Dr. Sam Christian clears the air re allegations of drug trafficking

When Dominican, Dr. Sam Christian, left the United States to return home to practice professionally, he knew that sooner or later, he would have some public explaining to do about drug trafficking charges which had been filed against him in that country.

In 2012, while practicing in a community called Tiffin in Ohio, United States, Dr. Christian had been indicted on 24 counts of aggravated trafficking on drugs, five counts of trafficking in drugs and one count of methadone treatment license violation. The indictment alleged he operated a drug addiction program that prescribed methadone to patients without being licensed.

According to media reports in Ohio, the allegations occurred from December of 2009 until May 2011 and involved the controlled substances methadone, Xanax, Methylin and alprazolam.

The charges were dropped in February 2013 but according to a release from the Seneca County Prosecutor’s office in Ohio, the indictment was dismissed to allow additional time for the State Pharmacy Board to work with the prosecutor’s office on retaining a new physician to review medication records and to serve as an expert witness in the case.

The release said the expert witness who had been retained for the case was diagnosed with liver cancer and would be unable to testify. This left open the possibility that the charges could be reinstated in the future.

However Christian has described the charges as racially and politically motivated.

He explained in an interview with Dominica News Online, “I was in a part of Northwest Ohio which is 98% white and very strongly republican. I became very active, not in a partisan way but out of conscience to help the working poor people who did not have insurance. What they call Obama Care or the Affordable Care Act was supposed to help. I had a Town House meeting and I have the newspaper account of that Town House meeting. It was a meeting in 2009 which was supposed to be for health care for the poor but instead, the newspaper portrayed it as (though) I was there to help OBama. So that was a very prejudicial headline that was put in the newspaper”

Dr. Christian said he also lead a demonstration to the Bowling Green State university and “I have a photograph where I’m standing in front the Ohio flag addressing the rally……. so it is very well proven that I was a very strong advocate for health care reform for the poor which was very unpopular among republicans.”

He said that as a result, he was targeted and charged with aggravated drug trafficking. “Aggravated drug trafficking is the charge that they use for drug Kingpins and Drug Lords and the irony of that is, I was the only physician in the area that was doing his best to help addicts overcome their disease,” he stated.

Of the two permits required for that practice, Dr. Christian said he was able to obtain the Federal permit ‘in quick time’ while state approval was deliberately delayed for two years during which time he had applied and paid twice.

“So basically what they did was to entrap me by allowing me to treat addicts which I did in full knowledge of the risk but to me, it was more important to save lives than to obey the law.”

The doctor, who is now a licensed medical practitioner in Dominica, refers Dominica News Online to a video made of one of his patients, Jason Lebay.

“Jason Lebay came to my office and Jason Lebay said he and his wife that they were so frustrated with their drug addiction that they were planning to write their names on a bullet. In fact they had written their names on a bullet, carved their names on bullets and they were going to shoot themselves in the head and, they heard of some patients who had been to me and they decided to give it a chance and if that didn’t work they would carry out that threat.”

He said he was “stunned” by the revelation and proceeded to record the video with his Iphoine camera. He said that video ultimately assisted his case as Lebay would eventually kill himself when the programme was stopped and he (Lebay) was being pressured by the authorities to testify against Christian.

He maintains that the State of Ohio brought ‘trumped-up charges’ against him which could not be sustained, offering him a plea for eight years if he agreed to the charges.  “I am prepared to serve every last day of the 30 years that you are charging me with. I will not plea. We will go to trial and I will defend my action in a court of law. So the state came back  and they offered further reduced charges. . . We said no, again. We will go to trial.”

Christian admits that he used methadone but says he did not wilfully commit a crime.

“I used methadone for pain medication for surgery. So, it has a dual purpose. So I did not knowingly or wilfully, commit a crime. I used a drug that had a dual purpose – number one, which is for regular pain medication and number two, that drug is also used in liquid form, for addiction treatment. I never used the medication in liquid form. I used the medication in pill form for pain control. So I was indirectly, treating patients for their pain associated with the addiction and so it would have been a matter for the courts,” he explained.

“I did not believe that I broke the law. I believe that I was helping people within the context of the law and I wanted to do more so I was applying for a permit to have a full fledged, above the board addiction treatment facility,” he argued.

Dr. Christian was defended by his brother Maryland based attorney Gabriel Christian and his associate Ed Leyden and his own son who was a senior in law school. He said they decided that they were going to fight the battle to the “last drop of blood”.

