The decision by the authorities to deny Jamaican dancehall artiste, Tommy Lee Sparta, entry into Dominica will be heading to the Caribbean Court of Justice (CCJ).

This is according to attorney Tehani Behanzin, who is representing the artiste locally.

“I have been in discussion with his managment team … they have already instructed lawyers in Jamaica to prepare a CCJ case for damages because the issue with Tommy Lee’s denial of entry into Dominica falls under the Treaty of Chaguaramas,” he told privately-owned Q95 on Monday morning. “Those provisions are decided and taken care of by the CCJ.”

The Treaty of Chaguaramas which established the Caribbean Community and Common Market, later known as CARICOM was signed on July 4, 1973 in Chaguaramas, Trinidad and Tobago.

Among its many components it acknowledges “the vital importance of land, air and maritime transportation for maintaining economic, social and cultural linkages…” among member states.

Dominica and Jamaica are members of CARICOM.

Behanzin added that there are “constitutional breaches” which will be filed in court today.

He said it appears the authorities are trying to deport the artiste from Dominica this afternoon.

“We will try to stop the deportation,” he said.

He noted that Tommy Lee was taken to the Marigot Police Station because the Melville Hall Airport has no place designated for those detained, to meet with attorneys.

The attorney stated that after Tommy Lee was taken into custody he was denied legal representation, which he said is wrong.

“Once you detain somebody you cannot deny them legal representation,” he noted. “What happen is that custom and immigration believe and feel once they hold you, then your constitutional rights all disappear. I keep impressing that upon them, you cannot deny somebody you have detained, legal representation.”

He also said the artiste was strip-searched in public.

No reasons have been given by the authorities for Tommy Lee’s denial of entry and detention, according to Behanzin.

Tommy Lee, who was set to perform in Portsmouth on Sunday night, was denied entry when his jet landed in Dominica on Sunday evening.

He was subsequently arrested after he and his entourage reportedly refused to return to their jet.

The religious fraternity here had expressed opposition to the concert saying the artiste’s music promotes violence and satanism.

Many Dominicans have taken to social media to condemn the action of the authorities.

    WELL i am not in favour with devilish music, But putting the guy in jail isn’t call for, you could have house him in cheap hotel or put him back on his jet.     Dominica suppose to be a democratic country and once again the government of this country has put us on the front burner .Tommy Lee went to Trinidad and he was allowed to have his show and the people took it upon themselves not to attend , But the bigger heads of this country had to make it look like they are doing something and things they should be giving attention like G.O.N Emanuel attempted murder ,they just sweep it under the carpet but dont worry change is coming .Where in the world a man getting bail for murder?       I am appalled at your comment after the first line. First let me deal with the abuse of the scripture that states “Judge not, that ye be not judged”. God give us authority to judge but not judge with hate. It also means we should not throw bricks in glass houses. Why do u think he allow judges in court room? The govt have every legitimate right and Biblical right to judge if he should enter the country or not, and thank God they made the right decision in his sight.
      And you r right about his equal love, but he listens only to those who turn away from their wicked ways n start obeying him. That’s the difference. And anyone who encourage a sinner to spread his sins, r as guilty as that sinner in the eyes of God, and will be judge by God in like manner.
      And yes, it is a nice way to stop the children from listening through any medium. They r now being sensitize about what Tommy Lee represents, and that would lead to them stop listening to his music.

    It is ironic we are not hearing a statement form the Minister who is in charge of immigration.The Government needs to come clear regarding such matter.Why was the young man detained and made to experience such horrendous treatment upon entry into Dominica.Did immigration personnel acted on orders from The Government who bowed to pressure from the religious organizations or on their own authority without following the standard Protocol allowed to all visitors to the Country and if so they should be disciplined.I’m sure this is not The Dominica we want to portray to our friends in the region.It is not good if The Government stay silent on the matter.This incident clearly is a violation of someone rights under the The Treaty of Chaguaramas which established the Caribbean Community and Common Market.I hope The PM was not just giving lip service to such treaty.

    If The young man was denied entry simply because of his music which was labeled offensive by the religious community that shows an attack on artistic freedom.If he was denied on a security threat then what is the evidence to support his detention and refusal for entering the Country.
    We need to have an explanation from the Government regarding such matter.

