The Speaker of the House of Assembly Alix Boyd-Knights said she should not have been included in a list of 25 public officials being taken to court for failing to meet a March 31, 2010 deadline to declare their assets.
Alix Boyd-Knights insists that she has, and indicated that she may take steps to protect her reputation.
She said she will be taking legal action against the Integrity Commission.
She has also called for the resignation of the staff of the Commission.
“I am finding that the Integrity Commission has acted so badly, as far as I am concern, they should be disbanded and they should all resign amass,” she told a media interview Monday.
Boyd-Knights said she holds a receipt from the Integrity Commission indicating that she filed on March 31, 2010.
“I filed using the same format that I used before. I have a receipt, I know that I filed. Somebody or some persons are trying to put me in a bad light and I have to take the necessary action. I cannot let that pass like that. If is the Integrity Commission that is doing all of this and getting their wires crossed, then they are not acting in accordance with the $4000.00 that they receive,” she said.
The Speaker has also questioned the IPO’s Commission’s ability to carry out its mandate.
However Director of Public Prosecutions Gene Pestaina told BBC Caribbean that the Speaker did not adhere to the existing rules in the papers that she filed.
“The information is that the Speaker filed what is called a statement of affairs, which did not amount to a declaration according to the act,” he explained.
Boyd-Knights is among 25 officials being hauled before a magistrate’s court for failing to declare their assets.
@Gary: The problem here is that our people are not educated on what it is that the IPO can or cannot do. The IPO is not a political body….The IPO is not in a position to listen to radio or read DNO and then take action based on what it has heard in the media… The IPO is designed to protect the interest of the people of this country which includes believe it or not, the public officials. If there is no protection for these public officials while making sure that they are not robbing the country, good people will not take up these positions. While it is in the interest of the IPO to educate the poeple on its role and function, it is also the duty and responsibility of the people to educate themselves particularly before attempting destroy the IPO or any body trying to work i the peoples interest.

The problem I have with the IPO has nothing to do with the persons that are on the list. I’m not advocating that people should not have opinions, I’m not against anyone having an opinion expressing how they feel. including you. The speaker made a statement, well she is entitled to express her feelings about the IPO and how it operates, and what is wrong with the process. Ron Green did the same also. I’m not there to defend the speaker, she made a statement, there is a process which will enable her to present

