Senior Counsel Astaphan now leads court battle on behalf of Stephen Isidore

Senior Counsel Anthony Astaphan is now lead counsel on a team of lawyers representing attorney Stephen Isidore who is alleged to have stolen over $6 million while he was a partner in the law firm, Emanuel, Isidore & Associates.

The criminal complaints were filed against Isidore by his former business partner Glenworth Emanuel.

The case was again adjourned after deliberations by attorneys for both men at the high court this morning.

March 11, 2011 is the new date for the court to hear further applications.

Astaphan told reporters after the proceedings today that he recently decided to assist his colleague in the matter.

“Well Lennox Lawrence, as you know represents Mr. Isidore, and they asked me whether I would be prepared to assist and I only had the opportunity to over the weekend. And having read the papers and having looked at all the files I felt it important that I assist a colleague of mine who I believe has been put under unnecessary and wrongful siege. As a result I am now leading the legal team on behalf of Mr. Isidore and the invitation of Mr. Lennox Lawrence. The team also includes as you know Mr. Julien Prevost, and Mrs Heather Felix-Evans,” he said.

He also informed the media on what transpired at this morning’s proceedings.

“We have filed an application for leave and for the extension of the injunction. The lawyers on the other side who are representing Mr. Glen Emanuel asked for an adjournment… so to allow queens counsel from Barbados to argue the matter on their behalf. And Her Ladyship gave directions today for that rescheduled hearing in March and as well continue the injunction that have been issued on behalf of Mr. Isidore,” he stated.

“So they now have to file submissions in response to our application; we then have a right to respond … and the matter will be fully argued in March,” he added.

He said that his team has a number of very important issues which they would like to bring to the court.

“There are several issues that we want ventilated, as to whether or not what was done was in fact constitutional, legal, and all in all indeed proper. And we take the view that they’re not but that will be for Her Ladyship to decide… I don’t want to be specific and I don’t want to get into any detail and I don’t want to say if this was the case, what the consequences if not… And we are very anxious to have a determination by the court on these issues,” he said.

“We were ready to start his matter today. We came here ready to start the case today, but they have asked for an adjournment and they agreed.  I did not try to score any political points. I did not try to score any cheap shots. We readily agreed to the adjournment,” he said.

At a previous hearing on December 6, 2010,  an order of stay was granted by the high court upon request from Isidore’s solicitors. The order  prohibited Isidore from being read over 42 charges brought by Emanuel.

Isidore, who was due to face those charges at a Roseau Magistrates, was spared that formality when his solicitors presented the Chief Magistrate Evelina Baptiste with a high court order which stated that the chief magistrate or any other magistrate is hereby prohibited from hearing the complaints or any other complaints filed by Emmanuel and Associates and or Glensworth Emmanuel against the applicant, pending the hearing and determination of the application for judicial review.

Meanwhile, one of the attorneys for Emanuel, Geoffrey Letang told reporters that the adjournment will afford his team the time to respond to applications from Isidore’s solicitors.

“So all these applications will be dealt with… One of the main reasons that we ask that the matter be adjourned is that we could respond to whatever submissions being served on us etc. and that we will have an opportunity to view the documents that have been served so that we can respond appropriately,” he stated.

“It would be quite premature for us to deal with the application now when we have not seen what they have filed. So we would need an adjournment to respond appropriately because my client Mr. Emanuel has a requisite interest… and we want to be heard,” Letang stated.

He is convinced that “whatever order the court made in respect to judicial review could have an adverse effect”.

Letang expressed confidence in his case.

Emanuel is also represented by Sir Richard Cheltenham of Barbados, who was not present at today’s proceedings.

Criminal complaints were filed against Isidore in the magistrate’s court on Nov. 19, 2010 by Emanuel.  Isidore faces 35 counts of obtaining property by deception, five charges of false accounting, one charge of false statement by a firm’s partner and one count of theft. The theft charge involves $6,975,070.88 which was allegedly stolen by Isidore from the partnership between 2006 and 2010.

The court had agreed to freeze Isidore’s assets in a move to prevent their dissipation, which could affect the judgment process.

This is not the first time Isidore has been in controversy.

In September 2007, Isidore claimed to have made a $51,000  error regarding a transfer tax calculation on a 2.989 parcel of land purchased by Prime Minister Roosevelt SKerrit at Wall House. This was subsequent to pressure from the public on a land transfer tax evasion.

The amount was later refunded to the Treasury.