“I think legally we destroyed them and as the time approached for the trial, there was a frenzy of activity. They had taken my passport and they had me under house arrest for eight months. At that last moment, they decided they will drop all my charges and they returned my passport and the pretext that they gave which is in the newspaper article was that my chief accuser, the medical expert witness was dying of cancer in which case he did die.”

However, Dr. Christian maintains that if all the work had already been done by that witness, they could have gotten another expert witness the following week. As far as reinstating the charges at some time in the future, he said his team found out that the state’s medical witness had himself been a drug addict who they believe was overcompensating by proving “how big and bad he is ” against doctors who were violating the state’s drug laws when he himself was a drug addict.

He makes a connection between his experience and the story of Shadrack, Meshach and Abednigo in the Bible, who were thrown into the fiery furnace and were not burned.

“I looked at it from a very spiritual standpoint that I went through the firey furnace in Ohio and they were unable to prevail”

Christian said the State of Ohio Medical Board did a thorough review of the case and in February or March this year renewed his licence to practice medicine in Ohio. “I can go back to Ohio today and practice. In fact I still help my patients in Ohio, if they need to have a prescription refilled.”

He said in Dominica, the medical board was given the information about his case upfront. ” They thoroughly researched it and basically they based their judgement on the judgement of the State of Ohio and the state of Ohio said I’m a licensed physician. I have done nothing wrong and on the basis of that Dominica granted me a license to practice in Dominica.”

He pointed out out that if the State of Ohio was really serious about charging him, they would have not returned his passport. Christian says he was prepared to take the matter to the media, the NAACP and make a federal case out of it. However the whole process had totally impoverished his family and seriously affected the health of both his wife and himself.

Instead he took his family’s advice and came back home to do what he had always wanted to do.

“My goal is to serve as a doctor in Dominica… so I’m very thankful for being delivered out of the clutches of the racist people in Ohio,” he said, ” I am very proud of what I did and I would do it again in a heart beat probably not in the same way. I would be wiser about it but saving the lives of people who are in the clutches of addiction has been the most satisfying thing that i’ve ever done and I would do it again in a heart beat.”

    Hello everyone,

    just wanted to give a shout. I came all the way from Canada to have dr. Sam Christian do my circumcision and i most say this was the smoothiest and painless surgery i have ever went through. I have heard the circumcision is painful for weeks, but to my surprise i prove that wrong. From the time i step out of the dr. Sam office even to day 6 days after i still have no pain. Traveling miles to come for the surgery was worth it. Docter Christian is one of the best and i would recommended him to any one; dr. Sam definately know his work. And i will definately make the next trip to have my son circumcised by him.

    Thank you dr.Sam for everything you have done i am now seeing circumcision in a new angle. Continue to do te great work in dominica and where you may practise. And to those who see otherwise, the most high(yahweh) always has his eyes on a man whose heart is towards the poor.

    I sympathize with what Dr. Christian went through in Ohio. I’m of Dominican decent, have lived in the United States for quite some time. After high school I was offered a scholarship to a University in Ohio, when I got there to visit the campus, I thought something is seriously wrong here. It was an eerie place, I got a hunch that the people there were racist… and I was right. After a few days there, I said to the tour guide… um this place kinda looks like they lynch black people… and his response was… two days before your arrival some guys took a black blowup doll and hung it from a tree with a noose around it’s neck as a prank… That was no prank to me, I called my mother then and said Ohio is not the place for me and neither is this University. Here’s the thing… I believe Dr. Christian and I’m happy that he’s returned home to help his country. Sometimes it takes that kind of situation to give you that extra push. I don’t know you sir but you are obviously well educated, the same goes for your family including your son. My hat goes off to you. Thank you for sharing your story. Truly profound indeed… Thank God for getting you out of the fiery furnace. In times like these, you can only look at it from a spiritual standpoint.

      Dr. Christian was a victim of law enforcement wanting to make a big “splash” in the news media. It is and was tragic!! Dr. Christian is a good man, I was a patient and he was the best doctor I ever had. We miss him dearly!! I wish him all the best. By the way, I am an attorney from Tiffin, Ohio area and in my view the charges against Dr. Christian were nothing but lies. Dr. Christian was my doctor and my friend. I wish him all the best!!

    First of all, thank you DNO for very balanced reporting.

