Former magistrate gives 24-hour ultimatum on alleged spy network

A former magistrate said he is giving the government a 24-hour ultimatum to explain allegations of a spy operation in Dominica.

While he was not clear as to what decision he will take after the 24 hour expires, former Magistrate Tiyani Behanzin has given Prime Minister Roosevelt Skerrit and the Commissioner of Police the time frame to explain to the nation about the alleged operation of the spy agency at the financial center.

Behanzin said he has credible information that police officers have been deployed to investigate private citizens.

According to him, if the alleged unit is in place, there are several issues which must be clarified.

“Tell us in the next 24 hours whether or not there is such a unit in operation on the floor or wherever they may be. Whether they are engaged in wire tapping, listening to people’s phone calls and intercepting text messages,” he said.

Behanzin said if this unit exists, the authorities need to explain “under what legal framework does it exist? who authorized its establishments? How long has it been operating? What resources have been allocated to it? By what authority has the resources been allocated and where is the budget for the unit”.

He said the police chief should explain to the nation “via a press conference”, and explain who authorized the establishment of the police unit and how could the force justify the deployment of six police officers to “this useless activity”.

Reports surfaced recently that the alleged spy network has been discretely snooping on the activities and actions of several Dominicans over the last few months. It is reportedly being ran from the sixth floor of the Financial Services Building in Roseau.

    Former Magistrate Behenzin since you are an interpreter of the law, could you explain to the Dominican readers the Security Act of 1984 which stipulates that ” A place that is occupied by or a thing that is under the control of the State shall be deemed to belong to the State”. Not Sure of the private citizens thing that you are talking about but to me it appears that they may be persons working within the government. If so I am thinking the computers,emails and all that the employees are using at the financial center of the government house belongs to the government therefore, the government has the rights to view it all. On the other hand, if the emails or whatever they are snooping into is at people’s homes or private computers, they would need a search warrant however, I have not heard of anyone saying that Police officers or intelligence officers have invaded their privacy in their homes or personal belongings.

    Also, Mr. Behenzin can you explain The Sharing of Intelligence among Member States of the Caribbean Community Acts of 2007 which I believe stipulates the Power of the Minsiter to make order. I am thinking that that gives the Minsiter the authority to make an order to create an intelligence Agency and designate a National Point of Contact. I did not see anything though that stipulates that the Minister has to inform the public of the agency and the point of contact.

    How can the State enforce these acts without doing the necessary for the security of the State and it’s people?

    I don’t know about spy network currently but I know of all the cameras the UWP put on ministry steps when they came into power, with the monitor in the then PM’s office, to be able to eavesdrop on people who were not supportive of them. So all those who runing their mouth about dictatorship, etc., all of you knew of it. Or is it convenient to forget that now? And to Behanzin, the 24 hours are up. What next? Stop blowing bubbles and go and do something real useful with your time, talent and treasure for the good of the country if you are so concerned.

    The office formally called the NJCC was established in 2000 in various caribbean countries to gather intelligence on drug trafficking and drug statistics.
    the office was situated at the coast guard base and manned by trained police and customs officers.
    the managers were the comptroller of customs and commisioner of police.
    after pierre charles died the enforcement office was hijacked and customs was thrown in the cells while the formally trained police were transfered, and untrained officers were replaced the trained police officers.
    the office was moved to the financial center and you can see these officers going around political meetings and has LOST THEIR FOCUS TO INTERDICT DRUG SMUGGLERS.

    drugs are given free passage through dominica’s waters and there is nothing we can do about it since we have lost our ability to work hard to achieve or set goals, we(police at NJIC) would rather play the political intelligence for favors like going from, coropal to superintendant in three years.

    As I read this article by Mr. Behanzin I feel compelled to write my piece on this subject. Mr. Behanzin has stated that there is a spy ring at the 6th. Floor of the Financial Center and has demanded an explanation within 24 hours.

