Police Commissioner wants implementation of a Bail Act

Police Commissioner Cyril Carrette is looking forward to having a Bail Act on the nation’s law books.

Presently Dominica does not have a Bail Act and according to the Commissioner this has been a challenge for law enforcers.

“We do not have it at this time and you find that there are persons who use to be remanded in custody, and because of the absence of the Act there is no specificity with regards to what you do to the individuals,” he said on DBS radio.

In legal circles bail is referred to as the temporary release of a defendant from custody. The defendant is usually released into the custody of a bondsman, who acts as a surety. The agreement basically is that the state will release the defendant from custody, the surety will undertake that the defendant will appear at a specified time and place to answer the charge made against him. If the defendant fails to appear, the surety become the absolute debtor of the state for the amount of the bond.

According to Carrette because of the absence of a Bail Act many persons who commit crimes are released and they go on to commit the same crimes. “You find that persons who commit heinous crimes are on the loose to repeat the crime again and you need to keep them behind bars because there is nothing in law forcing you to keep them,” he explained.

    The fact of the matter is we do need a Bail Act.
    And we need it sooner rather then later…It is high time we start looking at solutions to out problems, instead of engaging in all sorts of rhetoric .

    We think too much in terms of cheap partisan politics. We should go about solving of problems in a more intelligent way…….And also, constructive dialogue would not be a bad idea……

    Because of the abscence of the BAIL ACT, many persons who commit crimes are released and go on to commit more crimes. Check that statement by Carrette well as reported by DNO. But there are three heinous criminal acts every Dominica now know about:
    (1) The cases of firebombing of Emanuel and his wife.
    (2) Firebombing of the home of a Police Officer who said that he is investigating money-laundering activities in Dominica.
    (3) The alledeged criminal activities of fraud in the Emanuel vs. Isidore matter.

    Could Carrette truthfully explain to the Dominican people why all the shinannigans that have been going on, go-slow, stalling of investigations, contradictory statements? In some instances, no arrest, no court, no case given who is involved in the illegal or criminal act.

    Remember how or when the Court Order to arrest the Lawyer Isidore was disobeyed? Why Mr. Carrette? Isn’t that true DNO? No arrests yet, investigations still going on then in that grim criminal act of the attempt at Emanuel’s life? You see it is important to ask Carrette those questions in light of what he states compared to his actions relative to those crimes in question. We are hearing and seeing DNO.

    The truth about those heinous criminal acts will be revealed one of those days, just as the secret deals with the passport sales are being revealed. The truth of those corrupt practices must come to light. Trust me. Stop being hypocritical and sympathetic to those who commit either Blue collar or white collar criminal matters. Such attitudes will further destroy the country.

      So what does all that have to do with the Bail?
      You need to put things in their proper perspectives.
      What you said has nothing to do with the price of tea in china……

      However, what he is calling for now, didn’t the former Magistrate Tiyani Behanzin called for the same thing about two years ago, and it fell on deaf ears?.

      Why didn’t the then Deputy Commissioner, and now Commissioner, joined the Magistrate then and called for the Bail Act?….Had he no voice then?….does he have a voice now?……Will the Legislators finally listen?…

      I mean if you are going to bash someone, it is always best to do it in the proper context…..

        The perspective is in relation to heinous crimes being committed and no investigation, or stalling of investigation or influencing of the judicial process by operatives, thus not allowing justice to take its right course.

        Are you aware of heinous crimes that have been committed and no action much less for bail? Big Boys in Dominica on many occasiopns go scott free. Are you denying that? A holistic approach and strategy is needed as well as the will to properly and professionally investigate crimes and to bring the perpetrators, irrespective of who did the crime, to justice.

    Mr Carrette, even if there is an implementation of a Bail Act it will only work against those who are not on the team. Those that are on the same team will always get away just as the unlicense gun Bubbles used found a way to return to his address electronically.
    What we need is not more laws but fairness and justice for all.

    Cyril Carrette not easy, nuh. What about the investigations into those heinous crimes of firebombing, attempted murder, of Lawyer GON Emanuel, his wife and that of the Police Officer who said he is investiging money-laundering.

    It was Cyril Carrette who told Dominicans that SECO was a person of interest and he would try to get the assistance of US authorities to get SECO back to Dominica to be interviewed in that heinous criminal firebombing action. All of a sudden, Cyril Carrette makes a surprise announcement that SECO is no longer a p[erson of interets. What happened? was SECO interviewed at all?

    What about the Emanuel vs. Isidore case where Emanuel filed 42 charges against Isidore regarding allegation of fraud. Up to now no arrests, no court, no case. Three heinous crimes going unsolved after all that time. Why? Doh mention all the other criminal acts that have not been solved.

    Most Dominicans know and feel that the Police institution is being heavily influenced by political operatives. We are awaiting the outcomes of those criminal acts mentioned. Justice? So given the KOKOMAKAK going on with those cases, stalling of investigations, not getting SECO back to Dominica to be interviewed in that firebombi9ng crime, Carrette really has NO MORAL authority to make those comments. It is just words because they never supported Tiyani the magistrate when he was concerned about that same issue.

    Injustice is hitting us squarely in our faces. Justice delayed is justice denied. What about the investigative report and the recommendations from it? Yes,the one conducted by Superintendent Carbon re. the shooting of that guy at Convent Prep? The report was submitted to the DPP for action and legal advice. What happened? Recommendations not effected?

    A new investigation revealed that the person, a police officer, who was involved, was not wrong in his actions. What? So Carbon cannot investigate that unfortunate, but simple matter?

    Why did Superintendent Carbon eventually pull out, wash his hands in that case? Once a country’s police Force is being manipulatewd, or influenced by politicians and/or their operatives, expect problems like what we are witnessing.

    Good move Mr. Carrette, take it to the house and pass it as quickly as possible. The many persons who come forward to bail others are themselves supporters of the offenders, just to have them out to continue to support them. That way, the state would get some monies in the kitty when you ask for a percentage up front, and if they are deemed unfit then the offenders will remain behind bars until……..

    I am totally shocked to hear that there is no bail act in this country. This gives criminals the upper hand to commit more serious acts. I was sad to read about the guy who commited murder andwas let out on bail.

    I AGREE WITH HIM FULL .. AND DO LIKE AMERICA ..IF BAIL IS 50000 . MAKE THEM PAY 3 PERCENT OF IT .. CASH UP FRONT NO REFUND .. THAT WAY THEY WOULD KNOW BAIL IS A SERIOUS TING .. AND PLUS THE STATES GETS SOME REVENUE

      To my knowledge, bail is always refundable in full if the defendant shows up for court hearing as scheduled. The bail bondsman/agent is the one who demands a contractual percentage of the bail for paying the bail, (being the surety), on the defendant’s behalf. If your family pays the bail then there’s probably no fee/%.
