Opposition leader and MP for the Marigot constituency, Lennox Linton, along with two members of the community, on Monday delivered a petition to CEO of the Dominica Air & Seaport Authority (DASPA) Benoit Bardouille on behalf of Vescort Jones who was fired as a port security officer on December 10, 2014.

The petition, with over 500 signatures, is calling for Jones to be re-instated to his job.

“We are calling for the re-enstatement of ‘Vesi’ and so we have delivered a petition with over 500 names,” Linton said. “This is a clear act of political victimization for doing his job in the most professional and honest way.”

Jones was fired by DASPA after he allowed Leader of the United Workers Party (UWP), Lennox Linton, to dispose of crab backs that he intended to travel with but did not have the required permit to do so last year.

Escorted by a heavy contingent of police, who had camped out at the Woodbridge Bay Port, Linton and the Marigot delegation were not able to meet Bardouille since he was not in his office.

The UWP leader said Bardouille’s action went “far and beyond” the Labour Laws of Dominica.

“He (Jones) was transferred and also sent on leave and then fired, that can not be right,” he stated.

He also noted that it appears Dominica is now a police state.

“Dominica is now a police state,” Linton said. “We came to deliver a simple document and we were met with this heavy police crew. We did not meet Bardouille and was told he was out at a meeting but we left the document with his secretary who also gave us a receipt stating it was delivered to her and she will ensure that Mr. Bardouille gets it. We now await his response and that of the government.”

He warns that they will be following up on the matter until “justice is served” and Jones gets his job back.

      Lennox is not saying he was right or wrong to be exporting the wildlife without a permit. What he is saying, Vesi should not lose his job for doing the right thing. At the end, the wildlife did not leave the country without a permit, so Vesi did his job. Understood?

Who do you think you are blame Linton he was the one who made him lose his job no one else. If he did not try to smuggle the crab backs all that would not happen.

    When I read some of these comments, once again I am reminded of the profound statement made by the late Hon. Pierre Charles, “That Dominicans wear their ignorance like a badge of honor”. Although I would have used the word “SOME” before Dominicans, this statement is proving to be very prophetic for a lot of Dominicans, particularly those who subscribe to the the statement by the PM that “No Law, no Constitution can stop him from doing what he wants to do”. I have not read the la, but I do not think that the law refers to cooked food, (I am subject to correction), I suspect that when crabs were been exported raw and live, coupled with the introduction of specific times when they could be caught, it was necessary for legislation, requiring a permit to take it out of the country is fine, but did Mr linton take it out of the country? There is no law against having cooked crabbacks at the airport, all he had to do was eat his crabbacks, or give it away, he choose to return it to…

      Thank you very well explained at the end of your contribution. With that said the person who allowed Linton to dispose of his belonging, did nothing wrong, hence he should not be fired, this is a case for the labor department, nevertheless whereas everybody in governmental authority in Dominica, is a puppet of Skerrit, justice will never prevail in our country!

      I believe Bradolie or what his name is was instructed by someone perhaps Skerrit to fire the guy simply because the crab backs belong to Linton. This is nothing more than political victimization. The alternative is to take the government to court for wrongfully termination: You know we can cause plenty of damage; by hurting the innocent, only for a while it could be twenty years or more, nevertheless not forever, and when we politicians playing in their feces, and blind no point of praying for them.

Now it appears that the security officer knows them both and allow this to happen. I can guaranty had it been Joe Bloggs the police would take care of business.     My brother was once leaving the state with crab backs without a permit, the officer told him its either they take them away or he send them back to his home. He sent them home. The officer a young lady did not loose her job. This is the truth nothing else but the truth.

      Times have changed. Today, Laws are taken more seriously than in previous times. You must look at it in this manner. Laws do not remain the same. As time progresses, they became more stringent for obvious reasons. In the past too many took advantage of them even those who were supposed to uphold those Laws. Give this a thought.

    Secret passport sales, diplomatic passports selling to whoever for plenty $$$$,
    Bin bobol, land transfer deals defrauding the State’s Treasury of thousands of $$$$$$$$,
    Susan Olde and money given in exchange for diplomatic passport,, Felix Chen money and Layou River saga, Kick-Backs,
    42 charges of fraud filed by GON Emanuel against another Lawyer, Mano and his wife fire-bombed,
    Secret Court cases under permanent judicial Review, investigations stalled,
    Quick enrichment by dubious means by those in Public Office, etc. etc. etc. Too many to mention. Whose behaviour is outrageous? Those in authority who are, and have been found to be engaged in those corrupt acts? People asking where all those money gone? Again the Petro Caribe $60 plus millions owed to Venezuela? Where that gone too? Who in authority have been fired or dealt with?

