Patrick John’s football woes

His future as a football executive hangs in the balance, with Saturday June 30 expected to be  decision day at the Football House in Bath Estate for suspended president of the Dominica Football Association (DFA) Patrick John.

John’s fate now lies in the hands of Clubs which will be moving a resolution to have him banned for the remainder of his two year term, which ends in 2015.

The clubs are alleging that John’s ban by FIFA for two years which was upheld by the FIFA Ethics Committee, has brought the DFA and the office of the president into disrepute “shame, disgrace and ridicule.”

On November 17, 2011 the FIFA Ethics Committee found John guilty of violating FIFA’s Code of Ethics – he was slapped with a two year banned and also fined.

John appealed the decision and on April 25, 2012, the FIFA Appeals Committee rejected his appeal and upheld the ruling and decision of the Ethics Committee.

The resolution that could derail his comeback plans states that whereas as a result he (Patrick John) being found guilty he “has been banned by FIFA for a period of two years from taking part in any football-related activity (administrative, sports or any other) and has received a fine of CHF 3,000.”

“And Whereas Mr. John not being satisfied with the decision took it to the FIFA Appeals Ethics Committee. And whereas; on April 25, 2012 (Decision Appeal 110483 DMAZH) the FIFA Appeals Committee REJECTED the Appeal of Patrick John and affirming the November 17, 2011 decision of the Ethics Committee.”

“And whereas, the findings and rulings of the FIFA Ethics Committee relating to Mr. John having brought the DFA and the office of the president into shame, disgrace and ridicule.

“Be it resolved that this annual conference suspend Patrick John for the remainder of his term due to come to an end in 2015.

However, John has also lashed back at the clubs, labelling the AGM “a kangaroo court” and in the process stating that according to FIFA Statues Article 62 he ought to be given “a chance to go to Court of Arbitration for Sport (CAS).”

“The subject resolution has failed to recognize the fact that such said appeal of John pursuant to Article 62 of FIFA Statute has the effect of staying the decision of the ethics committee.

“In effect therefore, Patrick John at this juncture cannot be considered in the light of the decision handed down by FIFA and as such DFA if operating in the light fairness and natural justice should not at this juncture be looking to utilize such said FIFA decisions when considered against the further appeal of Mr. John pursuant to Article 62,” John wrote.

“The Annual Conference is therefore invited to suspend any such resolution until the outcome of the appeal process which is yet to be exhausted and without such conclusion cannot assume that John in his capacity as president has brought the DFA into shame, disgrace and ridicule,” the football executive said.

Article 62 however condemns John since his decision was handed down on April 25, 2012 and a 21 day stipulation for such appeals to be lodged expired on May 24, 2012.

Article 62 Jurisdiction of CAS states in part:
Appeals against final decisions passed by FIFA’s legal bodies and against decisions passed by Confederations, Members or Leagues shall be lodged with CAS within 21 days of notification of the decision in question.

    Before the millions used to come in the DFA never had these kinds of problems. No one was really fighting to be head of the association. Now FIFA is giving millions everyone want to fight to be the head. I have to say that PJ turn football around in dominica but I think his time is up. New heads needs to come in and revamp the system in dominica. PJ need to rest himself now. White and Bala needs to step aside too. There are to many programs going on that we can’t get young players going to college in the USA to play football.

    It saddens me that Dominica football keeps on going down the drains. Most of the other islands have improved but Dominica keeps on going downhill. Antigua, Grenada, St. Vincent and even BVI are doing better than Dominica. P.J is only concern about his pocket. Dominica needs a complete new executive who can revamp and revitalize football in Dominica.

    The new president must have a new general secretary one that he can trust. If not things will not work. I am sure the president can find out from cfu members if DFA took the 40k or not. If he find out the DFA recieved the 40k he must find out where it went and then the treasurer must also go because he said dfa never receive money. good luck mr president

    Before the elections last year we were told that PJ would be banned but we never listened. At the time I believe it was politics and some new guys wanted to get on the association. Now I see they were talking the truth. This time I will not make the same mistake again. We need some new people in the DFA

      Boy, you reading my mind? I just read on the other site apparently we only have one male athlete for the 400 mt. qualified at B standard. He propbably wont even make the heats. Papa, for that we keep a full-tme office and have to send a whole delegation to London? maybe that’s an excuse again for President and P.M. to visit the games, like they did in Bejing four years ago? Boy, life sweet for those who can get it.

    I read with interest to rebuttall of Mr. Patrick Roland John in regards to the so call Kangaroo Court which was established three years ago when he derailed members that were duly elected by the clubs. Now that the table has turned Mr. John is crying wolf. I for sure is not hearing Mr. John and I strongly recommend that he be banned for life.

    Too often we all sympathy to get to us and allow people who committed all sorts of wrongdoing to prevail over mankind. An offemce is an offence and now is the time to get rrid of the former.

    After he would have been removed the next move is to get rid of the football menace. No name no warrant, but we all know who this person is. His has a self imposed degree in football statistics. We had enogh of him likewise and after me Mr> John it will be thios individual.

    I hope to get an invitation from my team manager so I will be present. Halay whoray..their time is coming..enough is enough..get them out.

    In my honest opinion, I think someone ca bring anything as far as he can go, and Mr PJ has brought football as far as he could. NOW IS THE TIME FOR FRESH IDEAS AND PLANS. ALSO BALA ND WHITE WHITE SHOULD ALSO GO AS THEY ARE CROONIES AND KANGAROOS OF PF. LONG LIVE FOOTBALL

    I support the resolution 150%, and DNO thanks for clarifying the popular article 62, just goes to show how that man PJ thinks he is the most knowledgeable…. Saying he has a right to go to the CAS but never appealed..

    The man should just give up he is already over 70 he should allow younger people the opportunity, they should ban him for life!!

    It is not Mr. John, who matters here but the future and image of the DFA, which has been denegrated and besmirched by his actions, as confirmed twice now by the governing world body FIFA. Whatever good he may have done in the past has been undone and he hould not take any further part in the affairs of the DFA. If he truly has the interest of the sport, and country at heart he should disassociate himself voluntary.

    Patrick John should have gone a long time ago.Football in dominica was so vibrant and look what it has come to under his leadership.I look at football and see all teams having overseas based players who play football for clubs and return to their country to play world up qualifiers. Patrick John says that he doesnt want overseas based players to represent Dominica.Isn’t that a joke?No smoke without fire. When you get high on JACK (jack warner) you get a hang over.now deal with it .OUT YOU GO!!!!!