        Thank you Vincy. I reside in Toronto. I have a good friend who resides here who is from St. Vincent, an extremely nice and sensible person. We have known each other for years. In fact, we once resided in another Province of Canada. This is where we first met and are friends ever since.
        Guess what? I am a Catholic and she is Anglican. We agree on those topics. She has asked me for Holy Water. I promised to give her some. :) I will telephone her later.
        Why would the foolish Dominicans want this man to perform here? Why would they defend him and not their immigration authorities and the D/cans who stand up for them and oppose this man’s presence? As I have stated they lack godliness, common sense and good judgment.
        Whatever our religious beliefs, there are times we must come together, unite and stand up for God, His teachings and morality. This is what the Holy Bible teaches us and as the Church teaches. In this case, we have much in common. God is pleased.

      You must know the difference between expressing oneself and what is being expressed about. This is one of the issues against this man. He has a bad reputation and evil one and every country should keep him out. He was already refused entry elsewhere. Dominica is not an exception.
      Let him express his views in his country and in his home and keep it there. If Jamaicans love it, so be it but not to bring it out into the arena of other parts of the world. We also have the youths to teach and to preserve their innocence. Some of those so-called artistes are not doing that. They spew satanic and destructive words that others might follow and contaminatee the minds of the vulnerable and gullible. This is a downright mark against God Himself.
      Look! I do not want to state anymore. If you do not comprehend this, you are a fool who also lack common sense and good judgment.

    I have also noted that words are also changed when I am writing on your Website to cause errors which I did not write. This does not happen at any other time and on other Websites. I have written about this more than once in the past. I am wondering what type of system do you have?
    You should know that you will receive many responses to such articles from also worldwide. Therefore, your system should be equipped accordingly to be able to accept them without also a slow-down of your system.
    It depicts to me that you may be on the side of Tommy Lee. As a member of the Media, please do not take sides. This also includes political parties. Surely, you do not want to lose business?
    I reside in a country, if it is suspected that the Media is taking sides and denying readers/ viewers their rights by practicing preferential treatment toward them, we have recourse to the Broadcasting Association to lodge a complaint. We have many rights here. This is why the majority of us continue to reside abroad. There are very little rights in Dominica. Dominica is in need of a few.
    We also have expertise on certain matters better than some Dominicans who reside therein. I have noted the comments of some of them; a few may also reside abroad. This is for those who keep informed of what is transpiring in the countries they reside in, are willing to learn, have learnt and expanded their knowledge and are broadminded and fair.     This is the thing that people not getting here. i matters not weather you like the man music or not. i dont even care if he was worshiping the devil.The man is a citizen of a Caricom state and as such deserve the right and freedom that this citizenship provide.We are the same set of Dominican that was all over social media talking about Trinidad when they prevented some Jamaican from entering Trinidad. all the so called Christians that was bringing scripture after scripture.     I think Jesus would have dealt with this differently. He would have welcomed him and he would have communicated with him. This reminds me of the woman caught in adultery and the thief on the cross etc. The scribes and Pharisees were always eager to stone someone to death because of their actions. Jesus however extended a hand of love and forgiveness and instead of condemning Jesus used this as an opportunity to evangelize. As Christians we should do more to use these as opportunities to evangelize and not condemn. We are the ones who will be almost naked at carnival and reveling. We are the ones who forget our Christian values on carnival we the ones who drink get drunk and throw God outside during carnival time. Our actions should reflect Christ in all we do.

    By the way, the last time I checked members of CARICUM countries were allowed to travel freely from one island to another. If the guy did not commit a crime for which he was wanted and he was never suspected of committing any crime in Dominica, I cannot understand why the airport police and immigration banned the man from entering. All of them involved should be fired because something is telling me that they got their advice from Skerrit because he knows the organizers are not supporting his style of leadership. This is not a spiritual matter as some church leaders are making us believe. It is a political thingy and skerrit is just using his players to do his service.

    I don’t care what this man did or didn’t do…but the way the situation was handled was wrong.Our tourism industry is already at a down low and when this happens it will have serious implications regionally and internationally for Dominica.No one from the authorities has come out to say something to do some damage control…what a catastrophe!!!!