    Is a very good example on how to get re-hired ? It seems Vesi and Lonynox are not interested in any rehiring, but in confrontation. Vesi should have gone back to the boss and ask for his job back, politely. That is the civilize way. That kind of radicalize habit that Lonynox is promoting is regressive. Why is he so intent on gragging Dominica to street level.
    The police should be congratulated. In law and order prevention is better than cure.
    In some places Lonynox would be asked to leave, and if he refuse would be arrested for trespass, and that is not in police states

      Lennox had every right to either return his crab to his house, or give it away to anyone who would accept it, otherwise he had the right to dump it into a trash bin or in the river. If the fired allowed him to take his thing passed custom, without the permit, authorizing him to do so, then the dismissal of the officer would have been in appropriate, and in order.

      If we live in a democracy, or democracy exists in Dominica, people do have the right to demonstrate, and object to whatever wrong is perpetrated on the citizens of the country. We are at the moment reading on DNO where someone is talking about human rights: Well the Human Rights of the man who did nothing wrong except allow Linton to disposed of some crab back, is a violation of his human rights. Lennox is not doing anything wrong, accept that man, and leave the rotten politics out of it. The man was wrongfully terminated!

    That I heard MP Lennox Linton say on Q95 some weeks ago: ” so I TOOK THE INITIATIVE and returned My crab-backs to My driver so he could return them to My home . .”
    So if MP flips to PM, will we be allowed to use our INITIATIVE when a security officer catches us with contraband at a Port?
    But wait, isn’t that already the norm for some people within the system?

    The Guard needs to be disciplined since other people have been either arrested and/or jailed for the same offense. Maybe termination due to serious misconduct was a bit harsh but he obviously had no authority to make a decision on this matter. He could have been suspended for a month instead. Lennox has worked in HR so he should have some idea about these things and how he would have handled the employee if this had been done under his watch.

    Very unfortunately, Lennox has made this termination about him and not about procedure and so the Guard is the loser. This further approach trying to demonize a manager for taking a decision within his rights is rubbing lime on a fresh cut. The Guard should start to look for work elsewhere and learn from this.

    The man was fired for not adhering to regulations. I do feel sorry for him that he lost his job.
    The Law is, nationals must have a permit which grants them permission to travel to another country with items as crab backs. I would think that all D/cans are fully aware of that.
    Why did Linton not get a permit? I suppose he thought that his status as Leader of the Opposition would grant him preferential treatment.
    The officer had the authorization to confiscate them and dispose of them and not allow Linton to hand them over to someone. He should have known better.
    Employees must follow rules and regulations. Therefore he failed in this respect. How can Linton want him to be reinstated and making a fuss over it?
    Linton himself did not adhere to regulations. A man in his position, he also should have known better. The man also did not. Case should be closed.
    Linton, two wrongs do not make a right. Give the man a job since you were the cause of him losing his job.

    I believe a civil law suit is in order: I believe if someone shows up at the airport with something which requires a permit, and the be-longer of the article was not aware a permit was required, and could not be obtained. Immediately The person to which the article, belong be it it fruits or otherwise, the person should have the right to dispose of the article, buy dumping it into the garbage, or give it to someone to return to his/her or home.

    The owner of whatever it is do have the right to give away whatever it is to anyone who would accept it. We see this too often in Dominica where customs say to someone this cannot go with you, and when they confiscate it, we find that product becomes the property of some custom officer. That is a very bad practice, if not outright thievery!

      A few years ago I visited that was in the 1970’s I collected a quantity of Grafted Mangoes, and some other fruits, when I got to Melville Hall airport I was told I could not exist with my mangos, ect, ect. I ask the custom officer or whatever he was; what shall I do with my belongings. He informed me “you have to leave them here. I told the man, I do not “have to do anything except eating all of my belongings or dump them in the river. I began biting into my mangoes intended to leave them in front of him.

      Luckily; Leeford Castor was from the village of Marigot was the agricultural officer who issued the permits, so by the time sank my big front into a few mangoes, and was getting to smash the pineapples into piece, I Castor approaching, hence; in took a look at my fruits and issued a permit which I paid a few dollars to obtain. Another time I bought a Television and took home for my father, when I got the Airport some scoundrel although I presented him with my receipt, he…

        Well I screwed up on that last one, I meant to say by the time I began to sink my tooth into my fruits I saw Leford approaching he was the agricultural officer from whom I obtained a permit and I left with my belongings. On another occasion of my visit, I bought a Television here and took it home to my father.

