Man jailed for vagrancy

courtJoseph Pacquette, of Trafalgar, was sentenced to two months in prison after pleading guilty to vagrancy.

He appeared before a Roseau Magistrate Court last week.

According to reports, Pacquette was charged after he was found on the premises of Bernice George on April 20 2015 at Trafalgar for an unlawful purpose.

According to the facts presented in court by Police Prosecutor Inspector Valda Powell, on April 20th the complainant was standing on her porch when she saw Pacquette coming towards her direction from a white main gate.

George picked up two flower pots and threw them at the defendant who ran away from the scene.

She informed her husband about the matter who made a report to the Police.

When police informed the defendant about the report made against him he responded, “I never enter by them people, it wasn’t me she see that night, she took someone else for me but it wasn’t me.”

Joseph told the court that if he was asked to pay a fine for the offense he would be able to pay that fine.

However Magistrate Candia Carrette-George told Joseph that the law doesn’t allow fines to be paid for vagrancy.

    The guy was not taken to court for vagrancy, but putting his hand in the cookie jar far to often, he was caught for stealing, while Bernice and Henry George was away. DNO must report their news correctly.

    The punishment is even harsher than having 50 rounds of ammunition without a licence. Is it because he is a poor man.

    The state needs to use some of the proceeds out of our passport sales to help these people in whatever way possible.They are Dominicans also, whether we like it or not.

    Why is it that this guy gets caught and processed when at least a dozen people come onto my property and steal and destroy things and the police do nothing?

    I am a bit confused with this information…vagrancy means ..persons who moves from place to place with no means of support or more or less idle people who have no means of supporting themselves etc..
    nonetheless to my understanding ,isn’t it rather trespassing the correct word that should be used in that context in as much as the person involved was on the person’s property?..this person might be a vagrant but this does not make him a criminal who trespasses neither someone who trespasses might not be a criminal..
    neither should we discriminate a vagrant from a normal person who is passing on the road or close to any one’s property ..at the end of the day if a vagrant is on someone’s property this person should be prosecuted for trespassing..and not for vagrancy..,,hope he will learn by his mistakes,respect people’s property..

      He trespassed on someone’s property and this is a crime. If the owner had not seen him, he could have committed a crime by stealing something.

        So the crime is trespassing not vagrancy. If it were the later, all vagrants would be fair targets.

    I’m confused
    This seems more like trespassing than vagrancy to me…
    But regardless, I didn’t know it was a crime to be homeless. My good people lease educate me for I’m not well versed in matters such as these.

        I have a similar problem. I have complained about this more than once – over a year. I suppose it is the same with everyone which is why there are errors, not of their doing. Tonight, I noticed one in one of my comments. It was too late to correct it.
