More hardship for Behanzin

Tiyani Behanzin

Magistrate Tiyani Behanzin has said he is being victimized by some members of the legal fraternity by their refusal to have him called to the Bar.

Behanzin said he meets the qualifications to be called to the Bar but because of several reasons, has not been. He told the Between Me and You programme on Q95 FM last Saturday that on the basis of performance he should be called to the Bar.

“I have gained a sizable amount of experience, which is consequentially more substantial than most of the lawyers here and in the region. I don’t think that makes me any-more attractive a candidate per say but I think that I have contribute, I have worked and been available longer than most who have held the job,” he said.

Behanzin said the victimization that he faces is ridiculous. “They may have all kinds of reasons for not calling me but I don’t care what their excuses are because it is pathetic.  It’s a matter for those who have decided to victimize me. It’s ridiculous to say that I am lay magistrate because it means that you are unqualified in a sense that you have no qualifications in the profession,” he said.

According to Behanzin, if he is not called to the bar soon he will take the matter to the higher authorities. “I will do like everybody else have done – go to Trinidad and deal with the matter there. I could sue the government because of that but I don’t think I should waste my time,” he said.

Behanzin said further that “those with any conscience should clearly see that it’s an injustice… I think it’s important that there is an appeal process…”

According to the government’s website, “Behanzin, formerly Robert Douglas, is a son of Dominica’s fifth Prime Minister, the late Hon. Roosevelt Douglas and Ruffin Nicholas from St. Joseph. He graduated in 1991 from the University of Concordia, formerly the Sir George Williams University in Canada with a Bachelor’s Degree in Political Science, the same university that his father, Hon. Rosie Douglas was involved in the computer centre incident in 1969.”

The site also said Behanzin is a graduate of the University of Nottingham in the United Kingdom with a Master’s Degree in International Law. He was called to the Bar in England and Wales in 2006.

    mr.douglas from what i’ve been reading and from following your cases all i could say is, as much as you wants to contribute to your country, dominica is no place for you right now! this is not the government of hon. roosevelt douglas! it’s a different time now, a time where honesty, the law or the constitution dont stand for any thing a time where certain people are above the same law that you mr. behanzin are trying to protect, our constitution should be our foundation to the rule of law, if we are going to have a democrcy, but as we see in dominica that so call democracy is quickly slipping away, you could be sued this days for saying ah! if you are not with them you are against them, so my brother if you cannot join the rest the crooks, or hide behind the bible, or let them push you around like they are doing to your cousin, you will only frustrate your self just as much as these politicians and their contributers and lobbyist are frustrating you, so what ever you do stay on the side of the law as you are doing and remember regimes dont last forever.

    Your problem is you talk too much – not in a bad way, but this is Dominica. If you talk, especially if you talk the truth you will get victimized! Do like me, pack up and leave. You have a much brighter future somewhere else, where you will get much more successful, and do better than all those who are holding you back. The second problem is Dominica will hold you back because of the past. I’ve seen it happen to friends. They do one thing five years ago, given a bad appraisal for it. They change, work well for the next five years, but will never get a good upraisal. It’s not about my opinion, its reality. The ever so good mananger i had (sarcastic), held meetings for staff, unfortunately, no one could talk in those meetings, else they would be victimized.

