EXCERPT: ‘Derose’ management team/Patrick Pemberton matter

The management team of calypso finalist Dexter “Derose” Peltier has asked Dominica Calypso Association (DCA) chief Judge, Patrick Pemberton, to exclude himself from the judging panel of the 2013 calypso finals.

In a letter to Pemberton, from attorney Joshua Francis, Derose’s team said that Pemberton “exhibited poor taste and unprofessionalism” when he appeared on Kairi’s Heng Program and allegedly made certain remarks about the calypsonian’s song.

They said issues of conflict of interest were raised and Pemberton put his role as a judge in disrepute.

Pemberton now has until midday Thursday to respond or legal action will be taken.

Below is the excerpt from the radio show which generated the entire controversy. The show took place on January 28, 2013.

The dialogue was between Pemberton, host of the show Kamala Jno Baptiste-Aaron and DCA President, Kelly Williams.

    From what I read, it seems the hosts were discussing lines that could cause you to get sued. Over the years we have had many, many songs that calypsonians could get sued over. Many of these have gone on to win the monarch title (eg. Puppet man), road march (Eg. Run Solomon) and monarch of the tents (Eg. Pastor Rod). Were the libelous songs hurt by prejudiced judges? What about songs that are political or against the Catholic Church? I never hear requests to remove known political persons (like Lennox) or religious persons (like Fr Thomas) from the judging panel on the grounds that they will discriminate against these songs.

    Why then is Derose Management insulting and discrediting the judging panel with insinuations that they are biased and that they cannot be trusted to make objective decisions? Are we saying it is only wrong if it is directly spoken; that no other factors demonstrate possible bias? Everyone has bias, my friends. What we trust is that the panel judges the show solely on the agreed-upon criteria.

    There was no criticism of the calypsonian. Frankly, it was just a word of caution to him.
    To now turn this thing around sounds like bitter taste in your mouth Delrose. Just relax, light your candle and pray that you avoid last place in the competetion

    The audio clip should accompany the transcript. It also imputes that it was Delrose line than caused the booing of Scrunter. In the absence of the audio clip, this selective transcript will surely misleed anyone since it pales in comparison to the tone of the audio clip in itself.

    Pembo’s legal team will sulely be singing praises to DNO for “lightening” the load of their back.

    As the president of the Calypso Association Kelly should not have voiced any opinion on the song. He is a finalist. I wonder if he was being genuine when he gave his criticism or if he had ulterior motive to destroy the song of an other fellow competit I would have felt or. In the three-way conversation, Ras Kelly said the most.

    As a judge Pembo should have known better. He should have kept his opinion to himself. I would have felt the same way if I were Deros.

    I cannot get it??????? I don’t get it???? I read and reread and what is the issue????? I don’t get it?????? Making a mountain out of a molehill?? I still don’t get it??? Everything little thing now is a controversy. “that could have been a bit inflamatory”. Can someone not give their candid opinion. That is a non issue. foe I can say that I love Derose song but a line can be inflamatory but that doesnot mean that I don’t like the song?? That is why we love or adore persons so much that we cannot tell them that they are wrong. Howbeit we say is our children so we supporting them even in the wrong doing? From this we have to learn to be adults. I love my children but if they wrong, I have to let them know they wrong with love or else they can bite your ears when they really land in trouble.

    so if the Judge say that a line is inflamatory, the singer should listen and probably twist the line not to be “inflamatory”. Peopl should try not to get sued or in trouble when they sing. The bottom line is respect for others even in calypso.

    Hmm, what I deduce from all that is the chief judge was stating that there is a line in Derose’s song that says a calypsonian was paid and that could be a bit inflamatory…..right? If I am, can someone please explain what did the chief judge say that was wrong that warrants legal action to have him recuse himself from judging the finals?

    I think the calypsonian should take heed and adjust his lyrics (if this is the case of course) in order to avoid being sued

    Mr Pembo should have taken the high road. He should have said “the quality of calypso this season has been great. There is always room for improvement but we are continuously improving the artform”. He could have gone the other way with his comments, off course, but very general.

      The chief judge just said that particular line in the song could be libelous. He never said Derose song was not good. To me it was more a word of caution to the calpsonian rather than a criticsm to his song. This was taken in the wrong context by Derose management team and I see no reason why the chief judge should step down. Maybe it was an oversight by Derose management team not to see that line as libelous. Derose and his management team should rather thank the chief judge for pointing that out to them because later down the road he may be faced with a lawsuit if he does not restract that line

        Yes die hard that is my understanding too as you can see from my comment. We must listen to people when we are cautioned and not take thing out of context. That is what we are sowing for our children to see that they cannot be corrected at no time. If we heed correction just as we heed the word and commandments of God, you see later down, we get ourselves in trouble.

        Now I am not happy that certain individuals takes petty mole hills and make mountains out of it sometimes and lead those who are a little less intelligent than them astray. We all need correction at some point in ourlives. Yes we do since we are human beings and we are not perfect.

    Wow! What is the role of the calypso association, really? Shouldn’t it be to represent the calypsonians, look after the interest of the artform? My point is this: Although calypsonians may have different writers, managers, come from different tents etc… at the end of the day they represent the artform and what we wish to put out there to the wider world. So perhaps the association should get a team of lawyers to preview the songs and to ascertain that there is no libelous content before they are released. But to comment, as president (and a finalist) about the content of the mans’ song is not right. Further to return to the Derose’s song; the calypsonians’s name wasn’t mentioned, nor the names of those who allegedly paid him to sing that song. We have heard much worse in calypso; calling politicians, lawyers and doctors’ names.

        The President have a right to his comments but while he is on the judging panel he have to stay away from making comments and especially on the Air the only time he can give his opinions or make comments is after the final show he didnt wate so you see no one is saying he shouldnt but the method in which he did it is not proper

      Who sang the calypso that presents an entirely different picture of what Derose was saying about ‘Follow”. The worls knows it is Andrew :Scrunter” Bazil”. Only IKR seemingly did not know that Scrunter sanga song alleging that it is “you follow diffe’ that bwilley you follow”. A total opposite to what Delrose was presenting.

      Let the lawyers contend in a civil court of law. The boggers cannot help Derose of Pembo.

    What I am getting from that dialogue sounds like a critical principle all judges have sworn an oath towards!!!

    So the management team of the rookie calypsonian may not be able to get to the bottom of this after all.

    The other point I want to make for the public to bear in mind is this: The chief judge was given mid-day Thursday to step down leaving a day and a half with an unintended outcome to allow scrunter the legitimate right to place an injunction on Friday to the rookie’s song and make him tremble.

    Right thinking persons must stand up and urge Scrunter to place that injunction rightly so on this guy.

Whether Pembo is sued or he recuse himself from the show, this action or non-action will have little or no impact on the lives of Dominican. So let’s move on with the things which add value to life.

      A few lines before that then someone else will ask for a few more lines. When will it all end. There will always be a problem. Someone once said put some sheep a Shepard and a wolf in a field. The sheep will praise the Shepard for saving their life whilst the wolf will curse the Shepard for depriving him of a meal. In the end who is right? In this whole controversy we see what we want and no matter what is said or done it won’t end.

Personally, I see no reason for all this useless talk. There are so many other things to be addressed in our country. I think both sides should apologize to each other and move on.
