Opposition prepares to challenge election results in court

ROSEAU, Dominica, CMC – The main opposition United Workers Party (UWP) was Thursday making final preparations to file a number of petitions in the Dominica courts by Monday morning, challenging the results of the December 18th general elections that saw the Roosevelt Skerrit led Dominica Labour Party (DLP) return to office with an 18-3 majority.

The UWP has set Monday as its deadline, 21 days after a general election, for submitting petitions challenging the results of the poll.

Party Leader Ron Green told the Caribbean Media Corporation (CMC) he was ironing out the details with his lawyers in preparation for filing.

“There are going to be petitions. The deadline is approaching and the team of lawyers is advancing and really preparing before the deadline to file the necessary petitions,” he said.

The UWP was soundly defeated at the December 18 polls with Green losing his Laplaine seat by two votes to Petter Saint Jean, who was Monday sworn in as Education Minister along with the other ministers in the 15-member Skerrit cabinet.

Green revealed that he had spent close to three hours Thursday morning working on the petition to challenge the results in the Laplaine constituency as he remained confident that he was in fact the winner of that seat.

“I will definitely be filing a petition in regard to the results of Laplaine. I will be contending that I am the victor in the case of the Laplaine seat,” he confirmed to CMC.

Green also said the matter of dual citizenship remains a sore point for the UWP and it will be basing at least one of its petitions on that issue. The UWP had contended during the election campaign that Prime Minister Roosevelt Skerrit was ineligible to contest the Vielle Case constituency as he was also a French citizen.

“There are other filings and petitions that are going to be filed in regards to DBS (the state owned broadcast station) among other issues which are still being finalised.

“I would hesitate to name all of them until they are actually filed,” he stated, but told CMC the issue of dual citizenship was “definitely” up for contention.

The UWP leader said his party was persisting with the petitions, aware that it would be a difficult process, because it was determined to maintain democracy in Dominica.

“We are persisting because we think democracy was raided and we think that the only way we can ensure that there is a strengthened democracy is if we take action now,” he said.

“It is very costly in the first instance, but sometimes you have to go through the struggle in order to get what you want and the party has determined that it is going to take a route that is required now if we are going to have democracy in our country,” Green concluded.

    The only reason that the UWP is going to court(after having a history of losing all cases) is in a last ditch effort to save the party. You see the party is diminishing day by day and in 5 years time they might just cease to exist. The reason? … Up till last election, UWPites were continuing to say who they would fire from their jobs and who they would frustrate if they win. God sees the heart and cannot allow people to suffer. UWP has to come clean from the heart, not the mouth and environment alone. THANK GOD THEY LOSE BECAUSE MY BROTHER AND SISTER WOULD BE DEMOTED. THEY WILL LOSE ALL THEIR COURT CASES BECAUSE THEY DO NOT HAVE EVIDENCE. By the way has the party paid Mrs. Alix Boyd Knight her money? and the Sgt at arms? iam interested.

    Why are Labourites so scared? if Mr. Green wants to go to court then that is the right thing to do. The only alternative would be for him to act like a real aggrevied african leader and start choas in this country.
    I just hate it when people try to excerise their demorcatic right people want them to shut up. if Dame Eugenia had shut up in the 1970’s who knows what PJ would have done with the country. the sad thing is that he had supporters then, just like how skerrit has supporters today.
    Bringin in 4000 people to vote in marginal seats made a HUGE difference, and i have seen comments stating that DLP would still have the most votes. Well Dominica’s gov’t isnt decided by most votes but most seats. With only 61% of the vote DLP obtained 85% of the seats…. get it? and there are 5 seats really boosted DLP’s margin (Grand bay, cottage, veille case, Pix Bouche and Possy with DLP gettin 6000votes+ over opponents).
    of cousre there are people who say all dominican’s have the right to vote… and once its is agreement with the law i totally agree. But a similar situation had existed in Guyana in the late 70’s/ early 80’s where the party in power had a system where they would obtain 95%+ of the overseas vote. This of cousre is bais and does not constitute fair elections and this system was later removed. Same thing in Dominica, if DLP has a system where it gets 95%+ of the overseas vote then that does not constitute fairness… and i am not part of the UWP legal team, just a Dominincan making his opinion.

    So to end, all i gotta say is let Mr. Green go to court, if DLP has nothing to be afarid of then they shouldn’t be wasting their time sayin Mr. Green wasting his time and should retire. Cuz most Labourites i know are ton of hungry people with no morals (can easily be bribed) people.

    the constitution of any country is the backbone of that country whether the allegations are false or true the party has the obligation to contest the decisions hence the reason the provisions in the law were made. Anyone who disagrees with this goes right against the constitution!

    2. why is it that election is never over in this country since UWP lost in 2000? they have campaigned year in year out on Q95 and Kairi. (this time they were on DLP side).

    Please do not follow these guys, you are a first-timer and need the exposure, do not make the likes of Ron who lost his seat and Sam who for some reason is desparate influence you.

