Skerrit awaits court ruling

A High Court judge Friday reserved judgment in the dual citizenship case involving Prime Minister Roosevelt Skerrit and his Education Minister Petter Saint Jean after two days of hearing arguments.

Justice Gertel Thom is expected to make a determination whether the two ministers should be ordered to disclose their passports in answer to charges that they held dual citizenship at the time they were nominated to contest the December 2009 general election that was won by Skerrit’s Dominica Labour Party (DLP)..

The main opposition United Workers Party (UWP) had petitioned the court to overturn the election victories of Skerrit and Saint Jean on the grounds that they were citizens of France at the time of the polls.

In its petition, the opposition party stated that their nominations and subsequent election should be declared “void and of no legal effect.”

Senior Counsel Anthony Astaphan told the court on Friday that his clients had no obligation to submit their passports since the onus was on the UWP to prove its case against the two elected officials.

Astaphan described the UWP team as being on a “fishing expedition” in search of evidence.

But Trinidad-born Senior Counsel, Douglas Mendes, who is representing the UWP, argued otherwise, urging that there should be disclosure of the passports of Skerrit and Saint Jean.

He argued that a fair trial would require that both sides be given the opportunity to see all documents relevant to the proceedings.

    The UWP cannot prove their case because they have no evidence to substantiate their claim of dual citizenship. Disclosure should only be requested when the courts have in their possession that which is relevant to the case. The Court cannot disclose what they don’t have. You cannot ask the court to order the defendant to bring into evidence information which will place them in a negative light. When presenting a matter before the court any lawyer would have to be able to put forward tangible and substantial evidence to support their case.

    For argument sake, lets say the P.M and Hon St. Jean requested from the French Government to revoked their French Citizenship, then that said Passport would be in the possession of the Government of France. There fore the Prime Minister and Hon. St. Jean of his lawyers should not have those documents. A passport is the property of the country that issued the passport.

      What de hell does passport have to do with dual citizenship? So many French citizens or even Dominicans do not hold passports. Aren’t they nevertheless citizens….Tony and the UWP lawyers are taking you all for a jolly ride!!!
      Let’s face it. You may be a citizen and never ever apply for a passport. We all know where to find out officially if these two gentlemen were at the time of nominations holding French citizenshi, so cut the crap!!!!

    Has it occured to everyone that if the court rules that the PM & Petter were illegal, that all that needs to be done is to call a by-election in the respective constituencies? The Labour party will still win, whether we like it or not! For the sake of the PM and Petter I wish there would be a by-election in order to put an end to all this. That way, when they do win AGAIN, there will be no need to say that they were illegal.

      I do not mind them winning when a by-election is called if the Court decides they were not at the time eligible to contest. As long as it is done fairly, that’s all I need. It is important that rules are upheld and our people must respect the laws/rules of a country. Think of our kids. You cannot tell your child not to steal/ lie and then go about doing the same thing infront of the child. What kind of example is being set?

    So is the prosecution saying that their case is dependent on the accused passports? Wouldn’t the prosecution have the details of citizenship without the passport? The citizenship was obtained before the passport, so why would the case be based on the passport and not the citizenship document? You obtain citizenship before you can get a passport and the passport, at least from my experience, doesn’t show the date of citizenship. And why is the case so dependent on the passport?

    These questions are going through my mind along with many others. I would like to think that i am open minded enough and not naive to realize that this case is not about the CONSTITUTION and the Law…because i’m sure if it was, then there must be a new Constitution which i am unaware of. I am sure is it is not the same one as it was before my birth, when there were instances of other ministers having dual citizenship. I am sure it is not the same Constitution, for it would mean that the laws were being broken from way before.

    I hope that i am not mistaken, because if this is all about the Constitution, the laws of the land, which guarantees everyone the same sense of Justice – Innocent until proven guilty, the onus is not on the defense, the prosecution has to bring a case on the merits and not expect the defense to prove its case, but rather dispute its facts or allegations. There is no reverse onus here. The defense should not have to prove it’s innocence in the absence of a case by the prosecution. The prosecution should have some basis for bringing this motion before the judge and if it’s other evidence is not substantial enough to have a case on the merits then i do not see the point of the disclosure.

