Ian Douglas defends prime minister in the wake of dual citizenship charge

Legal Affairs Minister Ian Douglas is refuting claims that an Eastern Caribbean Supreme Court decision to allow petitions addressing the legality of Prime Minister Roosevelt Skerrit’s eligibility for nomination as a candidate for electoral office will create any level of instability in the country.

There have been concerns that while this matter hangs on, it could create some level of instability in Dominica.

But Douglas told the media following the hearing outside of the High Court of Roseau on Monday that even if the Dominica Labour Party (DLP) lost the five seats that were being challenged, the party would still continue to be the government of the country.

“Roosevelt Skerrit of Vielle Case doesn’t need to have the prime minister title for him to continue to wheel the kind of influence here and abroad. The work of Roosevelt Skerrit will continue and he will continue to provide for the poor, downtrodden and the unfortunate,” Douglas believes.

He said however there is no certainty in any court matter until the verdict is handed down.

We have to sometimes put our political caps down and speak with authority and principle on matters tht affect our country.Whethr you like Mr. Skerrit or not, he is not above the law, and too many secret deals are going in this country.     Most of us when presented with facts are blind and stupid. The issue is not one of preference but law and if skerrit is a dual citizen he is not now nor was he ever eligible to become prime minister. However even if found guilty all he needs to do is renounce his french citizenship and partake in a bielection where he will undoubtedly be reelected just like all the UWP candidates who didn’t attend parliament and just wanted to draw the money. In a claim of protest they say.
    Protest my rass. UWP should be shackled and chained along with most other politicians. UWP claim the man is a thief well it happen already i prefer the rich thief there than the broke ones. Tell Eddison take his big nose elsewhere at least when they claim Skerrit thiefing you can see things happening not hear intentions for things to happen

    In the UWP era all you heard were intentions and nothing has gotten done
    Well in the Skerrit era with all the supposed thiefing I seeing projects being done and completed which is less than I can say for other parties.

    The only complaint I have is that there is not enough work in the country and this needs to be addressed as unemployment leads to a rise in crime and the pattern is already taking hold on that front so the Government needs to do something

    being Objective does not mean taking sides but being reasonable and anyone taking a point of view based on a party is not objective but biased and obstinate.

    There is a wild card in Skerrit’s hands called a contingency plan; a what if something happens scenario and how to deal with it. Hypothetically speaking, let us say that the court ruling goes against Skerrit, does anyone in their right frame of mind think it would be the end of him? There is no law that states that he cannot take part in any bi-election as a result. Skerrit would have to renounce the French citizenship and he would be back as a thorn in the heart of the UWP and its cohots. The UWP and its cohots would not have achieved anyhing substantial but more grief. Skerrit has put a lot on the table to just walk away from it all. There is no one in Dominica who can beat him in a bi-election. At the end of the day, when it is all over,Skerrit will be able to pass legislation that will faciitate his position to take Dominca to the next level. The leadership of the UWP and others are not celebrating because they know for sure that Skerrit is not going anywhere. Infact we will notice a bolder, stronger and more charismatic Skerrit. Some of the people who have commented in this forum have not done it from a realistic point of view; infact they are merely using their emotions to convey a message.Anyway you look at it, Prime minister Skerrit is not going anywhere irrespective of the court ruling.

    While this is a civil matter he better be aware that the police is watching and waiting patiently. If found culpable he will be charged for breaking the laws of the land in a criminal court. He is El Supremo now and no officer will make a move for fear of retribution but as soon as he is off that throne and does not qualify for 24 hrs police security he better run like hell and not to the US because we have extradition treaty with Obama and the DC boys. I hope the opposition taking note to demand criminal charges when he and Peter is found to have knowingly broken the law

    I cant wait to see all them sexy girls lined up infront the prison to make their visits. PJ did and said more than that but was ultimately incacerated. I can assure you that his visitors were few and far in between because he no longer yielded great power. So Skerrit play your self now, but the officers of the law that have been victimized are ready and waiting with cuffs and truncheons. My advice to you is resign and run. I am sure PM Reggie will make you ambassador of China or venezuela because that is not against the law and you will be safe out there. Go with your first choice and bring Vince back from the UN and make him PM. Then Loren to the UN. Vince will more bring you back as PM than Reggie.

    But my last and best advice is RUN SKERRO RUN. I will be wearing my red T-Shirt on Monday in Roseau with RUN SKERRO RUN on it. I am sure the opposition will follow suit with Blue and White shirts saying the same thing.