    It is clear that Skerro is protecting Skimi and trust me the circle is very wide. 6 million is in the pockets of big and powerful people in Dominica who will do everything to make sure that the Skerro-Skimi partnership survives. But it won’t as for it to do so, there will need to be martial law in Dominica imposed by Skerro and if he does that, then for certain, he will suffer the demise of a thousand cuts together with his slimy mates.

    By the way, Mano is well connected with the British Security Services and Scotland Yard, so to pull a fast one on him is futile and a waste of time. To kill him solves nothing as the trail will lead right back to those who instigated it.

    Knowing the kind of creature Mano is, and the way he treated Stephen like less than a slave, Stephen should have cleaned him out totally. And why wasn’t he entitled to engage in certain transactions that to us seem crooked; they were supposed to be PARTNERS.

    But he was paying Stephen $5,000.00 a month for doing all the firm’s work. Stephen only made money on the side by being on Boards and stuff and doing work for government, including Skerro, without Mano knowing.

    All you talk about lawyers being crooked and unethical, GON is the emperor. Could be he trained Isidore too well, I don’t know.

      Mano is an eccentric, but has done more good than bad for a lot of people and does not deserved to be torched to death by anyone. Skimi had a good deal from Mano who was a goliath who gave Skimi an extraordinary chance to make better of himself. Skimi betrayed that and deserves to go to prison as he undoubtedly will. I am not saying that Skimi tried to torch Mano, but if you work things out you can see that he has every reason to want Mano terminated. Without Mano, the case dies and he and his powerful mates will breath freely and live another day to do some more robbing :)

    Check this out Peeps. Tony came in to offer assistance to his friend but yet he became leader of the legal team. So Lennox Father Preist Lawrence is incapable, Prevost is a moo moo.
    Tony is really not a smart lawyer. He was only asked to help over the weekend and became the front man overnight.This guy thinks that we are all ignorant and stupid.
    We all know why Tony is now the lead attorney. Tony is there to guard the secretes of doom. Remember this – Somewhere within the 35 counts of property acquisition by deception the King and couple ministers name will be highlightred – Take that to the bank.     All of you with all you negative talks. You all know nothing except what you all hear in rumours.

    You all seem to forget that Stephen worked at Scotia Bank before he became a Lawyer. You all like to jump on peoples back and do not want to see one move up. It is not everyone who waste their money when they are working. Most time when you see someone with a house or vehicle, you all get jealous and retort that the person has money or your minds going hay wire and in your minds accusing persons of all kinds of things. I am speaking from experience .. I know the things you all say when you see one person striving and trying to become decent even if they were raised poor.

    It is about money management. Putting you priorities right. leaving out the unneccessay expenditures. It is about cutting and pasting – priority. It is about knowing what you want to achieve – Is it a house for a shelter or is it a car first . Is it to party ..Is it to buy the most expensive clothes, shoes, latest styles , brands etc. It is about money management I say. After the food bill which is necessary for life , then what next in line of expenditure.

    So do not grudge the man and he was doing well for himself before he joined the partnership. He had most of the clients there. I am one myself. Another thing he has helped so many poor person since he came from a poor family himself. So the Lord will give him favour and deliver him from his enemies ( who ever you all are) and he will come out victorious.

    Stephen continue to lean on the everlasting arms of the Father.. He will see you through this.. Put your trust and confidence in the Most High. Man will let you down but he will not let you down. You will be victorious and remember the three (3) Hebrew boys in the fire.. They never got burnt but those who had cast them got burnt and died. Don’t you ever forget the Father o fthe Hebrew boys is also your Father Stephen.

    All I wish to ask is given Mr Isodore relative tenure as a lawyer, i.e he was a junior partner in the firm, how the hell could he fund that big “HOTEL” he is building in St. Joseph?

    I was not aware that lawyers in DA can “legally” amass that level of coinage. I read that some of you talk about envy, hatred etc. But use some common sense, how the hell does a lawyer with limited experience on the job amass that dough

    I wonder how much of all that money tony Astphan makes is given to charity like the infirmary, House of Hope, the Prison, hospital etc. He is cashing in a lot of dough which he can donate a small percentage to a worthty cause if he really cares and loves Dominica the way he claims he does.

    Everyone should know IsIdore is the “CORNER STONE” the building is about to crumble. To those who do not know about (last born) Isidore childhood. He came from real poverty reached the top but greed is about to bring him back just where he came from. I was so proud of him for not staying in the condition he was born. He really disappointed me. Most people who forgot where they came from God Almighty is always reminding them.

