A lawyer acting on the behalf of Ruth-Ann Cyrille Prince, a teacher from the Carib Territory, is warning that “there are repercussions” for the “wrongful detention of her client at the psychiatric unit by consultant psychiatrist, Dr. Griffin Benjamin.

Prince said she was detained for seven days in the psychiatric unit for reasons, she said, are unknown to her.

A letter written to Dr. Benjamin by attorney at law Heather F. Felix Evans claimed that on May 24, 2013 Prince was admitted to the psychiatric unit in “total violation of the Mental Health Act Chap 40:62 of the 1990 Revised Laws of Dominica.”

The letter, which was obtained by Dominica News Online, said after discussion with Prince and based on her account of what took place, the attorney is of the view that the action of Dr. Benjamin was “totally unauthorized under Part II of the Act, more specifically sections 6, 7, and 8 and therefore unlawful.”

Prince told DNO that on May 24 she went to the Oncology Department at the Princess Margaret Hospital and wanting to kill two birds with one stone decided to go to the Psychiatric Unit in the hope of seeing a psychologist. It was then Dr. Benjamin asked to talk to her.

“He told me that I am crazy and I have mental issues,” she said. “I tried to figure what was going on because I never asked to talk to him or never asked to see him.”

She said she decided to leave but Dr. Benjamin ordered the wardens to restrain her. She ran and the police were called in. “He called the Task Force and I was arrested and dragged back to the APU,” she stated saying that her arms got bruised in the process. “Then I was escorted to the ward by three police officers.”

Prince said she was threatened by Dr. Benjamin that she would be drugged if she didn’t obey orders.

She said on May 30, after being on the ward for seven days, she simply walked out. Now she said she is traumatized by her experience. “I was placed among real crazy people and now I am traumatized and I have difficulties sleeping,” she stated.

She said she is seeking further redress in the matter.

The attorney’s letters described the detention as arbitrary and dictatorial. “I continue to be of the considered opinion…in addition to the mental anguish and embarrassment my client suffered at being treated in this arbitrary and dictatorial manner, she has also sustained physical injuries at being forcibly restrained,” the letter states.

The letter views the actions of Dr Benjamin as “patently unlawful” and states that the authority and power he has conferred on himself as consultant psychiatrist under the Mental Health Act is “frightening and dangerous and does not portend well for the mental well being of the sanest of persons who may come in contact with you as a professional.”

The letter was copied to the health officials on the island and the chief of police.

Several attempts by DNO to contact Dr. Benjamin on the matter have proved futile.

    So if Dr Benjamin did not keep that young lady and she went home to kill herself or an innocent person Dominicans would say Dr Benjamin should hv kept herand action should be taken against him.This story is only her side and who knows if its even credible.

    Something is missing in that story, because of per the reading she was in the same area with the really crazy people. This is strange for some one under observation and be placed in that area and simply walk out on the 7th day. Hmmmmmmmm strange no update on you condition, just walk out on the 7th day why not walk out on the 5th or 6th day.

    Big Big mentally ill patients and homeless individuals and I could tell you the negative effects a lot of these drugs has on these clients. So I hope to god that instead of counselling, they do not just medicate individuals, I pray it doesn’t happen.

    People have a tendency to mask their inefficiency by being extremely arbitrary and abusing their position of power, I have been a victim of that so I am speaking from experience.

    No where in the civilized world you can involuntarily hospitalize a patient without a court order. A court has to issue the order if the person is deemed dangerous to self or others.

    The mental health unit has been the worst it has seen in years, so many sick people on the streets doing mischief and this is the person he seems most concerned about.

    By the way what is therapeutic about this type of intervention.

      Aye Dominican….read the mental Health Act. The “psychiatric Unit” does not operate the same way under the same laws as the “general hospital”. The psychiatrist under the law has the authority under the law to “hold” someone if he feels it is necessary. I do not wish to comment on the specifics of this case as I , or we do not have the facts. You can voluntarily refuse treatment at a hospital and walk out but you have to be officially discharge from the Psychiatric Unit by the Psychiatrist and his staff. You cannot discharge yourself, the police will be called under the Act to pick you up and return you. You are in there at the pleasure of the psychiatrist and his staff team.