    There was time Dominicans could not even hold high offices in the land, we were ruled and governed by others and the french, maybe that is why most of us find that we can make a better living in the french? and maybe that is why we are so bent of petty foolishness that we cannot make progress. so what if a person has dual citizenship, to me I see an advantage having both.     @lasko: What’s wrong, your full stop isn’t working or what? You should move in front your pc according to you. Whatever Skerrit did to help develop Dominica wasn’t a favor, it’s his job. Besides we are lucky that while he was busy loading his pockets he actually found time to do what he’s paid to do. So you need to do us all a favor and shut the hell up, because what’s going on here has nothing to do with who voted for Skeritt or not, but upholding the fundamental law of Dominica. The Vieille Case constituency needs to be blamed for the current situation, not the non labourites. They were informed of his dual citizenship and still voted for him, so deal with it. A wrong deed doesn’t magically become right depending on who is involved.

    The hypocracy of UWP and its supporters is beyond comprehension. . All of a sudden they are all constitutional scholars, but ignores the fact that members of their own party holds dual citizenship. Matthew 7:5 says, “You hypocrite, first take the plank out of your own eye, and then you will see clearly to remove the speck from your brother’s eye”.

    In the 2000 election campaign one of the wise men on Q95 had a talk show on Marpin tv and interviewed Rosie Douglas who had seven or ten passports with him, which he displayed on the table infront of that wise man and he said nothing. He did not say to Mr. Douglas sir you cannot be Prime Minister; the constitution says this, that and the other. He said nothing, so why now?

    Let’s not be fooled, this is not about dual citizenship!! This is about trying to unseat a very very popular and unbeatable Prime Minister; a Prime Minister that’s the backbone of his party. Their thinking is, if we cut off the head the body dies, then the Labour Party goes the route of the Freedom Party. Remember what happend when Ms. Charles left the Freedom Party? This is what they are trying to duplicate; we cannot beat them one way, we will try another.

    Mr. Douglas, I read with horror this piece and what you said about the PM. Are you sure you mean him well?     You even made arrangement for the Labour Party when the PM is impeached, “that even if the Dominica Labour Party (DLP) lost the five seats that were being challenged, the party would still continue to be the government of the country.”

    As an attorney and the Legal Affairs Minister you make a very weak and halfhearted statement about the issue, with the Prime Minister job and Prime Ministership (is that a word) on the chopping block. It is almost as though you cannot wait to see the PM impeached. No hard feelings though for you must have your reasons for not coming more convincingly to the PM Skerritt’s defense.

    I support most of Roosvelt Skerrit’s domestic policies !

    I also believe the rule of law and the constitution MUST be respected at all time. Personally, I hope he does not have dual citizenship, but if he does then he needs to resign, renounce his French citizenship, and run for election again.

    The fundamental question “IS HE OR IS HE NOT” a French citizen, I do not know, and that is what the court is looking into. If is is dual citizen then he needs to go, if not let him govern.

    It’s that simple, but you can’t have it both ways !

    I am no attorney but I can see that the outcome of this case will be that the current PM will be disqualified as Parlrep hence he will loose the leadership of the party and be out of government ( as a minister) for some time. How long will depend on his course of action after the verdict.

    MB: I totally agree with you that the PM might have good intentions but he has very bad political advisors .

    Skerrit should have done his home work before seeking a French Passport. On the other hand..this may just be an indication of his level of allegiance and confidence in Dominica as a nation with the ability to succeed. This act does not go down in history as one of unwavering patriotism at all…NOT when you are the nations leader pursuing another soverienty .

    What sort of signal would be sent to the Cuban people if Fidel Castro (who by the way is no longer the leader of Cuba) were to now seek a US passport or a passport from any other country for that matter? I’m no Cuban but I have a feeling that the people would think that he will be leaving them to perish and heading for higher grounds if it becomes necessary.

    A leader should be totally focussed on his country and should be willing to die for his people.

    Skerrit has had high praise for his friends Chavez, Castro and the Chinese Prime minister. Apparently he has not been informed in depth of these men degree of patriotism to their respective countries…. It a little to late for him to take that page from their books. But he surely can do a bit more reading for himself.

Judith pestaina is stillonradio quoting ceratin sums of money peopel were paid to bribe, yet still she could not bringthe evidence in support of hers and the UWP charge. So how do you expect the court to adjudicate when our system – the same one that has served us from Crown Colony Rule to now demand that the person making the charge must prove what they are saying. Prime ZMinister Skerrit has notnhing to prove.he does not have to prove that he did not bribe anybody. Judith and the UWp must prove their case in court or else stop wasting the court’s time Stop the “fishing”. bring the hard cold evidence. It was that same Ian Douglas who disclosed in a telephone conversation with someone allegedly from New York, that he was badly hurt by the knowledge that PM Skerritt was in the habit of BAD TALKING him behind his back, even though he has given his heart and soul to him. He stated that the PM’s conduct was dishonorable. Remember, that conversation was released on YOU TUBE and subsequently on the HOT SEAT on Q95. The whole world heard Ian Douglas putting blows on PM Skerritt. He never disputed what he said about his PM. That same Ian Douglas admitted that he was the victim of a set up and was lured into making those statements about the PM. Ian said that was a blunder on his part. He agreed that sometimes we say things that are not in the spirit that they were said. ‘THAT WAS A BLUNDER.’ Ian Douglas admitted later. He blamed the recorder but tried to turn and twist the conversation, never taking responsibility for his EXHALING. That was IAN DOUGLAS. That is the same IAN DOUGLAS today.