    I’m sure it’s not that Constitution which we are talking about!!!!

    But i am naive, and my naivete has led me to conclude that this is not about DOMINICA nor it’s CONSTITUTION – it’s about SKERRIT, and the need to get rid of him at all cost, even that of highlighting the HYPOCRISY of everything Dominica. After all, if the Constitution doesn’t fit me now as it’s being violated and raped, but when it suits me….what Constitution?

    UWPites, it is simple, the PM and Saint jean do not have to produce passports. that is law. they did not brng the case to court. This is about law of the land, based on the law the Pm and St. jean do not have to produce any passport. We must respect the law. Once again the UWp has demonstrated it is not equipped to rule the land. they go to court ill prepared, just as the faced the elctorate ill-prepared.

    The court and people of Dominica should demand that the pm and hon. Minister bring everything relating to the case on the table, including passports which will enable the court to make the right decision. This is a serious matter relating to our constitution, all politics aside. Every law abiding citizen of Dominica would want the law of the land be respected and obeyed by all, especially by our leaders who should lead by example.

      This is absurd! Why should the PM or Petter be forced to produce their passport? for argument sake, let’s say that you accused me of stealing dasheen. Isn’t the onus on you to show the courts the dasheen that you have accused me of stealing? Why must I be the one to bring the evidence to the court? Why would I want to incriminate myself?

    It would be a real shame on Dominica if the PM had to step down from his post. THere is no way anyone is going to find him guilty of such a charge- that’s just the facts- he is the PM he has the law on his dise. If is me and you then we will have to deal with the consequences.     Skerritt himself claimed that he possessed a FRENCH passport and by virtue of that disclosure he would have DUAL CITIZENSHIP. Skerritt and Petter St. Jean both wrote to the French Embassy seeking to denounce their French Citizenship. Isn’t that TRUE? If they did not hold French citizenship, why request from the French Embassy to denounce it?

    What is WRONG is RIGHT those days in Dominica? Nothing done against the constitution is WRONG. CHEATING is NOT WRONG? A candidate going up for election to be in Public Office, GIVES FALSE INFORMATION on the Nomination Form to the Electoral Commission responsible for conducting election, is not WRONG. Dominicans those days LYING is accepted in our society as normal?

    If some of you people love Skerritt and the Labour Party, Fine, NO PROBLEM. But if he did something WRONG is that OK, NO PROBLEM TOO? You love your son or daughter. Good Certainly love them. But if your son or daughter commits an illegal act, embezzle money from his or her place of work, cheats an exam, creates problems at school, would you tell them that’s Ok, go and do more WRONG, nothing will happen to you?     Skerritt and Petter admitted that they held dual citizenship at the time,. Is there any TRUTH in that? And if it is true did they disrespect the LAW? Your Guess is as good as mine.     This is a very interesting case. First off, I believe that Senior Counsel is right IN PRINCIPLE that a person who brings a case against someone else should have to prove his/her case. Imagine if any of us fell victim to other persons who accused us wrongly and who then expect us to provide the evidence for them to prove their case. This seems very unfair and wrong, especially if one is falsely accused.

    On the other hand, especially if the ministers are innocent, they should gladly give their passports to the Courts to examine and let the chips fall where they may. It is either they and all previous dual citizen ministers knowingly broke the laws over the years or they did not. If it is wrong for Skerrit and St Jean, then it is wrong retroactively.

    The Courts may have to then decide to nullify the sitting of every single minister who committed the infraction since the Constitution or decide to enforce the elections laws going forward. The Electoral Commission would then be charged with conducting and managing elections according to the laws of Dominica or face stringent charges, including imprisonment. After all, they were responsible to check that all persons nominated for elections were qualified to do so.

    Enough already with the distractions! IT IS TIME FOR THE COURT to make a decision in the best interest of the Country and move on. After all, what the Constitution was hoping to do was to protect the Country from all evil and evil intended people….to ensure that no one would harm it and its people in any way.

