Murder-accused gets bail

court2Don Prosper, one of the three young men awaiting trial for the murder of Irishman, David Joseph Costello, at the Pagua Bay Guest House in Marigot, was granted bail in the sum of $270,000 with two sureties.

Prosper is charged along with Silas Bruno and Eustace Benjamin of Wesley for the 2011 murder.

Last year Bruno was granted bail in the sum of $270,000 by High Court Judge Justice Brian Cottle with two sureties.

As condition of his bail Bruno is to report three times a week to the Portsmouth police station.

Among Prosper’s bail conditions are: he is to report to the Wesley police station every day between the hours of 5 am and 6 pm, surrender his passport, social security card and drivers licence to the police and is restricted from entering into the area where any witness or person associated with this matter reside.

He is also prohibited from having any contact or communication with witnesses, whether by himself or agent or persons acting on his behalf.

He is also to reside with his sister at Wesley and is also prohibited from going to within 120 feet from any point of entry and or exit into the Commonwealth of Dominica.

The incident also involved an attack on Americans, Rick and Alicia Davison, owners of the establishment.

Costello, 43, managed Silks Hotel in Hatton Garden.

The trial is set to begin in April 2013.

Clement Joseph represented the office of the Director of Public Prosecutions (DPP) while Bernadette Lambert represents Prosper.

    dominica move from nature isle to bailland long time .dominica have the highest bail history in the world .they quoting the bible you have to be convicted 70×70 to really be punished.yes dominica.our greatest grand parents must be moaning in their grave

    Good morning my people. I have read all the post and I agree with all who stated that. This perpetrator shouldn’t be granted bail but we must remember that bail shouldn’t be used as a punishment rather its to guarantee that the person return to court. It’s my understanding that this person killed someone before so its clear that he didn’t learn anything because he was involved in another murder. I say certain crime like Murder,Rape ,Kidnapping and Shootings shouldn’t be crimes where perpetrators qualify for bail because they are vicious crimes.

    People it’s time to take to the streets in large numbers daily.Bring your cats,dogs,goats,sheep,
    fowls,parrots whatever you have,and let your voices be heard.
    It’s time to demand an end to that foolishness.
    Even if it means that the government build a bigger prison down at Pond Case,since it appears to me that there is some kind of problem at Stockfarm.
    But I’ll tell you all again,it’s time to take to the streets to deal with that foolishness.

    Why are they granting these guys bail? There are too many murderers walking the street. THese guys are dangers to society this really was’t a good idea. I hope that’s not a license to kill.

    The reason why they gave him bail is maybe because they know when next month come, prosecution would not be ready to proceed with trial. They are never ready and drag cases for years.

    That’s so sad, its true he is human but how many people must one kill before he can be denied bail in Dominica. Don Prosper is on killing number two now. Remember the St.Andrews high school killing of that young man by the name of Wadicor , cant remember exactly how his name is spelt . Mr.Joseph is this a second failure on your part within two weeks? hmmmmmm . Sometimes i believe BOOPLAY’s calypso where he sings some of us just have to stay at home , it could be changed to some people just have to stay in jail period.

    Wait!!!!!!! so today i reading court news and everyone seem to be getting bail is the prison full or something? Am I to harbor a rapist and a murderer in my home and all they do is stay away from the ppl who they hurt or any one who have anything to do with the case, what happens after 6 when they check in the police station? They go out and cause more trouble or be good boys?PLZZZZZZZZZZZZ i am sorry but the system of justice is doing us no good better we all turn into killer and rapist and then get sent home and just check in with the police.

      Haven’t it occurred to you that maybe he was granted bail but did not get a surety?

      You can get bail but if no one stands as a surety, you remain in jail.

      Exactly, Dominica we are sending the wrong message to our people and people that wants to invest in Dominica. A murderer belongs behind bars not on the street with law abiding people. This nonesense is getting out of hands in Dominica. I don’t care who is responsible this but it needs to be fixed.

    It is the second time that this young man has killed somebody? Pleae take note. That is the same Jackie Chang, that said he would be back again after killing the boy at the St. Andrews High School a few years ago.