    The question is where was Mr. Behanzin during the period that his father was Prime Minister? Where was he when Patrick John was Premier and Prime Minister? Where was he when Dame Mary Eugenia Charles was Prime Minister? Where was he when Mr. Pierre Charles was Prime Minister? Bet he must have been either suffering from dementia, was in a coma or delusional or maybe he is just plain malicious or just too naïve to admit certain established facts.

    Every country in the world and Dominica is no exception has an intelligence section, in Dominica and the other Caribbean islands we have what is known as the Special Branch, this Branch is known to collect information from ordinary citizens, listen to political meetings and inform the powers that be of impending danger to the state or its citizenry.

    As a former police officer who gave 33 years of service, who worked in the Special Branch with former and now deceased Police Chief O.N. Phillip as the Head of Special Branch, there was reporting and that has continued up to this day. To say that there is a spy group of six at the Financial center is just plain malicious and misinformed. This unit has always been based at Police Headquarters and nowhere else. When Mr. Roosie Douglas was PM and he received confidential information from the police was it spying? When Mr. James was PM and he received information from the police and by the way his brother worked in this very same spy unit, was it spying? Why now because it’s Mr. Roosevelt Skerrit who happens to be the Prime Minister it all of a sudden becomes spying?

    It is therefore; clear that Mr. Behanzin doesn’t know what he is talking about. Sir Brian can confirm that immediately after Mr. Edison James was elected Prime Minister, he quote from a report which was sent to him under confidential cover, stating, “I’m reading from the report sent to me by the police……”, and Sir Brian took offence in that he thought that Mr. James had divulged and damaged the integrity and confidentiality of the police, and that was routine police work to supply the powers that be with reports from time to time.

    The Police Special Branch has a function as any other intelligence unit in the world and is under no obligation to divulge to the public and by extension Mr. Behanzin how and where it obtained its information. As an officer of the Court and a former Best Magistrate in the World, he can take the matter to court and force the police to answer all the million and one questions he has asked.

    Congratulations to the Dominica Police Force keep making us proud. You’re definitely the Best in the entire Caribbean.

      Oh really?…So why are there so many unsolved crimes on the Island?..to wit murder.arson, robbery,and burglaries etc.?……These are all indictable offenses. Why are they yet to be solved in such this small Country?.

      There is a difference between intelligence gathering for the purpose of crime prevention and solving, and for the purpose of National security;which by the way must be legislated and should be obtained through a Court order i.e. a Judge or Magistrate, and the wire-tapping of private Citizens phones, and intercepting of private Citizens E-mails for the purpose of eavesdropping and political persecutions.That my learned fellow, is an invasion of privacy…and is down right illegal. This is the point that most people are missing.

      Does Dominica have a wire-tapping act?,if so I am not aware of it…You see my over zealous fellow,those things have to be done in the conforms of Democracy,and must be subject to the Constitution of the Commonwealth of Dominica.Any Law that is passed must comply with the Constitution.It must be in line with what the Constitution say concerning that particular matter;hence the regulations and the legislation…

      In a Democracy,Governments and Police just cannot do as they please…When the Law is violated,there are serious Legal ramifications.No one, or no body or entity is above the Law. Period.

      Just because you violated the Law in your time and got away with it,does not mean that it is OK to do today……Constitutional Rights and Human Rights my seasoned fellow.

      People need to be adequately and accurately informed so that they will know their Rights and can make the correct decisions in the context of Democracy.

      What is alleged to be going on here, is one of a personal and political nature…which makes it illegal and wrong.
      It is therefore my belief, that most people are missing the boat on this one…..
      We are not talking about espionage,security cameras,or legal surveillance here. We are talking about the violation of People’s Right to privacy. Governments; i.e Police,simply cannot just pry into People’s personal lives,and listens to their conversations and read their text messages however and whenever it chooses……It’s illegal and therefore wrong….This is the essential issue and People must understand that.

      What leaders?