The IPO commission needs to come forward, tell the public what is going on. They owe it to the public. What is the secrecy. I hope at some time a statement will be made. It is very sad reading some of the comments posted, some people misunderstand the mandate of such a Institution(IPO), and just make wild and unfunded statements and innuendos, even to choose who they wish to be on the list and if such a person or persons are not there they scream foul play or the IPO was compromised, this just shows the understanding people have of such institution. They disregard the rule of law regarding documented evidence, all these things are thrown away and replaced with hearsay and suspicion, that is the kind of justice they want, thinking the IPO operates like a “gestapo” organization.
When will this type of thinking come to an end. Why can’t we look at things objectively and put Politics out of the window. I took some time to digest this article and the following are my conclusions and observations:
1. Speaker claims that she submitted her returns December 31, 2009 and has a receipt!
2. The Prosecutor states that the Speaker’s submission was merely a statement of affairs which is a balance sheet. A Balance Sheet in financial circles gives a snapshot of an individual or a business assets and liabilities if the T-Account style of balance sheet is produced or net worth if a vertical style of balance sheet is produced – the liabilities are subtracted from the assets. If the Assets are greater than the liabilities then a positive net worth is realized or if the liabilities are greater than the assets a negative net worth reveals itself.
3. The trouble with 2 above is that it gives broad titles in a summary form. Hence the need to give additional information similar to a company publishing its annual accounts where there is what is called Notes to the Accounts. This will show for example the heading land – it will itemize the various pieces of land that one has by the certificate of titles folio numbers and square footages and the year acquired along with purchase price and current or close to current market valuation.
4 Another item that is to support the statement of affairs must be the Funds Flow Statement – the sources and Application of funds. You see to have assets you must have cash (a liquid asset itself) to obtain land , cars, and all other tangibles or you must get a loan from a reputable source.
5. The funds flow statement must reflect all of your legitimate income sources and that can be reconciled with your income tax filings for that year in which you earned that income.
6. The Inland Revenue and the IPO will have a cause for concern if your fixed assets as well as your liquid assets are way beyond the legitimate income that you ought to have earned!!! Why? Cash is the first assets one owns and it is cash that is converted to acquire other assets. Loans will help you get an equity stake in some of the assets you acquire, but that is the reason your statement of affairs or balance sheet will show your liabilities – the amounts you owe. But the amounts you owe must be in a reasonable proportion to your income to give an appropriate debt to income ratio as well as to state for every dollar of income earned how much cents from that dollar goes to paying loans. Now it cannot stand to reason that you paying more money to repay loans than you earning!!! If such is the case you have not disclosed everything – u hiding something!
7. Now it stands to reason that the IPO has a strong suspicion and are interested in capturing more than one person!!! You see members of the IPO are Dominicans and all kinds of news reach these people ears. They are former bankers, accountants, lawyers and other professionals capable of tearing a balance sheet apart.
It is very easy as a lawyer for the Speaker to hide monies of clients that the IPO may have an interest in – politicians and their families and classify these funds as monies of clients and attempt to seek attorney client privileges!!!
8. Now such knowledge could have been acquired via hacked e-mails, telephone taped conversations or the work of a double agent – carry go bring come, or a banker exploiting the whistle blowing protection afforded unto him/her under the anti-money-laundering act!!!
9. But do not expect the IPO to state their sources to the public
10. The November case will make for interesting revelations since the prosecutor will pierce the veil of Attorney -Client Privilege that the Speaker has already appeared to lean on!!! No amount of withdrawals of client’s funds can stop such an investigation!!1 Why? The statement of affairs or balance sheet is a snapshot at a particular point in time and an accountant can recreate the events!!!!!!!
11. At a later date I will discuss the advantages and disadvantages of Lennox’s approach towards revealing what he has discovered in e-mails and why it will hurt his wishes for transparency.
12. Oh one more point: If the speaker is found not guilty by the judge, the IPO can appeal the decision as far as the Privy Council. If they do not, a citizen like Lennox can! If the Speaker is further absolved of any wrong doing then she has reasons to sue for millions of Dollars!!!

So they are paying all the staff of the IPO $4000/Month. Why do we have to be paying this kind of money when we have other groups such as “Income Tax, The FIU” doing the same job. Madam speaker, you of all people should know the contents of the act like the palm of your hand. You can sue ‘somebody’, or the ‘some persons’ in all fairness if it is evident that someone has wronged you, or failed to do their job properly. BUT if all your ranting and raving is an attempt to save face and your case is found to have ZERO merit, I strongly suggest they send you packing, go and sit down and babiyay in your office instead of embarassing our honourable house. To me that is fairplay.
Agree totally with the Speaker. This Integrity Commission is a joke. A bunch of well-paid men and women with little to do and distracting and upsetting a lot of busy people. The Commission should be disbanded; and amendments circulated for public comment before going back to Parliament. The UWP has to take some of the blame for causing it to be rushed into implementation half-baked. The thing needs lot of amendments — the net is too wide, it’s ridiculous. This just increases the work load of both the IC and those persons unnecessarily targeted. And not even the members of the IC have to make declarations. How can that be explained? Who is more “a person in public life” than members of the country’s Integrity Commission. There are a few more amendments to be made as well. As Alix says, scrap the IC now. Take another comprehensive look at the Act; let the public have a say; and start over.
Madame Speaker you now know how it feels after you consistently and deliberately cast a dark shadow on the Opposition …
… and paint them in a bad light
Now you know how it feels when somebody is incompetent and you want them fired1!