    The Court needs to put this situation in the correct context (consult every major judiciary if they have to) and decide in the best interest of the people. The same way a precedent was set in Jamaica, a new one could be set for this case in Dominica. Otherwise, the Jamaican law can be observed. Whatever, let us just move on please.

    P.S. Skerrit should think before he speaks or throws tantrums. His angry words about “no constitution…” is a big part of this problem.

    No offence to uwp supporters. And I’m not here to get under anyone’s skin. Honestly, I think the case was held in a fair way. Things like that could lose supporters for Skerrit if it was exposed to have been corrupt. Secondly, if he was to lose, uwp will still be in the shadows because “in my opinion”, and I’ll say again, “in my opinion”. Labour is doing well for the country. They are more popular than uwp by far and it is unlikely for that to change soon. Even without Skerrit. And no I don’t support labour. I support Dca.

I wonder if there was a counter suit by the Skerrit what would the results be.

      I am not a supporter of neither parties and the UWP most definately needs to go back to the drawing board if they want to have any type of serious opposition.     I listened to Puke95 for a few minutes the other day….the host was in a conversation with Cecil Joseph about comments he had made on Libya.

    To make a long story short, I never thought it was possible for a media organization to be more biased than Fox News, but Puke95 takes the cake!!

    Sadly, not everyone is like myself and other DNO readers who have fulll internet access and the will to inform themselves from various sources on topics. These Puke95 hosts are preying on the ignorance and gullibility of people who have limited access to information..They are also inciting hatred.

    Like a lot of Dominicans I want peace in D/a and would wish that the conclusion of this case would bring peace. But as long as there are political activists masquerading as media workers on Puke95 there will be no peace…

    Even if Skerrit wins his case we already know they are going to say its because the court system is compromised, and the hating will go on.

      Dominicans need all the prayers they can get because all I can see is the opposition and their rag tag team of bandits taking the country to hell in a hand basket.
      Lots of people may not have the means to read and see what’s going on around the world but some do have radios and can hear what is going on. We are not the worst by far.
      Dominica has come a long way since Skerrit has been in power. Does it needs improvement? yes it does. Government alone can’t do it, we all have to do our part in some shape or form.
      As for the UWP and others what is their goal for Dominica and the people? All they are doing is barking and braying. No one is coming up with an alternative to what they can or will do for the country, just a bunch of empty vessels making a whole lot of noise.

      It’s time to grow up you men and women. Stop acting like little kids that had their toys taken away.
      Opposing everything for opposing sake is not going to help. All it will does is set us back.
      Try to come up with some better plans than what Skerritt and his party has come up with and maybe then the people will begin to take you seriously. Until then if you can’t come up with a concrete plan on how you are going to bring better development for your people and country just put up or shut up.
      Skerrit; continue to do what you’re doing for Dominica Just be honest and transparent in all you do.
      Be the PM for all Dominicans not only for those who voted you.
      To my people also, don’t just look for hand outs. Try to be self sufficient. I look around and see the Haitians cultivating the land you all feel is too degrading to do. Dominica is your birthright begin treating it like it’s yours. Stop losing your identity to America.
      You all pattern after everything you see on TV. America is not a good role model to pattern after.
      Look what is hapening to them right now. I look at that country as being the modern day Sodom and Gomorrah. I can see we are going down that same path unless we regain our own identity.

      I will continue to pray for my country and it’s people because it’s the land of my birth and I’m 100%

          I usually listen to DBS talking point or whatever is going on while i’m at work, but they were having some issues so i’m like ok, maybe i will try Q95 not being aware that they had their own talk show and boy was i in for a surprise. Angello was interviewing someone and asking questions about what he thought about a particular subject to do do with the prime minister so the dude was like i can’t really comment about that issue until i have more information, he angello kept on pushing and pushing trying to get the guy to talk and say something negative, and i’m thinking to myself are you serious? Then in between peeps calling these guys were making unpolite comments about skerrit, not about the labor party but the leader, now someone please tell me if this is OK? After being subject to this i just closed my browser and shook my head in disbelief. One day someone from that station will pay for their mouth. Now i know ya’ll will try to attack me but who cares, this was not hear say, i heard it myself on Q95 peeps.