    I don’t think that anyone who knows Tony Astaphan should be surprised of this move. Once he figures that UWP is involved he will join the fight. What amazes me though is the level of hatred and bigotry that this man spews. One thing for sure and that is Tony not defending SCareit. Tony defending himself. It cannot be that he is proven wrong again. You remember the investigations into the UWP? He was PI,police, judge , everything and then he told us that it was a political strategy that has lead us into this tragedy. If Scareit says anything nice about the Workers Tony will bash him.

    The Chief Magistrate SIGNED and ISSUED a WARRANT for the POLICE to arrest Isidore because of the Magnitude of the crimes. What did the police do? The High Command blatantly disobeyed the court’s order and REFUSED to ARREST Isidore. But isn’t Isidore Skerritt’s buddy, his very close friend? The present Ag. Commissioner, not the real one who was, as speculated, forcibly sent on leave, in an interview aired on MARPIN news, told Dominicans and the World, in their faces, that Isidore was not arrested because he, the Commissioner, was out of State. The Ag. Commissioner expected Dominicans to swallow his irresponsible EXCUSE. You should have seen that Ag. Commissioner’s FACIAL EXPRESSION on MARPIN that night concocting his excuse.

    Lest you Dominicans forget. Wasn’t it that same Ag. Commissioner who told Dominicans in a Press Conference that there would be NO INVESTIGATION, not any time soon, meaning never, into the RUBBISH BIN BOBOL, which certainly need to be investigated? But even on his return to Dominica a few days after, wasn’t the warrant for arrest still VALID? Yet that Ag. Commissioner didn’t BULGE. Dominicans knew all along that they would not arrest their friend Isidore. Oh, if it was the poor person’s child PRONTO the HANDCUFFS would be on.

    Imagine what is going on in Dominica, my people. The Police disobeying the Court’s ORDER? The Ag. Commissioner making some blind, wicked excuses for not carrying out the COURT’S order to ARREST the ‘BIG BOY?’ Witness trouble in the JUDICIAL CAMP. Although the Chief Magistrate’s warrant to arrest was deliberately not carried out, the Judge in the HIGH COURT, at a previous hearing on December 6, 2010, granted AN ORDER OF STAY upon request from Isidore’s solicitors. The order prohibited Isidore from being read over 42 charges brought by Emanuel. Can you IMAGINE THAT, MY PEOPLE. CRY FOUL.

    The FRATERNITY again is at work protecting those in ‘HIGH PLACES.’ NO WAY could that happen if it was a ‘SMALL FISH.’ NOW here comes Tony Astaphan wanting a piece of the PIE. He cannot miss that action. Big MONEY involve for legal fees. The JUDICIAL SYSTEM is in SHAMBLES. Too many times corrupt practices are discovered, brought to the public by independent patriotic Dominicans, HARD FACTS and EVIDENCE are presented, those BIG BOYS involved cannot refute the criminal acts done, yet NOTHING happens. ABSOLUTELY NOTHING. NADA. RIEN.

    SOME kind of KOKOMAKAK, FALSELY COINED TECHNICALITIES, surface. Dominicans keep your EYES and EARS wide open as regards those court matters. The one with Isidore and the DUAL CITIZENSHIP one of Skerritt are CLASSICS The FRATERNITY is BUSY at WORK, devising ways and means to PROTECT, DEFEND and FREE UP members of the CABAL. Lies, deceit and corruption will continue to thrive. TRUST ME. Dominica will suffer immensely as a result.

      Judicial Melee! Who can doubt that you topped the class at the Kangaroo Court at the University of Kangaroos at Q95. What evidence do you have concerning this matter except what you read on this blog, so why are you so worked up on issues you are not informed to draw a conclusive conclusion.

      Why not let the courts decide. Tony is a Darn Good Lawyer and one who does not take any foolish case and when he is at it, he does a great job. I’m aware that Tony may well be the only Dominican to argue cases before the Privy council, and since you’re from the Kangaroo court, the Privy Council is the highest court in the commonwealth of nations and situated in London, England.

      Those good gentlemen are legal scholars (legal luminaries) not like the Chief Justice of the Kangaroo who holds a BC, that is a Birth Certificate in Law,

      What crimes???? The charges are brought by a former partner Emanuel who alleges that he stole cash and property from the Patnership firm. This is before the courts and you all are judge, juror , executioner etc. The way you speak is as though you are party and privy to everything and you know all the facts. Come on stop politicising everything and sowing the seeds of discord and hatred.

      Mr Isidore is not the one who killed anyone and is on the run. Why don’t you people (political) leave the man alone. Let the court decides. They both have their legal teams. This is a civil matter.