    Believe me, I just want to quietly do the work I was trained for and serve the sick. I did not want all this attention or have any political motivation. I have zero involvement in election. I sincerely appreciate the comments and learn a lot from every single one of them. But let’s get this over with and get back to work.

    Couple things I must clarify: When the article says I used Methadone, it means I used Methadone TO TREAT MY PATIENTS. I have never personally used illegal drugs (unlike my chief accuser, the expert witness, who died). Trust those in the profession who understand these technicalities and found nothing wrong to prevent me from practicing. I used the drug LEGALLY for treatment of patients’ pain as do a great number of other physicians. Jason Lebay had chronic pain. The prosecutors (who run for election in the US) who tried to entrap me, have already gotten their bang from the publicity even though they had to drop the charges.

    Finally, I don’t have to be proven innocent. I am innocent. I have never been convicted of any crime. I did not break any laws. However, when it comes to to the urgency of saving lives, I always choose to obey God than man. It’s a David and Goliath story all along and they still are capable of great mischief. But I have not blinked; I have not flinched; I have not compromised.

    They are other shocking details which I will detail in a book when the dust has settled. I have medical job offers in Ohio and can return to the US at anytime to continue the fight. However, my priority is to remain in my country where I have always wanted to be. I’ve got more important work to do right here. You can depend on that.

    Dr. Christian, I knew two Christians, one who resided in Roseau and the other in Goodwill and of course their family. I am curious to know if you are the son of one of them. If you are, I may know you and vice versa but in those days when we were obviously younger.
    Now that you returned home and will be practicing medicine, I expect you will be able to help those who are addicted to illegal drugs. You should be an asset to fellow Dominicans who are in need of this help that they may become useful nationals.

    This story is believeable as it has happened to not only Dr Christian in America. If you are in a conservative section in america, they will arrest you for no valid reason to tarnish your reputation. A Dominican was arrested for taking her child to school because he was suspended for refusing to pick up trash that he did not throw to the floor. Mom was unaware of the suspension and took her child to school. The school called for her to pick up her child, on arrival at the school she was arrested for disorderly conduct just because she told the sheriff that she did not receive any suspension paperwork from the school and that no one had given her any suspension.paperwork. But why was there a need for three sheriff at the school? Simply for the purpose of entrapment.

      Mom was released without bond, and a judge was smart enough to dismiss the charges without court appearance a couple of months later. But the embarrassment and victimization is ridiculous. Why? mom and family lives in a community where there are few blacks and the folks there are very racist. As a matter of fact her some is one of the three blacks in a class of 17-19 children.

    I would much rather have socialized medicine than a system where millions of individuals have no access to some type of health care. Yes, some people can take better care of themselves by changing their living habits. however one’s health issues should not be an incentive for generating vast profits. It s a country’s duty to ensure that its people have access to affordable and decent health care and a decent education. A country that does not have enough people who are healthy and educated will go no where !!

    It appears that Dr. Christian has suffered a modern form of “Lynching” in Ohio.

    Lynching is a peculiar American institution that was very familiar to American blacks from the period of Reconstruction after the slaves were set free to relatively recently, especially in the 1940’s and fifties, mostly in the American South, but also in mid western states like Ohio and Indiana.
    Gangs of hooded and mask white men would round up innocent blacks accused of trumped up charges, often involving white women. They would cut off their testicles and hang them on a tree by the neck with their tongue sticking out, eyes bulging, their lifeless body on full display to terrorize other blacks in the neighborhood. This is the history of lynching which went on for a very long time, an institution of violence and brutality that remains a stain on the collective conscience of the American people.

    These days they don’t lynch in this manner any more. They do it in a high tech way, to recall a phrase from Supreme Court Justice Clarence Thomas during his confirmation hearing.
    Occasionally, they try to lynch Obama, as when they try to deny that he was born in America.

    So I understand why they would do this to Dr. Christian. He suffered a high tech legal lynching which has become something of a rite of passage if you are have become a successful black professional in the United States.

    Believe me; I have experienced some of it myself.

    One mess after the next. The ObamaCare Affordable Health Care Act is illegal under the U.S. Constitution and both the Congress and the President way overstepped their boundaries. I hope that it is defunded and repealed. It is definitely not what it implies. It is socialized health care just like Princess Margret Hospital is in DA. Quality health care takes money and it takes people that are educated enough that want to take care of themselves to begin with. Don’t depend on a health system to save you if you abuse yourself. Respect yourself that much at least.