      Who ever you are, this is a perfect example of keeping one of your own down, and another reason why DA is becoming a growing nation of crime. You sending Behanzin back to law school is an insult this guy spend over seven years in law school, unlike the so called Paralegals in DA who are calling themselves lawyers, solicitor, attorney and so on, to graduate from any universities in Canada be it medical school police foundation law school, paralegal school, social worker or what ever one one to pursue after graduating from high school or college, it takes over four years graduate. get your license to practice and to be a member of body representing the field of study.
      Some of you people posting comments asking Dominica studying outside of the island to return to DA to utilize their skills and experience, Behanzin choose to do so, he choose to come to DA to help fight all the lawlessness, high level of crime in DA, where DA is becoming a lawless island, with all sought of murderers walking the streets, DA safe Heaven for criminals, foreigners committing crime in DA and escaping prison, young men chopping off wrist and out on bail and many more, this is the reason why he left Canada and move to DA, Roots, do your research and find out lawyers salary in Canada, USA, and Britain, Behanzin moving to DA , working for peanuts, whereas in Canada his salary and fee per client is big box, this guy choose to come to DA to make a change, and some of you DA people do not like change and he is practicing law according the the books, unlike the Paralegals in DA,who are calling themselves lawyers and do not believe in justice it’s all about the money for some of them.
      Where else in the world would you see someone moving from any country and within months of arriving in another country practicing medicine, only in DA where you have all sought of fake doctors working with fake diplomas some having their families producing fake medication and shipping to DA, only in DA, i know that in some countries any internationally trained in other to work in their field of studies, for example Physicians or Doctor as you call them in DA, have to contact the body representing their profession, do send their transcripts and diploma/degree for evaluation through the Medical Council of Canada , they meet all the medical requirements, first do the Evaluating Exam, then, Q1, Q2, CARMS, TOEFL and so on then do their residency and so on before getting the license to practice medicine, which is a very long process, this is why in Canada people who left their countries and are highly educated they are bus drivers Cab drivers, Pizza delivery person, cashiers and so on, also i know of people who left DA, with high profile jobs, such as police, teachers and nurses, moved to the CANADA and the USA and working in factories doing general labor, the very same jobs that when is DA would look people doing these jobs as uneducated this is what they are doing,reason is that they cannot work in these profession , first they need to have an assessment of there education documents to see if it is comparable to a college or university degree, if not they need to go back to school to upgrade, for which one need money to do so and this will take years, another thing, where in the world will you see people walking , paroling streets after six months calling themselves police, only in DA, to become a pole office one have to be a full-time student attending Police Foundation for four long years, only in DA, whenever a police is walking the streets of DA even before you see them from a far distance all you can hear is the sound of their boots, i am wondering which from country these boots and being purchase, for sure not in Canada nor the USA, hell no, so to you Roots before you open your diarrhea mouth saying that Behanzin need to go back to law school and learn law,you idiot need to access The Law Society of Upper Canada and the USA

      Mr. Tiyani Behanzin Douglas is the son of the late, former Prime Minister Rosie Douglas. As a supremo, Rosie was above board, dedicated, devoted – a human being whose heart overflowed with the milk of human kindness. He did so much for so many, as he had an undying love for his country and his people.

      We have the firm belief that Tiyani is following in his footsteps. He is in fact la crème de la crème of his vocation. As an academic from the university of London , I had enlisted the services of Mr. Tiyani Behanzin. His eloquence, his grasp of legal facts, his knowledge of legal procedures were spectacular. He won the case with great ease against all the sharks involved. Those were the upper middle class lawyers, with the stiff upper lip, at the top of their vocation, qualified from the very best universities of the UK. I feel anyone who is desperately trying to cast an aspersion on Tiyani has no legal basis.

    Ok, I know this magistrate is an educated fella BUT why is he surprise that so far he is not being called to the bar. First of all, he has been a very outspoken magistrate. Something that’s not expected of magistrates in Dominica;

    He went on attacking the government of corruption,accusing the police of drug trafficking and seemingly using the magistrate office as though he was leader of the opposition!

    Now… do not misunderstand me!! Some of the accusation could very well have been true……….. But please don’t expect anyone in political and legal circles to be warming up to you. After all DA is a small place. Everyone of any status and significance in DA knows each other.

    My suggestion…….. If being called to the bar was so important to you THEN……you should have lunch your attacks and accusations AFTER you had been called to the bar!!!!!

    As a person of legal wisdom and analysis YOU Tiyani Behanzi has represented yourself BADLY!!!

    tiyani talking about he is being victimized but what about all those poor people children that he has been victimizing in de court system.you don’t know that it will fall back on you. this man believes he is in some kind of muslim country where they stone people to death or something. take them harsh senteces you giving poor people children somewhere iran or saudi arabia or something.you don’t know what goes around comes around. just earlier this year i think they caught this guy in giraudel with about 13 pounds of marijuana.i’m not saying that he shouldn’t be charged or do jail time or something but i mean ten years.that is what he should call ridiculous and pathetic.i’ve seen guys caught with 50 pounds of marijuana and never did that much jail time.guys commiting murder and only getting 5 years.i mean is this man insane or something.stop harrasing poor people children boy tiyani you not in a muslim country. somebody will good for you one of these good days.you lucky somebody grandmother don’t spoil you yet, but your day will come.stop victimizing poor people children and best you take your a…. back to abu dabbi somewhere. :-x :-x :-x :-x :-x :-x

      Anonymous stop being so damn stupid and hypocrite, why you think we have all those repeated offenders, and some of them even escalating or I would rather say GRADUATING to higher levels of crimes? That is because thEy are not being severely punished. All they get is a 2- 3 yrs or some are let off (which is equivalent to a pat-on-the-back) which also indicates TO THEM that what they have done is no big deal. Well!! the result is the high level of crime rate in Dominica. Don’t get me wrong, I am not saying that sometimes he may have been too harsh, but you have to; as the saying goes; kill them before they grow – not the people, but the crime. Do not let it get to such a level that we cannot control. These perpertrators needs to be taught a serious lesson, so they will think twice before committing those crimes, and leave Dominicans to live in peace and enjoy our beautiful country without having to look front, back, left and right before leaving your house.