    I do not have to wait for the court to decide on the outcome of this case, Bases on the injustice and lawlessness going on in Dominica, it is going to be an easy victory for Skerrit. However, what we must not forget is this: because the court gives their judgement which most times is unfair and very bias, that does not really make a person the winner in the face of the public. As far as the public and law abiding citizens are concerned, Skerrit has destroyed our very proud reputation and makes us look stupid in the eyes of the world. If Mr Skerrit cared about Dominica as many think, he would have put Dominica first and graciously resign.

    They did not break the law the precedence was set when Green was appointed with dual citizenship, so base on Dominica precidence not Jamaica but Dominica and Dominica constitution they did not break any law. So our PM was right in his statement that no constitution could sto him, because he was within the constitution. I can say no law will put me in ail, reason I have not broken any laws. We must understand context of statements. The PM did not break any laws if he got his citizenship based on his mother.
    So the fishing expitditon hoping for something to turn up in court, have to stop. Let us go back to mature politicks. UWP represent the peole in the house, formulate a plan for dominica and show the peole that u are a viable alternative to the Labour Party, stop wasting valuable resources of time and money.

    Am from SVG & and I go on other Caribbean news blog site, to read about what happening in their country. I have never been to your country, but am planning to be there in the future! With one of my friend from Dcan…; Dominicans concerning the PM Dual citizenship, I personally don’t agree with anyone who is running for the highest office in the land should have a Dual citizenship, am not living there so I wouldn’t know your constitution. The laws about someone with a Dual citizenship running for the highest office in the land, if something as confusing like that to happen in SVG, we’ll be protesting every day until the Gov resign. Dual citizenship, let say in the future the Gov, get caught up in a conspiracy, and to the best of his knowledge, he know he will be going to prison, what makes you think he will stick around to go to prison..? I doubt it; he will go back to his second country, and what will make situation worse, if your country doesn’t has any diplomatic right with that country to go in and take him out. Just a theory…

        @ love: Once a ruler has fear of Allah, he implements justice, he is able to execute his duties professionally it really doesn’t matter his ‘nationality.’ Nationalism and racism goes hand in hand. I do not believe in that; I do not care about being ‘Dominican,’ that is a stupid name invented by the liar Christopher Columbus. I’m muslim first before everything else. What does that mean, it means one who submits to Allah only. Therefore, we reject democracy, socialism and all the other isms except Islam. We believe that only Allah’s laws are supreme not man made laws. We worship Allah alone without any intermediaries etc.

        With that said, this court case is a retarded one. Skerrit can have 10 passports, once he does not show enmity to Islam we cool. At least when Skerrit met me personally he extends the message of peace, he has contacts with some Islamic countries, just the other day the avenues for scholarships have been opened up in Morocco.

        The Dominican society is too dam hypocritical, Mr Skerrit is a citizen of Dominica as well. Stop the nationalistic rubbish! Why Ron Green and the other persons are not prosecuted as well? You people have too much envy and jealousy, dam hypocrite talking about law, what law? Stupes! You call that law?

        Mr Skerrit, you can have 10 passports, Tony do right, don’t show them no passport, stall the case if you have too because I find that is rubbish! Get a better case to call, for example, if Skerrit molest a little girl, or there is ‘evidence’ that suggests he is involved in cocaine or some major crime like that.           Let’s legalize marijuana and cocaine while we’re at it, imo the criminalization of these drugs is a waste of time. Drugs on a whole should be legal. People should be free to do what they want with their bodies as long as they don’t hurt other people. Now in the essence of balance while we’re taking away laws let’s add some. There should be a law against religious harrasment, i.e. people who hound others with their religious beliefs.

