UWP responds to by-election declaration; calls it unconstitutional

UWP leader Ron Green

(DNO) Leader of the United Workers Party (UWP) Ron Green has described as unconstitutional, an announcement by Prime Minister Roosevelt Skerrit that by-elections will be held in Dominica on July 09, 2010.

Green said in a statement on Tuesday, that any by-election without establishing definitively and by which competent authority, the Marigot and Salisbury seat are vacant is unconstitutional.

He said to date neither Prime Minister Skerrit, the Attorney General nor the Speaker of the House of Assembly has informed the citizens of Dominica “definitively” as to who declared the seats vacant and by what authority.

“This call for by-election should be considered unconstitutional. The UWP will continue to listen to the people and represent their call for honesty, integrity, good governance and a productive economy. The UWP will continue to do things right following our constitution,” he said.

According to Green, the UWP stands firm for real democracy, and denounces fraudulent elections and as such the UWP will continue to work hard to advocate and mobilize for electoral reform, “such as ID cards, clean voting list, fair access to the Nation Station…”

He said Dominicans near and far should realize that it’s only by breaking the silence of the night and reaching out to each other that justice will prevail “and trickery deception, greed, lies, arrogance and other evils will fade away.”

Skerrit’s DLP won 18 of the 21 seats in parliament, but the UWP started a boycott following the announcement of election results, claiming that there were irregularities in the poll.

Elected member for Marigot Edison James, Salisbury’s Hector John and Roseau Central’s Norris Provost have been boycotting parliament in protest.

However Prevost managed to keep his seat after attending the third parliamentary sitting.

House Speaker Alix Boyd Knights declared the two seats vacant last month after the parliamentarians missed three consecutive sittings of parliament.

Prime Minister Skerrit said Monday that the by-elections were “unfortunate but necessary in our quest to uphold the provisions of the constitution”.

By-election date is 9 July with nomination day on 21 June.

    El Presidente, and I mean Liverpool not Castro or Chavez, should call for fresh general elections with ID cards and no diaspora. If you don’t live in the country then you have no right to determine how others live, we are not a colony anymore and you are not our slave-masters so stop pulling our strings.

    Dear my lil used to be friend of the family, I thought u stop running your mouth. Fella, all the time you and your guys were calling for a re-run in a few constituencies. All of a sudden the La Plaine issue and Mr. St. Jean drop. I never understood y. So much was being said about that seat. Y was it then a 3-seat issue. You’ll wanted a re-run and now u get it, your talk changing. The governing party cannot just do as the opposition say. Ok, maybe the wrong person decleared the seats vaccant but doesn’t the same constitution say about missing 3 parliamentary sittings in a row? The call should be on the President now to do his thing. Anyway, I wish u guys luck.

    As Ron Green the leader of the opposition have stated the bye-election is unconstitutional, then the UWP will not be putting up candidates for this bye-election. They cannot without withdrawing all their claims of unconstituionalism.

    Well in view of Mr. Greens comment, the UWP have only one choice, that is not to participate in this illegal by-election. Remember they have said the last election was fraudulent and the government illigale, and now they are saying there is no authority which can declare their seats empty. therefore they have a principle right to refused to take part in the by-election. If they participate they will be saying that they were wrong all along and the government is legally elected by the people, and therefore the question needs to be ask, so why were they boycotting the house again?
    So these are the men who want to lead the country?hhhhhhhmmmmmmmmm ,interesting scenario. They have boxed themselves in a corner, They honestly cannot participate in this by -election. I dont think Ron is that stupid, but Ron have just made it impossible for Eddison and Spraggs to participate by his comments. Are they willing to legitimise the action of the PM, that is what they will be doing if they participate. Making themselves into jokers. They have established there owm peoples parliament, representing the 12,000 votes they got. So a minority would like to rule the majority who have rejected them.hmmmm, then they talk about democracy.

    I don’t understand how a man( Mr Ron Green) who is fighting to be the Prime Minister of the country ( and didn’t even win his seat) does not even know the constitution of the Land. What is so difficult to understand, that missing three sittings of the house disqualifies one from being a member of the house? And Mr Green, James and John should tell us why is it that Prevost rushed to take the oath after missing two sittings of the house. Is there something that Prevost knew that Edison and Hector does not know? Earl Williams knew it when he was studying to be a Lawyer, coming to attend Parliament every third sitting after missing two parliamentary sittings. Peter Carbon knew it when he was parliamentary representative of Wesley, coming down from the Virgin Islands to avoid having his seat vacated. Are Mr Green, Mr James and Mr John so dunse that the former Minister of Instruments(even before he became a Lawyer) could understand the principle of three misses and you are out while they can’t?. Even Romanus Bannis would have known what these three men are ignorant about.

    I am not politically savy but I know that based on the Constitution, the Speaker is the one in charge of the proceedings of the house. When Edison and Hector wanted to find an excuse to stay out of the third parliamentary proceding, did they write to the President , or to the Prime Minister or to some other authority? No. The addressed the Speaker. Isn’t that enough to establish that the Speaker has the authority when it comes to house matters?

    Mr Green once again is showing his ineptness and attempting to frustrate the political process by coming up with his competent authority nonsense.
    Mr Green let me tell you who declared your seat vacant-The Speaker of the House – and the authority- The Constitution. Go read it for your self.

    So you need to come better than that.

    According to Green, “the UWP stands firm for real democracy”. It will be left to be seen whether his party will participate in the bye-elections which according to him is unconstitutional. Or maybe he needs to take it to the court again to be thrown out as the pattern has been.

