Application filed to strike out UWP’s petitions

Astaphan speaking to reporters outside High Court following the hearing of the UWP vs. DLP matter

The Roosevelt Skerrit-led Government has filed an application in the courts to strike out petitions filed by the United Workers Party (UWP), challenging the general elections results in five constituencies.

Senior Counsel Anthony Astaphan said the judge ordered that the respondents must file an application to strike by March 21.

He said the petitioners – UWP – now have 14 days in which to reply.

“Thereafter we will continue with the case. It is all part of the process of the court and the order of the court,” he said.

Astaphan noted while he would not want to prejudge the case, if the Dominica Labour Party’s (DLP) application is accepted, that will be the end of the case but if they are rejected, a trial will take place.

In their petitions the UWP alleges the DLP’s win of 18 out of 21 constituencies was accomplished by bribery and unfairness.

Those constituencies are the St Joseph constituency involving UWP’s John Abraham and DLP’s Kelver Darroux; the Roseau South seat involving  UWP’s Bobby Frederick and DLP’s Ambrose George; the Salybia constituency involving  UWP’s Claudius Sanford and DLP’s Ashton Graneau. The seat of Parliamentary Representative of the Vielle Casse constituency Prime Minister Roosevelt Skerrit is also being challenged by UWP’s Maynard Joseph. In addition to that, UWP’s leader Ronald Green has challenged Petter St. Jean’s seat.

To all the know it all UWP supporters #1 go back and read the news report when MR Green and judith pestaina went to st kitts. He gave an interview to the media and said this is from DNO 12/31/09 look it up “Green told reporters that the election which the ruling Dominica Labour Party (DLP) won by a convincing 18-3 margin should be declared null and void based on a number of irregularities including the payment given to more than 4,000 Dominicans residing overseas to come home to vote in the election.

“First, their travel was paid and second their expenses, money was put in their pockets to come to Dominica,” he told reporters.

He said that many of those Dominicans had arrived on the day of the elections “voted and left the next day”.

. this is Mr Green words “many of those over 4000 dominican had arrived that day voted and left the next day,

… this is what he said “They are targeting the Laplaine constituency” he told reporters. “I have a list which shows they plan to bring in some133 persons to illegally vote in Laplaine”. Now you want us to belive that UWP have video and photo proving what they are saying and not show it to press ? what a joke come better than that, i will be waiting to see the photos and you all manifesto.

    Dear editor,
your readers should see how Jimmit Dominica has become a strategic refueling target in the newest nuclear arms race.

“Chavez said Moscow and Caracas would strengthen security ties to “continue increasing Venezuela’s defence capability” and move ahead with cooperation on nuclear energy.

“We are not going to build the atomic bomb but we will develop nuclear energy for peaceful purposes. We have to prepare for the post-petroleum era,” Chavez said on Thursday.”

Putin in Venezuela to meet U.S. foes
    Fri Apr 2, 2010 6:11pm BST

Russia’s ties with Venezuela: arms, energy, politics
By Darya Korsunskaya and Anthony Boadle

CARACAS (Reuters) – Russian Prime Minister Vladimir Putin arrived in Caracas on Friday to meet the two main South American foes of the United States and launch a $20 billion (13.1 billion pounds) venture to tap the vast Orinoco heavy oil belt.

Putin will discuss energy, agriculture and defence issues with Venezuela’s leftist President Hugo Chavez and later hold talks with Bolivian President Evo Morales, both fierce critics of what they call U.S. “imperialism” in Latin America.

Russian companies will launch a joint project with Venezuelan state oil firm PDVSA aimed at pumping 450,000 barrels a day — almost a fifth of the OPEC member nation’s current output — from the Orinoco belt, which Chavez says holds the world’s largest hydrocarbon reserves.

Putin’s quick 12-hour visit provides a welcome lift for Chavez, who is facing domestic and international criticism for failing to solve Venezuela’s economic woes and attempting to silence opposition to his 11-year rule.

Chavez said Moscow and Caracas would strengthen security ties to “continue increasing Venezuela’s defence capability” and move ahead with cooperation on nuclear energy.

“We are not going to build the atomic bomb but we will develop nuclear energy for peaceful purposes. We have to prepare for the post-petroleum era,” Chavez said on Thursday.

Facing a national electricity crisis that has caused widespread power outages, Chavez’s government is turning to Iran and Russia for help to develop nuclear energy.

Venezuela, South America’s top oil exporter, is seeking foreign investment and technology to tap its heavy crude deposits and loans to pay for Russian military hardwareSince 2005, Venezuela has bought $4 billion worth of Sukhoi jet fighters, M1-17 helicopters and 100,000 Kalashnikov assault rifles. Chavez received more than $2 billion in loans for more Russian weapons during his eighth visit to Moscow in September, including T-72 tanks and the S-300 advanced anti-aircraft missile system.

U.S. Secretary of State Hillary Clinton expressed concern last year that the Russian weapons purchases by Venezuela, a major oil supplier to the United States, could trigger an arms race across Latin America.

Chavez says the United States could attack Venezuela for its oil reserves and his growing arsenal is aimed at countering a planned increase in the U.S. military forces at bases in neighbouring Colombia, Washington’s closest ally in the region.

The arms contracts have been watched with concern by Colombia, which has stormy ties with Venezuela.

    ORINOCO OIL VENTURE

A Russian Beriev amphibious plane to fight forest fires arrived on Thursday to help extinguish blazes that have ravaged the drought-scorched Avila mountain overlooking Caracas.

The highlight of Putin’s visit will be the rolling out of the joint venture to develop the Junin 6 field in the Orinoco, which will require $20 billion in investments over 40 years.