    Was Ian demoted as AG in the DLP GOVT. and made Minister of legal Affairs for reasons unknown to the public? Dominicans had many reasons for speculating on his reshuffle. Isn’t the position of AG all about LEGAL AFFAIRS? Think for yourself my people.

    Mr. Douglas must grow up, he has essential admited that Mr. Skerrit is guilty. Also he made no mention was made of Dominica continuing, instead it is the “world of Roosevelt Skerrit” and the labour party. Why all the worship of Mr. Skerrit? This is the same man who never held any management or responsible position before getting into politics, this is the same man who hardly owned anything before getting into politics and made himself rich on the back of the tax payers, this the same man who is not qualified to hold public office in Dominica because his has dual citizenship, this is the same man who refuses to respect the intelligence of Dominicans by continuing to feed us with obviouse lies, this is the same man who is unable to have a conversation with a straight face because he is well aware of the lies which he tells, this is the same man who has no respect for the constitution, laws, rules of the Commonwealth of Dominica.

    Dominicans wake up, PM Skerrit should be in Prison, there are many Dominicans who have done much less who are currently in prison. It was a mistake by the citizens of Dominica to allow a person of such low quality to become our Prime Minister, he is not qualified to run even a shop and i’m not talking of degrees or educational background, i’m refering to quality of person. PM skerrit is a low breed who should be removed as soon as possible from the high office of Prime Minister of this land using the constitution and laws of the Commonwealth of Dominica which he treats with such disdain.

    Mr Douglas. I am not a supporter of either party, how ever the law is the law and we all must abide by the the law. Now your are the Legal Affairs Minister in Dominica and I strongly reccommend that you do your research and read up on both the french constitution and the constitution of Dominca before you go public with your comments.

    (A child who was born abroad and who has only one French parent can repudiate his French nationality during the six months prior to his reaching the age of majority, or in the year which follows it (article 19-4 of the Civil Code.) This was take directly from the french constitution).

    The Prime Minister falls directly under this section. In other the words if you were born abroad and you have one french parent like the PM does then you are not a french citizen. Please Domincans read and understand what the laws states. In Dominica we called it the age of consent which is 16 in France they call it the age of majority which is 18. If you were born abroad and has one french parents you CANNOT claim french citizenship or repudiate it 6 months before turning 18 which is the age of consent in france and other french territories. The PM obtain his first french passport in 2006 he clearly broke the law he was the sitting PM at the time and he knew what he did was wrong not only that he disrespected the entire nation and said that now law or no constitution can prevent him from holding political office in Dominca. I hope they play the tape in court so the judge can hear it. Now the constitution of Dominca states : please read this section was taken directly from the Domincan constitution

    Disqualifications for Representatives and Senators.
    32.-
    1. A person shall not be qualified to be elected or appointed as a Representative or Senator
    (hereinafter in this section referred to as a member) if hea.
    is by virtue of his own act, under any acknowledgement of allegiance, obedience or
    adherence to a foreign power or state;
    b. is a minister of religion;
    c. is an undischarged bankrupt, having been adjudged or otherwise declared bankrupt
    under any law in force in Dominica;
    d. is under sentence of death imposed on him by a court of law in any part of the
    Commonwealth or is serving a sentence of imprisonment (by whatever name called)
    exceeding twelve months imposed on him by such a court or substituted by competent
    authority for some other sentence imposed on him by such a court, or is under such a
    sentence of imprisonment the execution of which has been suspended;
    e. subject to such exceptions and limitations as may be prescribed by Parliament, has an
    interest in any government contract and has not, within seven days of his nomination as
    a candidate for election or, as the case may be, at least seven days before the date of his
    prospective appointment, disclosed the nature of the contract and of his interest therein
    by means of a notice published in the Official Gazette and in a daily or weekly
    newspaper circulating in Dominica; or
    f. holds or is acting in the office of President.

    What’s the big deal now we all know that the PM was an adult when he sworn allegiance to France in 2006 to obtain his french passport so he is and was not qualified to hold elected office in Dominca. The case is a clear cut . Dont get me wrong the PM might have good intentions but he has very bad political advisors .

    The PM cannot break the law and lead the nation.

    I don’t expect you to say anthing different Mr. Douglas. You can keep living in your Roosevelt Skerrit world, but everyone doesn’t have to. The party in government is not the issue here, but upholding the Constitution. There is no room for special treatment, rules are rules!
