Man fined for slapping, threatening former girlfriend

court newsA man, who claimed that his ex lover had ‘spoiled’ him, was fined in a Roseau court on Tuesday for slapping and threatening her.

Lionel Oscar, 28,  of Newtown will now have to dig deep into his financial resources to pay $2,000 after he pleaded guilty to battery on female, threats and intimidation.

Reports are that Oscar met his former girlfriend, who was coming from a shop in the Potterville area, and slapped her across her face, causing her to fall to the ground.

But he did not end there. He later pulled out a knife and told the young lady, “I will kill you.”

The traumatized woman, whose name  was withheld, was assisted by members of the public and had to seek medical assistance at the Princess Margaret Hospital. She also made a report at the Roseau Police Station.

When confronted by the police at his workplace Oscar told them that his ex lover had “spoiled” him. “That woman (expletive) spoil me … when I see her I vex … I have no proof and so can’t take the matter to court,” he said to the lawmen.

Oscar’s lawyer, Peter Alleyne in mitigation, told the court that his client had not wasted the court’s time and he begged for a non custodial sentence for his client.

Court records, however, indicate that Oscar has previous convictions, as recently as 2009, of battery on female (same woman), threats and also intimidation.

Alleyne suggested to the court that Oscar should receive ‘some level of counseling’ for his apparent obsession with his former girlfriend.

“You need to let go … the lady has moved on … I always frown on men who raise their hands on women. Women are to be cherished and loved and not beaten,” Oscar was told by the magistrate.

He was charged $1,000 for battery to be paid by April 30, 2013  or in default 3 months jail, $1,000 for threats to be paid by June 30, 2013 or in default 3 months in the slammer.

No fines were imposed on the intimidation charge.

The woman in question told the court that she fears for her life and has since applied for a restraining order which will be heard on February 28, 2013.

“Take my advice don’t raise your hand on women,” the magistrate told Oscar as he left the court.

    That Judge should be fired! A automatic restraining order should have been ordered and this man placed in jail. Dominicans need to stand up when we have lawmakers that are not protecting their rights. This is not just for this young lady but for all other young ladies, mothers etc. that are living with this type for fear.

    This girl has no brothers to bit the crap from him. He is a bully and a criminal. He needs to feel some pain and he will shake up. He knows the court is a revolving door for him and has no respect for the victim and the law on a whole.

    These law makers, unless it becomes their child husband, or some love one, they will not be serious with the criminals. A stitch in time, saves nine. You have to weed the garden, if not taken care off, it will kill your crop. A criminal is like cancer. If you don’t get rid of the cancer by drastic medications, it will kill the cells and eventually kill the person.

    This is a different world we are living, drastic times are called for drastic measures. Did thy see what the other murderer did right in court the other day? Suppose this criminal had aids and he started biting the people in the court? What then. These criminals don’t care, so the law protectors has to protect themselves and the public.

    This is outrageous! Something seems very wrong with this court decision.

    The man has already shown that he is willing and able to terrorize and brutalize the woman. Yet, the only outcome of the court case is a stern warning and a $2,000.00 fine? No mandatory counseling, no mandatory restraining order (the victim still has to wait a few days before even knowing if it will be granted), no apology, no penance…! Based on the magistrate’s admonitions, i must conclude that the fine is the most that she can impose. It is clear then, that we need to update our laws! If the State cannot protect its citizens, especially those who are most in need, people will start protecting themselves and then, all hell breaks loose.

    This is not a man he is an abuser and a looser,for the life of me those type are the most dangerous when they think they can beat on women and cannot take “No” for an answer, by his own admission and he also have a previous conviction. What! a persons life is worth more than $2000. 00 give me a break SMFH, This Dog should be fined,and put away for some time to cool his heels, and think of his actions, I think our court system is all about raising money for the treaure, hence all those ridiculous fines. Every thing is really inside out and upside down in Dominica, where some of us keep asking what the heck is wrong with our system. Woman restraing order cannot save you from this abuser, just watch your back at all times, make sure your phone is always handy and working at all times, learn self defence, make sure you never travel alone,keep this Dog within your site and any false move on his part call the police A.S.A.P. or fall in love with a big bad a… man who will protect you and keep this thing in check. But do not take the law in your own hands.

    The next time it may be to late…DA is not the only courts who runs a dirty system like this…I too was threatened in my life..was held locked up in a room by my boyfriend….I had broke off with him..fighting for my life…I went to the police to make complaints…They did not react right away..he ran away…I received daily threats vie mobile…and when i went to them to complain,they said,there’s noting we can do..Till he takes his words into actions….hahahahaha….

    “As he left the court” WHAT? He gets to leave the court – to do what – kill her? What the heck is wrong with Dominica? This is the second assault on the same woman and he gets to walk away free. Wake up Dominica, this is 2013. This kind of behaviour is no longer acceptable (not that it ever was). Women need to get together and march down to the courts and DEMAND JUSTICE for their sisters. PROTESTS – THAT’S WHAT DOMINICA NEEDS. THESE MEN NEED TO GET IT TOGETHER. WOMEN ARE NOT YOUR PROPERTY TO BE USED AND ABUSED. This is ridiculous. I am so peeved!
