Murder-accused to know fate on Wednesday

A Marigot man charged with murder is expected to know his fate on Wednesday, May 31, 2017, after presiding Judge Victoria Charles-Clarke summed up the case on Tuesday, May 30.

Rudy Junior Jones is charged with the August 2012 murder of Falcon Wallace.

The State and prosecution both closed their cases and both sides have already addressed the jury on the matter.

In an unsworn statement from the prison’s dock, Jones told the court that on the day in question, Friday, August 24, 2012, he came from work on a bus and went to Marigot. He had gotten paid and had EC$1,800.00 in his possession.

“The bus dropped me in the junction and I took out the plastic of money in my pocket…I took 20.00, paid the driver and he gave me back 10.00, I went to the shop of Jeffery Charles to get a Guinness,” Jones said.

According to him, while being served, he felt two hands in his pocket.

“When I turned I saw Falcon (the deceased) on one side and Frankie on the other. I asked them what’s their problem. Falcon said he was going to rob me tonight,” he stated.

He said that he took the drink, left both men in the shop and made his way home.

“I went to a standpipe close to my home, I always stop there to clean my shoes. I heard a voice saying, ‘you going to get robbed for true tonight.’ I continued cleaning my shoes and then felt a slap on my ears,” the accused stated.

After receiving the slap, he said he asked (Falcon), “why you slap me…I am not your child.” He said the deceased told him, “the plastic of money I want.”

Jones said that he asked Falcon if he was working for him but he replied that he (Jones) only come up to Marigot on weekends.

“He made another attempt to give me another slap, so I pass the piece of knife on him. He fell. I went to the pipe and drank water and went home, that’s all,” Jones stated.

However, State attorney attached to the office of the Director of Public Prosecutions (DPP) Fernillia Felix, in a one-hour address to the jury said an eyewitness account given by Ronald Junior Tony is telling.

Jones she stated has given “two versions” of his actions and he is “lying and not credible.”

“The deceased never tried to slap him (the accused), he was bounced inside and formed his intention. He had a knife on him, he was not acting in self defense,” she said.

She continued, “Self defense is off the table, he stabs the man and was under no threat. Look at the evidence in totality, the inconsistencies are great and major because he was lying and still lying today. The defense is alleging provocation, we are saying the deceased never provoked the accused. It’s a matter of plain revenge and retaliation, the prosecution has proved its case to you and we ask you to return a verdict of guilty of murder.”

Defense lawyer David Bruney maintained that Jones (the accused) was provoked.

“The State has to prove every element of its case. Where is the knife? We have a search warrant for the knife…no knife. What is the deceased doing in the vicinity of the home of the accused?” he asked.

He added, “The statement of the accused is clear, very clear. He was going to be robbed he had $1,800 in his pocket, I am asking you to accept the fact that he was vulnerable and was going to be robbed. He was provoked that night and had to defend himself.”

The medical report stated that the deceased died of a 10-cm wound which damaged his intestine and caused severe shock and haemorrhage.

Justice Victoria Charles-Clarke will address the jury and sum up the case on May 31, 2017.

    whether this guy have a smile on his face doesn’t mean that he did it. Please don’t judge him and if you don’t have nothing nice to say about this case dont say it. He have to hold up his spirt. let god do the judging and let us hope for change in this individual life. His statement makes lots of sense this case is almost 6 years old time have pass and things have forgotton. it is normal for him to remember and forget he his human. whatever the outcome we will stand by him and god will forgive him and we will move on from there. thanks for all the support that his friends and love one gave him but we will stand by him. thank you jesus.

You and falky had a confrontation on the ghetto in dam, and he stated that he didn’t want to go back to prison, and he walked away from you on the ghetto to avoid getting in problem with u diddie. And you followed falky and and stab the man across the bridge. U still slapped him in his face several times when he fell to the ground.     Reading this story i could not come to a conclusion…. i say poor reporting by whoever penned this story…

    On one hand is the account of the accused but there is no side of the prosecution…. for the story to be balanced a summary of the chain of events from the proclsecution has to be provided….all we have is the side of the accused, and the summary rebuttals of both defense and prosecution. Where are the details of the openning arguments of the state??

    If you were to come up to any police… Dominican with intention to steal… I think this case may be repeated…

    The better question is:

    In such a situation, do you:

    a) Go the Christian route and accept another slap, while giving $1,785.00 to collections…
    b) Go the Police route and hope they actually DO something…
    c) Cry for help
    d) Hope the person leaves you and goes away, forgetting the $1,785.00
    e) FINISH HIM…

    Now really and truly options “a – d” does not really exist in this world.
    a) The person would keep coming back for more.
    b) No one is more useless than the police… they don’t care.
    c) Who will actually help? Dominicans only unite where politics is concerned.
    d) This will never happen… do not hope for it.
    e) Well… this is what happens when you meet said confrontation.

    Yes the guy could have immobilized him with his “magic” shank but we don’t live in an assassin society.

    Again, why does it take so long for a case like this to come to court? Nearly five years have lapsed. The old dictum “justice delayed is justice denied” applies. We chose the CCJ as our final court of appeal, instead of the alleged colonial Privy Council. I increasingly question the wisdom of this. I am interested in both the quality and speed of dispensing justice and delays like these do not bode well for either.

    This drastic rise in Caribbean crime is destroying the islands’ economies, social development and their very souls. We must take equally drastic actions to stamp this out. The lament amongst Caribbean folks overseas is palpable. This is/was their dream to retreat to their quiet islands and away from the noise, hustle, hassle and racism of the developed world. These are people of means with the capacity to not just buy property and business, but to bolster the middle class that strengthens the society for all.
    Recently, a Kittisian friend who had visited reqularly and longed for the day when he would return, bemoaned the terrible crime on that tiny island. He is now considering selling his land and not ever returning. I was shocked at his turnaround but was more so at the crime on an island of 13K people.

    New leadership is needed throughout. Leaders that are selfless about promoting small island values of modesty, goodwill, tranquility and yes, subsistence living.

    Another murderer gonna be set free in the community , which embolden them to go out and Bragg saying [ I kill before and I will kill again} thereby intimidating the community , he should not have been out of prison, he has a smirk on his face like he is proud of what he has done, he show no mercy, or repentance, or apologetic of his action, he is a killer, and will do it again in a heart beat , the Judge gonna slap him on the wrist like a child and say go home and be a good boy, and don’t do it again, but Waite what about the victim’s family?, Dominica judiciary system is what we call catch ,and release, it is a shame I scared to come home.

    His statement makes no sense. No one is going to give you advance warning before robbing you. Second of all, if someone threatens to rob you, then you should have called the police. Your broth has no salt, Sir.

      Well, some people are brazen enough to actually TELL you not warn you, of what they’re about to do to you., It happens everyday. If his story is true, then he acted in self defense and should be released. Obviously they saw the money or knew that he worked and comes home on the week-ends. they had no right to try and rob him. He should have destroyed the BOTH of them. Voler!
