PJ files lawsuit against DFA, Glen Etienne

Former president of the Dominica Football Association (DFA), Patrick John, has filed a law suit against the organization and its president, Glen Etienne.

John was banned by the FIFA disciplinary committee for two years in 2011 and later a DFA conference voted unanimously to suspend him for the remainder of his term of office, that is until 2015.

John is now seeking, among other things, loss of salary and allowances totaling over $100,000.

According to the statement he is claiming loss of 23 months of salary from November 12, 2013 to July 25, 2015 at $3,000 per month or $69,000.00 along with loss of allowances from July 2012 to November 2015 at $1,500 per month or $34,500.

This amounts to $103,500.

In the suit, filed by his lawyer J. Gildon Richards, John is also challenging the decision of the conference to suspend him.

He labeled it as “disciplinary action made in total disregard and abrogation of the rules and procedures prescribed by the Constitution of the DFA for the investigation, prosecution, adjudication and determination of guilt or innocence in disciplinary matters.”

He further stated that as a consequence of the decision by the DFA and the wide publication of it in the media, he has suffered “much physical stress, psychological and emotional distress…”

John is seeking an injunction from the court restraining the DFA and Etienne (the defendants), by themselves or through their agents and or servants, from obstructing hindering or otherwise preventing him (the claimant) from resuming and continuing the performance of his functions as the “lawfully elected president of the DFA from November 24, 2013 to July 25, 2015.”

John got himself in hot water with FIFA in an alleged bribery case involving Mohamed bin Hammam. FIFA later dropped the charge but found him guilty of infringement of its statutes and fined him 3,000 Swiss Franc (then US$3,300).

The matter was appealed and the Court of Arbitration for Sports (CAS) was expected to look into it.

John eventually withdrew the appeal, forcing CAS to cancel hearings into the entire matter.

    All the fighting only hurts the reputation of the DFA, its hard enough when you are a small country. Lets hope Mr. Etienne can do something exciting to help the cause of the talented players we have.

    footballers are making no money, if an injury occurr they have to depend on relatives and pj sueing the association come on pay the guys instead and that will give them a clear mind to leave the drugs alone

    Let’s hope when he wins his case against the DFA!, he will share the funds with the two players who travelled from the U..K. to represent Dominica in the first leg at Windsor Park and the return leg of a world cup qualfier in Barbados, who he wanted to prove their attendance in Barbados before they got paid and are still awaiting payment. HOW MANY YEARS HAS IT BEEN???????!!!!!!!

    P.J , my thing is, you claimed that FIFA cleared you of all the charges, so why don’t you file these charges against FIFA for defimation of character and lose of wages?
    To come after an amature organization like the DFA you are being pathetic.
    Give it up already.
    You should know the financial status of the DFA and as such come out to show us the salaries of everyone.
    I think you are upset that Glen is getting what you think is yours.
    But in all truth after the fact that FIFA kick you out, the was no-way the DFA should keep you among it’s ranks.

    It is funny how everything you hear is about the money they should be getting. But they loose sight of the fact that the most important ones here are the players themselves. The guys kill out themselves mostly because of love of sport while these men fight over money. The players are the ones who should really be getting a salary from this. Can someone please show me a genuine person who can take this DFA forward. We hear of 3 and $4000 plus sllowance etc, but what about the playerS? When will something be put in place that they can benefit from representing their countries?And PJ do us all a favour and stop finding all ways you can to milk the association for money. You make it so obvious that this is why you are yearning to be there. For the love of football and betterment of DFA give it a blinking rest…GOSHHHHH

    How can he sue for salary that he has not worked for or the period has not even arrived yet? The Privy Council in a case involving Jamaican Attorneys from the AG’s office who went on strike, that no work, no pay. So it is clear from the authorities that you must first work before pay. Now when November 2013 reaches and PJ goes back for his position, if he is barred, then he can seek a declaration from the court that he is the duly elected President. But I am sure this matter will be dismissed with costs. PJ seek better legal advice than that please. You have a case but only when November 2013 comes because FIFA only ‘SUSPENDED’ you for a specific period.

    We must all remember that Patrick Roland John was the one who started that precedent when he suspended Walter Greenaway and Larocque as the Treasurer and Assistant Treasurer respectively. Ge got the AGM to further suspend them for the rest of their term even though no resolution was brought forward. In his case a resolution was brought forward and duly passed. He should just give it a break, after all he is not wanted.

The last chance you had ….. you just blew it. Patience is a virtue which comes from the MOST HIGH GOD. If you had waited until 2015 you might have had a chance….. YOU’VE JUST SELF DISTRUCTED…. What is that for “nuts! We as Dominicans should sue your A???for trying to over throw a legally elected Government.     Way papa!I never knew that football had so much money.P.J wants to get from foot ball monies he never acquired during his reign as Prime Minister $4500.00 a month???? Football officials do not have to do anything else, with a salary of that magnitude{for doing what,I dont know}they can take care of their family, now what fraction of that amount is being paid to the foot ballers, petance?
    I would like to know what requirements do I need to apply for that position? Just inquiring

    I wonder what salary Glen Ettienne is getting? I would not be surprised if he is making more than $4500 a month. Is he paying the footballers? I honestly doubt that.

    I will honestly say that it is not for me to say that PJ should be banned from de position that he held. I clearly remember that he was clear of de alleged bribery by none other but FIFA itself. Instead he was found guilty of infringement of FIFA statutes.

    I don’t know anything about the constitution of the DFA. I notice that our Government has very little respect for de Constitution of our land. Its not only de PM that disrespecting constitution. I expect other people to try de same thing. After all our PM does it with impunity.

    Hey PJ was on de team that drafted Dominica’s Constitution. I am not prepared to put Glen Ettienne or even PM Skerrit before PJ where matters of a Constitution is concerned.

    Billy Doctrove is curious as to what went down over the weekend where they were electing executives for sporting institutions here. Serious roro boy. Some people know where to go for position and fame.

    I guess PJ like the Olympic Committee officials ran for office because they love the sport, want to see the development of the sport and all the good things they want for the sport that they feed to the public. What they forget to say is that what they really love is the money-salary, allowances (as in football’s case), stipends for travel (DOC) and travel. What have they really done for the sport? The football house was buit without a gym_go figure! Apart from football, what other programs does the association run to futhure the development of young footballers? The Oympic Committte officials hold associations at ranssom. If they do not say “yes sir” ” no sir” the amount of support they get is little or nothing. If athletes speak their minds, they are term “ungrateful” and not supported. These men are merely out there to exploit sport and young people. I guess if Olympic Committee official found themselves in PJ’s position, they would sue for loss of stipend and travel opportunity. Love of sport???? What a joke!

    P.J not easy. he really wanted to come back after the FIFA ban? You withdrew your challenge of FIFA’s decision, By your actions with Bin MHammin and the subsequent ban by FIFA you brought the DFA into disrepute. Jack Warner, Bin Hamin and yourself received the biggest punishment in varying measures. Every body else received much lesser punishments. PJ you really have gull. just want to stay in the news by all means necessary. I wait to see what will happen on November when your FIFA is complete. I am also looking forward to seeing what the Football fraternity is prepared to do then. PJ you should seek to retire peacefully nd enjoy the rest of your days.