    If Dr Griffin did not detain her and she had returned home and had done something terrible, then the doctor would be blamed. Dr Griffin is trained to do his job and the lawyer is paid to do her job. The doctor did what he considered as best in the circumstances. Mental problem is not easy. Today you can be nice, nice and tomorrow you are a different person. Only a trained doctor can make a proper diagnosis, so let the so-called doctors talk. Dr Griffin continue to do your work without fear or favour. People will always talk especially the haters.

    If people are sick, their first action is to go to a medical doctor. This is, to make an appointment with a doctor and not merely walk into the office without an appointment unless it may be an emergency. If they have a medical emergency they should telephone the paramedics – 911, if you have such a number or whatever the number is. Most doctors visits require making appointments and not walking in, if it is not a walk-in.
    Usually medical doctors refer their patients to psychologists/psychiatrists. Or if people need to see them, they must first telephone the office and make an appointment. This is how it is done.
    Doctors also prescribe medication for those have mental problems as also those who experience depression. They discuss the patients’ condition and then decide and recommend if it is necessary that the patients should see those othher professionals. Know that their fees are higher than doctors. They will not merely see patients who walk into their offices. These professionals offices are not usually opened for walk-ins.
    I will not comment on what this woman stated occurred to her. What I am commenting on is that if she is a sane person she would not have walked into his office and expect to be treated. She did overstep her bounds. There are some people who do not follow rules and regulations. Only in Dominica you say that people can simply walk into a professional’s office, expect and demand treatment and think it is normal to do so. I do believe that this woman has a severe problem, if not a mental one.
    Dr. Benjamin is a professional. I do not think that he would have ordered the police to arrest her and to detain her for no reason. Folks, all of us have a right to our opinion. However, keep in mind, there are two sides to all stories. Therefore, those who are blaming Dr. Benjamin, put on your thinking cap and think about this story and beyond. The woman could have made some derogatory comments which resulted in her so-called detention.
    You should know that since she has retained the services of an attorney, do not expect Dr. Benjamin to respond. At this stage he is under no obligation to respond to anyone whatsoever. He obviously retained the services of a lawyer. Every sensible person should know, under the circumstances, his lawyer will advise him whether to speak or not. Therefore, for now, hold strain :) and do not place the blame on Dr. Benjamin since none of you were present and you really do not know what transpired. This is also what smart people do.
    You only have the woman’s statements which may be lacking in credibility. When the two sides have provided their comments, then you can evaluate them and blame one or the other.

Tumors of epithelial origin may be benign, or malignant (carcinoma); they are fund in glandular tissue, or such organs as the breast, stomach, uterus, or skin. Mixed tumors contain different types of cells derived from the same primary germ layer, and teratomas contain cells derived from more than one germ layer; both kinds may be benign, or malignant.

    Benign tumors do not endanger life unless they interfere with normal functions of other organs, or affect a vital organ. They grow slowly, pushing aside normal tissue, however, not invading it. They are usually encapsulated, well demarcated growths; they are not metastatic; that is they do not form secondary tumors in other organs. Such tumors usually respond favorable to surgical treatment, and some forms of radiation therapy.

    Malignant tumors are composed of embryonic, primitive, or poorly differentiated cells. They grow in a disorganized manner and so rapidly that nutrition of the cells becomes a problem. For this reason necrosis, and ulceration are characteristic of malignant tumors; they also invade surrounding tissues, and are metastatic, initiating the growth of similar tumors in distant organs.

    To deal with this any further, I would have to get involve into cancer okay. now there is someone who asserts ” she is a teacher!”

    So what?

    Teachers are human also, they get sick, just like doctors, and people of all other professions, I had a doctor, an endocrinologist who treated me for diabetes, he himself was a diabetic, he had the diseases for more than sixty years he told me, he died recently.

    If this lady we are talking about is prone to tumors, she could be a very sick person, because it is likely they could be all over her body, and that could cause some mental problem, that she may not even be aware is affecting her behavior; remember someone who is mentally ill can function as a normal person until they kill themselves or some person.

