Former president of the Dominica Football Association (DFA), Dexter Francis, has filed yet another lawsuit against the association claiming it has breached its constitution by wrongfully suspending him as a member.

He also accused the association of “refusing his right to a special conference requested in accordance with the said constitution; refusing to hold elections for President of the DFA and refusing to agree to, or appoint a Tribunal to hear his disputes.”

In the suit Francis claimed to have been a member of the DFA “in or about 2005” and the association had no grounds to suspend him.

He further states that the DFA, through its Board of Management, further breached the association’s Constitution “by failing or refusing to hold elections for the post of President, but rather declaring that Glen Etienne would hold the post until 2015.”

He noted that to have Etienne continue as president without election the DFA “is also putting into jeopardy every decision made by the Board of Management on behalf of the DFA and its members, of which he the Claimant (Dexter Francis) is one, since such decisions would be null and void.”

Francis noted that by allowing Etienne to continue serving as president “the DFA is also putting into jeopardy its legal standing with the Federation of International Football Association (FIFA), which requires its affiliates to abide by their own constitutions.”

The former president, through his lawyer Noelize N. Knight Didier from the firm of Harris & Harris, is also seeking declarations that Etienne “has since June 22, 2012 not been the constitutionally elected President of the DFA” and that he (Francis) was not “lawfully suspended from the DFA and as such is seeking an order that his membership in the DFA be re-instated retroactively from March 4, 2013, and prescribed costs.”

He is seeking an order from the court that the “DFA holds a Special Meeting for the purpose of lawfully electing a President.”

This is not the first time Francis is suing the DFA. In 2012, he filed a suit claiming that the organization owed him arrears of salary for the months of December 2007, January, February and March 2008, plus two weeks vacation.

The matter went to mediation and a settlement of $12,000 was agreed upon.

    Come on Dexter…you presented your case at the last DFA meeting. While members understood your case of disregard for the Constitution- in the interest of moving forward, we supported the move to have you ejected from the meeting.
    There was a settlement reached……now, this!
    My brother – while you have my support on the issue of the President we can’t continue to be interrupted at your whim. There is work to be done and some of us are working too hard to see progress in football, for us to continue to be supportive everytime you want to see more chaos than already exists within the DFA.
    Find another playground Mr. Francis……trust me when I say that members are growing weary and wary of you and your intentions.

    Look closely, and tell me if our country talk of the next level is rapped up in all kinds of controversy. growing up I used to hear persons say ” If some persons born in Dominica, live in Dominica all their life,{some persons of course”} and die in Dominica such persons are going straight to heaven.” But fast forward to 2014 that should be changed to some persons will go straight to HELL! All it appears is some persons are delighted to MAJOR, IN MINOR”. SMFH!!!!. Go figure. Who the cap fit wear it.

    Patrick John is still President of DFA, he was only suspended, therefore, no other person can be appointed to the office of President of DFA until such time that his term of office expires. For the duration of Mr. John’s suspension Mr. Etienne is acting as President, he cannot be appointed.

    DFA cannot appoint a President if Patrick John is on suspension. Patrick John is the elected President and until his terms ends or his appointment terminated another person cannot be appointed President. Mr. Etienne is presently acting President until the end of Mr. John’s suspension.

    It is very sad and unfortunate that most sport news is actually not about sports but about controversy. Does the general public have any idea how frustrated footballer are? Does anyone know how little advancement there is in the sport? That when you see guys playing football it is simply because of love of the game. There was a time when the junior teams were well organised and travelling to play games, what has happened to all of that? gone with the wind……..so fight on guys in true Dominica style, that’s why there is no progress.

    Dexter get hard work for you to do. Before you and after you football will continue. You are too impossible!!! If you cared so much about football money wouldn’t be your motivator whilst the players themselves get nothing. You are being a nuisance to the court system right now.

    It is beyond my comprehension. What is this guy after? Went to mediation, agreed on s decision, then after a few days says that he wants to go back on what was already agreed upon. Even his uncle who represented him gave up.

    OMG. Our footballers not getting paid, can’t even go in camp before games, can’t depend on football for anything financial. Only a sweat. That’s all. And those vultures just after DFA little money for doing nothing. . Footballers should demonstrate . Because it’s their money. Guys playing football without proper gear,teams can’t get money for transportation to games. THAT’S NOT RIGHT.