      Oh shoots who asks for the adjournment?? The other party’s lawyer but is on Isidore’s back all of you are.

    From the last episode at the court there was a big uproar when the case was not heard.After over a month the legal team of Mr Emmanuel say they are not ready .So what was all the big fuss about a month ago?I really can’t understand the reasoning . Somebody please enlighten me.

    I would like to start by saying in the words of Shirley Allan that I wish all Dominicans, a merry Christmas, a bright, prosperous and ENLIGHTENED new year, because I do believe that we Dominicans need to be enlightend. We need to stop these personal attacks on people who express their views on PUBLIC Matters and PUBLIC OFFICIALS. We really need to learn to draw the line between Public official and private INDIVIDUALS. Oh we have so much to learn!!! I pray to God that we do and 2011 catapults us into the age of rationality and critical analysis. REASON and COMMON SENSE people!This is my wish for my people! I hope that we reagain our MORAL compass, it seems that we have lost our way there to.

We expect a lot of peope including Tony to be implicated when all the facts come in under discovery, and Tony wants to ensure that those facts are not revealved, but I am also cetain that Lennox and his team be ensure that that they are..

      When you mentioned that Dominicans need enlightenment in the New Year, are you implying that
      it should come from you and those who share the same partisan Politics as you, what a travesty on the word enlightenment. Well sure we all need enlightenment in our lives at some point but please not by you. I’m not there to defend anybody, what I’m showing is the hypocrisy and double standard you portray and them talking about enlightenment truth and fairness. The things you say i think you are only paying lip service.

If Tony decides to step in and represent Mr Isidore is there anything illegal about that, making silly comments about being not surprised about it. What is your justification passing judgment about people are going to be being implicated.         Who can aganist being enlightened? You are making assumptions as you normally do.. We all have something to bring to the table! Don’t you agree? Are you also suggesting that what you beleive is the enlightment? Let’s just put what we have outside there and just let the people analylize the contents for themselves.. Yes I agree to the innocent until guitly conecpt, but that also applies to everybody, just as ALL should be prosecuted, how can people be found guilty when there is no prosecution, there are many she should be prosecuted and the evidencxe exaamined, but they shielded by the same institutions which are supposed to be prosecuting them, so if you want to argue about equal justice under the law, be my guest.. I am talking in general terms when I say lawyers like Tony.. And to me Tony has put himself out there as a public figuere, don’t you hear his shows on q95? Don’t you read his articles? he is a representative of the Government and that my dear makes him a public offical!! Lennox is REPORTING, the facts and doing a damn good jos of it.. If he libels anyone just as Bubbles saw it fit to sue him others can do the same.. Libel is only when what is reported is not factual, and Lennox will prove that what he has been reporting is fautual or not… We lwould like to see Skerritt sue him as well to prove his innocense, but reason and common sense tells us why Skerritt will not sue Lennox so they will use poor Bubbles as the pansy!! I do not think you understand how the Judicial system works with some of the statements you have made Oh Boy! you are so laughable,Here is what i mean. You are asking a question quote “how can people be found guilty when there is no prosecution”? Well, is it not what i have being trying to explain to you all the time, and here you are asking me a question which you are guilty of doing making assumptions finding people guilty without hearing there case.. Don’t you understand the phase people are presumed innocent until proven guilty in a court of Law with evidence to support the verdict. Then when you talk about quote “ALL should be prosecuted” again another of your nonsense. A Prosecutor cannot go to court to Prosecute if there is no evidence of a crime, bearing in mind hear say is not evidence. The prosecutor Job is to prove that a crime was committed and to do that you need evidence, so when you talk your nonsense about all should be prosecuted, people cannot be brought to court to be prosecuted just on hearsay or prosecuted arbitrarily. Why is it you believe if someone does not reply to an accusation he is guilty?

          Yes, i know there are Universal Laws and Principles that Govern this world but believing in the bible and
          the 10 commandments are not the things needed to discover these truths. When it comes to morality and ethics Religion is the last place to seek and find such things, bear in mind I’m referring to the “Institutions of religion” Religion has retard human knowledge on this earth more than any other institution. it is the simple truth.. I’m not here to offend you and your religious beliefs you are entitle to what ever you believe even to as what God means to you.       Jay, there is protocol even in the legal fraternity. Tony Astaphan is SENIOR COUNSEL and therefore automatically leads a team of JUNIOR attorneys. Just like the Queens Counsel from Barbados will automatically be the lead counsel for Gon Emanuel, Letang is Cheltenham’s JUNIOR.
