Woman withdraws complaint against accused murderer

A woman who brought three complaints against a Grand Bay man charged with murder, has withdrawn her case against him.

The woman, who appeared before Chief Magistrate Evelina Baptiste this morning, said that she was no longer interested in pursuing the matter against the defendant.

The young lady, earlier claimed that she was beaten  and wounded by the defendant in an altercation on April 17, 2009. Since that incident, the accused man has been remanded for the murder of a man from his community.

The woman assured the court this morning that she had not been beaten, threatened or promised anything to withdraw the matter against the defendant. The man had also been charged with malicious damage for the April 17 incident.

“Since then he apologized and we kind of settle out of court,” the woman told the magistrate.

“Aren’t you concerned that he will behave in that way in the future?” Magistrate Baptiste asked the young woman.

The young lady hesitated before answering, “Well, I don’t understand the question…”

When asked again she stated, “I think it was a onetime random situation… I have never witnessed any violent behavior otherwise.”

Before granting her request Magistrate Baptiste stated, “Apart from imposing penalty, the criminal law seeks to rehabilitate… it’s not just about you. It’s about anybody that come (in contact with the defendant). I’m concerned that there’s too much of this behavior going around. Too many people being attacked, too many people being killed. I hope he is going to use it as an opportunity to assess his behavior and not to reoffend.”

Baptiste then told the defendant, “I am going to dismiss it, but I want you to be sure that you have some sense that you will not behave like that again.” The defendant answered yes.

The defendant is currently on remand, awaiting his murder trial, at the Dominica State Prison.

@d/ca in j.a,,,,, it real funny how u mentioned n.y but left out the others that i pointed out,,,,, and many more cities which have strict laws but a increase or insignificant decrease in crimes,,,, i dunno know wat i talking bout? hhhhhmmmm any parent that want to have a firearm should know that it have to be in a secure place away from the reach of children,,,, any responsible parent knows that,,,, my point is that,,, there’ll always be crimes love it or hate it and criminals will always have firearms,,,, like i said criminals hate a dirty job,,, they want it clean and fast,,,,, if criminals know that every citizen has or can have a firearm they’ll less likely to take the chance of attack because they would not like an open of fire,,,,,, i gave my reasons in an earlier post so u can check it out below,,,,, AND D/CA IN J.A,,,,, i hope u not from the ghetto or rough parts of d.a,,,, D WAAY U IMPLYING HOW GHETTO YOUTS KILLING RICH MAN FOR HIS GUN LOL,,,,, i’m a ghetto yout and i’m not a criminal so please do not classify us as criminals,,,, u could simply have said delinquents,,,,, u r supposedly studying(good 4 u),,,,, don’t try n spread them irrational racial slurs hhhhhmmmm

    @ mouth of the south:

You don’t know what you are talking about!! Since they imposed tougher gun laws in New York crime has decreased. Murders have been down for like 10 yrs in a row in NY if you don’t believe me go look it up.

Giving every citizen a gun is pure insanity and is a completely ridiculous and naive statement!! Jeez!! First of all, a law-abiding citizen CAN obtain a firearm, once that person goes through the proper background checks and training. So y r u acting like its illegal or impossible for someone to arm themselves?

Secondly, if you just go around giving people guns, what you will end up with is serious gun crimes. In j/a over 80% of murders are committed by guns. Guess what happens, rich man buys a legal firearm, ghetto yout run up on him and shoot him dead, simply to steal his firearm. They kill cops in j/a all the time as well to get their guns.

If you’re armed and someone wants to rob u do u know what happens? they shoot u dead b4 u can draw on them. What could have been a simple robbery and u lose ur phone and some money, life goes on, u could end up losing ur life!!

Plus u’re talkin about situations where you have a domestic dispute, there’s a gun in the home, more likelihood of spouses killing each other. Kids finding their parents guns and using it to commit crimes or accidentally shooting themselves or family. I could go on and on but i think u get the picture…

Well Bush could not say it ‘fool me once shame on you, fool me twice, shame on me…’ but that is the reality. HMMN… interesting… man on charge for murder and people taking back other charges??? The magistrate made a valid point… I wonder if the woman thought through what she was doing before she did it! Because, I tell you, maybe she in a forgiving mood, but why now???

@CELUS u made a valid point but,,, my belief is that,,, the GUN itself is not the problem,,,, its the person holding the gun,,,, my belief is there should be a law allowing everyone to bear arms,,,,,, simply put,,,, because there will always be criminals love it or hate it,,,, they will always have guns and god forbid,,, they’ll commit a crime and escape free cause they may afford the best defense lawyer,,,,,,

EVERYBODY SHOULD BE ABLE TO BEAR ARMS,,, WHILE WE SAYING NO GUNS WHILE U CELUS THE GOOD CITIZEN GOING ABOUT UR BIZNESS NOT CARRYING ANY GUN,,,, A MURDERER OR THIEF WHOEVER IT IS,,, RUN UP ON U,, TRY ROBBING U,,, END UP IN A SCUFFLE SO HE PULLS OUT HIS GUN AND HIT U 3 TIMES IN THA CHEST AREA,,,, NOW U DEAD,,, UR KIDS,WIFE AND FAMILY CRYING OVER UR DEAD BODY,,,, NOW THAT’S NOT PLEASANT,,, THE GUY GONNA GO TO JAIL FOR 5 YEARS ON A MANSLAUGHTER CHARGE,,,,,, U SEE WHERE I’M GOING,,,,,,

THERE’LL ALWAYS BE CRIMINALS,,, SO THE LAW ABIDING CITIZEN SHOULD BE ALLOWED TO PROTECT HIS OR HER PROPERTY,,, BECAUSE THE LAW ABIDING CITIZEN LIKE CELUS WILL NOT GO ON A SHOOTING SPREE,,, HE/SHE WILL NOT GO OUT N ROB,KILL OR CARJACK SOME INDIVIDUAL,,,,, BEAR IN MIND THE STATES THAT ALLOW BEARING OF ARMS IN THE U.S.A IRONICALLY HAVE THE LOWEST CRIME RATES LOL,,,,,, WHEREAS NEW YORK(MAYBE THE STRICTEST ON GUN LAWS),,, CHICAGO,, BALTIMORE ETC HAVE SERIOUS CRIME INCREASE,,,,, U SEE IF A KILLER,,ROBBER WHOEVER KNOWS THAT CITIZENS CAN CARRY ARMS AT ALL TIMES THEN THEY’LL NOT TAKE CHANCES TO DO A CRIME CAUSE THEY’LL EXPECT A RETURN OF FIRE AND NO CRIMINAL LIKES TO ENTANGLE IN A BATTLE,,,, THEY WANT IT CLEAN AND FAST NO HASSLE,,,,,,,,

That woman was definitely coerced into withdrawing her charge. Witness intimidation is alive and well i dominica.First of all, dominica needs to create a gun law that efectively says : If you are caught with an unlicensed gun in your possesion, you will do ten hard years without release for good behavior, period!! If you are caught a second time for the same offense, you will do twenty years hard time without early release; you see where i’m going with this. A gun amnesty needs to preceed this law so as to put the so called “career criminals “on notice.