    The lady said on the radio that she has thyroid cancer and hyperthyrodism. Now I think the symptoms can cause you to act erratic and any form of cancer esp a young woman with children can cause undue stress and anxiety. I will wait for the doctor’s side. And people stop sounding like fools, somebody does not have to be crazy to sick mental help, actually it can prevent you from becoming crazy so some of you here need to check in advance :mrgreen:

      Primarily she should have gone to a medical practitioner who would examine her, inform her of her condition and treat her. People do not just go running into a mental institution and requesting to see a psychologist/psychiatrist. No wonder he concluded that she is insane.
      She needs Our Lord Jesus Christ in her life by recognizing him, practicing the faith and doing her utmost to live a holy and pure life. If you are a Christian you should that by not doing so it is the result of some mortal woes and all spiritual ailments? This would eliminate their mental disorders, fears, anxiety, distress and insanity.
      Our Lord Jesus Christ said: “Apart from Me you can do nothing. By My Spirit you can do all things” and “Come to Me all you who are heavy- laden and weary and I will give you rest…” Such people deny themselves God’s blessing, graces, peace and protection. They should be taught accordingly. If only some people knew how to live in a godly manner, they would not experience such.
      The government/doctors must get down to the real root of their problem prior to encouraging and prescribing drugs in order to assist them. Once they are on drugs, they are hooked for life. In addition, very seldom drugs heal those ailments.
      I am further stating that it is a worldwide situation, right here in Canada, no exception the US. As educated and intelligent those experts are or appear to be they are unable to determine the cause of most ailments. It is high time that they smarten up and provide patients with proper health care which will heal them, not worsen them and eventually lead to their demise and a premature one. Many have died in this manner. People, in turn, must take charge of their life and live healthily. This would be helpful to living a healthy, normal life and if possible, free of such ailments.

        She was at the hospital already so she went where she thought she would find a psychologist. She has cancer for Christ sake and she needed to talk to somebody. First of all, she shouldn’t even have had to go looking for one because her oncologist should have recommended her to one in the first place. And even though you may say that is not the oncologist job, it is not a question of practice its just being a considerate human. That lady should have had a psychologist a long time ago… All of this could have been avoided if the doctors at PMH got the stick out their butts for once and acted like PEOPLE.

        While I appreciate that we do not have all of the information at this point in time, especially the good doctor’s side of the story, you appear to be already coming to conclusions that are not based on what is so far known and reported. She did not “just go running into a mental institution and requesting to see a psychologist/psychiatrist” as you keep repeating. I am not sure why you need to twist what is already reported and known to make your point. A psychologist evaluates, diagnoses, treats, and studies behavior and mental processes. A psychiatrist specializes in the diagnosis and treatment of mental disorders. Psychiatrists evaluate patients to determine whether or not their symptoms are the result of a medical illness, a combination of medical and mental, or a strictly mental one. She did not ask to see a psychiatrist but instead asked to see a psychologist. Should not the statement read with words to the effect that she was held without her consent, or better yet that she was prohibited from leaving the APU

    I think the time has come to have a national conversation on mental health. It doesn’t matter what a person is experiencing, from depression to pyschosis, we pain them all with the same “Crazy” brush. It is my opinion that the government has no interest in addressing mental health and wellness … all we get is an address by the Minister of Health in observance of world mental health day (or something like that). It may be up to some of our churches to send a few of their pastors or priests or elders to study/train as psychologists so that they can serve the mental health needs of our people.

      Maybe the woman was stressed. They say is better to talk about your problem, but maybe she should have go home and talk to her own self because see where trying to get help put her. Now if you cannot talk to a counselor or psychologist about depression stress or anxiety without being labelled as crazy then we have a serious problem.

    Something is strange about this lady; if one went to visit the oncology unit for consultation, unless they went to visit someone, not a doctor, or any specialists; this is an indication the person may be aware that they have problems with tumors.

    Now a tumor can exist in any part of the human body including the brain, and sometimes can cause psychological problems, that is why she probably wanted to see a psychologist. It is one thing to read a letter from a lawyer, with all kinds of penal code, but as written on DNO, we do know what the codes states, nor the ramifications.