    If you for example mouth of the south, the case involving the people who was found dead on sea the other day. The people who were charged for the offence the case was dismissed due to lack of evidence.

    That is the same that should happen with the PM and St Jean case, you cannot take someone to court without evidence and want the people you take to court to present the evidence for you. Bullsh*t.

    It is the prosecution’s (in this case the UWP) job to prove their case. The burden of proof lies in the hands of the prosecution.

    The Defense is not obliged to present the prosecution with any such evidence that it knows with put it’s clients in trouble. For that matter, it has nothing to do other than to sit and defend itself based on evidence brought forth by Mendes. It is simple.

    To ask the Defense to present such documents, in my mind goes beyond the rules of law.

    Honestly it is just a waste of taxpayers money to be in court. Both parties do the same and they are just there picking on each others weaknesses. I always say political parties are just there for power sake not developing our country. Most of the ruling party’s tactics are geared towards making the pm look like the good Samaritan. Its our tax payers money and foreign governments taxes that are being used there. There are so many inefficiencies in the government service. we work hard and so many of our tax dollars are used to subsidy laziness for votes sake. I think we should all be prepared to work and make sacrifices. These political parties are there fighting each other and it is not teaching our peoples to be humble and admit that we are not perfect and we need each other to make it durring hard economic times. Folks please read educate ourselves and stop being labor workers or pappy because great granma, granpa, parents were labor workers or pappy……….

      Political Science, I agree with you. To prove dual citizenship the individuals have to hold a passport from the country in question also. Roosevelt is a Dominican, born and bread.

      To those on the other side, so what if he had gone to another country and became a citizen there. Venezualans and some other countries in the USA vote for their country all the time.

      Astaphan, I hope you DO NOT role over or bend backwards. The UWP is questioning Skeritt’s and St. Jean’s citizenship, and representing the UWP is TRINIDAD BORN counsel, NON DOMINICAN CITIZEN. Show me the difference. What make the UWP think that even if Roosevelt should no longer be the PM they would be in the PM position.

      Skeritt and St. Jean, you DO NOT have to produce anything. You hold your Dominican passport and your birth certificate that say you are Dominicans. Also, let the UWP spend the money that they should use to help the Dominicans fighting. Give it a rest people, the term is almost over, you will get your turn.

      Thought UWP was already in control and did nothing? What is it they want to do that they have not already done? cripple the country more?

    If the rules are followed and the PM provides his itinerary when he is traveling, all the opposition has to do is get those records to include the passport used from the countries where he went. Might be difficult, but doable. But something tells me that those trails are cold and possibly no longer exist.

    On the other hand, is Tony getting paid simply to say that they are not presenting this passport? What if the judge says that it has to be presented, is that the end of the case? I hope not.

    I know that the burden of proof is on the opposition this time, but if there is nothing to hide, what’s the big deal? Why go through all this if the man is not guilty? This just sounds real dishonest to me.

I have one request: Let’s talk about the case at hand which involves the PM and whether he had dual citizenship when he contested the elections. Not about the Chinese, Haitians or people from the Dominican Republic. Those can be discussed anther time.

        It just seems like every time there is a discussion or debate about the PM, some people forget about having a clear objective discussion, but instead, always making comparisons to everyone else. If I say Skerrit is a thief, their response is, “ Ron is a thief too”. If I say Skerrit is wicked, they say Eddo wicked too. Is that all there can be? We are here talking about the PM and dual citizenship, you talking about the Chinese and them not employing Dominicans. The Chinese not the PM. Skerro is the PM. ..the Dominicans are not PM.. Skerro is…Now again, the question is whether Skerro had dual citizenship..answer that and stop telling me about Chinese and Eddo and Mamo and everybody else. We can discuss those another time.     Even if court overturns both Skerrit and St Jean’s election victories making them null and void, the UWP and Athie Martin have still not been victorious. As long as both ministers have renounced their foreign citizenship, a bye-election can be called for both constituencies, and we will see both Skerrit and St Jean victorious again at the polls. Another minister can act as Prime Minister in the interim until Skerrit makes his way back