    The following is Section of the Legal profession Act 2010. That should help with this dicussion. ( sorry its not formatted, but you could read.)

    20. (1) After the commencement of this Act a person may
    apply to the High Court to be admitted to practise law in
    Dominica if the person –

    (a) is certified by the Council to be a person fit to be
    enrolled to practise law in Dominica;

    (b) has attained the age of twenty-one years;

    (c) is a citizen of Dominica or of a country listed
    in the First Schedule;

    (d) has obtained a Legal Education Certificate issued
    by the Council of Legal Education;

    (e) is of good character;

    (f) is not or has not been disbarred or struck off the
    roll of attorneys-at-law however described of
    any court of a country listed in the First Schedule
    or of, England, Scotland or Northern Ireland;

    (g) has not done any act or thing which would render
    him liable to be disbarred or struck off the roll
    referred to in paragraph (f);

    (h) has paid to the Registrar the prescribed fee.

    I would like think that most people who make comments here are educated and have some common sense and it would appear to be the case. But judging from what some of you very people write I think I am wrong. There is a provision to have persons called to the bar without having to go through the law school and this privilege has been bestowed on a number of persons, the current AG included. So what is backdoor about the man wanting to be granted the same if it was promised to him as part of his contract? I think it would be better if some of you kept you foolish comments to yourselves rather than trying to sound intelligent but making fools of yourselves.

    There may be Victimization in all due truth but ask any Any Lawyer who studied outside of the Caribbean and they will tell you that they HAD to go to Law School for 2years in either Trinidad or Jamaica before they could be call to the bar in ANY Caribbean Country.There maybe were a few exceptions to this rule but the majority had to do so. Most of you who are commenting here are ill informed so therefore you are looking at it from his perspective only and not paying attention to the requirement of the entire system. He knows the procedure and he is not above it.

      actually, seeing he has already been called to the bar in the UK all he needs is 6 mths in Trinidad, not 2 yrs. 2 yrs is for someone who has never been called to the bar in any jurisdiction.

    There may be Victimization is all due truth but ask any Any Lawyer who studied outside of the Caribbean and they will tell you that they HAD to go to Law School for 2years in either Trinidad or Jamaica before they could be call to the bar in ANY Caribbean Country.There maybe were a few exceptions to this rule but the majority had to do so. Most of you who are commenting here are ill informed so therefore you are looking at it from his perspective only and not paying attention to the requirement of the entire system. He knows the procedure and he is not above it.

    Strange but true, are we really serious? If Mr. Behanzin wishes to be called to the bar, why not go the Sir Hugh Woodings Law School in Trinidad as every other lawyer in Dominica. Are we still in the Constitutional and Democratic Right business in Dominica.

    If it’s Mr. Behanzin Human, Democratic and Constitutional Right to be called to the Bar in Dominica, then are you all telling the wider community that the other lawyers who have gone to the Sir Hugh Woodings Law School in Trinidad and other similiar institutions in the region before they were called to the Bar, were they done an injustice? Were their Human, Democartic and Constitutional Rights violated? Or for that matter they only have Human, Constitutional and Democratic Wrongs/left and no Rights?

    I urged every blogger to this article to consider whether we should have a special law for Mr. Behanzin and another for the other lawyers. Should the lawyers who spent several months (2years) and paid thousands of dollars did that in vain?

    It would be far more unstitutional to have a law in place just for one man. No exception can be made in favour of Mr. Behanzin, he must follow the law if he is so true, just and fearless as he wishes to make us believe.

    He should seek no preferential treatment, there is no blogger or Just Between You and Me Program that can change that. Please Mr. Behanzin just do what is required to be called to the Bar, and one more thing, maybe, just maybe, you could take the opportunity to asked the Host of Between You and Me to go to Law School along with you, instread of masquerading as a Kangaroo Lawyer.

    My good friends Messrs. Pestaina, DPP. Richards, Rivierre (Magistrate) and Richards and Laetang, who were all senior police officers, went to law school, they didn’t claim I have extended law enforcement experience and lay prosecutors status… they all towed the line and went to law school….these guys must be pretty upset and horrified to know someone wishes to go through the Back Door as it were to be called to the Bar, while they struggled to attained that status.

    No longer can we have people masquerading as best magistrate, great magistarte, most honest and fearless magistrate, and at the same time does not want to go to Sir Hugh Woodings Law School in Trinidad to achieve their goal. Are you serious guy, really serious or it is just a joke to feel the pause of DNO readers? Are you really kidding me?