    Take it from me now is your time to take up the mantle of the UWP and lead it in the House of assembly believe me my brother Ron is getting on like that because he lost his seat if he had won and you lost he would have been announcing his senators all now, he would not be crying so much even if he knows that salisbury is a strong workers seat he would just appoint u as a senator and cry foul inside parliament.

    Think of it Eddo is on his way out he really doh care, Prevost only won by 3 votes you in a better position to keep winning your seat than him plus you are the youngest amongst them. You need to carefully plan your future, the leader of the opposition gets over $4,000 monthly and now the PM said that the position is going to be housed with a secretary with all amenities required for research etc.

    I know u have your loans and is working part time now so don’t let that opportunity pass you by cause you may live to regret it.

    I think Ron & Sam is very selfish and you should dissassociate yourself with them trust me as a friend my brother. You won your seat fair and square and deserve to experience being a parl rep for the first time in your life. Those guys are dreamers they hope that the international community will get involved and sanction a regime change here, my brother this won’t happen the ppl have spoken and we all know that the 4,000 dcans did not return here on a DLP paid for ticket to vote the results are clear. Don’t take my woird for it just check the results yourself, if the President call u because the others refuse take it my boy your future both in politics and financially depends greatly on it!!!

    Lets look at the result of the election and put it in perspective:

    1. the seats that DLP won in 2005 look at the results in terms of the margin they won over the DLP or the closest candidate

    11 sure seats that workers cannot touch:

    – Petite Savanne -975 over Sam
    – Grandbay – 1231 over UWP
    – Roseau South – 919 over uwp
    – Pointe Mitchel – 437
    – Mahaut – 679 over UWP
    – St Joseph – 350 over UWP
    – Colihaut – 421 over Freedom Party
    – Portsmouth – 1160 over Freedom Party
    – Cottage – 807 over PDM
    – Paix Bouche – 1006 over UWP
    – Vieillecase – 893 over UWP

    now look at what happened in seats UWP thought they could have taken from DLP:

    – Salybia (Carib Territory) 329 over UWP
    – Castle Bruce 155 over UWP

    Now seats that the DLP took from UWP:

    – Roseau Valley – 278 over UWP
    – Roseau North – 117 over UWP
    – Wesley – 75 over UWP
    – Grand Fond – 5 over UWP
    – Laplaine – 2 over UWP

    Now seats that UWP won

    – Roseau Central – 3 over DLP
    – Salisbury – 305 over DLP
    – Marigot – 607 over DLP

    Its obvious that the ppl has spoken and spoke loudly, where labour won in 2005 gave overwhelming support that support was so overwhelming that it spread to damage UWP strong holds, we all know that in areas where UWP was strong the results would have been tight and the new voters would have made the difference so i just cannot understand what is the fuss!!
    I checked 28 deposits remained in the treasury amounting to an unprecedented $14,000.
    I noticed the only seat UWP is contesting in courts is the laplaine seat that also speaks volume, one more seat to UWP will still give labour a landslide and if the court rule that skerrit cannot be pm and there is a by-election in vieille case DLP will still win that seat and skerrit can still be appointed advisor to whoever the new PM will be, so what is the point really?

    Why they hate skerrit so much i think is based on jealousy which is met sourciere.

    DEMOCRACY IS ALIVE AND WELL IN DOMINICA!

    I do wish people would stop insinuating that some problem exists in Dominica regarding our democracy. It seems they do not understand the meaning of the word!

    Simply put; Democracy is a system of government where the power is vested in the people, either carried out directly by the people (direct democracy) or by means of elected representatives of the people (representative democracy).

    The term is derived from the Greek: δημοκρατία – (dēmokratía) “the power to the people”.

    On 18 December 2009, Dominicans from all walks of life, without restrictions for religion, race, creed, colour, etc., exercised their rights and elected their representatives without fear of coercion, intimidation or bullying. Each voter, in the privacy of the voting booth, voted as his or her conscious dictated.

    The elections were FREE & FAIR (as noted by all the international observers) and the results express the true desire of the people, to return the Dominica Labour Party to office. Granted under our constitution the minority (opposition) can certainly have its say… but the majority (the elected government) will have its way. Clearly, that is what the people want.

    Please, can we now return to the important business of nation building and stop with the petty politics and divisiveness – ENOUGH SOUR GRAPES ALREADY!

