One year in jail for a gold chain

gold chainOne young man of Gutter Village has been sentenced to one-year behind bars while his accomplice walked away with a slap on the wrist.

Chevonne James was jointly charged with Michael Cloones for theft of one gold chain worth $2000.

According to police reports, both James and Cloones approached the complainant with masks on their faces.

Cloones, who was armed with a cutlass, held on to the complainant and ordered him to stand still.

He then proceeded to snatch the chain from the complainant’s neck and asked him whether he had anything else of value on him. The complainant was then released and ordered to get away from the area.

The complainant proceeded to the Roseau Police Headquarters where he filed a report.

He identified one of the defendants by a red hat which he was wearing. Both James and Cloones denied having any involvement with the offence. However, upon further questioning, James told the investigating officer, “Officer work with me, I will work with you.”

He then brought the officer to his home in Gutter and directed him to two blocks under which he had hidden the chain.

Wayne Norde, attorney for Cloones, pleaded with the court to avoid sending his client to jail. According to him, although he was fully aware that this was not his client’s first encounter with the law, sending him to jail would not help him.

Norde added that some people learn at different stages of life and suggested a suspended sentence for his client.

James on the other hand, who represented himself said to the magistrate that he “would not do it again.”

Magistrate Bernard Paquette told the men that he was taking into consideration the fact that they both co-operated with the police and pleaded guilty. However, he said he was still charged with the responsibility of sending a message.

He fined Cloones $1,500 or 3 months in jail. He was also ordered to pay compensation of $120 or face 1 month imprisonment and a 6 month suspended sentence of hard labour.

James was sentenced to one year behind bars.

    Wow! Ple-Bargain for that ? Does that sentencing and charges send a message to similar would be Criminals? This is not to be considered Peti-crime with a weapon such as a Cutlass and masked Men.

    This is what’s wrong with Dominica. You all are steaming over the fact that an armed robber got sentenced to jail after his hearing over drug dealers beign granted bail before their hearing.

    Wow.. and we wonder why Dominica is so screwed up With you guys and your twisted idea of what’s right versus what’s wrong.

    the accused robbers haven’t even had their case called and yet, you’d rather the arm robber be released and not serve anytime for his actions?

    So allu just think like once s e body do a petty ting is jail dey hve to go but one thing I telling allu bad wishers one day things will change all of allu hve to hve children and already hve allu dnt kno wht the future hold. Jail on the other hand allu think it so nice for them but the truth is it doesn’t help na cause as they come out is the same thing and even more cause jail doesn’t turn you into a nice person, it may make u break dwn n think again but it corrupts ur mind as a young man. And I haven’t been there hell no And hve no plans but I can tell u cause I witness it already

    Lax Court system again. Consider the victim and the fear these men put in him. You should have sentenced him to prison. He who had the cutlass to the victim’s throat should have been imprisoned. This was a weapon which he could have used to injure and murder the victim. It was not a toy. Consider if he had not given them chain, he would have been a dead man.
    If this is the type of Court System which exists in D/ca and the type of sentence criminals get, is it any wonder that crimes will always flourish in Dominica?
    I would like to think positively but from this case, the worse is yet to come.
    Fellow D/cans you know you must pray for Dominica and for criminals alike that crimes will be eradicated from Dominica, at least the types of crimes which are being committed.

      You call that a little thing? Downplaying the seriousness of the crime? A man with a cutlass to the throat of the victim and theft of a gold chain worth $2000? It should happen to you. You would not call it a little thing.
      They should have thought before they committed those crimes. Rather, pray then so that they would not commit them.

    that is a big joke. a year for stealing a chain, but for murder and BIG drugs bust people are out on bail and the cases might never call so they won’t spend more than the fews days they did when they were captured. SHAME SHAME HAME

    Up to jail you shall go for stealing a chain which was recovered yet murderers, rapists, drug dealers and thieves walking the streets on bail!! Something is upside down in this country for sure!!!!

      Armed Robbery where someone could have been killed or hurt vs being caught with lots of drugs when there was no immediate danger. That’s what we are comparing? TWO WRONGS DO NOT MAKE A RIGHT.

      Bail for a crime not proven vs sentencing for a crime proven! And then you guys complain the system not working.

      the drug dealers will have their day in court. Just pray that the prosecutors come well armed to defend them.

    Hold up Paquette not so fast!!! So Cloones who had the cutlass and could have killed the man is set free with a $1500 fine or 3 months in jail, meantime James who was part of the deal, gave up the chain, but had no attorney goes to jail for a year? What de is going on in Dominica?

    Is James being punished for the crime or for not having an attorney?

    Why isn’t Cloones charged with aggravated assualt or even intent to commit bodily harm and given a stiffer jail sentence?

    What kind of message are we sending to the society? Lately it seems to be in Dominica the more heinous your actions the lighter your penalty.

    This is outrageous! Was an extra penalty imposed for not being represented by an attorney? The stolen good was recovered, he should have been penalized, however, this is too harsh. Changes must be made immediately to address these flaws in the Judiciary System asap. How can you want to jail someone for 6 weeks due to allegations made by someone with a famous last name, if a Fine is not paid, for accusations of missing items and rent, yet you are quick to release murderers? This injustice must be addressed.

      @Ya, the lesson for you is “POOR PEOPLE CHILDREN MUST STAY AWAY FROM CRIMES” Crime don’t pay so if you poor you can only get poorer cause it won’t pay you!!!

      Instead use your god given skills and take yourself out of this poverty, get a job, get an education its’ free these days, that will definitely pay you, don’t be envious of people and what they have work for yours and be contended with it!!!!

      So once they can do the crime they must make the time, I will never condone such behaviors nor feel sorry for them Ireally feel for the victims!!!!