    It was uwp supporter, in their zeal for power, who started questioning the church and religious organizations for keeping silent on a number of issues. Calypsoes were made condemning their silence. Now they have let their voice be heard and look at the disaster that this has led us to. That is why in the US there is a separation between church and state. I hope that this a lesson to all of us. In fact most DLP supporters I know do not like Tommy Lee’s music but realized that it was wrong to deny him entry into Dominica to perform his show for his supporters. In trying to be political we create one mess after another. I hope that this will be a lesson for some. Most of the uwp supporters will just be happy that the government will be sued. It fits right into their agenda. This is what happens when we try to mix church and state. Dominicans let this be a lesson. I hope the courts send a clear and strong message. I hope this folly is never repeated.

    I have no interest in this guy but he is a member of CARICOM and the way that he is being treated is wrong. Imagine that all you have to do to be arrested is to go to another man’s country! Dominicans are scattered all over the globe. would anyone of us like to be treated likewise?. some of the same Religious community members that do not want him to keep the concert have been involved in scandal with their members that cost them their family that God established. Was there a protest?
    He needs to sue the individuals, the institutions that they represent and by extension the The Commonwealth of Dominica. People’s rights have to be respected

    Get ready for another decline in church membership in Dominica. This is history repeating – Rastafari back in the 70’s, were driven to madness and the church was in the forefront of the battle, to ensure that the movement did not take ground, therefore rendering them defeat. The church membership is taking a downward slide once again, and they are not happy. They are blaming the youth now-a-days, since the youths are not in line with their tunes of bondage.         Do not blame the Church! Blame those so-called promoters and the government politician who gave their consent to this man, knowing his reputation and refused to call off the concert.
        The Church is entitled to and has a right to oppose godlessness and immorality in the land and to do its utmost to deter such types of people from entering the country and performing. If the Church does nothing and fails to do what God expects of it, God will hold the authorities accountable. If you have common sense you should know that.
        The Holy Bible is the Word of God. It is for each one of us with no exception whether proclaimed muslims and rastafarians. God created them all but some have swayed from the truth.
        If you knew what is contained in Holy Scripture you would not make such a comment, you godless person.
        Say nothing against the Church in general lest God punish you on the spot, you ignorant person who bring down the wrath of God upon you and those others who speak ill of the Church.

    I don’t know Tomee Lee. Never heard of this dude prior to his engagement in DA. What I do know is that no artist should be persecuted for his/her form of expression. Unless I hear some justifiable reason why this was the only alternative left to the officials, this cannot be a good move, as far as it relates to human rights and the free movement of caricom nationals across its boarders. I wish we had a society where answers were given when questions asked. :-|

    Well you see Police is a kinda job in Dominica that young men and women enter after they have applied everywhere else and were unsuccessful. So what you find happening is the other jobs take all the smart students and the less intelligent ones are left to join police.

    Any man in their right mind know you cannot deny a man entry into a country because you dont like his music. Also any man of average intelligence and above know once you arrest somebody they have right to legal representation.

    Now as usual police go and do what they want. Like big stupids now is tax payers money that have to payback the lawsuit. What a country I live in. Dominicans….I wish i could leave this place and never turn back.

      Immigration is the same all over the world. If you have the necessary legal papers you cannot be denied entry. It is when you lack them including having a bad reputation according to police records you will surely be denied entry.
      Tommy Lee knows he is involved in a lottery scam and he was arrested. This may be Number One of his denial. He is also not a good influence on the youths.
      A country has a right to deny entry to such people. Consider this. That man who beat up Rihanna, her ex-boyfriend was denied entry to the UK and other countries. Did he call for a lawyer?

People around the world are reading your comments and quite frankly it is embarrassing. When the cruise ship passengers were arrested, so many of you were attacking the police and government until another passenger came forward and said that the actions of the police were justified. I find it hard to believe that someone in authority would give orders to detain the man for no reason at all. Let us just wait until we get the details.

