Counsel for the Opposition undeterred by recent judgment

Letang

Counsel for the Opposition, Geoffery Letang, has promised tremendous cross-examination when the dual citizenship matter is brought before the court on September 5, this year.

Letang indicated that whether or not his team would have received the passports of Prime Minister Roosevelt Skerritt and Education Minister Petter St. Jean, the defendants in the case, the matter would be presented skillfully, leaving no room for doubt.

The statement comes after Justice Gerthel Thom ruled that the application by the opposition, for the production and disclosure of passports and other documents of Skerritt and St. Jean, be dismissed.

The court has asked the chief elections officer to produce, within seven days, the defendants’ Form 13, a declaration form in which the defendants, as candidates for election, were to state to which country (s) they have allegiance.

According to Letang, if the defendants stated their allegiance to another country on the forms, they would be disqualified as candidates.

Letang believes that evidence can be presented proving mendaciousness, if the forms do not state that they were, at the time.

Justice Thom ruled that the Eastern Caribbean Supreme Court Civil Procedure Rules do not authorize the court to order the release of these documents, despite the petitioners’ plea that it need not apply to petition cases.

According to Letang, there are currently no election petition rules.

It appears that Mr. Letang took a try and he missed, poor fellow…I take solace in the fact that win lose or draw, he is being paid…I hope!

The Court/Judge was right to dismiss this part of the case.

The UWP claimed in their petition that Mr. Skerrit and Mr. Joseph are citizens of France and Dominica. They (UWP) do not have any documents to show that this is true (The French Citizenship), like a copy of passport or a Naturalization Certificate. To win their case or make their claims be truthful they are asking the courts to force the defendants to produce documents that they (UWP) claim the defendants are in possession of.

That is where Tony earning his money. He asked the Judge to throw out that part of the case, which was a smart move and legal one.

Come to court with your proof that I am a French Citizen, show your evidence and not rely on the Defense to prove your case.

This case will soon be dismissed as if UWP had the “Smoking Gun” we would have seen it or known about it. There are no surprises as evidence has to be disclosed to all parties.

Thom ruled that the Eastern Caribbean Supreme Court Civil Procedure Rules do not authorize the court to order the release of these documents,Just a thought that if that is the position of the Court, then for the life of me why hear the case in the first place,it make no sense to me, because the Court does have certain provision by law to intervene in the interest of justice, but because the judges in the Caribbean are so fearful that their appointments would be in jeopardy as it requires the agreement of the heads of states to appoint judges in the Caribbean so we do not expect any justice once its a case against heads of states, but if its the poor man on the then the judge would have the authority. It is high time that justice in the Caribbean should be totally blind. We talk about peace, but how can we have peace when we cannot have JUSTICE.

Naturally the counsel for the opposition will try to drag this case out as long as he can. His fees will just keep adding up. I guess Eddie, Ron, Sprags and dem have more money than they know what to do with.

They just keep getting blows (at the polls and in the courts) but they never learn. What a total waste of time.

Thank God these UWP losers will never form the government, they are always trying to drag Dominica down. But the true patriots will not let them.

We just stay positive and work towards our continuing national development – God bless Dominica!

I love your choice of words “blows”,at least you are being honest. The court’s refusal to do it’s job is indeed a blow to democracy, like throwing out cases of election fraud which can be proved and not allowing skerritt to produce his passport.