      I reside in Canada and I do hear about this health care. At first I thought it was a good idea for especially the poor but it is not operating as it should and as intended.
      As I listened to the debates, also on CNN I was all for it and supported it then. I would comment on CNN in favor of it.
      From what I am now hearing, I no longer support it even though it has nothing to do with me and my health. People must listen to the discussions on this health care system.
      We do have to take charge of our health. A US man speaking about health care on TV said, his mother told him, if you do not have good health, you have nothing. This is indeed true. Let us be broadminded about that. Good health is a great asset which money cannot purchase.

      Some parts of obamacare went into effect almost immediately. Namely kids can be on parents insurance up to 26 yrs old and no denial for precondition. There could well be other stuff.

    There are always, at least two sides to a story and it would be premature to accept the good Dr.’s version without checking all the facts. If he is indeed innocent and a victim of racism and prejudice I would have thought that he would be man enough to stay in his adopted country and fight his corner. He would not be the first man to do so. Yes, that may be tough but it but it would have my total respect.

In particular those by ‘essential workers’ which will comprise most of the civil servants and port workers etc. this would mean that all the major strikes held in the 70’2 were illegal. Never here u complaining about that. a few years ago it was illegal for blacks in america to ride in the front of buses. They had to publicly challenge it for it to stop.

      So the point is, not all laws are just. Unjust laws are best dealt with by non-compliance.

    Everyone except ‘Yessir” knows that drug addiction is a disease. FYI eventhough methadone in itself is some type of a drug it has a 60 to 90% rate of weaning people of real narcotics.
    In reference to Dr.Christian I truly believe his story. This happens quite often in the backwoods of the USA. They find a way to bring you down. If the charges were valid they would not have been dropped. They are trying to save face.Their loss should be DA’s gain.

    I don’t understand the support for someone who admitted to breaking US law and then he is granted a licence to practice in Dominica…I am confused…He said he’s not sorry he broke the law he just should have been more careful…I am now more confused as to why we as Dominicans supporting someone who admittedly broke the law…

      You are missing a very important point that the Ohio Medical Board reviewed his case and renewed his licence to practice in that State.

    Mr. Christian’s explanation may be as stated, and his skills could serve Dominica well. I am left to wonder, had he not been embroiled in this situation, would he have returned to serve as he claims he always wanted to do. I hope I am wrong, but there just may not have been enough evidence to convict him and not that he was not culpable. Racism exists, but sometimes we are too quick to play the race card which a majority of blacks embrace without questioning. Whatever the truth is, I trust he will be more careful in his practice. It would be a pity to waste such talent; talent we need in Dominica.

      If he is/was such a talented doctor why was he practicing in the backwoods of Ohio? By his own admission he practiced in a region that was 98% white. Why would a man want to go out his way to help “white” people and later cry racism? That makes no sense. He probably get a job in the first place and was relegated to the bottom of the heap.

      With all due respect I do not believe this good doctor should be legally practicing medicine in D/ca. What is his specialty anyway?

    Man go back home, but don’t lose your morals. Don’t allow yourself to be infected by the corrupt. You sir are a man of honor and integrity. Those who work for the benefit of the poor are always persecuted.

    Start your business home, work toward helping your own people who will in turn value your contribution. Working and living in a foreign country aint all what it seems.     First of all drug addiction is not a disease… Cancer! HIV! Etc is a disease because they strike unaware….when people seek gratification thru drugs it is a calculated risk on their part. we see the faces of addiction plus there are tons of documentaries. Secondly methadone is just as addictive as heroine and cocaine and most persons use methodone as their drug of choice

      Agreed. If methadone is used to treat a drug addict that drug addict can eventually die. Many people use prescription drugs as a way of relief, but an overdose of methadone is deadly.

      yessir, you clearly do not comprehend the nature of addiction. Habitual usage of drugs changes the biochemistry of the person consuming the drug(s). This is how drugs entrap their victims. Fighting drugs is not only a security issue but also a medical issue.

      Sometimes we have to take heed of the goings on. If Dr. Christian is innocent of the charges it is okay to practice medicine back home, but if he is found guilty he should NOT be practicing medicine back home or anywhere else.

      Nothing personal, but these things take time. You do have to be strong to fight against the American legal system. They do not give up. I hope your legal team are as determined as the American legal system. If you are innocent, justice will prevail.