      Be careful when you make statements about people especially when they have passed on. They are not here to defend themselves. You should know them thoroughly prior to doing so.
      You did not know Miss Charles. She was a lady of good character, dignity and morals and a no nonsense PM. In the end she was not appreciated which is why when she was not re-elected, Dominica got a bad and non-caring PM who cared only for himself, his pocket, and not for Dominicans.
      If you reside in Dominica, keep that in mind when you go to the polls next year. Vote wisely for the right PM who has done the most for Dominica and nationals. As some of you want change, you are not smart to recognize good change and bad change. You cannot see beyond and to detect people’s motives. Be careful you are not punished along with nationals this time around and in a worst manner.
      Miss Charles did not mean that a country has to let in all types and undesirables who have police records and their immoral, ungodly performance.
      If Miss Charles were still the PM she probably would, from the beginning, in no uncertain terms, put her foot down and out rightly inform the promoters of this concert and immigration that this man was not welcome. He would have been so notified and would never have flown to D/ca much more to set his feet down on it.
      They must adhere to rules and regulations of the land. If people have questionable characters and are involved in illegal activities, arrested by the police and indulge in other disreputable matters, each country has the right to deny them entry. Which country will welcome them?

      The last thing Dominica and nationals want is a man as he to perform in Dominica. Thank God he was denied entry and will not perform in Dominica, hopefully never.

    If religion wants to speak out against what is wrong then why did they not speak out when they heard of the many criminals that bought our passport? Why did they say nothing when a very popular pastor closed his church, one of the biggest churches in the island, a Pentecostal church on a Sunday morning so he and his members could attend a DLP convention during the 2009? Why did they say nothing when that same pastor dressed in his Red suit, decorated his church in RED, his members dressed in RED, other pastors including the Bishop dressed in Red, on a Sunday Morning to celebrate the DLP victory? To me, these things along with the other ungodly things that they were quite on affected the well being of Dominica more than anything I have witnessed. If it were Skerrit that organized Tommy Lee Sparta to perform during a DLP convention they would say nothing and some of them would even follow the crowd to the convention. So trying to impress now makes no sense.

    Once again two very common organizations are in play…politics and religion. Once again I am not ashamed to say that I am a born again believer that is fully sold out to God but I cannot stand hypocrisy. I don’t believe it is the role of the church to get involved into the negative politics that they are involved in. Now if they were standing up against all unrighteousness, then I would understand them and would support them. But when they want to play pick and role in the name of God, that I disagree with. Do I know or support the artist? Absolutely not! I don’t know who this chap is and neither have I listened to any of his music. Why did they (pastors) arrange to have a private meeting with him with the view of winning him? Why help denying him entry to Dominica? Have we become the police of Dominica? If they are concerned about music that promotes Satanism are they saying that other foreign artists that are not so labeled always promote God? No, I am NOT in support of this guy not because of his music and what it promotes but simply because I am a believer. The pastors need to preach the word, leave the word and grow up. I have heard and seen pastors criticize and even match against homosexuality and abortion. But guess what? Some of the loudest voices are secretly practicing homosexuality and some pastors that living in secret adultery, pay to have abortion performed to cover up their sin. Am I saying we should say nothing? No. I am simply saying to stop dealing with issues that Christ died for and instead preach the solution.

My god if they did why it is that the immigration authority cannot give a reason for their action. Felix Thomas you guys are so out of touch to recognize that we are not in 1970.       The immigration department must act on the basis of LAW. A solitary immigration cannot refuse a Caricom nationa entry into Dominica because he feels like it.       There are ignorant Jamaicans, many of them who care not about their Jamaican Law and there are some Jamaicans who are not ignorant who will concur with what the Dominican immigration authorities did. Just as Dominicans as you, some ignorant and others not ignorant.
      The non-ignorant ones who are on the side of justice and peace will agree with the Dominican immigration authorities.
      Keep in mind there is a Jamaican Law and Jamaican immigration authorities and system. Why did they arrest Tommy Lee for a lottery scam? It is because they are the Law.
      The man may still be under investigation. If so, he should not be allowed to leave Jamaica and to perform in another country. In this case (also) it is rightful to deny him entry to Dominica.
      So he is fighting Dominican immigration authorities and the Law of the land. As God knows too well, some of you have no morals anyway to stand up for that man. You are also godless. I hope you are not practice Christians.
      If he arrived in Canada, US or Europe he would also be denied entry. If he was so bold as to refuse to return to his jet, he would be held in a detention centre and never allowed to leave there until he was deported. What would he do about that?
      Since you are so blind to the Law of Dominica and its rights, you better speak to the D/can immigration authorities and/or wait for their version why they denied him entry in Dominica. It is not without reason which limited minds as yours that lack godly enlightenment cannot fathom and never will.
      The Jamaican colleges/universities authorities will not interfere in this nor will the Jamaican immigration authorities especially where a lawless person is concerned as this man. They have better things to do than defend one as that man and stand up for him. He is beyond their status.
      If the authorities of a country deny someone entry, they should not be bold and strong on it to defy the authorities. This man showed lack of respect for Dominican Immigration and its authorities. He may have had an idea that this would occur and planned it with his attorney, should it occur. This is why he boldly and defiantly did not return to his jet as ordered by the immigration authorities.