    According to some who say it is unconstitutional, you mean the election is going to or not happen?And if that is the case, the reader should understand that the PM made a statement and it is going to happen, so if the other parties do not fill their positions and the elections are not contested by other parties, what would that mean? Therefore the fact is the elections will take place on the day I guarantee you that peolple will go and vote, especially those that people say the PM will chater from the US and other places like he did in the last election and so guess who will win. Or maybe the other parties can take a page in the PM book, and learn to take their oath seriously?

U all losers knew that a by-elections were on the cards thats why u sent prevost on the 3rd sitting because u all knew it would be very difficult for him to retain his seat, while the member for salisbury and marigot laid back feeling large and incharge. green stop your foolishness there is nothing unconstitutional about the PM’s announcement. the technique UWP used by sending prevost on the 3rd sitting is simply showing you all knew what lies ahead.

    Although President Liverpool in a prophetic speech to Parliament in June 2009, forewarned that neither Parliament nor the Speaker Alix Boyd Knights could invoke Parliament to declare seats vacant, his advise fell by the wayside. He instructed that the matter would best be decided by the High Court. It fell on deaf ears. Someone of the caliber of the President, a learned legal mind versed on matters of the constitution is not an Executive President and therefore has to very often do the bidding of the PM Skerritt without question. Should the PM simply inform the experienced, learned Liverpool, about issuing a writ for bye-election and expect him to just sign the writ? Did the PM, the SPEAKER, the AG, or the GOVT legal adviser listen to the advice of the President on that matter? Should the President now just pay heed to their advice, whether it would have serious CONSTITUTIONAL implications for our democracy and issue writ or agree for bye-election? The President’s credibility is certainly at stake here in that crisis. The situation exposes the problems therein and the POWER that Skerritt has taken unto himself to govern with no integrity, accountability or regard for the CONSTITUTION or to seek advice from his learned elders. Is the President too old to give legal advice? The whole of Dominica will be watching and listening to what will unfold and how President Liverpool will react to the unwise call for bye-election.

    The Speaker, the AG, the PM, the GOVT legal adviser, supporters of DLP GOVT. are yet to tell or show us Dominicans which section of the CONSTITUTION, the highest LAW of the land, gives the Speaker the RIGHT to declare seats vacant? If in the HIGHEST LAWS OF DOMINICA, nowhere it states that the SPEAKER has the authority, where did she take that right from? Sincerely, the Framers of that CONSTITUTION would be lacking foresight and would have done a great injustice to give any Speaker the Power to excuse or not to excuse a member of Parliament from attendance at parliamentary meetings and added to that still give that same Speaker more power to declare those Members’ seats vacant. My people, are you dismissing those framers as fools, who did not know what they were doing? The only intelligent people in Dominica are DLP and those now in GOVT.? Any other Dominican wise enough to visualize the trends and who dare question the haste for ABSOLUTE POWER need to shut up or put up and accept any illegalities? DOMINICA FOR ALL DOMINICANS, NOT FOR A FEW WHO FEEL THEY COULD DO WHAT THEY WANT even their actions are very questionable and think that our CONSTITUTION does not matter to them. A stitch in time saves nine Mr. President. Do not allow bad precedents to be set. Do the correct thing according to your conscience and the CONSTITUTION, the latter which you have all those years of your life vow to respect and protect.

      Absolutely Power! Judging from your writing it appears that you’re well schooled, but you continue to display attitudes and utterances that are reminiscent of someone with a qualification of the UWP Constitutional/Legal Advisor Attorney Lennox Linton BC; GR; (Birth Certificate; Good Reader).

      Mr. Green and the UWP must be happy to have people like you write on their behalf, but my friend your utterances (writing) are total rubbish. The Constitution has provisions for redress for anyone who thinks that he/she is being taken advantage of. Should Mr. Green and the UWP are serious about the constitutionality of the Speaker, Prime Minister, President, Attorney General and the Government by extension for taking action which are in breach of the Constitution, the one party who can address such a violation is the High Court.

      Is Mr. Green and the UWP and you Absolute Power expect the parties that you named above will take themselves to court, this is the function of the UWP, Mr. Green and you.
      Surely, the UWP are again seeking sympathy and continues to play on the intelligence of people like you Absolute Power. I believe it’s time for people like you to wise up and listen to people without an exe to grind, as it were, not Attorney Lennox Linton whose only legal qualification is a (GR) Good Reader and no legal qualification. Then and only then you’ll have a better view of the Constitution and is provisions.

      UWP must now prove to Dominica and the world that they’re serious about electoral reform by not participating in this sham by the illegal government. By the way if the illegal government calls for by election in Marigot and Salisbury, then this should be of no consequence to the UWP since the Government is illegal. All they need to do is continue to hold on to the premise that they’re the legally elected representatives and no illegal government (DLP Government) can remove them, any participated will be viewed otherwise.

        It amazes me how people in here as soon as they disagree with someone’s openion, they call it utter rubbish. The fact is there are few people in here who truly do not have an axe to grind. having lived away from Dominica for so long, I have developed a true understanding of the partisanship of the people and their openions, I respect everyones’s openions and believe that although there is a vested interest in some, most are fair minded people who truly love and care about the advancement of Dominica. That being said, there is something sinister about one of the three memebers of the oposition taking the vow.I believe that the uwp considers Prevost’s seat in trouble in a bye election and the other two save, so thats why they sent him to take the oath, if that is true, the integrity question goes out the window, because if you believe you are in the right, or atleast protesting for a worthy cause, why the underhandedness.

      my point exactly. they should clear the way and allow the green party the opportunity of representing some people. I am with Labour, but don’t support an entirely red house. There needs to be some mix. UWP clearly does not wish to be a part of the mix.