        I paid US$125.00 plus a few cents, I got to Dominica and some scoundrel decided to value the TV, at more than two thousand dollars I showed the man my purchase receipt, he informed me “well you all does go into store, and buy things to come here, and you tell the people you will pay them the value, but you want them to give you a receipt for less.” That is the dumbest thing I’d ever heard. If you go into an department store an buy something who will risk their job as a clerk or cashier to involve themselves into something like that. I ask him for a receipt, and told him on my returned Miss TV is leaving with me.When I told my father what happened, he decided to go to pay…

        That should read sank my big front teeth into my mangoes, and was getting ready to smash my pineapples and leave them in front of the man, I saw Castor approaching, he took a look at the remainder of what (me big teeth had not yet chew into,) and issued me a permit for the rest.

        The only reason why one requires a permit to take such out of the country is in order to present, that permit to the port disembarkation, proving that the product is not contaminated, in the case of fruits they are not bring some sort of fruit disease into the country of embarkation. Las Vegas is about three hundred miles from Los Angeles, each time I go to Vegas, halfway between Vegas, and Los Angeles there is a check point where we stop, and are questioned as to wether we are bring fruits into California for obvious reasons such is prevention of bring fruits fly’s into California. Leaving Arizona into California ii is the same!

    I really can’t believe It have some Duminicans supporting this constant embarrassment with Lennox Linton. UWP and their dumb supporters can twist the story how they want. The security officer was wrong and the worst part is he knows he was doing something wrong.The security Officer because he is a poto workers supporter choose on his own to give Lennox a break, knowing fully well he was suppose to have seized the stuff and even fine Lennox. He choose to break the rules of his job for his personal reasons, so don’t blame no one now. On top of that, even if the UWP gang tries to paint a different picture that security officer has had previous problems at work for misconduct etc. And has even been transfered and moved to other locations because of previous incidents. Dominicans don’t waste you time with foolishness. I don’t know who Lennox think he is but if there is any complains etc he needs to make, do like the rest of us civilized people and make an appointment, not creat a pappy…

    Linton said why should there be a number of police officers present just because they came to deliver a letter but i would like to ask him why does he need a number of persons to come along with him just to deliver a letter? was the letter so heavy that he needed help to carry it? And not only that but a number of the persons with him were carrying placard with slogans, doesnt that warrant the presence of police officers to ensure safety of the public?

    I can imagine what will happen if Lennox is prime minister….

    I believe that if Mr. Badouille had gotten the crab backs for himself then Vescott Jones would still be employed. The Hon. Lennox Linton has a moral & legal obligation to fight on behalf of the oppress and down trodden and no matter what, be it comments from the ignoramus , the wicked or plain heartless people, Mr. Linton is a champion and that is what the Leader of opposition must be . The Labor party would like a stuff Teddy Bear as the leader of the opposition but it shall not be.     Cabrit,,,behave,,,,,,,this discretion has been used many time and I witnessed it,,,…..i was also asked years ago to hand this package back, cannot go through with it, very politely.

    This is a simple harassment, victimisation, prejudicial matter because it is Lennox Linton…and in the hunting season albeit.
    This matter should NOT have resulted in total dismissal, of a young man and a lost of job but rather a warning or a slap on the wrists.
    This is very insensitive matter….and politically motivated. Franco Charles a Forestry Officer was quoted on the Chronicle that Lennox Linton should have been arrested………..Mr Charles was one of the obvious , visible campaign manager for Ambrose George.

    I think that Mr. Linton has just made it more difficult for the guy to get his job back. Going to demand that the get his job back when clearly was in the wrong is not a good idea. You are making it more political. The guy Union should have taken that up and negotiate for him to get his job back. Security at the airport is a very serious thing and one should be cautious in exercising discretion. In that case he exercised discretion that was not in his preview. I think that he could have been punished without being fired. That is the ultimate punishment. But instead of Lenox using this as a political game, the guy’s union should be handling this. Lenox remember that you cannot always demand things because when you do that especially when you aren’t entitled to it, you are creating a wall that cannot be pierced.

