The management team of 2013 calypso finalist Dexter “Derose” Peltier, has asked well-known calypso judge, Patrick Pemberton, to exclude himself from the judging panel of the 2013 calypso finals.
Pemberton was a guest recently on privately-owned Kairi FM where he reportedly criticized Derose’s song.
This is not going down well with the calypsonian’s management team who made its position known in a letter from the law firm of Joshua Francis to Pemberton and copied to president of the Dominica Calypso Association (DCA), Kelly Williams, and co-ordinator of judges, Ferdina Frampton.
According to the letter, Pemberton said on the show, “I remember that there was a line in the song before Scrunter that said a calypsonian was paid….”
Pemberton has until ‘Midday on Thursday 7 2013’ to respond or legal action will be taken against him, the letter stated.
“Our clients are of the opinion that you exhibited poor taste and unprofessionalism in appearing on the afore-mentioned radio talk show, hence raising issues of conflict of interest and putting into disrepute your role as a Judge of the DCA 2013 Calypso Finals,” the letter states.
It continues: “In view of the above, we have been instructed to make it abundantly clear to you that your decision to make certain comments on the said show has raised the possibility of your favoritism and bias as a Judge for the 2013 Calypso Finals. Our clients are of the opinion that you will not dispose a fair treatment to ‘Derose’ at the DCA 2013 Calypso Finals because of your expressed ‘personal bias,’ ‘and prejudice’ against “Derose” and ‘conflict of interest’ in the public arena.”
The letter stated that the position of Pemberton “as a judge” has become “untenable” and that in the interest of the integrity of the DCA 2013 Calypso Finals, he should recuse himself.
“In the circumstances, we respectfully ask you to consider the ongoing controversies which have mired the Calypso season thus far, and in the interest of the integrity of calypso and calypso lovers, you would behave impeccably and cure your action which appears to have tarnished your reputation as a Chief Judge by relinquishing your role as a Judge in the said show. Should you fail to respond favourably by Midday on Thursday Feb 7, 2013, we have been instructed to consider the appropriate legal action to settle this matter,” the letter stated.
Derose is known for his song this year, “Ba Yo Babalen.”

Whether he may be able to put aside his obvious bias on the night of the show doesn’t even matter at this point. He may be able to rise above and judge fairly at the show but the fact that there is an appearance of bias is the issue at this point. He should not have made the statement that he made and the fact that he did means that he should not be judging the show.
Seriously ? Whatever ever happened to the fun of calypso. It is getting too serious..People analyse the calypsos all the time and as a judge he has the right to JUDGE the song. Derose should take the judge’s advice. This is just stupid and those lawyers more soutiweh. Not like Derose could win anyway.

Are we saying that because Pembo made the comment that he is bias towards Derose and that the other judges who did not make comments are not bias at all? Our socialization, circumstances, environment, religion, level of knowledge etc makes us implicitly bias to one topic, subject or another even to a race and a nationality. And that implicit bias can affect the way people evaluate a job candidate or as in our case judge a calyposnian.
Regardless of what Pembo said or did not say there is always a level of implicit bias as an individual and by extension as a judge. So what is all that hue and cry about? We really idle in this country, making controversy about everything and nothing. Please my people get real.
Yes Pembo is being biased and the comment you made about the other judges is rather ridiculous. If the other judges are bias, we do not know because they did not go on the air and publicly announce it but Pembo did. So he needs to step down!