    With that said, I must say that even in Dominica, one cannot forced, one to accept medical treatment; if in fact she refused treatment, that should not be forced on her.

    The question now is that was at the time of her visit she was portraying a state where she could be a danger to herself, and the public. The fact that she of her free will went to visit the oncology unit, and then the psychiatric unit is an indication that she has a mental problem, and that gave the hospital the right to ward her for at least forty-eight hours for observation only!

    Now I do not know if Police should be called in this case, and I do not know if they should have kept her the length of time they kept her, but the first forty-eight hours could be legitimate!

      If my memory serves me right, some years ago, there was a radio-thon to raise funds for her to sick medical attention (unless I am mistaking her).

      But I am not aware of her having any mental health issues.

      I dont agree with you. I think someone could be experiencing problems warranting a visit to the oncologist. And because of physical pains or woos be experiencing anxiety and probalbly decides maybe I should talk to a someone maybe a phychiatrist to explain the anxiety and pobably fear that she experiencing because of her condition. there is no rocket science to people being itt and not being aware of what is causing the problem start to display signs of anxiety of pychological unease because of stress.!!!

      to inform u.. it does happen… numerous cases where this doctor forced drugs into persons thats not crazy causing them to go crazy… think u need to get ur facts straight first

      FETe I do not know why so many people did not see eye to eye with you opinion here, because I was thinking the same things.

      What was that “killing two birds with one stone” that this lady mentioned, by leaving one department of the hospital to go to another, if it was that she was searching for medical help? That action alone to me, would mean that this lady was indeed confused about herself or much more than confused.

      A good psychiatrist would notice that situation and to decide how serious it was, so to keep her in the hospital for observation–unless our Dominica, and her people, is among that mad, mad, mad, mad world out their.

      Anyway I have learned to read what the locals have to say about such situations, because they are there; and they hear and see.

        Liz, when people do not know any better, they tend to see things in the simplest form: These people who are writing their nonsense are not people with any type of academic nor sound scholastic background.

        All they know is that they have access to DNO via a computer, and that’s all she wrote; we do not see any cognitive thinking in play here; so what can one expect?

        I read where someone continuously used the word “sick” when they should be using the word “seek” indicating she sort medical treatment:

        Well, here you mentioned something about surgeries; all the more reason to believe that she has a psychological problem also, because: And I better not mention it since these little worms who are limited and shallow will jump all over me.

        However, if DNO had released the post in which I elaborated on tumors, you would have read where I touched a bit on surgeries and how tumors respond.

        It is one thing to read a lot crap, however, when scientific and medical facts are censored the debate becomes one sided, and the idiots who are talking get away with their nonsense feeling great, however left in their ignorance.

        I mean I hear all sorts of nonsense out of peoples mouth: i.e. last evening I heard someone in Dominica on Radio talking about someone who has a bachelor degree in piloting, and this fool was adamant about it.

        A trained pilot who fly’s aircrafts can only obtained a pilot license, the same as one who takes a test to get a driver license.

        I can understand someone obtaining a Bachelor in Science degree in aviation, but the crap that person spoke, If I am in Los Angeles, and heard it, the rest of the world must have heard him also; and so the beat goes on another joke on Dominicans.

        If most of what is allowed on DNO is the rubbish we are reading hear, perhaps it would be appropriate for us Dominicans in the Diaspora, except the stupid one to conceal our identity, no intelligent person should know that we are Dominicans.

    Just wondering where was her family?,why did it take 7 days before she could have gotten out,dont make much sence.Some would have missed her and shaould have been able to put up a fight for her sanity.If its true hope it works out well for her…

      her son was arrested the same day because he told the doctor that his mom wasn’t crazy. he was arrested by Task Force and spent the night in the cells.

    This is not surprising. The majority of Dominicans refer to people as crazy, once your ideologies, intellectual capacity is different from the so called norm. Protocol must be followed in making a diagnosis. No one has the right to confine anyone without justification, the reason for admittance must be noted. The unit is to remedy mental illness, sadly, many patients condition deteriorate while they are institutionalized. The patient has every right to seek litigation. We must never use our position to violate human rights. There will always be someone to take a stand.