    I thought crabs had no brain and now crab making headlines. When an item is confisicated at check point you don,t give it back,you report the matter to your supervisor so that he can double check the contents for safety.What was the contents in the crab-back? It could have been anything. Mr. Linton should have known better. If you want the the checker to have his job back, The manager should be made an offer he cannot refused. What was being concealed in that crab-back

    As the years gone by, Dominicans have become more difficult to please. It is the same Linton who has been criticized by Skeritt, the DLP Government, the host of the animal show, Aaron, DLP supporters and the Crazy man, to be a bully and likes confrontation. Quiet peacefully he presented a petition as the constituency representative of Marigot in an effort to have a young man reinstated in his job, for his efforts he has been heavily criticized. In the sixties and seventies before Skeritt became a master of Dominicans, we had endless petitions and strikes being presented on behave of workers. However, since the event of Skeritt as leader of the country, Dominicans are afraid to speak far less strike to protect their jobs. At last, a deliver in the person of Hon. Lennox Linton, the Moses of Dominica, has landed, their is no need to be afraid, Dominicans, to fight for your rights.

    Why does Lennox Linton continue to act this way? Does he show any signs whatsoever of being prime minister material? Even if Dominicans want an alternative to the Labour Party, a Linton led UWP is clearly not the answer. A leader uses the laws of the land and does not make every little issue into a carnival. Seek the proper, lawful method to challenge the dismissal. This is not for the political arena. No one listens to one who is always making noise. Lennox has all the right as Parl Rep and Leader of the Opposition to address issues of wrongful dismissal and abuse on the rights of Dominicans, especially by this Skerrit led DLP illegal government. Mr. Linton is not making a little issue into a carnival but is instead bringing the issues to the forefront. a mans livelihood is on the line here and here we are marginalizing. where will it end or rather when will it end. the problem is the very issues we deem irrelevant now are the very issues that will come back and bite us in the ass. the thing is no issue is ever too small to address when your freedom is at stake. our country is supposed to be a democratic state but some of our leaders and lots of our fellowmen don’t seem to accept that fact simply because party politics. wake up people wake up. had Dr. Martin Luther King felt the same way would America be the country it is today. had Nelson Mandela felt the same way would south Africa be what it is today.     The officer did not follow protocol, which is to report the matter involving exportation of wildlife without a permit, to his superior, which he clearly did not do. Instead he decided to brush the matter under the carpet to protect his parl-rep . It doesn’t matter who was involved, wrong is wrong. I know other DASPA security officers who did not follow protocol and were FIRED and nobody made it an issue, so whats the issue?

      Cabrit,,,behave,,,,,,,this discretion has been used many time and I witnessed it,,,…..i was also asked years ago to hand this package back, cannot go through with it, very politely.

      This is a simple harassment, victimisation, prejudicial matter because it is Lennox Linton…and in the hunting season albeit.
      This matter should NOT have resulted in total dismissal, of a young man and a lost of job but rather a warning or a slap on the wrists.
      This is very insensitive matter….and politically motivated. Franco Charles a Forestry Officer was quoted on the Chronicle that Lennox Linton should have been arrested………..Mr Charles was one of the obvious , visible campaign manager for Ambrose George.

      There were instances he did report to his supervisor and he was told to use his description as the persons involved were Labour Party operatives and one being a high court judge….so he simply followed his supervisors advice and used his discretion….the kairi fm man travelled with 8 rounds of ammunition in his bag unknowing to him…security didn’t pick it up…the only reason he wasn’t arrested on arrival in st thomas is because he was an ex police officer there… A report was written yet no officer was fired or disciplined…why did they hide the old log book with many other instances recorded where persons were allowed to travel and the had crab backs out of season without a permit…

I can understand that if somebody is transported LIVE crabs or similar sort which is illegal can be arrested but not dead meat or food which is served in the restaurant!!! The custom officer had no right to allow Linton to dispose of the items, the items should be removed from him and placed in the garbage..no where today travellers are allowed to move away from the customs officers to dispose / hide / give to someone else, anything. Once again we can clearly see that these customs officers need proper training to carry out their duties effectively and with a high level of professionalism.

Besides the factual errors, do you really, really believe Mr. Jones should have been sacked because he allowed the crab backs to be returned? What is the great crime in his decision? Many persons have arrived at the security of the departure lounge with items that were not allowed through and permitted by the Port Authority employees to hand over to a family member or friend who has accompanied them to the airport. Should all the employees be fired for this harmless discretion?