After reading this letter from the lawer i think the judge should not judge the finals this year.but i would suggest that we have a new set of judges for eliminations/ quarters/ semis/ and the finals i think we will get better results during the season and less row- row.i think the judges we have now are to comfortable and there mind are set as to who they want to be king.please don’t kill calypso it is sweeeeeeeeeeeeeeeeet.
I did not hear the Linton show and so I cannot give an opinion on the above quote, supposedly from Mr. Pemberton, without first understanding the context in which it was made.
I did, however, hear part of Matt’s “Hot Seat” show in which he replayed a recording from Mr. Linton’s show on the weekend past. It seems Mr. Linton had discussed the Pemberton affair and was very suggestive to the Derose management that it should act.
I find it highly ironic and utterly reprehensible that Mr. Linton, would now cry «bias» and “prejudice” and suggesting to Matt, the said manager of the calysonian, to act against Mr. Pemberton. Let us recall …
1. Mr. Linton does not think that the IPO Commission is tainted and biased against the PM although he knows that it contains some of the most ardent critics and, some would say, enemies, of the PM. In fact, in his eyes, this Commission is good enough to «judge» the PM.
2. Mr. Linton sees no evil in his public use of information that was leaked from the Commission, in flagrant contravention of Section 21 (1) and (4) of the IPO Act. The immediate effect of this leak is to hijack the process by implanting biased opinions, inferences, and suppositions in the minds of the public and whichever Commissioner cared to listen.
Yet, Mr, Linton, at least publicly, cannot see the bias against the PM that is entrenched in this present process. However, he quickly sees bias and prejudice in Mr. Pemberton’s statement. Mr. Linton is in no moral position to point that finger. He claims to speak for integrity and all those warm fuzzy concepts, but here he is publicly showing that his understanding of “truth, justice, and integrity” is warped; twisted, even! Are his double-standard and hypocrisy (I am being kind here) the type of integrity that he wishes for Dominicans?
I suppose an act is fair or just depending on who does it, and a patriot is a “patriot” depending on which side of the fence he sits. Like I always said, Mr. Linton’s definition of justice does not extend beyond justice for himself and his associates. I will now add, that his vision of justice indeed CANNOT extend beyond himself and his cartel. One day I will tell you more about this extension.

Hello sweet Dominica. Well based on what I read in this article I must agree that the judge should step down. He can no longer be fair to the contestant after he criticize his song or even if the judge feel that he can be fair . He must still recuse himself because he already pass judgement on the contestant song although the contest has not been held. So Mr Pemberton please do the right thing otherwise DCA will have to suspend you from judging the competition. Mr Pemberton you placed your self in this situation and you should have known better because you are task with being impartial as a judge.

As a calypsonian who made it to the finals, if a judge would criticise my song i would look on the positive side and make the necessary changes. Change the line!!!! Fix the song, make it good. Stop all this negative vibes and grow up. I know of judges who have spoken to calypsonians about their songs to try to get them to improve on it and guess what, they turn around and hate the judges.

he stripped Hunter, Ras Kelly and Pembo. I heard the sound bite as it pertains to Pembo, Pembo was responding to a statement made by Kelly that the line in Derose’s song about a calypsonian being paid to sing the anti-GON song maybe libelous. Kelly was struggling to find the word and Pembo gave him the word. I am sure most of you here never heard the interview. Lennox pushed and pulled the issue and here you have it Pembo is being burned at the stake. Lennox is doing as if his kith and kin have no maypwe or dirty linen..those of us who went to Goodwill School in the 70s have some very unsavoury stories to tell…he better go and console his dying father and stop picking fights with everybody; give another man a chance. First and formost let me say that it waqs the same Pemberton that was on the pannel that Derose got in to the finals .if i had been a judge he would not be there full stop and the only thing that got him there as the candles that were lit on the grounds and some of the judges took that as a form of presentation and aawarded him ppoints for that.Secondly the so called LYRICS is very poor,i see nothing wrong in Pemberton talking about what he thinks as inflammatory in the ensuing sentence.As a former judge i have personnaly called on a few calypsonians and told them where they had gone wrong ,I can make mention of Sye,Hunter Scrunter ,Checker to name a few,and that they were very happy about it ,The media has caused Hunter to withdraw from this years competition and in the very same week he won the Police Calypso King Competition,with the same song i think,If i do know this gentleman i do not think this is going to worry him at all. Calypso and Calypsonians are judged only on the night that they present and performntheir songs on the night of the performances,it was the same chief judge that judged him from scratch to where he is at the present why no one ever sain that he was to step down.Lyrics are Lyrics and then after Scrunter Sang he was Booooood and the radio talk show s never comented about that if they did it was in support of the crowd Pemberton is already rescued so i do not know why he has to rescue himself anymore.