    Don’t be silly Mr. Behanzin, you’ve taken Dominicans for a ride for far too long. Just stop it.

      Get your facts straight before u start commenting. The AG was called to the bar, Don Christopher, another magistrate, Blomquist Williams and a bunch of other. 3 Lawyers from the legal aid. He was promised to be called as a term of his contract. Ignorance should not be worn as a badge of honour. I don’t get the point of your nonsense.

    What are the requierments to be called to the bar? if he is called to the bar in Britain, what is the difference here.

    weren’t we call coverned by the queen, and the majority of the legislation and policies that we follow are still based by britain or the UN? isn’t the OECS governed by one rule as it relates to acceptance to the bar?

    please assist by informing us as to the requirements needed.

    i refuse to think that we are being bias! is he to radical? is he to down to earth? some lawyers think after them is God!

    If it was my personal decision i would have called the gentle man to the bar.

    BUT my problem he is claiming to be victimized but has not stated the requirements an individual needs to be called to the bar. If the rules say you need to meet certain criteria to be called to the bar then i think if u are just you should meet these requirements like everybody else. You being qualified to be called to the bar in another country do not mean you should be called to the bar in Dominica if u hasn’t meat the requirements. I like the work the guy does but to say he is being victimized does not seem fair.

    He never ask the gentle man what is the differences with the two. Yet he went as always to say that the whole system in DA is bad.

    Lay Magistrates do not need to have any formal legal qualifications.

    The term ‘call to the bar’ is a legal one and it refer to the license that entitle a lawyer to argue in court.

    The term is being used in various forms but the meanings they convey are almost the same. You can use the term about a lawyer and can say that he is called to the bar, which says that he received a license to argue.

    SO GUY HE NEEDS TO HEAD TO TRININDAD TO LAW SCHOOL SO A LAWYER IN DA CAN SPONOR HIM AT THE BAR CALLING.

    He must no try to circumvent the system. He is dead wrong on this one.

    I am curious about the process of being called to the bar in Dominica. Most other places you just do the qualification exams, or the work requirements, then you get accepted into the legal society as a qualified legal member.

    What’s the big deal with Dominica anyways? The man was called to the Bar in England and Wales in 2006 so he definitely is a lawyer whose credentials can be certified for the Dominica/ Caribbean system.

    Our system is modelled on the British so I am sure that the call to the bar process here cannot be that difficult for him.

    But then again, this is Dominica…they perhaps do not have a very legitimate process, since he is claiming that he is being prevented from being called.

    Everything in Dominica seems to function in reverse, since they just saw it fit to form a governing body for the legal profession, when this should be a must for all professions, where these professionals can be disciplined, complained about etc…

      All of this setback has to do with human fear. For examples some of the Jewish Leaders were afraid to accept the Power and Authority which they perceived in Jesus. Their fear was that Jesus would gain popularity from the people, which was already obvious to them. Their only alternative was to plan to get rid of Him by killing Him. But they were still stupid; Jesus was destined to die on the cross. Their authority could have done nothing to Him, against the plan of Almighty God.

      The same is for Mr Tiyani Behanzin. Authority is afraid of the wisdom and power that they perceive in him. I only had to read one news article with the expressions of this man, to perceive his wisdom and authority both politically and socially, much more for men who have been around him for years.

      What they are afraid of is that Mr. Behanzin can become the most famous Lawyer, not only in Dominica, but in the Caribbean as well. Those who do not want that to happen will do everything in the power to stop if from happening. But that is foolishness as well.

      What God has planned to do through this young man, it will be done. No one can stop him. Mr. Behanzin simply has to work at his plans in harmony with God, with that truth in mind.

      FYI, after studying in the UK, you only need 6 months (not two years) at UWI to practice in the Caribbean. And you don’t need any experience. Case in point, how long has our Kalinago lawyer practiced?

    This man is right and we should stop this victimizing if our country is to move forward with all the qualified men and women that are there to help build the nation. What is it that we are trying to create? Those real educated individuals who are being pressured so as to be frustrated out of the way of wrong doings. If these things do not lesson, Dominica will suffer even more hence our children and those after them will have nothing here.

        And what they are scared off, is if he put all those criminals behind bars, how are they going to make their money, they need those repeated offenders out their committing those crimes so they can represent them. No criminals, no cases, no money it’s as simple as that. These laywers we have here are not interested in the country, their first priority is making their money, and to do so, they need to keep those criminals on the streets on a regular bases. Why do you think we have so many lawyers? Everybody want to study law these days, because that’s where the money is.