        There is a difference between having liquids for example or pepper sauce etc. which you can’t carry in hand luggage which you can be allowed to take back out and pack in your suitcase as opposed to items which are prohibited without a licence or other documentation.
        The thing is that so many people are making comments here who do not know the young man or anything about the situation. The situation with this young man is so sad because he is such a lovely and caring person and it is heart-wrenching to know that he is the one who fell into this misfortune.

        I would think that rather than making this into a political melee and probably making it worse for the young man, the over 500 people who signed the petition should each have contributed $20 to assist him in getting a good lawyer to fight his dismissal in court and have him compensated if not re-instated. Political posturing should have no place in an employer/employee industrial relations matter.

        All Arturo has to do is to test the system next time he is in Dominica or better still ask someone to do it. Then he wild have the best opportunity to determine whether crab meat is indeed wildlife as defined by the law. The law and practice has been in operation since 1976 – no change. mr. Linton took on the leadership of his party just over a year ago. Suddenly he finds problem with the law and not only that, he is blaming by inference PM Skerrit for the definition of the law and its method of implementation. He might as well stay in his ignorance of the law as he claims and then work, now that he is Parl Rep to change the law and make it easier for people to travel overseas with wildlife without a permit. That would be the most sensible thing to do – work to change the law. He instead is seeking to change the definition of the law. By the way there are laws which deals with wrongful dismissal. Mr. Linton as he says is a Human Resource Management Practitoner. He should know that.

        Skeritt paid no one got in trouble, not even the Registrar whoes responsibility it was to ensure that the proper fees were collected. It was Lennox who exposed this matter. Now Lennox has violated the law by attempting to leave the Island with crab backs without the required permit, he claims he was ignorant of the law relating to the export of wildlife. The security officer did not do his job as required by law and was fired pure and simple. Too many people believe that the politicians they support are little gods and can do no wrong. If you ask the 500 people who signed the petition about the recent election they will all tell you that skeritt broke the law to win the elections. But these same people fail to accept that Lennox VIOLATED the law and is now trying to blame the Port CEO for the young man loosing his job. We cannot choose which law is good to break.

    Why the heavy police presence? Are they afraid of Lennox Linton, is he too powerful for them? And mr. Bardouille, you are a coward, avoiding mr. |Linton. I know you are squeezed between ship and dock but a real man must stand up for what is right. That has nothing to do with politics but common decency.

    I guess when one doesn’t have a real job he has to create work for himself. Wasn’t Linton the same one who ran a campaign on right and wrong? The questions are:
    1. did Mr. Jones follow protocol?
    2. why didn’t Linton stand up for the many people who were detained, missed their flights/boat and charged for similar offenses? DNO carried a few of those stories.
    3. why doesn’t Mr. Jones challenge it in court if he feels it was political victimization?
    It’s just more of the same with the UWP, fighting losing battles. Probably the UWP should boycott parliament until Jones get back his job.

      In Peurto Rico, They told me that I could not enter with meat sandwhich. I could either go out and eat it or dispose of it. It was a busy day and I told him I was very hungry and that I would eat in the lounge. He gave me a pass. Ate my sandwich peacefully whilst waiting on the flight.

        @ World Cup I find that very hard to swallow PR is one of the nastiest place for other island nationals to enter everyone knows they don’t like us, but it all have to do with what type of food you had, if I may ask was it cooked crab backs you had?

      I was saying the same thing , they keep hiding from him , yet they are saying he is not educated but they refuse to meet with Mr Linton face to face to have a constructive conversation. Mr Linton is the best thing that has ever happen to Dominica in a long time . He has not fear and lots of humanity and i love him for that . change is a must .

        You all really believe that gainfully employed people have time to waste with Linton and his BS. This guy should be arrested every time he try to disturb the peace and tranquility of dominicans who are trying to work and concentrate on what they are doing.. Really if Linton believe every time he mus t stage a public protest to be heard and seen and to be in the limelight tell him to think again.in my view he is a public nuisance.

        Get this man out of the news I really need to read something more stimulating about dominica.. Linton has a lot of free idle time on his hands. Bardouille on the other hand does not…the police has to be present whether it’s a peaceful protest or not we are not living in the Wild West. Dominica is governed by laws, the last time I read. I believe this guy gas done more protest in dominica than any one else. What a joker..

      That is a good observaiton. It looks like mr. Skerrit is even delaying the opening of parliament because he dreads facing mr. Linton in the House. TYhe longer he waits hte weaker he looks.