As far as we know, that may be true, but a good lawyer can debate that this still remains an assumption, thereby introducing the frivolity defence.

What if Pembo was speaking the view of the other judges as well? It could be a risk to ask him out when the others may take offence and right him off.

obviously a judge of the calypso show caanot publicly critize a calypso. think dominican think. let me put it in basic terms, if you are going up for a queen show or some paegent and u overhear a judge say you are too ugly to be in the competition. would you want that judge to be in the panel of judges assessing you. obviously that judge will be bias because he has already said you are ugly. just an example to try to make u understand, then again if u are blinded then…..

I disagree with that view, especially the part about foreign judges. The judge should be able to identify with the issues/messages in the songs, something which a foreigner will find difficult. Would a judge from trini know for example what caressar is talking about in his song?
I have alot of respect for mr. Pemberton, I think he is a man that many in Dominica can look up to, but considering what was said he is not qualified to be a judge at this year’s Calypso finals.
But Pembo was a judge at the semi finals and Delrose made it to the finals.I’m sure Pembo had the same view on the calypso at the time. Delrose you made it to the finals, the furthest you can reach. Crown? No way.

Best DCA cancel the Calypso show wi, cause before Saturday night, they will find another issue to cry about. I have never seen Calypso in so much controversy. Never has it been to that extreme before. Its ridiculous!! I have no taste for Calypso again.

Such ignorance helps promotes the divisiveness that’s destroying the country today. How can one dignify him or herself with so much hate? It is disconcerting to say the least of the state of affairs in our little Dominica.
I heard the program and what Pemberton said was in very poor taste. As a judge he should know better than that.
Mr. Pemberton even if you thought that way about a Calypsoian, you dont say that in public as the CHIEF JUDGE. SHAME ON YOU! Please recuse yourself in the interest of CALYPSO.

But let’s not get it twisted – a personal opinion need not bias one’s professional conduct. For example, if I’m not mistaken, Pemberton served on both the Quarter Finals and Semi Finals judging panels, and Derose still made it to the finals.
To me, it is then obvious that either the protocols set up for fair judging are working well (well enough to make it so that Pemberton’s “biases” do not keep back Derose) OR it could mean that Pemberton keeps his personal opinion at bay when he is judging.
OR, it could mean that the scores of the 5 or 6 other judges made up for whatever bias he may have held.
There is o doubt that he has prejudiced his position as a chief judge ans should step down with immediate effect. I am rather surprise that Pembo would make such comments, taking into consideration his position. He has to go now!

I think we’re finally becoming alert and have begun the process in not ‘laying down’ so we can be taken advantage of. Many may view this as a ‘roro’ by DeRose who’s manager is his brother, Matt Peltier, most criticized talk show host on Q95. But calypso is big man thing, and is an even bigger money thing.
We all have our favorites, and Mr. Pemberton is no exception as he too is human. It’s unfortunate he got caught up in the hype and took to air his views next to the anti – Mas Camp Ras Kelly on the anti Mas – Camp Kairi FM (who coincidentally doesn’t air songs from that said camp)
As for the competition, DeRose chances are good as mine but you never know he might put on the performance of his life and elevate into the top four if the usual suspects (Dice, Karessah, Chess, or Bobb) fail to execute exceptionally.
With that said, Mr Pemberton should kindly withdraw himself from the panel and if he fails to do so then the coordinator should do us the service. If that too fails, I’m sure the court (once not influenced) will make the right call. Anyway calypso must go on and no DeRose or no Pembo is going to stop us.

Why is it that Dominicans just refuse to see the facts with this case as a judge he had no right to air his opinions regarding any of it while still on the pannel he was wrong therefore he should step down he had all the time to give his opinions after the final show is over why did he say those things And what about this Calypso that is touching so many nerves it’s a good one regardless if goes thru or not.

Very good. I wish Dice would have done the same cause there are certain people who stated clearly that they doh like Dice and they put this same person on the judges panel. I know of a certain person who does not leave in Dominica, but comes home for carnival and he judges sometimes. The way that person talks as long as he is a judge, Dice could never win a crown. That is so wrong.