    My Dear Freinds and suporters of DLP, UWP, DFP and Independent Candidates. Let me first Congratulate the incumbent Labour party for retaining and increasing their total members of Parlimentarians. Of course after any race you must have a winner and a loser, Some losers bow out gracioulsy in defeat others scream and ball at the humiliation. Humilaition only caused by their empty pre-election boasts and promises. UWP was in office (1995-2000). What did they do to help Dominicans… The international airport still not built and landowners/homeowners already finish the pay out money they received intended for re-location from the path of the airport. All countries except Montserrat(because the migrated population is overwhelmly bigger) allow their citizens from abroad to vote/return to vote that is their Constitutional right. May I suggest that if Ron Green and the UWP were in power they would have done the same thing by bringing in supportes to vote. He Ron Green could not hold on to his own seat he should take this as a hint that his time as leader is up. If he couldnt win his own seat then he is certainly not fit to be PM. The fact that the count was even close means that the people ( and thats their right) wanted the younger chap. When Micheal Howard (Leader of the Conservatives in U.K) Lost the 2005 election to Tony Blair and Labour he immediatley relinquish the Leadership. There were observers in Dominica and they all said the elections were free and fair. Where was the Lawyers that he Ron Green is using for the challenge when the votes were counted. Didnt he have agents and himself at both the original and re-count. No man is perfect but if Dominicans are honest they will recognise that Skerrit and the Labour Party have done a lot for Dominica. The Late PM Pierre Charles when he thrusted to the helm following the death of Rosie Douglas had to implement unpopular measures to save the economy of Dominica. The meaures were hammerd by the opposition because they didnt have a long term vision. Now that Dominica can even afford to not use their credit facility at ECCB and allow 2 other neigbour governments to utilize it as they struggle with their own economies. Thats what long term goals and vision is all about not short term fixes. My advise to you Ron is to work not only with PM but with the young man that defeated you and use the money to help the people in your constituency. Take the Humble and Honest thing in the site of God and accept the results..

    To All the Defenders of the Status Quo.

    Consider,

    1) The Iran Elections of 2009 – The incumbent won by a Landslide contrary to reality on the Ground; the protest continues. It took ~1 year to get rid of the Shah.

    2) Civil Rights Struggles in the USA – 5 decades to 1 century before meaningful results. USA society and the World have directly benefited from these struggles.

    3) The opposition struggle in Venezuela – more than 8 years and counting. Chavez has won most battles so far, but history dictates that he will eventually lose the war.

    4) Other Notables, where incumbent seem to always have the upper hand: Marcus (Philipines), Alberto Fujimori (Peru), Augusto Pinochet (Chile) etc etc etc.

    I urge readers to use these examples to shed some perspective on two seminal issues: a) the Dominica elections of 2009 and b) the current atmosphere that DLP can do no wrong. Today its the DFP, UWP and other political parties; tomorrow it may be non-political entities (business, farmers, taxi drivers, venders, individuals)

    Attacks on characters do not produce new ideas or solutions; serious adult discourse is more apt to be fruitful.

    Ron Green has indicated that the Labour Party brought in 4,000 people to vote. He has revised that figure from 600.

    Labour Party got 22,000 votes while UWP got 12,000 Votes. If you remove the 4,000 votes assuminig Ron Green is correct, (He is definitely not correct ) Labour Party would receive 18,000 votes still 6,000 more votes than the UWP. So what is the cry about?

    All how you look at it The Labour Party won the elections hands down. UWP just cannot take the humiliation. Come on guys wake up and smell the sweet aroma of the coffee.

    We all saw the pictures of people at UWP meetings and convention on DNO. You could literally count the people in attendance at some of those meetings , how was the UWP going to win ? it was clear they did not have the suport of the people. DLP got 61% to UWP 35% did the DLP import the 61% they got? Mr Green said the DLP imported 4000 people ( first he said 600 ) to vote in the election but that’s not even half of the over 35000 that voted ,so where did the rest of the voters come from mars? Elections are not decided in courts Mr Green that’s not democratic it’s decided by the people and the peolpe spoke the numbers add up now be an honorable gentleman an except it.

    Mr. Green & the UWP went into the election saying all what they are saying now, yet still, they contested it . If Mr. Green and the UWP truely felt that the election was going to be stolen, then they should not have taken part. Think about it people, elections cost monies why would someone take part in something if they knew the fix was in? Does he not realize that when he took part in the election he legitimize the whole thing? You cannot have a democratic election without an opposition and that he was and is. Mr Green and the UWP are not going to present nothing new to the courts but the very same things they were saying before the election with no evidence. The observers they ask for, ask for the evidence and they could not give it… i guess they were saving it for the courts . A man of morals and principles would have said we are not going to contest this election and give the reasons why, then the world would look at him with more credibility. The UWP has been around for about 20 years and in those years every election they ever contested win or lose they have had an election dispute matter brought before the courts and lost every time. This is nothing new.

    It is your constitutional right to challenge the result. But as i see it, the people of this great nation has spoken, and have decided that Mr Skerrit is better suited to run this country. Now, if i were you, i would accept the decision which the people of Dominica has made. And as a true Dominican that you are, you should help unite the country by working with Mr Skerritt. For a country which is devided cannot stand. And we all want what’s best for our wonderful Island name Dominica.

    Is Ron Green for real?
    Mr Green should realise that in a democracy the people decide what they want and it is not up to him to decide what the people want. The people decided overwhelmingly that they want labour and Skerrit to lead them for the next five years. If Mr Green truly believe in democracy, he should accept this decision by the people and move on. I don’t think that the court can change what the people have decided for the benefit of giving mr Green the power that he so desperately craves but by all means let him have his day in court and make a further fool of himself. i hope after that he can disappear from the surface of the earth (go to Mars), and allow the rest of Dominicans to get on with their lives.