      The majority of D/cans did not want him performing in our land. Just who he think he is? He heard about D/cans position. He could have bowed out and gracefully too from this appearance. This would have saved him much and all other problems.

After this controversy broke I googled Tommy Sparta and had the opportunity to watch a 15 minutes performance and found him to be positive. He denounced violence and clarified that his stage persona has absolutely nothing to do with his personal life. It is all entertainment. He also asked that he not be held responsible for the actions of deviants who choose to act recklessly.     Too often in the Caribbean, so called “Pressure Groups” force our small governments to live up to their wishes ignoring the commitment of these countries to regional and international treaties and conventions.

    I sincerely want the artist to sue the government of Dominica in other to teach the rest of the region a good lesson as if the recent Myrie case was not enough.

    At most, the religious fanatics could have persuaded their followers to boycott the show but NOT to dictate to the state that the artist should be denied entry.

      Any island in the Caribbean (through its immigration department and foreign affairs policy,) has the right to deny any visitor that they may deem unfit, to enter. And if they also believe that this individual would also cause some form of instability in said island.

      Though all the islands should adhere to such treaties, one must also safe-guard its own interest. And if there is a legitimate reason to deny entry, so what. Take it to the courts and let them decide.

      The Myrie case is totally different.

      The law has no emotional component. As a Jamaican, a CARICOM member, the authorities must have good reason to deny him entry into another CARICOM nation. His brand of music is not good enough reason. Your taxes will go straight to him after he sues the country and wins. Many of our people go to Jamaica to study. I was one of them. The immigration there always respected me. That my countrymen could not do the same for one of theirs is sad. And you all too hypocrite. Most Dominican women have children out of wedlock. A lot of men cheat on their wives but you all will pick the sins you want to protest against. Please.

    So the Christian community can be guaranteed a victory if a gay ship attemps to visit DA…we cant afford to lose the vote of the Christians. I do not support Tommy Lee lyrics but we are too selective when it comes to wrong … politics is the order of the day.

      Do you have any intelligence? THINK GOD AND WHAT WILL JESUS SAY? This is what you have to be concerned about. God does not condone sin. He knows he has many enemies in the world to their detriment and eternal banishment and punishment. Tommy Lee is one of them if he keeps up his evil ways. He cannot go before God with a name that means Satan, the enemy of God and all those tattoos on his body which obviously represent Satan.
      The man is a follower and worshiper of Satan. This is another reason we should have to fear him and not want him to perform in Dominica. He will also leave this dreadful and destructive enemy in Dominica and among the people who especially would have attended his performance.
      It appears that you are devoid of God’s blessing. If you do not know the difference of right from wrong, you have a huge mortal (moral) and spiritual problem. I feel sorry for you.
      St. Paul’s writing in the New Testament, through the inspiration of The (God’s) Holy Spirit has told us and taught us against homosexuals and their practice of homosexuality.
      By no means is God pleased with such people. Their so-called marriages, even the Law foolishly allows it, they are not blest by God and never will. Keep in mind the Law is not God even though, in some cases God approves what the Law has instituted if it is for the benefit of nationals but not this one which highly offends him. It is a curse upon them. You need the Church to teach you about this.
      They try to silence us for they fear that we will inform them accordingly and more. We know as contained in the Old Testament that God destroyed Sodom and Gomorrah for this same evil practice. To say more will take longer.
      You need God’s graces and enlightenment to comprehend this for you and others who feel that he should be welcomed to perform, you lack godliness and comprehension. Pray to God to grant you his graces and enlightenment.
