Murder retrial gets underway in High Court

A murder retrial began at the High Court on Wednesday, involving Garvin George, whose appeal against his murder conviction was granted on May 3 by the Court of Appeal of the Eastern Caribbean Supreme Court.

George appeared before Justice Bernie Stephenson-Brookes on  Wednesday morning along with his attorneys Wayne Norde and Bernadette Lambert.

He was previously sentenced to 14 years in prison by Justice Stephenson-Brookes after he was found guilty for the murder of Julien Joseph, following an incident which occurred on February 5, 2010 at Calibishie.

The appeal was granted on the grounds of the trial judge’s “misdirection” to the jury.

During the start of the retrial earlier Wednesday attorney Norde inquired into a bail application being made on behalf of his client.

However this was dismissed by Justice Stephenson-Brookes who wanted to recuse herself from the matter.

She advised Norde that Justice Brian Cottle would be dealing with the case, and the bail application should be made then.

The retrial is expected to continue on June 25 (2012).

    The man took the life of another, his solicitor should accept the 14 yrs. on his client’s behalf. Was he expecting to get a slap on the wrist for the life for the young man? Come on man, if you cant do the time do not do the crime

    Where are the redants on this matter? If it was a Tyani matter that was sent back to the courts you all would be here wankarlaying the good man name but all lost tingue on this one. I guess the DPP office lost its tongue this time. Hmmmmm…..oh Dominica!

    Can the lower court judge who heard the original trial be the same judge in the appeal? I think not.

    I’m pretty sure that appellate judges and lower court judges are not the same people…so how can the appeal be granted on the original decision and the retrial is with the same judge who granted the orignal decision?

      Tha article said that the judge recused herself an sent the matter to another judge. Recuse really means, she removed herself from hearing the matter since she was the judge on the original hearing.

        That is not a true statment. No one recused themselves…reporting should be accurate. Thatz how things get distorted out there…SMH

      That was my concern, yet by vertue of the fact that she is trying to recuse herselfn that means that she can actually hear the case again. The problem that I have is how comes his attorneys are not the ones asking her to recuse herself instead they are requesting bail from the same judge who’s decision was overturn? There are just too many of these important cases being overturned by the appeals court, judges need to be retrained.

      Didn’t you read that the judge asked to be recused from the case for that very reason. The only quam I have is she denying bail before being asked that she be recused. Her descision can influence the other appellate judge to do the same