      I am all for surveillance cameras in certain places were there is a high crime rate. In places like the UK, you expect someone to be watching you as there is CCTV everywhere. Even your bus/train pass (Oyster Card) can tell the authorities your daily movements.

      Big brother is watching you is not new. My concern is tapping peoples phones/reading private emails. We’ve all heard that the reading of peoples emails goes on in Dominica (and not by government).

      Mr Behanzin has issued a 24hour ultimatum, but he is not yet clear what action he will take. Ultimatums usually dont work, especially when you are not yet clear as to what action you will take (or can take) if that ultimatum is ignored.

    Its clear that some people comment before reading the article or the level of interpretaion skills by we Dominicans is very poor or we just wicked.
    No where in the article did MR.Tiyani mention that its wrong or not normal for governments to engage such practices. However he is questioning the legitimacy of this unit which implies that government would have had to develop the legal framework, put it before both the lower and upper house , then it must be gazetted and authorised by the president and becomes law.
    Also if allocation was not made in the current budget to finance such operation , the government would have had to resort to the use of a special warrant and by law this apporval for use of special /advance warrant must be granted by paliarment.

    Somebody please help – would like to know if evidence gain illegally ( wire taping, buging, hacking etc) can be use in the court of law in Dominica.

    I do hope that this unit does not exist.

      I’m some what confused by this article, in one part Mr. Behanzin is saying ALLEGATIONS OF SPY A OPERATION then later he says THIS UNIT EXISTS. While I’m nconfused I’m not suprised since this is all part of the greater mischeif making, dishonest and deliberate misleading effort of an opposition that cannot energize its own base nor offer any meaningful alternatives to develop this beautiful country.
      My friend TED. can you recall former PM Eddison James installing bugging devices in the ministry to easedrop on the conversations of public officers?? this is a fact, not an allegation. Did you hear anybody speaking against it then?. They did not because they were fearful of the level of victimization that was going on then.         A defined framework refers to the laws governing such activities by our government, but I’m sure most of you don’t care about the government having rules within which they operate.

        Checks and balances means that someone must be accountable for the RESPONSIBLE use of these technologies and ensuring that they are not used for unlawful and illegitimate purposes that would infringe on any of OUR civil rights… Yes I was a kindergarten teacher too.. :mrgreen:

    As a former police officer who accidentally heard of this operation among my former colleagues I find it distasteful that the institution that I once work for is sniffing at people’s private text and audio conversations. Whether this act is done by the opposition or the government this deliberate invasion of privacy should not be tolerated by any means. Note that in situations where national security is of great concern then one should understand and tolerate this method of espionage however when those in power or in opposition is performing such despicable act only to gain political advantage then Dominicans from across the political party spectrum . I’m sure my former colleagues particularly the two trusted and honorable friends continue to be unhappy with the direction of the police department. I do understand your situation.

      Everyone seem to have a bone to peak.We all understand that there are intelligence departments throughout the law enforcement agencies throughout the Caribbean. Dominica would be lacking if this wasn’t so. There have been joint intelligence groups throughout the Caribbean where the various countries law enforcers share intelligence among themselves in their bid to combat crime. There are a lot of criminals out there who would like to see these agencies crumble hence the reason for all these negativity. There is not one law-abiding individual who has reported that they are being wiretap.

      I applaud the commissioner and his men for using current techniques in combating crime in Dominica. This is the right approach as it helps restore confidence in the police for we know that they are going after the criminals. Anything to restore peace and tranquility in Dominica.

      I do hope that the commissioner doesn’t reply to these demands. We cannot and should not let the criminals out there know what our law enforcement is doing to catch them. We need to keep them on there toes and place the handcuffs on them when they least expect it.

      If this unit actually exist, I see nothing wrong with the actions of the unit if it is in the interest of National Security. We have a lot of power hungry people out there who will do anything in the interest of gaining power. If such a unit existed prior to the Defense Force attemped Coup, maybe the coup will have never taken place.