Venezuela expects the venture to begin producing 50,000 barrels a day by the end of the year.

The Russian consortium involved in Junin 6 are state giant Rosneft, private major Lukoil, Gazprom, TNK-BP and Surgutneftegaz.

PDVSA holds a 60 percent stake in the project, and Caracas says the Russian firm will pay Venezuela a first tranche of $600 million on Friday — out of an agreed total of $1 billion — for the right to take part in the venture.

To boost its sagging output from traditional wells, Venezuela needs to exploit the Orinoco belt, where the oil requires considerable upgrading to turn it into lighter crude.

Putin’s first visit to Venezuela is seen as part of an effort by Moscow to help Russian firms expand abroad and own oil assets all over the world.

Industry sources said Rosneft, Russia’s largest oil producer, was seeking to buy stakes in four German refineries from Venezuela as part of the Kremlin’s drive to encourage its companies’ activities abroad.

Rosneft said on Friday it was in talks with PDVSA, but that there were no proposals to acquire its German assets.

Chavez hopes Russian cooperation will reach as far as the space industry. “We could even install a satellite launcher,” he said on Thursday.

  20. john brown
    April 6, 2010

What’s amazing is that before the election Mr. Green and members of his party said that the DLP was going to pay people’s tickets to come down to vote; there were people on Q95 calling out flight numbers as confirmation that they knew all about it. After the election Mr. Green said over 300 people were brought down to vote then he said it was 4000. Mr. Green said and I quote, “they had buses with police escort drive up to the runway pick people up and take them to the polls”. Now this is where things get retarded. UWP supporters need to ask themselves and Mr. Green how did 4000 people get to DA on election day and leave the next day? American eagle holds about 50 people and there are only 2 flights a day for the most . Ok so lets say they hired planes that hold about 100 people, it would still take 40 planes with a 100 people to get that much people to DA. Now, that much people and planes landing in DA at one time would never go unnoticed in Marigot, a UWP strong hold, especially when people on Q95 and leaders of the UWP said that they were coming. So why oh why are there no photos or videos of this? Why did the leaders of the UWP not send out some one to ducument this so they can show the courts and the world? You don’t even need a camera, most cell phones take photos and videos. Q95 is filled with investigative journalist, yet none of them went to investigate and take pictures or videos why? why? why? I guess they did not believe their own lies!! You can’t take hearsay, rumors, innuendos and un-proven allegations to court!!

      April 6, 2010

Another sad case in my lovely country.

My first advice to you is before you try to diss people in whose shoe you cannot feet, get your facts straight.

Number 1 – The people who came in to vote started coming as early as December 12th. I personally witness a few bus loads on the 13th, sunday morning while going to collect someone. The person indicated to me that the plane was loaded with labourites in red shirt. So this crap you talking about on election day, get the facts, and stop belching bubbles. For the 5-6 days before December 18th, DLP flights were coming in. Closer to the 18th, there were charters which were in addition to the total liat flights per day. AND, liat does not have 2 flights coming in per day. I doh know where you get that from lol. Additionally, persons also came in via feary all week long. So you really need to get your facts straight.

Number 2 – Ron Green never said that over 300 were brought in overall to vote. If he mentioned a low figure, he would definately be referring to a particular constituency. Learn to listen and understand when people speaking. Stop putting your foot in your mouth while thinking you dissing Ron Green, cause trust me, alot of readers laugh at these kinda posts from people like you.

Number 3 – Are you aware that photo and video evidence cannot be used in our courts? Are you aware that there is no legislation in place with respect to photo and video evidence? Why don’t you do some research before coming here and making a complete “A” of your self?

My friend, the legal team of the UWP know exactly what is need to prove their case. Documented and other evidence accepted in our courts will be presendted. Stop beating up and confusing yourself. Seat back, relax, enjoy your 18-3 and don’t bother your head with UWP. It’s not healthy for you, it’s making you malfunction and act like a real uneducated, uninformed embicile.

When allu are not able to partake in sensible discussions just stick to the usual “laaaaybaaah powerr”…”skerrit for life”….”tell Ron Green go and rest”…and those nonesense…

Don’t try to open conversations that is above your level of intelligence and knowledge.

Take my foolish advice….or else you will continue to provide alot of readers with some much needed comic relief to help cope with stresses associated with living under this government.

It is an election tradition to bribe and transport people to Dominica to vote and it will not stop. UWP need to take defeat as the word sate “DEEEEEEFEAT”.

What Antigua giving them hope but should know that it is a different situation.

the fact is skerrit has dual citizenship, so does peter pepper, so unless that fact can be disputed everything else there is need need to laugh at Ron Green. and if ron Green citizenship could be called in question i believe it would- this issue was resolved years ago all skerrti had to do was do denouce his French passport- ask urself how hard is that to doif u really love only ur country..

If the DLP could have brought 4000 people to vote in Dominica they would have won 21 seats, considering the fact that the UWP only won in Salisbury by 200+ votes and Roseau Central by 2 votes….

These people are just beyond ridiculous. I mean why would you challenge Roseau south!!! ROSEAU SOUTH MAN????

      • AT7
        April 7, 2010

American flies the AT7 into D/ca with a full capacity of 64, but with minimum baggage. They however only allow 50-55 on any flight because of weight and fuel restrictions. During elections there were only 2 flights per day except for 4 days in early December when they annually increase their flights to 3 a day to accommodate the medical students to return home. The bottom line is the air traffic was normal for Christmas. It was a good strategy because people would always be coming home but that’s the most that can come from this. Any photo or video still would not be admissible in d/ca courts.
