/money” but if someone doesn’t step up how will things improve? In the past 5 months alone we’ve seen instance after instance where laws are openly broken, ignored, or unenforced, from traffic safety, to child abuse, and open corruption. You guys talk progress but clearly think some benevolent minister is going to just hand it to you on a platter.     This reminds me of a recurring bad dream I’ve been having which includes some sort of listening device, a water drinking competition, the name sake of a prominent man from a neighbouring island, a desperate individual and a powerful woman. Cannot make head or tail of it and the significant of it all. Very fuzzy cannot put them together for the life of me; very bad dream that keeps popping up ever so often. whenever I think I am going to solve the puzzle my clock alarms and I wake up.

        Interesting! so dreams can be real? I am not sure that our dreams are the same because I never see the end of mine. Do the real dreams happen when we are awake? Because I am reading this new charge and the names to me are the same names in the prostitution charge? Ministers of Government!!

        I do not know the plaintiff but the defendants’ names I know. This I believe is another distraction for something more sinister. We are in a state of mourning why the sudden distraction?

        The opposition says the country is broke and yet they want us to spend the little resources we have going back and forth in court?

        Will they be asking for the seats they won to be dissolved? Their seats cannot be legally won if the elections was illegal. We believe the Dominica Labour Party won their 15 seats legally, if they believe the seats they won are illegal, there should be a by-election in the 6 ridings the UWP won. What else is the UWP telling us but that!!

    We should be used to such antics by the UWP. Remember the court case against the PM who was said to be a foreigner because he had a french passport? Well, a member of the UWP who was the holder of a US passport while he sat in parliament during the reign of UWP, and who was also able to secure US citizenship for his kids who were born and raised in DA. was the main person behind the lawsuit.       Please re-read your comment. Are you amazed b/c the accused was innocent, or simply b/c someone on the UWP committed the same offense.

      As a citizen you should wish to throw the book at BOTH of them, since you – the citizen – is who the law was designed to protect.

      The problem is political parties are left to do the job that citizens are supposed to undertake. I don’t know…sometimes I wonder if Dominicans had to fight harder to have gained sovereignty perhaps they would be more serious about their responsibilities as citizens.

    I’m sitting in the stands and watching. This is a very interesting move and the magistrate will have to rule on it. If it is rejected it will go to appeal, if it is upheld it will go to appeal. It is not the DLP in the dock but the law. Don’t know who is behind it but this is a very, very clever move. Political life in the Caribbean may be corrupt but never boring.

    “For the purpose of corruptly influencing that person, or any other person, to vote or to restrain from voting at the election, or on account of that person or any other person having voted or refrained from voting at the election.”

    It has to be proven, not merely by inference, but by going into the minds of each respondent thereby pointing out beyond any reasonable doubt that fiovided is not enough.

    The fact the Entertainment was provided is not enough, regardless of the circumstance. It has to be proven that it was done for the purpose of corruptly influencing votes.

      And by providing witnesses willing to state that the high level entertainment caused them to vote for any of the respondents is not enough either. ..(Well they may very well be charged with perjury…but without the ballot paper that case will fall) It has to be proven that the intention of the respondent.

From your argument seem to be leading in the direction that would suggest that the electoral commission could be critical as it this department alone which has the evidence required. The trend would also suggest that there is no chance as the already compromised electoral commission will and must never act against the interest of the politicians they serve.
        On technicality and chicanerism this case is DOE. In fact the smaller yard dogs will secure another defeat for the UWP.

    Again do as I say but not as I do. Mr .JnoBaptiste if you are correct every rally that the UWP held where local artist performed was a violation of the election code, so why are you not bringing criminal action against the UWP? Is it because that some of the performers at the DLP rally were foreigners? The DLP should now use the same argument to bring criminal action against the UWP. We might very well get a ruling where both parties violated the code.
